The 64th Texas Legislature passed the "Texas Surface Mining and Reclamation Act," Chapter 131, Texas Natural Resources Code (subsequently referred to as "the Act"), at a point in time when little surface mining had taken place within the state. Thus, enactment of regulatory control governing mining operations in our state has, for the most part, preceded widespread, intensive mining activity. I should point out that the statute applies only to the extraction of coal, lignite, uranium and uranium ore. A recent opinion rendered by the Attorney General's office has stated that extraction of the named elements, when it occurs incidental to the extraction of other materials, e.g., clay, is not not an activity subject to the Act. An important theme of the Act, frequently overlooked in other environmentally oriented legislation, is recognition of the Act's affect on the mining industry. The Act states that "the extraction of minerals by surface mining operations is a basic and essential activity making an important contribution to the economic well-being of the state and nation" and, in reference to reclamation being accomplished contemporaneously with mining, provides a recognition that "the extraction of minerals by responsible mining operations is an essential and beneficial economic activity." This legislative recognition is, of course balanced against the need for proper mined land reclamation, the rights of surface owners, the need to guard against unreasonable degradation to land and water resources and numerous other actions or events that the Legislature wanted protected. Another rather pervasive general theme that is established in the Act is the concept that the agency is entitled to obtain whatever information, or take whatever action, that appears reasonably necessary to effectuate the purposes of the Act. This concept, coupled with the detailed requirements placed on mining operations in the portions of the Act dealing with Permit Applications, Reclamation Plan and Reclamation Standards, easily insures that surface mining activities can and will be regulated to the extent necessary. Section 131.102(b)(2) is probably the most relevant provision in the Act which deals with the preclusion of mined lands becoming waste lands. This portion of the Act states that the surface mining operator shall: ". . . restore the land affected to the same or a substantially beneficial condition. ." In this language the Legislature had made it abundantly clear that the abandoned or orphaned lands found in some of the Eastern states, will not be tolerated in this State, and provided the Commission with a degree of latitude to determine what condition would be appropriate in each individual mining situation. I bring this area of the Act to your attention because it is the area which has received the most inquiries and concern by operators, i.e. what does "substantially beneficial" constitute? The Commission's staff has spent a considerable amount of time wrestling with the statutory language "substantially beneficial" to determine the legislative intent and provide operators with guidance of what they can expect. In this regard, the most definitive criteria in our opinion lies in the Act's legislative hsitory. The Legislature had before it basically three reclamation standards namely: House Bill 656, considered to provide the most stringent reclamation standard and identical to Senate Bill 66; House Bill 1717 which was supported by industry spokesmen and was considered to contain the least stringent reclamation standard; and Senate Bill 55 which was adopted by the Legislature. During the Bill's initial hearing before the House Environmental Affairs Committee, the House sponsor of the Senate Bill 55, which was the Bill eventually adopted, made the following statement: (I am quoting verbatim from the Committee's transcript although substituting the speaker's reference to the authors names with the Bill's numbers.) "An example of the differing approaches of the four bills can be seen in the area of reclamation standards and this is critical. House Bill 656, talking about restoring the surface of the land, House Bill 656 has this statement: 'At least fully capable of supporting the use to which it was capable of supporting prior to any mining or any higher or better use.' In other words you have to restore it to the level it was prior to the mining. Senate Bill 55: 'Restore the land to the same or substantially beneficial use.' Substantially beneficial use. (Emphasis his) House Bill 1717 says: 'Restore insofar as practical to appropriate beneficial post-mining use.' So that House Bill 1717 said to, 'restore insofar as practical to appropriate beneficial use. I think that's too weak, whereas I think the House Bill 656 that would call you to restore it to at least the use it had prior to the mining may also be too tight the other way. I think the Senate Bill 55 approach is down the middle of the road which says that you do restore it to the 'same or substantially beneficial use,' is a proper way to go there." Therefore, the conclusion that we have drawn from the legislative history of the bill is that the extent of reclamation required by "substantially beneficial" may be something other than the use it was prior to

Since 1904, when exploration of the Mayari deposits of iron ore in northeastern Cuba was undertaken, there llas been increasing interest in these ores. Tlie Transactions contain numerous references to t1ieln.l This iron ore, which is shipped to the Tinited States in the nodulizecl state, has been thoroughly tested and found very valuable; the deposit covers over 25,000 acres and there is in sight over 500,000,000 tons of ore that, by systematic mining, runs practically constant in composition. With nickel and chromium present, also titanium in sufficient quantities to attract attention, as well as extremely low phosphorus and sulfur contents, the iron founder is naturally interested in the utilization of RInpari ore for pig iron for the better grades of finishrtl iron products. The present point of coilsn~iil)tion ol ILlapri ore is at Sparrow's Poi111, where hlayari pig iron of ally desiretl coml>osition is made. The composition of the dried ore is about as follows: Iron -29 per cent., silica 3 pc.r cent., nickel 1 per cciit., chroiniun~ 1.5 per cent., alumina 11 per cent., ant1 coinbined water 13 per cent. When nodulized, the iron runs up to nearly 56 per cent., the silic:~, :tlumi~i:i, nickel, and c~llromiurn are slightly highr than the arno~l~its just given. Traditional mine planning concepts are discussed and suggestions for improvement through use of the developed model are proposed. The approach developed in this paper allows optimal planning of the complete mining-concentrating-refining system over the entire planning horizon and permits the system to dictate how and when to process a block of material, i. e., a dynamic cutoff.

A SERIES of seven hypoeutectoid alloys, up to 18.2 atomic pct Mn, was made by the levitation melting technique. The loss of weight on melting was considered to be entirely due to volatilization of manganese, and compositions were computed on this basis. Filed samples (—200 Tyler mesh) were helium quenched from 1000°C after soaking for 5 min by a technique already described.' Quenched Alloys -Assessments of the amounts of a phase produced and the hardness of the quenched alloys are summarized in Fig. 1. The experimental techniques and calculations involved have been described previously. The amount of a decreases as manganese content increases, until at 10.6 pct Mn only a trace of a' is observed. GENTLEMEN : Herewith are transmitted the reports of your Treasurer and the Chairmen of your standing committees on Admissions, Membership, Papers and Publications, and Library for the calendar year 1931. To these reports you are referred for further details of the year's activities. Finances.-Depressed industrial conditions prevailing throughout the year were reflected in a substantial decline in current revenue. Aside from interest on sundry special funds (but including that from the Life Membership, Library, and General Reserve Funds) total receipts amounted to $168,274, compared with $194,636 in 1930. The principal items of decrease were $17,000 in advertising income from the monthly magazine MINING AND METALLURGY, and about $9,600 in dues and initiation fees. Of this shrinkage $4,000 is accounted for by decrease in the number of new members enrolled; and $5,600 by diminished income from current dues and arrearages. This naturally has coincided with an \ increase in delinquency and "drops" or suspensions for nonpayment of dues. The decline in advertising income, amounting to 38 per cent as compared with that of 1930, in general paralleled the experience of all technical and trade publications; and it is problematical whether 1932 will show as large a return from advertising as did 1931.

THE deductions drawn in crushing and grinding operations have heretofore been based on a separation of the products into various sizes. A crushed product may be sized by sieving, by elutriation, and by aid of the microscope. To estimate the surface of each size the relation of the surface to the estimated average diameter must be assumed. Such a relation, owing to the irregularity of the particles, may involve two assumptions: First, a factor to convert average diameter to surface for one particular size; and second, a variation in the factor as the diameter of the particle changes. Obviously a surface measurement in which such assumptions and estimates are involved is questionable. In the first paper of this series1 a method has been given by which an accurate measure of surface of quartz can be obtained from its dissolution rate. By the use of this method, surface measurements have been made on a series of sieve sizes of crushed quartz, the results of which are given and discussed in this paper.

Electrostatic methods of separation are used only when some peculiar advantage is gained. Such cases are minerals that are not separable by differences in specific gravity or magnetic response and that are desired in particles as large as 10-mesh, a size on which flotation separation is inefficient. This paper covers several separations of this type and others. It includes studies in the electrostatic behavior of kyanite, sillimanite, and zircon, simple silicates that cannot be called either acid or basic but are more nearly neutral. Kyanite and sillimanite are both desired in 10-mesh size and are difficult to bene-ficiate from low-grade ores to give that type of concentrate. A separation of garnet from diopside was studied because this mixture had been removed from a wollas-tonite product by drying and magnetic separation, and no special or extra-preparation for electrostatic separation was necessary. The Separator The separator used in these tests is of the nonhomogeneous field type shown in Fig Ia. It consists of a 11.4-cm-diam rotating metal roll 2 at ground potential over which the dry mixture of minerals is fed. The roll serves as one electrode of the separating field, and the other electrode is that of 3, a smaller 5-cm-diam rotating metal cylinder which is held at a high direct-current potential. In this paper the term "electrode" will be confined to the electrode at 3, roll 2 being designated only as "roll."

The purpose of this technical note is to briefly present some data on a phenomenon—recrystallization with concurrent deformation—that has been found to occur in a plutonium. This phenomenon is unusual because a plutonium is considered brittle, not easily deformed, and not easily recrystallized; the a phase is simple monoclinic having 8 atoms per unit cell and it is stable below about 115°C. The properties of the recrystallized metal were different from the as-cast metal. Even though a plutonium is difficult to deform, Ianniello successfully rolled it' and he also observed some recrystallization at 120°C.2 Pavlick and Hanson3 detected some recovery at 109°C but they observed no recrystallization. Gardner4 and Bronisz5 studied the compression properties up to 100°C but they did not report having seen recrystallization. In the present deformation studies of electrorefined plutonium pronounced recrystallization took place concurrently with plastic deformation in compression between 24" and 115°C. The metal contained less than 300 ppm total impurities with the major impurities being 100 ppm Am, 30 ppm C, 40 ppm W, and 25 ppm U; all other impurities totaled less than 100 ppm. The compression specimens were machined to dimensions of 1.2 cm long and 0.8 cm diam from as-cast rods having a density of 19.65 g per cu cm. They were heated to the test temperature in a high-temperature silicone fluid that was evacuated to 10-4 Torr. With this procedure the specimens oxidized a negligible amount, and the temperature was maintained within ±0.2°C for times up to 3 weeks. Deformation and recrystallization

With the introduction of rotary drilling in the Gulf Coast area, some thirty-two years ago, and its subsequent spread to other producing localities in the United States, there has been a constant change in the design of equipment. Only the general features remain, namely the rotating drill stem and the circulating mud. Only recently have the properties of mud and their behavior received attention from petroleum engineers, but circulating problems in present deep drilling demand further study and understanding. It is the purpose of this investigation to determine the relative changes in the apparent viscosity of muds with changes in temperature and to discover other physical effects due to heat. Very little information has been published regarding the effects of temperature on the viscosity of drilling muds. Maustl states: "The viscosity of most muds is decreased on heating, but the interesting thing is that the degree of flocculation is also increased on heating. There will be a greater tendency to seal off formations at high temperatures than at low temperatures." With regard to the effect of temperature on viscosity and yield point, Herrick2 states: "The variation of yield point and viscosity of mud with temperature.....is not very clearly brought out by the data available. Both appear to decrease slightly with increasing temperature up to 200' F." The experimental results presented in this paper further emphasize this point. Two types of viscosimeters are available for measuring the apparent viscosities of drilling muds: the efflux tube type as used by Herrick3 and Marsh, and the torsional type such as the McMichael or the Stormer viscosimeters. 1. INTRODUCTION 1. Location, Topography, and Climate The Burro Mountains are located in the southwestern part of New Mexico, in Grant County. The group is made up of two distinct moun-tain masses, known as the Little Burros and the Big Burros, the former lying about 6 miles southwest of Silver City-, and the latter about 9 miles farther in the same direction. They are separated by the valley of the Mangas River, a tributary of the Gila, and a stream only in name, except after a heavy down-pour of rain. . The Little Burros attain an elevation of 6,625 ft. above sea level, and the Big Burros 8,054 ft., with the surrounding country averaging about 6,000 ft. To the south of these mountains stretches the desert plain, while to the north are the more frequent elevations of the mountainous country.

ONLY in recent years has any practical headway been made in the application of aerial photography to geological problems, and up to the present time its principal value to the geologist and mining engineer has been in "areal geology;" i. e., the study of formations as revealed at the surface. The object of this paper is to set forth briefly the principal advantages that may be derived from aerial photographic data in geological work and to serve in a measure as a guide to those who may be con-templating its use. Geophysical prospecting has for object the locating of mineral under the surface. Inasmuch as the geologist's chief complaint in life is a dual one-inability to see under the surface and inability to visualize comprehensively what he does see on top of the ground-geophysical prospecting coupled with aerial photography should do much to lessen his burdens. To what extent aerial photography can be made a useful adjunct to geophysical prospecting remains to be proved, but the inference drawn here is that it holds many alluring possibilities. To avoid disappointments, it should be stated at the outset that to the :geologist or mining engineer an aerial photograph or mosaic is only a tool, the effecient use of which he must set out to master. Upon his skill and ingenuity in applying it to particular problems will depend largely the value of the results that he will obtain. Under the most favorable conditions an aerial mosaic or even a few loose photographs, because of the exceptionally comprehensive oversight which they afford of field data, such as dips and strike observations at isolated outcrops, local indications of faulting, mineral and fossil finds, greatly facilitate study and correlation, save much tedious foot work, and may repay their cost many times. Even so, types of country may be found where the most, skillful use of the best of pictures will produce results so meager as to render the cost of aerial photography entirely unwarranted.

THE following data were obtained during Tan exhaustive research into the possibilities of concentrating United Verde massive sulfide copper-zinc-iron ores by flotation. The composition of these ores approximates the following mineralogical analysis: 3 to 15 per cent chalcopyrite; 3 to 11 per cent marmatite (ferruginous sphalerite) ; 47 to 69 per cent pyrite; and 10 per cent quartz. The remainder is usually schist gangue. THE subject of classification is so broad that this discussion is confined to what the author believes is of prime importance in connection with proper grinding and classification. The years passed have witnessed many noteworthy changes in fine grinding and classification, which have been accompanied by a readjustment of ore-dressing flowsheets for the preparation of better ground and/or sized products at an expenditure of less power, steel and maintenance than formerly. Nowhere in the industry is more being done in the way of experimental work to lower costs than in grinding circuits, because, at best, grinding costs are high. Recent years have indicated that, on the average, finer grinding has a real application. Without careful preparation of the process feed, no operation can be highly efficient or successful. In an earlier paper, the findings of an extensive survey at representative concentrators were presented1. Also, in the year of 1935, a technical discussion was given by Dr. J. V. N. Dorr (Some Notes on Classification Trends in America) before the Chemical, Metallurgical and Mining Society of South Africa In both papers mentioned, much has been said regarding flowsheets, grinding and classification. The author is very familiar with these papers, having had considerable to do with the actual operation of the flowsheets, as well as large mills and classifiers in the work described. Some data from the second paper have been included in the following discussion. Circulating Load In this particular paper it seems advisable to deal with the classification phases of the work that to a major extent govern the success of any closed-circuit grinding unit.
