Eminent domain overview Eminent domain is the power of the Government or a municipality to take property for public use without the consent or acceptance of the owner. Typically, the agency taking the prop¬erty will make an offer, hoping the owner will immediately accept and allow work to begin. If a mutual resolution regard¬ing its value cannot be reached, how¬ever, the municipality will institute a condemnation action in court seeking possion of the property. This is when the problems begin. The power of the Government to take the subject property is limited by Federal and state constitu¬tional requirements to pay "just com¬pensation" for the property. The exact nature of an owner's prop¬erty has been the subject of much debate and discussion. It is generally under¬stood, though, that property is consid¬ered to be "every kind of right or inter¬est, capable of being enjoyed and recog¬nized as such, upon which it is practi¬cable to place a money value" (US vs. 53 114 Acres of Land). A taking, for condemnation purposes, is considered to occur whenever there is a substantial interference with the free use and enjoyment of the property. Rarely is the necessity for the taking ever challenged and more rarely is the taking ever successfully challenged. When a taking occurs, it is not only the fee owner who is entitled to compen¬sation. Every person holding an interest in the subject property will be recog¬nized. Thus, all persons who at the time of taking have a compensable interest in the property will be made parties to the case (Swanson vs. US). Minerals, like all other interests in land, are recognized as property rights, giving the owner the power to dispose of them as he or she sees fit. Thus, the only remaining considera¬tion is only "just compensation." Ex¬actly what "just compensation" is has been difficult to define. Generally, it is that amount of money that will "put the person in as good a position as the per¬son would have been in had the taking not occurred." The owner must not be forced to sacrifice or suffer by receiving less than full and fair value for the prop¬erty. Every element that effects the value of the land and that would influence a purchaser must be evaluated. Courts have employed a variety of techniques to determine just compensa¬tion but have generally relied on market value as the standard for measuring compensation to the owner. The deter¬mination of market value is based on sales, income, costs, and use. These factors have been employed in various ways but can be summed up as: -The highest estimated monetary price the property will bring if exposed for sale in the open market with a reason¬able amount of time allowed to find a purchaser who is buying with knowl¬edge of all the uses and purposes to which it is adapted and for which it is capable of being used. • The amount the property would bring if it were offered for sale by one who desired, but was not obliged, to sell, and was bought by one who was willing, but not obliged to buy. • What the property would bring in the hands of a prudent seller, at liberty to fix the time and conditions of sale. • What the property would sell for in negotiations resulting in sale between an owner willing, but not obliged to sell, and a buyer willing, but not obliged to buy. • What the property would be rea¬sonably worth on the market for a cash price, allowing a reasonable time to affect a sale. (Michigan Standard Jury Instructions). Special consideration regarding mar¬ket value is given when the taking is only partial, rather than complete. An example of this partial taking is when a state highway cuts across the northern half of a parcel of property, leaving the rest behind for the owner. A variety of problems can be immediately seen. In a partial taking, the owner is permitted to recover not only for the property taken, but also for any loss in the value of the remaining property. The measure of compensation for partial taking purposes is generally the difference between the market value of the entire parcel before the taking, and the market value of what is left of the parcel after the taking (Michigan Stan¬dard Jury Instructions). Determining the partial taking value for mineral bear¬ing lands is the difficult issue.

All industrial processes are economically driven, resulting in the ever increasing need for process optimization in order to stay competitive and profitable. Numerous models has been published depicting the optimization of the raw material usage in an arc furnace, as well as the thermal and electrical efficiency; however, to obtain a holistic view of the cost-effectiveness of the process one needs to expand the model to include the cost of all the operational variables. This project therefore aimed to not only include the raw material feeds and power consumption as input variables, but also the labour, maintenance, and environmental costs to generate an all-inclusive financial balance. In the end, the model was able to mathematically optimize the ferrochrome (FeCr) production process through evaluating the effect of a specified combination of input parameters. It could therefore be used as a tool to aid in managerial decision-making; to appraise and correspondingly adjust certain operational variables in order to achieve a maximum return on investment. This paper fully describes the reasoning behind the choice of the essential model components, the assumptions made during the models development, the calculation approach, as well as the advantages, limitations, possible applications, and areas for expansion of the final model. Through running simulations with plant data, it was found that the accuracy of final model remained fairly constant when applied to stable furnace conditions, but was met with a number of limitations when applied to more complex situations. These limitations could, however, be overcome through further development and expansion of the existing model to include a larger number of process variables.

In this decade of the 1.970's it is forecast that eight billion cubic yards of rock will be excavated from 400, 000 miles of new tunnels, drifts and other underground workings in the western world, according to estimates in a report of the Organization for Economic Cooperation and Development (OECD). It is expected that the cost of this work will be in excess of $54 billion in constant 1970 dollars. Most of this underground excavation will be in mining -- 97% of the tunnel length and 89% of the volume - -the balance in construction. In addition to this huge excavating task, in the 18 developed nations of OECD, will be projects in the Communist Bloc and in the developing nations. Underground excavation requires the successful completion of three principle activities: A. Break -- to free rock from the solid work face. B. Remove-- to clear the work area of broken rock. C. Support -- to assure stability of rock surrounding the underground excavation and to eliminate risk of rock collapse. In today's fully mechanized excavation systems, continuous miners, roadheaders or tunnel borers, (A) break the rock loose from the face, and (B) remove broken rock with their mucking devices and load it onto belt conveyors, mine cars, trucks, or any other appropriate haulage system for disposal. The Bond grindability testing procedure has been standardized to measure the same grindability values, i.e. Bond work index (BWi), for the same ore when tests are performed in different laboratories or by different operators. This is accomplished by the standardization of mill dimensions, tumbling speed, grinding ball charge weight and distribution, sample ore charge weight in the mill and operating practice. The results of this investigation reveal that the Bond work index grindability values may differ substantially with different standard Bond ball mills. This paper will review the results.

THE consideration of the present value of a mine is of great importance when planning for the operation of a property,, and it is particularly so in the case of mines that have large ore reserves. At various times during the past 15 years, the writer has had occasion to make rather thorough studies of the subject, and has been greatly impressed by certain important points which these studies have brought out, points which, though they may be well known, are often lost track of in the rush to obtain low mining costs and high daily tonnage output. . It is the object of this paper to present briefly, and in a general way, some of these points, and especially those which have to do with the relationship which (1) ore reserves and plant capacity, (2) grade of ore mined, and (3) ore losses in mining, bear to the present value. Present value, sometimes called present worth or actuarial value, means the value today of the future earnings of an enterprise. Great industrial, manu-facturing or railroad enterprises, if properly handled, go on indefinitely and their value is directly dependent on their estimated annual earnings. Mines, or oil properties, on the other hand, have an earning capacity only until the ore or oil is exhausted, and their present value is dependent not only on their annual earnings but also on their life, which is the length of the period over which they can produce at a profit. A mine, or an oil property, is a "wasting asset," while an estab-lished manufacturing business is not, or should not be. In other words, the present value of a mining property. represents a sum of money on which there could be paid from operating profits a determined rate of interest, say 8 per cent., and in addition an amount which, if invested at compound interest as received, would at the end of the life of the mine pay back the present value. In his "Wealth and Income of the American People," Walter Renton Ingalls says: "The fundamental principle of mine valuation is the present worth of an annual dividend accruing during the period of years corresponding to the life of the mine."

Although not fully accepted in South Africa, the Theory of Sampling originally proposed by Pierre Gy is fast becoming the cornerstone of sampling practice throughout the world. The growing acceptance of Gy?s Theory of Sampling in South Africa can be attributed to a number of factors, chief amongst them being the development of a tradable mineral asset market, the promulgation of the Mineral and Petroleum Resources Development Act (MPRDA), the growing number of commercial and academic courses that are offered on sampling, and the regulation of the industry through internationally acceptable guidelines and rules for reporting and trading in mineral assets. The size of the South African minerals industry and the dependence of our economy on mineral production have also meant that correct sampling is of key importance to mineral trade. ISO standards have been the principal guides for producers of mineral bulk commodities who produce to customers? specifications, whereas Gy?s insights have been most readily accepted by precious and base metals producers whose product is sold into metal markets. Understanding of small-scale variability is essential in the precious and base-metal industries, but detailed studies of the effects of heterogeneity have not been as productive in the bulk commodities. Sampling practices at different stages of mineral development from exploration, face sampling and grade control, ore processing and handling, metallurgical sub-sampling, point of sale sampling, and sampling in the laboratory are considered in the gold, platinum, ferrous metal, and coal industries. A summary of the impact of poor sampling in these industries is presented. Generally it appears that poor sampling practice is most likely to erode mineral asset value at the early stages of mineral development. The benefits of good sampling are considered, especially with regard to the financial implications of bias and error on large and consistent consignments of bulk commodities. Conditions in the South African market relating to atmospheric emission control has changed dramatically over the last 10 years. Companies have become more responsible, environmentally aware, and have to comply to more stringent environmental limits set by legislation. This paper describes briefly the current best available atmospheric pollution abatement technologies relating to particulates, acid gases, NOx, acid mists, aerosols, mercury, dioxins and furans. Mention is also made as to the best practices for product work-up and waste product disposal.

Blast vibration seismograms are generally collected strictly for compliance with regulations. The peak levels (including dominant frequency) are typically all that are looked at. However, these records contain a lot more information about how a blast has performed. The seismogram is actually a record of explosive energy that was not used in fragmenting rock. The trick is to determine how to extract information that would be useful in analyzing blast performance.

A prototype EM Location System was fabricated and tested at the Geneva Mine near Dragerton, Utah. This system consisted of six manpack transmitters and six manpack receivers covering the frequency band from 900 Hz to 2900 Hz as well as a six channel receiver designed for use, in a helicopter. Tests showed that EM signals from lightweight (3/4 lb) transmitters could be detected both on the surface and from a helicopter through as much as 4450 ft of relatively high conductivity (2 X 10- 2 mhos/m) overburden. Furthermore, the resulting field strength profiles could be used to determine source location to within 150 ft of the actual surveyed location in the mine. Modifications were made to a Monitoring, Locating and Communications System being tested at the Bruceton Mine, Pittsburgh, Pennsylvania. These modifications have improved the performance and quality of the paging and voice telephony mode of the system. Subsurface receiver modifications have improved reception of voice downlink signals.

"In the process of smelting copper ores and secondaries in the reverberatory furnace to produce a copper matte and a slag low enough in copper content to be discarded on the dump, it is essential to the best functioning of the process that most of the iron in the material charged into the furnace be at the end in the form of sulphide in the matte or ferrous oxide in the slag. Ferric oxide and magnetite present in the charged material should be reduced to ferrous sulphide or oxide. Ferric oxide offers no difficulty in reduction, at least to the magnetite stage, because it reacts very readily with sulphides at quite low temperatures. Magnetite is less reactive and consequently more resistant to slagging, so that the furnace man must take advantage of all factors favoring its reduction in order to prevent accumulations in the furnace.In order to determine these factors more definitely, the Bureau of Mines in cooperation with the Department of Metallurgy, University of Arizona, has undertaken at the Southwest Experiment Station an investigation of the effect of various factors upon the rate of reduction of magnetite by ferrous sulphide. A previous paper's reported the nature of the reactions taking place and the effect of various physical factors when only pure sulphide and oxide were present. Since in the actual smelting operation, many other substances are also present, it seemed desirable to make a study of the effect of their presence upon the rate of reduction of magnetite by ferrous sulphide. Such a study has been made; the work done and the results obtained are described herewith.As will be shown later, it has been found that of the substances usually present in the smelting charge, silica and magnesia accelerate, whereas lime, alumina, and cuprous sulphide hinder the reduction of magnetite by ferrous sulphide.No report of a previous laboratory investigation of this subject has been found. Almost all furnace operators have made at one time or another at least qualitative ccmparisons of the effect of various changes in operating oonditions upon the behavior of magnetite in the furnace, but the conclusions derived from the experiments have never been published."

he Wyalong goldfields were discovered in September, 1893, Messrs. Neeld and Sons, owners of the principal mine, being the pioneer prospectors. During the earliest days of the field the ore was sent to Barmedman, a distance of eighteen miles, for treatment at a battery there. The field rapidly increased in importance, and it was not long before a public battery was established on the spot. After some considerable quantity of ore was treated by this process, it became apparent that battery treatment was quite unsuitable for the richer ores, involving, as it did, considerable loss in the tailings. Recognition of this fact led to the erection, in 1895, of plants by the Wyalong Chlorination and Cyanide Works, owned by Mr. Walter Sully, for treatment by their processes; followed, at a later date, by Messrs. Neeld and Sons Chlorination Works. The Wyalong Chlorination and Cyanide Works, after a delay of twelve months in the erection of their plants, have since catered continuously up to the present time for the requirements of the field.Their plant consists of a No. 3 Gates' rock·breaker, a revolving dryer, a No. 5 Krupp mill, revolving roasting furnace with finishing hearth, two chlorination vats of 20 tons capacity each, "nine cyanide vats of 30 to 100 tons capacity, two Wheeler pans and three chlorine generators. The ores are purchased outright on assay at a fixed scale of charges, and treated by the owner of the works on his own account.

THE PROCESSING OF A TANTALITE ORE(a) The OreThe minerals in which tantalum and columbium most commonly occur are tantalite and columbite. These two minerals are the end members of an isomorphous series of tantalates and columbates of iron and manganese, but in nature the series grade into each other.Some of the best deposits of tantalum and columbium ores in the world occur in the north-west of Australia. Until recently tantalite low in columbium was the only mine~al in demand but discoveries of extended uses for columbium, e.g., addition of ferro-columbium to high chromium I steels inhibits intergranular corrosion (weld decay), have created a demand for columbite low in tantalum as weB. Both of these types of' ore occur in the Pilbara district in Western Australia and most of the ore mined is exported to America after a preliminary grinding and concentration by gravity.A sample from the Bynoe Harbour locality, west of Darwin, was used in this investigation. Geomechanical factors at the mine are important and will become even more relevant as the pit expands and deepens. To address these demands a team was assembled to collect geomechanical information and perform numerical analysis. The west wall is the largest and flattest of all the design sectors in the pit and rigorous studies were carried out on this wall. The wall behaviour is controlled mainly by a set of steeply dipping joints within the slope in the Fortuna Granodiorite and a weak zone, the Zona Plastica, that extends vertically near the pit bottom. These features lead to large toppling displacements in the upper portions of the wall. Two numerical models were used to reproduce the general features of failure observed in the wall. The modelling indicated that a toppling mode of failure results from shear on the steeply dipping joints. The toppling leads to slumping or landslides whereby the west wall flows slowly downslope as the Zona Plastica compresses

A simple and cost effective technique to increase fragmentation and burden velocities without making major modification to the overall blast design is with ALTERNATE VELOCITY LOADING OR BOOSTERING OF ANFO. The technique requires the placement of a cartridge or slug of explosive, having higher density and detonation velocity than ANFO, every few feet in an ANFO column. The greater the difference in density and detonation velocity of the Alternate Velocity Load to ANFO, the more pronounced are the results. Emulsions were selected as the Alternate Velocity test explosives because they detonate closer to ideal conditions than most other commercial explosives.

In order to meet increasing demands for water supply in the next millennium, the Government of the Hong Kong Special Administrative Region have identified the need for a major new water treatment and transfer scheme. The project now under construction will comprise a 1.2 km long raw water aqueduct, a major new 0.25million cubic metres per day water treatment works (with space for upgrading to 1.2Mm³/d), a 12.1 km long treated water aqueduct and a primary service reservoir. The Bureau of Mines conducted a laboratory investigation of copper electrowinning from electrolytes produced by solvent extraction. The purpose of the research was to gain a better understanding of the fundamental relationship between copper electrowinning conditions, anode corrosion, and cathode purity. Processing variables were evaluated in a cyclic semicontinuous system in which the depleted electrolyte was used to strip copper from loaded organic extractant. For the production of high quality copper cathodes, the electrolyte was dosed with cobalt and stripped of organic solvent extraction reagent. An optimum cobalt addition of 60 ppm, and removal of the entrained extractant with activated carbon provided the best conditions for electrowinning copper containing the least amount of lead and controlling anode corrosion. As little as 13 ppm of the entrained organic extractant, LIX 64-N, significantly accelerated anode corro-sion. However, the addition of 1,000 ppm of organic diluent kerosine did not affect anode corrosion. After cobalt dosing and removing the entrained extractant, cathodes containing less than 2 ppm lead were consistently electrowon at widely varied current densities, electrolyte copper and acid concentrations, and temperatures. Dosing of the electrolyte with selected impurities including magnesium, aluminum, manganese, and iron did not affect the cathode purity. However, 0.05 giL of chloride ions markedly increased anode corrosion and the sub-sequent transfer of lead to the cathode copper.

Magnetic separation is an age-old technique for mineral beneficiation operations. The existing mathematical models for magnetic separators are quite complicated, and it is very difficult to measure the theoretical separation efficiency. The connectionist approach of modeling, to establish the relationships of the inputs and outputs, is preferred for this kind of problem. Experiments were carried out on a high-intensity roll magnetic separator to develop a database using four input variables (magnetic flux intensity, particle size, splitter position and roll speed) and two output variables (weight recovery and Fe recovery). The artificial neural network (ANN) and statistical methods (MLRG) were used to model the magnetic separation process. For the ANN, the regression coefficient (R2) values between the predicted and measured results were 0.89 and 0.94 for Fe recovery and weight recovery, respectively. Compared to ANN, the multivariable linear regression analysis showed inferior performance in predicting the weight recovery and the Fe recovery. The ANN models for the roll magnetic separator can predict the separation efficiency up to an acceptable limit. These models can be used to modify the operational parameters at mineral beneficiation plants to minimize the effects of variations in the raw material characteristics.

The ever-increasing pressure on the profit margins of ferro-chrome producers and the gradual depletion of deposits of rich hard lumpy chrome ores calls for the ferrochrome industry to maximise the use of fine fractions of concentrates and friable chromite ores. Zimbabwe is endowed with huge deposits of refractory and friable ores that occur on and off the Great Dyke complex. The conventional metallurgical process of smelting of chromite ores in submerged arc furnaces is favoured by the use of refractory hard lumpy ores. The requirement to use all lumpy ore has been circumvented to a large extent at Zimbabwe Alloys. The use of briquetted chrome ore fines in the production of Ferrosilicon Chrome and High Carbon Ferrochrome has yielded positive results over a period in excess of twenty-five years. Of the three industrially used methods of agglomeration of chromite ores; sintering, pelletisation and briquetting, briquetting is preferred because the other two are associated with higher capital and operational cost. Zimbabwe Alloys has developed operational and technical expertise on the briquetting and utilisation of chromite ore fines and concentrates. Variations in the quality of available chromite ore fines imply that their amenability to briquetting is a dynamic problem. Appropriate briquetting parameters to guarantee quality briquettes are essential to the successful use of briquetted chromite ore fines. In developing a technology for briquetting of chromite ores, it is important not only to study the mineralogical and grain-size characteristics of the chromite ore fines but also to make an informed choice of the type and quantity of the binder and the conditions for producing a physically and chemically competent green and cured briquette. This paper discusses Zimbabwe Alloys' experience on the briquetting process and the advantages derived in the smelting of the briquetted chromite ore fines in comparison to the use of conventional lumpy chromite ore with respect to improvements in chromium recovery and as a consequence related efficiencies and unit cost of production.
