PRESIDENT HERRES: Our ses¬sions this afternoon will be on safety. They will be under the direction of Mr. Dan Harrington, who has come here from Washington, D. C., particularly to preside at these meetings. I do not think Mr. Harrington needs any introduction to anyone present. He is a member of both the A. I. M. E., and the Rocky Mountain Coal Mining Institute, and has been for a great many years. The Rocky Mountain District is his old stamping ground. I take pleasure in turning the meeting over to Mr. Harrington. (Ap¬plause.) DAN HARRINGTON (Chief Engineer, Safety Division, U. S. Bureau of Mines, Washington, D. C.): Gentlemen, I suppose you have rather a long program, so there is no necessity for any introductory remarks. Inasmuch as I have rather a long-winded paper of my own, I presume the best thing I can do is to go ahead and read it. Mr. Herres asked me some time ago if I would preside here, and also have a paper, or at least have something to say to the Institute on safety. I thought it best to put whatever I had to say in written form, so I would know exactly what I had said and so I would be able to, if necessary, defend it later on.

Executive Summary The future of coal as an important energy source in the 21st century will depend heavily on whether or not our industry is recognized for its performance. We have had a major role in powering our nation through the 20th century ... but many today do not understand that role nor do they know that 56% of our nation's electricity today comes from coal. Corporate communications, marketing, and public relations must be a high priority of our industry if we are to survive in the society of the 21st century as a viable energy option for powering our nation. The time to start is now. The place to start is locally. The way to strengthen local and regional efforts is to network on a regional and national level with associations who have the ability and the will to develop effective communications strategies. Introduction The Minnkota Power Systems is a regional association of 26 electrical suppliers. Serving more than 96,000 customers in a 34,500 square mile service area in Minnesota and North Dakota, the association includes 12 municipal utilities, 12 distribution cooperatives, a municipal power agency, and a generation and transmission cooperative. The Minnkota Power Systems generating capacity totals 613 megawatts, and 83% of it is fired by lignite coal. On an annual basis, 80% of our total energy is derived from coal. We are proud of our long association with the coal industry. Our pride shows in the very visible role that coal plays in our marketing and public relations efforts. In 1993, the Minnkota Power Systems had one of the lowest wholesale rates in the country, at 3.1 cents per kWh. Average residential rates were 5.8 cents per kWh. Minnkota Power Cooperative, One of the Minnkota Power Systems, is a generation and transmission cooperative headquartered in Grand Forks, North Dakota. Minnkota's Strategic Plan - Shaping the Future Minnkota recently completed a strategic planning process which is intended to give direction to our future and allow us to proactively influence the shape of that future. Minnkota's mission is to assist the associated systems in Improving the quality of life of their consumers by continuously improving the value of electric energy to the consumer. Profiled here are the six RMCMI Scholarship Award Winners for the 1987-88 academic year. Five attended the Diamond Jubilee Convention as guests of the Institute at the June 83rd Regular Meeting held in Snowmass Village. Colorado. Each received a recognition plaque and $500.00 to be used toward tuition in his junior year beginning September, 1987. Keith McGinnis. Scholarship Chairman, personally interviewed candidates at three of six colleges and universities in the program. As this is a continuing award the winners this year and those from last year will receive an additional $500.00credit toward tuition if they maintain a satisfactory academic average and are again recommended by their colleges or universities. Criteria for these awards are: I. That the award be make in the spring to a sophomore student to be used toward tuition during the junior year 2. That the recipient be both a U.S. citizen and a resident of the state involved. 3. That the recipient have good academic standing be pursuing a degree In a mining-related field and have an expressed interest in Western coal as a possible career path. It becomes my pleasant duty to call the meeting to order. This is our fiftieth regular meeting. And the session we are opening today, I am sure: will be as interesting and informative as those in the past. These gatherings present a fruitful opportunity for an exchange of experiences and ideas that will aid all of us in our work in the various segments within the coal industry. Walter Johnson and his Program Committee have arranged a wonderful program for us; Walter, due to his standing in the industry and his large acquaintanceship with the leaders of the industry, has really gone to town in bringing outstanding speakers and personalities to deliberate with us in our proceedings. A lot of things have happened since we last met; in the operating end, and in safety we have made marvellous headway, but we have slipped badly in the marketing end. However, I am sure the messages and discussion you will hear will point out ways and means of overcoming at least some of our difficulties. Before we get on with the program, I want to thank our hard working Secretary, Fred Whiteside, who, by the way, is a charter member of the Institute and has attended every one of the fifty meetings we have held; and the various committees who have been meeting for the past several months and who have arranged this fine program you are to hear. I hope all of you enjoy the convention; the business as well as the social sessions.

The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. (Articles of Incorporation and Bylaws as adopted are printed following these minutes.) Additional resolutions were read by Linville as follows: Item 1: WE RESOLVE herein that in the year since the last convention of the RMCMI, the Institute and the coal industry have suffered the loss, through death, and the services of: Lloyd W. Taylor Charles T. Holland THEREFORE, BE IT RESOLVED, that we record in the minutes of the RMCMI, recognition of the passing of these members who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere sympathy and deep regard of the members of the Institute. Item 2: RESOLVED, that in recognition of their long and faithful service to the coal industry that the status of Life Member be conferred upon: Bernard Bernstrom Roy Coulson Shirl C. McArthur Item 3: RESOLVED, that we commend and express our gratitude to our Executive Secretary, officers, chairmen and committees for an outstanding job in presenting. the 80th RMCMI meeting. Item 4: RESOLVED, that the RMCMI express its gratitude to K&P, INC. of Golden, Colorado for their generous donation of office facilities and furniture for the RMCMI office and to K&P SALES ENGINEERS, INC. also of Golden, Colorado for their assistance in telephone answering, other office procedures and the use of certain office equipment. Item 5: RESOLVED, that six scholarships be awarded annually to advance the education program of the Institute to worthy students pursuing career paths in mining or other related industry in the six states in which the Institute generally operates and has members and in accordance with the criteria set forth by the Scholarship Committee. The sixth Annual RMCMI Mine Rescue Evaluation was held during the 1997 Institute convention at Sheraton Steamboat Resort, Colorado. The Mine Rescue committee, co-chaired by Becki Boam and Gary Cook, is one of 18 committees of the Institute. In 1997 the largest number of teams participated in the program. There were nine: BHP Minerals - La Plata Mine, BHP Minerals - Navajo Coal Co., BHP Minerals - San Juan Coal Co., Bridger Coal Co., The Coteau Properties Co., General Chemical Co., The Sabine Mining Co., Solvay Minerals and Western Energy Co. Professional evaluators who provided challenging scenarios for the 80 participants were Jack Knight of Milton, Florida; Wilson Begay, Chris Saxon, and Gaylon Yazzie all of Western States Security; Mary Bailey, Bailey Associates; Tom Bass, California Department of Corrections; and Art Saenz, BDC. Seven members made up each team plus one or more trainers and represented the states of Montana, New Mexico, North Dakota, Texas and Wyoming. Ten different scenarios were presented during the two day evaluation. Each team was given the pertinent information to solve the problem as they assembled at the site. Mine Rescue families and friends participated as victims providing realistic scenarios to simulate the stress of an actual rescue incident. Each team was unaware of the circumstances until arriving at the various scenes in and around the Sheraton resort. [ ] These teams are providers of prompt rescue and medical care for accident victims at their respective properties. The members act with immediate and professional knowledge to save lives and prevent further injuries. Sponsors who contributed financially to the 1997 program are: Argo Industrial, Antelope Construction, Fisher Safety Supply, Flanders Electric Motor Service, Inc; Intermountain Electronics, Inc.; King Energy Services, Inc.; Rocky Mountain Electric Motors, LS.; TerraMatrix and Triune Inc. On Saturday evening, June 28, a reception was held for all mine rescue participants and spouses who had advance registered for this social event. The RMCMI Board of Directors was invited to attend and meet with the teams. As convention attendees, all mine rescue participants and registered families attended the Monday night country western reception and Bar-B-Q. This was followed by an adult western melodrama. [ ] Glass awards with the RMCMI logo and a Mine Rescue figure were presented at the Tuesday Mine Rescue buffet breakfast to all nine teams, each of which had achieved proficiency at level 3. Captains of the teams pictured below are (from left standing): Ron Neff, BHP-San Juan; Ted Laughline, Bridger, Terry Davis, Coteau; Jim Knutson, General Chemical (from left kneeling): Dan Allerdings, Rosebud; Ron Miller, BHP-Navajo; Jonathan Sorrell, BHP-La Plata and Ray Blaisdell, Solvay. Gary Cook is to be commended for his solo last minute supervision of the Mine Rescue program, due to Becki Beam's unavoidable absence. The teams look forward to the 1998 convention at Snowmass Village Resort, Colorado Thursday and Friday, June 25 and 26.

The Annual Business Meeting of the members of The Rocky Mountain Coal Mining Institute held during the 83rd Regular Meeting of the Institute was called to order by the president, Bernard Bernstrom at 2:50 p.m. Tuesday, June 30, 1987 in the Janss Auditorium of the Snowmass Conference Center in Snowmass Village, Colorado. Thirty-one were present and a quorum was established. The president outlined the purpose of the meeting was to inform the members of the status of the affairs and activities of the corporation during the preceding year. It was moved by Leon Jeannot, seconded and carried to approve the minutes as published in the 1986 Proceedings. The chair called for reports of the various committees and these reports will by placed on file in the RMCMI Office. Bylaws and Resolutions. Chairman Loren V. Linville reported there were no bylaws revisions. He further reported that the Board had adopted three resolutions: (1) Noting the passing of members since the last convention-Benton Boyd, E. A. Hare, E. S. Moran, Jr. and Edward Prostel. (2) Of appreciation to the Executive Secretary, officers, chairman, Diamond Jubilee chairman and committees and convention committees for an outstanding job in preparing for the 83rd Regular Meeting of the Institute. (3) To recommend to all RMCMI members that, on an individual basis, they each oppose replacing coal fired generation with natural gas generation. Membership. Chairman Leon Jeannot reported that at the beginning of the 1986 fiscal year, there were 881 active or dues-paying members. During the year, 219 members were dropped for a variety of reasons such as non-payment of dues, transfer, employed elsewhere, change of address. Ninety-six new members have been recruited for an active total of 758. In addition there are 55 Life Members, 20 senior members, six scholarship winners and seven supporters for a net total of 846. The budget of RMCMI calls for 1,000 active members and we must address and plan for those short-term prospects as they will certainly impact our membership. A full report is on file in the RMCMI office. Patrons of the Institute. Chairman Ira McKeever reported that only 59 Patrons renewed their support during 1986-87. Program. Chairman Bill Balaz announced that the convention program theme "This is OUR Life", as presented in "Past", "Present" and "Future" segments was very well received. He called for additional helpers another year and suggested that next year's program format be changed to a hard hitting one. Publicity. Chairman Tom Egan reported that of the three newsletters sent members during the year, that the most effective one was the newspaper format one and recommended its use next year. RMCMI hired Bob Jacob who heads his own public relations firm to solicit advertising for the Proceedings on a contract/ commission basis. He attended the convention for this purpose and to solicit business card ads. A full report is on file in the RMCMI office. Scholarship. Chairman Keith McGinnis reported that five of the six scholarship recipients were present at the convention. Each was introduced to the membership at the Tuesday morning Scholarship Breakfast, presented a plaque and responded. The input from each winner was most favorable to the program. Each was appreciative of the many contacts made and the educational seminars and programs. The selection process started in March and was completed in May, except for one university which had difficulty in providing a candidate. It is suggested that the initial contact with the institutions be made in December and completed by April 1. This year, for the first time, three of the six universities were visited for the purpose of interviewing the candidates. They were Colorado, Utah and Wyoming. A very positive feedback was received from these schools and it is recommended that the practice continue. CONVENTION COMMITTEES Convention Arrangements. Doris Finnie presented the following report: As a professional meeting planner, this Diamond Jubilee convention was indeed a great challenge. One meal was added to the package and thus increased the individual cost. Snowmass Resort Association is unique in that they utilize a conference coordinator who acts as the middle man between myself and the usual persons we deal with, like AV personnel, the chef, the banquet director, the steak fry personnel, the Sunday tour etc. so the office had to become creative. For instance, we learned early on we could not deal with the local florists. It cost us lots less to buy our flowers wholesale in Denver, have my husband drive them up and our West Virginia daughter to arrange them! But, finally her floral arrangement class at CSU paid off! This was truly a Finnie family orchestrated convention. Our Lakewood daughter acted as Scholar-

Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

"Guests and Members of the Rocky Mountain Coal Mining Institute: "It gives me a great deal of pleasure to call the Fifty-Second regular meeting to order this morning. "I think that you will agree with me that we have an excellent program planned for the next three days, comprising various interesting and educational subjects by authors of prominence, which will be of keen interest to all of us in the coal industry. "The Program Committee, chairmanned by John Peperakis, has done an excellent job in securing this very splendid talent for our convention. "I would like to say a word as to the, condition of the coal industry in our part of the country as well as elsewhere. I believe we can look at it with more optimism than in the past several years, particularly in the state of Colorado, with which I am more familiar. "Annual coal production in Colorado gradually dropped from around 12 million tons during the years of World War I to as low as 8 million tons during the last war, and to less than 3 million tons in the year of 1954. We believe that it touched bottom that year, as in 1955 the state production went up again to nearly 3,400,000 tons, equivalent to an increase of 15%. As you know, the national increase in bituminous coal production for the year of 1955 was roughly 2000 over 1954. "The national increase for the first two months of 1956 over the same period of 1955 is approximately 2100. Colorado's production is running around 1000 over the comparable period of last year, and the 5 states represented by our Institute came up with a nice increase in 1955 over 1954 of 1000. "Figures on the increase so, far in 1956 for this group of states are not readily available, but I fully believe that. our industry locally, as well as nationally, is now starting out on a steady rise despite the fanfare of nuclear energy and its more glamorous competitor, solar energy. Many authorities tell us that real competition from these sources is a long way off and that the atomic energy program will consume far more coal than is displaced by nuclear power. "I do not mean to infer that we coal people are out of the woods by a long way' so far as holding and regaining markets, for our coal. The captive operators, which are well represented here, have not lost their market for coking coal, since coke is still a necessary

Sorenson, President, presiding. PRESIDENT SORENSON: The meeting will conic to order, please. Gentlemen, we have quite a program this morning, so we had better push this thing along. Be fore we start this morning, I would like to ask Mr. Davis if he wouldn't come up and say a word or two for us. He is the editor of Coal Age. Mr. Davis. MR. DAVIS: This is quite an unexpected honor. I didn't know that I would be called on to speak to you. It will be brief, but very sincere. All winners were present as guests of the Institute at the June convention in Durango, Colorado to receive recognition at the Institute Awards Luncheon Monday, June 29, 1992. Each state vice president served as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman, Dr. Matthew Hrebar, each winner receives $750 tuition credit for the coming academic year. As this is a continuing award, the winners from the previous year will receive another $750 for tuition credit in their senior year if they have maintained good academic standing and are recommended by their university. A mident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the member state. (3) That the recipient have good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in the engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholar- ship program and the various vice presidents con- tribute the travel expenses to convention for these outstanding young collegiates. TRAWEEK University of Arizona - Tucson, AZ The winner from Arizona, Brian Traweek, attending the University of Arizona, is a mining engineering major from Tucson, Arizona. Brian is the treasurer of the Society of Mining Engineers Student Chapter and spends many of his weekends working at the school's San Xavier underground mine. He has had summer work experience at ASARCO's Ray Unit. [ ] COLORADO WINNER MARK ANDREW NORRIS Colorado School of Mines Golden, CO The winner from Colorado, Mark Norris, attending the Colorado School of Mines, is a mining engineering major from Eaton, Colorado. Mark is active in varsity swimming, intramural sports, and Army ROTC Pathfinders and Pershing Rifles. Mark is a co-designer of the Clear Creek County, Colorado, abandoned mine hazard rescue team plan though an introductory engineering course at Mines. [ ] MONTANA WINNER MARK J. BREN Montana College of Mineral Science & Technology, Butte, MT The winner from Montana, Mark Bren, attending Montana Tech, is a mining engineering major from Butte, Montana. Mark is an excellent student and active in the student chapter of the Society of Mining Engineers. He has worked at a gold mine in Montana, in the Earthquake Studies Office at Montana Tech, and a volunteer on the Neversweat and Washoe Railroad.
