This paper analyzes the opinion in Bragg v. Robertson, 72 F.Supp. 2d 642 (S.D. W.Va. 1999), a case which threatens the future of surface mining in West Virginia and which will almost certainly result in new policies or rules that will affect surface mining everywhere. This paper addresses: (1) the jurisdictional bases of the action which relies on the federal surface mining laws to enforce a state mining program; (2) settlement agreements reached in the case that threaten to alter federal policies beyond West Virginia borders; (3) a programmatic environmental impact statement on mountaintop mining being undertaken by the federal government; and (4) an opinion by the Court outlawing excess spoil disposal in intermittent and perennial streams.

Mining is a complex and intensive industry. Extracting raw material with different shapes, sizes, chemistry from the earth?s crust and transform them into a standardized and high quality final product is a big processing challenge - which involves energy and control on large scales. Not only is the physical work challenging, the mining industry today is facing unprecedented challenges: Decline of mineral grade and reserves, cost escalation for new developments and modernization, regulations, safety, lack of skilled people, and market uncertainty are the new constant. It is clear that process control and management of electrical power will be of increasing importance to the recovery rates the mine will achieve. The objective of this paper is to provide a quick vision about future trends and evolutions in technology related to these fields and their impact on Electrical Safety and Control of the mineral recovery. The paper will cover trends in safety, energy management and efficiency, communications of data, control room evolutions, plant integration, other control technologies, and we will examine how these technologies provide information and the benefits of aligned reporting systems to address current industry challenges. More than just the trends or breakthrough concepts, current technologies are available today that can be applied in the mineral recovery operations now to help overcome anticipated future challenges will be presented later in this document. Finally, a brief discussion to look at some real tools to help make real time changes to the process while maximizing recovery and optimizing cost.

The Old Hickory mineral sands ore body in Virginia (>2000 ha) currently supports a productive rowcrop agriculture. Reclamation experiments were implemented on pilot-scale mining pits from 1995 to 1998. Half of each mining pit was topsoiled (25 cm) while the remaining half was left as either (1) mixed tails/slimes or (2) re-graded subsoil over tails/slimes treated with 112 Mg/ha yardwaste compost. Post-mining productivity was estimated to be reduced by 23%, 3%, 27%, and 20% for each crop (wheat/soybeans/corn/ cotton) in sequence when compared to undisturbed soils. The dramatic increase in molybdenum prices from the low of less than $2.50/lb in 1999 to more than $40/lb in 2005 has caught the attention of molybdenum mine owners and exploration project developers. Between 2005 and early 2007, prices pulled back and stabilized within a trading range of $25/lb to $30/lb. This 1,000 percent price increase has motivated most existing producers to expand production and is motivating those with molybdenum prospects to accelerate the development process for earliest possible production. It is still unknown how much new production will come from existing mines, how much production will be needed from new mines if demand continues to grow and how many potential new mines might be available to meet future demand. And of course, the billion dollar question is whether molybdenum prices will remain high, or will they fall back to the low levels seen during the 1980s and 1990s? This article attempts to answer these questions in a way that will help molybdenum project developers and financiers plan for the future.

In 2005, Black & Veatch Corporation began designing a raw water conveyance system for San Luis Obispo County from Lake Nacimiento to the city of San Luis Obispo. The first element of the water transfer system will be a raw water pump station and lake tap. The wet well of the pump station will consist of a concrete lined shaft approximately 180 feet deep constructed in the very incompetent sandstone of the Vacqueros Formation. The lake will be wet tapped at approximately 172 feet below grade using a slurry earth pressure balance tunnel boring machine. The 48 to 72-inch finished diameter microtunnel will be approximately 500 feet in length. Construction is scheduled to begin in the winter of 2007.

Heavy minerals have been mined from the sands of the United States’ Atlantic Coastal Plain since the early part of the twentieth century. Production of ilmenite from beach sands near Mineral City (Ponte Vedra), Florida, began in 1916. The first reported large-scale recovery of zircon in Florida was reported from this deposit in 1922 and of rutile in 1925. These operations ceased in 1929. Today the Ponte Vedra Country Club and Golf Course is situated in the center of the former mining site. In 1942 heavy-mineral operations were established on 202 hectares of land situated in Duval County, Florida. The location is about 16 kilometers east of the center of Jacksonville, Florida, in an area known as Arlington. This operation demonstrated that low-grade sand containing only 2 to 3 percent titanium minerals could be concentrated economically with the Humphreys spiral and that the oxides could be separated from the heavy silicates by electrostatic methods. Much of this area is now covered by a large mall and is a major retail- commercial center. Between 1958 and 1964 the Skinner tract, a deposit about 4 kilometers south of the above deposit, was mined. Today the area of this deposit is known as Deerwood, a gated country club community on the southside of Jacksonville. Further inland, E.I. du Pont de Nemours and Co. has been mining heavy minerals from a physiographic feature known as Trail Ridge since 1948, and a deposit near Green Cove Springs, Florida has been in production since 1972. Since the start of heavy-mineral mining in the southeastern United States, nine heavy-mineral ore bodies either have been or are being exploited in Florida and Georgia. Other deposits either have been lost to mining or are yet to be mined. These deposits have different origins. Some formed along shorelines at the heights of marine transgressions while others formed on regressional beach ridge plains during periods of temporary stillstands or slight transgressions. These different origins are reflected in the chemical and physical characteristics of the deposits. Ilmenite in older, more western deposits has a higher TiO2 content than ilmenite in younger, more eastern deposits. TiO2 content does not very with north-south direction. Garnet and epidote are absent or rare in the older Trail Ridge deposits, but progressively become common in the younger Duval Upland, Crestal Pamlico, and Holocene deposits. Grain size is coarsest for Trail Ridge sediments and finest for sediments in Duval Upland and Crestal Pamlico deposits. The average grain size for Holocene deposits is intermediate between Trail Ridge and Duval Upland deposits. The two models for the origin of the heavy-mineral deposits – deposits formed at the height of major marine transgression; and deposits formed during periods of temporary stillstands or slight transgressions that occur during a general marine regression; - are consistent with known sedimentological data and depositional trends.

New developments in the pipe conveyor and belt are advanced to address the growth in the capacity, length and complexity of pipe conveyor systems. Improved belt construction can offer better stability during horizontal curves and resistance to twist. Low rolling resistance rubber compound can significantly lower the power consumption and belt tension, producing capital and operation cost savings. Dynamic analysis, when used to analyze the conveyor?s starting and stopping behavior, can improve the design and reliability of long overland pipe conveyor systems. For these three aspects, technical backgrounds and field installations as examples are discussed in this paper.

NPV is a static measure of project value which does not discriminate between levels of internal and external risk in project valuation. Due to current investment project?s characteristics, a much more complex model is needed: one that includes the value of flexibility and the different risk levels associated with variables subject to uncertainty (price, costs, exchange rates, grade and tonnage of the deposits, cut off grade, among many others). Few of these variables present any correlation or can be treated uniformly. In this context, Real Option Valuation (ROV) arose more than a decade ago, as a mainly theoretical model with the potential for simultaneous calculation of the risk associated with such variables. This paper reviews the literature regarding the application of Real Options Valuation in mining, noting the prior focus on external risks, and presents a case study where ROV is applied to quantify risk associated to mine planning.

The OptiPit® software program is developed based on expertise gained at the Colorado School of Mines (CSM) using Mixed Integer Linear Programming (MILP) techniques. This program has been developed to satisfy the need in the mining industry for a multi-time period schedule and cutoff grade optimization tool that handles large scale open pit and underground mining operations involving many dumps, stockpiles, complex processing options and blending requirements. The current software (or earlier development versions) has been beta tested and used on various large scale projects within Placer Dome Inc., Newmont Mining Corporation, and Phelps Dodge Corporation since 2003. Through the use of this software, these companies experienced additional value creation by optimizing mine sequences, cutoff grades, material process flows and stockpiles under complex operational and processing constraints. This paper will present simple case study results to demonstrate the power of OptiPit® when used as a cutoff grade optimization tool. Furthermore, the paper will show, by example, how significant the difference in the Net Present Value (NPV) of a given project can be, depending on whether results are obtained by way of cutoff grade optimization using OptiPit®, or by using traditional breakeven cutoff grade approach.

Nowadays more infrastructure tunnel projects are procured using design-build method. In this environment, the Owner’s engineer would typically provide performance requirements for the design-builder, and the Contractor’s designer would work with the contractor to design the tunnel lining based on the Contractor’s means and methods and manufacturing process. This paper will describe the typical requirements provided by the Owner based on its design objectives, and the means and methods by the Contractor that would significantly impact the design. Project examples and recommendations for Owner’s requirements will be provided that can optimize the design and still achieve the Owner’s performance objectives.

The presence of hydrogen sulphide in sewerage systems leads to severe concrete corrosion. Acid causes breakdown of the concrete matrix, and attacks reinforcement. Older sewer systems under acid attack are often found to be acutely corroded, sometimes after short operational periods. Consequently secondary liners are now almost always used. Polymer concrete is extremely acid resistant and if used in segmental linings can forgo the need for a secondary lining. Combined with fibers and/or GFRP rebar Polymer Concrete can produce a very strong acid resistant lining, saving considerable time in the installation of additional liners. This paper explains the problems and advantages of using Polymer concrete in segmentaly lined wastewater tunnels, addressing areas of design, cost, and programming.

Membrane technology has been available for over 36 years, but has been used sparingly in the general mining industry. However, recent developments in polymer chemistry, spiral wound element construction, pretreatment equipment and techniques and an expanded understanding of membrane fouling and cleaning techniques have dramatically improved the reliability and robustness of membrane based systems in the mining industry. Harrison Western has expanded the use of this “new” technology to enhance the use of membrane technologies to separate metals from large volume heap leach mining solutions containing copper, zinc, and iron, gold or silver. Moreover, membrane technologies are ideally suited to fractionations that add value to processing fluids from refineries like separating metals from acids or concentrating acids and producing high quality process fluids. Finally, wastewater from Acid Mine Drainage (AMD) or, as in the case of the Newmont Yanacocha Mine in Peru, the treatment of excess barren leach solution created during the rainy season, can be cost effectively processed to meet World Bank Standards for surface discharge. Polymeric membranes, specifically thin-film composites, have been developed that will purify, fractionate or concentrate gold, silver, copper, zinc or nickel. Recent applications have been developed for spiral wound modules that operate across the pH spectrum from 0 to 14. Systems using membranes have been constructed that operate on feed streams from 140° C to 300 centipoise. Opportunities exist to apply membrane technology to concentrate gold, silver, copper, zinc or nickel using thin film composite membranes. Engineered membrane types can operate across the spectrum from low pH (<2) acid applications to high pH > 10 cyanide applications. Incorporating HW EMS™ membrane technologies into current mining operations could allow one to increase production because the membrane technology would be used to pre-concentrate heap leach solutions, and therefore, increase utilization of existing extraction and refinery capabilities.

Nuclear power currently produces about 20% of the electricity in the US, with 104 nuclear power plants located in 31 states. The commercial US nuclear industry contributes over $4 billion annually to US workers in salaries and wages. 25,000 new jobs need to be filled in the next 5 years. There are over 30 new power plants under consideration by US utilities. The operating reactors use uranium oxide fuel enriched to about 4% U235 and fission is the process used to generate heat to form steam to drive the turbine generators. Nuclear energy is an important element in the US generation portfolio and represents the largest producer of nearly emission-free electricity. Most, if not all, of the operating plants will secure an extended 20 years of operation or more. The last plant constructed was ordered in 1978. New smaller, modular reactors are under design to provide less expensive, expandable generation options.

China’s vibrant economic growth is built on coal, the source of two thirds of the country’s electricity. Over 95 percent of China’s coal is mined underground with the average mining depth at 410 m and in-creasing at 10 m per year; today, the deepest Chinese coal mines have exceeded 1,000 m. With increasing mining depths, there are greater challenges including increased methane emissions and spontaneous combustion. According to the government, nearly half of China’s coal mines are classified as gassy (with specific gas content at least 10 m3/mt). Coalbed methane (CBM) is a clean energy source. However, only a small percentage of the methane is captured, and the rest is vented directly to the atmosphere. This paper describes China’s CBM resource, its production and utilization.

Image analysis for feed belts and flotation has been used for over 20 years. It has been shown to aid in the modelling and optimization of Sag Mill circuits, and any improvements in the image analysis result in improvements in the model for control. Using a laser to measure the height-profile of rocks on the conveyor has been shown to increase the accuracy of the size classification. We have developed a system using two cameras in a stereoscopic configuration to provide height-profile measurement without the added expense and safety concerns of using a laser. Additionally, we have developed a novel technique for calibration of the system, using artificial intelligence techniques to optimize the model fit by adjusting the image analysis tuning parameters to values resulting in the best classification.

Cleveland-Cliffs’ Northshore Mining Company operates a magnetic iron ore (taconite) concentrator and pelletizer in Silver Bay, MN. These are two recent cost reduction projects: 1. Rougher Magnetic Separators were upgraded throughout the concentrator; throughput and recovery were simultaneously improved. 2. Green Ball Roll Screens on one agglomeration circuit were upgraded from 3.5-inch to 2.5-inch rolls. Throughput improved by 24% from 62 to 77 LTPH. Green ball size distribution improved as an added benefit.

Freeport-McMoRan Copper & Gold (FCX) is committed to preserving and enhancing biodiversity in the areas in which we operate. As a member of the ICMM, FCX is committed to implement the 10 Sustainable Development (SD) Principles throughout our business. FCX is also a member of the Wildlife Habitat Council (WHC), a nonprofit coalition dedicated to protecting and enhancing wildl ife habitat. In alignment with ICMM SD Principle 7 and our Environmental Policy, FCX has set a performance goal to prepare a biodiversity inventory in 2010 and land management plan by end of 2011 for all active mining sites. In 2010 FCX established a Biodiversity Task Force to assist sites in biodiversity management; optimize use of resources around the globe; implement FCX goals and targets; and align biodiversity programs with ICMM principles and guidance. The task force consists of Environment and SD Department management, scientists and engineers from FCX sites, and WHC staff. The Task Force recently issued a biodiversity inventory guidance document to set expectations and provide consistency across the sites when developing a biodiversity inventory and land management plan.

The Aynak copper deposit, located 30 km south of Kabul in Afghanistan (Figure 1), was discovered by Soviet geologists in the 1970s. Extensive exploration undertaken in the area between 1974-80 included several hundred boreholes, seventy trenches and nine exploratory adits. This work identified a “drill-indicated resource” of 240 Mt at 2.3% Cu (ESCAP, 1995).

D.G. Wilder I found the suggestion that the amount of displacement of a fault can be numerically related to the thickness of gouge or breccia to be both intuitively satisfying and intriguing. I have long agreed that there is some type of relationship between the amount of gouge and the amount of displacement of faults. I congratulate the author for developing a numerical relationship between them. However, I am concerned that the limits for applying this relationship be fully understood. An underlying assumption in this approach is that there is either a uniform thickness of gouge or breccia along a given fault or the thickness does not vary widely. Since it is not always possible to confirm this, the displacements derived by this method should be viewed with caution unless significant fault extent can be observed. At the Nevada Test Site, in drifts constructed in granite for test emplacement of spent nuclear reactor fuel, we found a fault with 0.3 to 0.4 m (12 to 16 in.) of clay gouge. Within a few meters of this location, the fault had no clay gouge, but rather consisted of a highly fractured zone with significantly altered rock and some slickensides. Based on Fig. 1, the 0.3 to 0.4 m (12 to 16 in.) thickness of gouge would indicate a displacement in excess of 30 m (98 ft). However, no gouge thickness would indicate essentially no displacement. Based on a quartz vein that terminated on the fault, and is not identified nearby, an estimated displacement of more than a few meters was made. This estimate is consistent with that obtained using the regression line proposed in the paper if the 0.3 to 0.4 m (12 to 16 in.) thickness for the gouge is used. However, using the regression curves with zero thickness would not yield results consistent with what was observed in the field. Therefore, it is important to recognize that the suggested procedure would properly yield a range of probable displacements. ? *Work performed under the auspices of the US Department of Energy by the Lawrence Livermore National Laboratory under Contract W-7405-Eng-48. Reply by E.C. Robertson It is certainly true that the t (thickness) of gg-bx (gouge and breccia) on a fault does vary along the fault. My observations have been that near the termination of a fault, the displacement d is small and the t is also small, whereas the maximum d and t will usually be found in the central part of the fault. The information on gg-bx and t of the fault found in granite in the NTS tunnel by Mr. Wilder could be interpreted somewhat differently than he does. He speaks of the fault changing within a few meters from 0.3 to 0.4 m (12 to 16 in.) of clay gg to "a highly fractured zone with significantly altered rock and some slickensides," but no gg. The highly fractured rock may be taken to be bx, rock not so finely ground as gg but still crushed by the fault movement, equivalent to the gg in my usage, and probably occupying about the same t. Mr. Wilder&apos;s estimates for the fault in the NTS tunnel for t of 0.3 to 0.4 m (12 to 16 in.) and for d of a quartz vein, in excess of "a few meters," would place the point on the low side of the central trend line in my Fig. 1, at the lower limit. There is, of course, a problem with determining d using displacement of only one planar surface. It would be greater or lesser depending on the rake of the movement. Finally, estimating the d of a fault from its t should be made with awareness of our present uncertainties, as pointed out by Mr. Wilder. Although the central trend line in my Fig. 1 has a ratio of d/t of 100, I have put the limiting ratios at 10 and 1000. Understanding of the values of the ratio will be improved only with collection of more data, for which the discussion of Mr. Wilder is much appreciated. G.C. Waterman E.C. Robertson&apos;s paper provides significant information to a geologist attempting to deduce fault offset by noting the products of structural dislocation. However, considerable mapping in underground and open-pit mines, and examination of structures produced in different geological settings, have convinced me that gouge and breccia thickness are controlled by geological conditions and fault movement. The following paragraphs suggest geological variables that control them. 1. Depth of Loading A near-surface fault resulting from tensional stress has more breccia/gouge than is produced by a similar stress at considerable depth. A deep-loaded compressional stress may produce a linear zone of schist, or structural dislocation may occur along an earlier formed belt of schist. Such "shear zones" are common in Canadian mines in precambrian rocks. In neither case can offset be directly deduced by an analysis of the minimal gouge/breccia in the shistose rocks. At greater depth, stress may be partially to wholly relieved by flowage. I vividly recall first noting the regional "Midas Thrust" in the Lark mine, Bingham Mining District, UT (where we called the structure the North Fault). My recorded notes, as I remember them, showed a narrow gouge streak separated the `Jordan" and "Commercial" limestone units from impure, muddy limestone beds of uncertain stratigraphic position. Introduction Precambrian shield terrains the world over are experiencing an unprecedented level of concerted exploration for lode gold deposits. Reasons for this include: • The increase in the price of gold (following 40 years at $1.13/g or $35 per oz) has transformed targets that were once unattractive into viable exploration propositions. • The relatively suppressed market for other metals produced from shields (base metals, nickel, iron, and uranium) has further focused exploration attention on gold. • The preeminence of gold production from rocks of early Precambrian age, as shown in Fig. 1. • The relatively high grade of gold in these mines (averaging about 10 Wt or 0.29 oz per st) permits profitable extraction even under depressed gold prices. A number of these mines have been in continuous operation for more than 50 years. • The recent discovery of the major Hemlo deposit, in well exposed rocks adjacent to the Trans Canada Highway, has had a world-wide impact. This demonstrates that a major new deposit can be found even in an accessible, well exposed area of a shield; gold mineralization is susceptible to rational exploration; and new target types for gold exploration exist. This paper reviews exploration activity for gold in shield terrains worldwide (Fig. 2), excluding Early Proterozoic paleoplacers of the Witwatersrand type. Emphasis is on the Archean, which is traditionally the most productive part of the Precambrian shields. There is also an emphasis on the Canadian shield (Fig. 3) because of its vast areal extent and exceptionally broad range of mineralization styles. Geological Approach A basic problem exists in gold exploration when compared to exploration for base metal massive sulfides that predominated during the 1960s and 1970s. Gold concentrations cannot usually be detected by airborne geophysical instruments. The majority of massive sulfide deposits were detected using airborne electromagnetic detectors and magnetometers. A full 75% of Canadian gold discoveries can be credited to surface prospecting. The percentage is even higher in other countries. This observation allows for great optimism for two reasons: • Large areas of shield terrain are obscured by either surficial deposits (glacial tills, clays, and desert sands) or deep surface weathering. This makes them inaccessible to prospectors. Logic dictates that such obscured areas should have the same potential for gold concentration as has exposed bedrock. • The Hemlo style of mineralization, a roughly tabular ore body where gold is associated with disseminated sulfides, is different from the traditional prospecting target. The gold is hosted by discrete quartz veins. While it is true that limited discoveries were made at Hemlo more than 30 years ago, and this style of mineralization is present elsewhere, recent
