This paper will address methods for minimizing liability and protecting materials from disclosure as result of self- evaluative audits and internal investigations. Specifically, the paper will cover the role of counsel in the investigative process and how best to design and conduct internal investigations to minimize the development of problematic material and disclosure of information. The paper will also address the extent of privileges that may be relied upon to protect materials and information from disclosure. These include the attorney-client privilege, the self-critical analysis privilege, and the attorney work product privilege. These privileges are qualified and understanding the limits of their coverage is essential to minimizing liability.

A model of a new laboratory magnetic separator has been conceived to cater the needs of process engineers and mineralogists world over engaged in mineral characterization and beneficiation. It would be essentially a laboratory instrument for the separation and concentration of various ferro and non-magnetic minerals. Based on the basic concept of Frantz Isodynamic Magnetic Separator, the new separator conceived would not only speed up the work of a process mineralogist and save the energy, but it would effectively separate and sequentially produce about fourteen fractions at a time. In the present paper, the probable operational procedures and the design have been discussed in detail for the various mining companies to assess its economic feasibility. If it could be fabricated, it would have a worldwide market The concept has been patented in author?s name in India.

Excessive vibration is known to have an adverse affect on soft body tissue and operators of heavy mining equipment can be exposed to vibration that exceeds levels recommended in international guidelines (ISO 2631-1, for example). Research has found that many of the seat and suspension systems currently used in mine haul trucks and load haul dump vehicles are actually amplifying the vibration. This overview presentation will outline the current research being conducted at Laurentian University and the University of Western Ontario, and the roles of partners in rating the ability of a number of commonly used mine vehicle seats to isolate harmful vibration.

Ventilation is an expensive prerequisite for underground mining. Current mining trends, including increasing depth and mechanization and more stringent health regulations would generally dictate that more air volume is required in order to provide good working conditions underground. However, any increase in the mine’s intake airflow can produce a disproportionate increase in power consumption and hence operating costs due to the cubic relationship between the sup-plied air power and the airflow (Power a Flow3). Furthermore, forecasts of significant increase in energy prices and new commitments with regard to reductions of greenhouse gas(GHG) emissions, determined the mining industry to look into developing new concepts, design tools and incorporate the latest mining technologies in order to lower capital and operating costs while meeting commitments regarding GHG emissions. The advances in computing power and modelling software now make it possible to design, model and schedule a mine from opening to closure. A developing trend is to design and plan the mine by means of orebody modelling software, followed by using discrete-event simulation techniques to predict production rates and evaluate various operating scenarios throughout the life of the mine. The authors are currently evaluating how such process simulators could be adapted in order to forecast the need for materials or a specific resource, and one of these would be the mine’s “life-cycle” airflow demand as a function of scheduled production rates and mine operating characteristics. Further to this, based upon the mine’s life-cycle airflow demand schedule, the ventilation system could then be designed using a mine ventilation simulator. This new design approach would integrate in parallel the development of the ventilation system with the current mining conditions, therefore, heading towards “develop-as-you-go” as opposed to developing the system for final requirements with high upfront costs. This new ventilation system design criteria would also incorporate the use of the “ventilation-on-demand” technology, which will further lower development and production costs and implicitly, the mines’ GHG emissions.

In 1995 I was asked to participate in a litigation matter between a corporation and its insurance carriers concerning insurance coverage for remedial costs at a large, environmentally contaminated closed-down former industrial facility. One of the buildings on this site became known to the lawyers representing the company as “the infamous Building 8”. This building housed millions of documents retrieved from various locations at the facility while it was being shut down. It became apparent that the facility management had no document destruction policy, and thus Building 8 contained internal memoranda, notes, copies of correspondence, permits, operating records, inventory records, and the like from fifty years of operation. Needless to say, some of these documents, all of which were subject to discovery by the insurance companies in the litigation, contained material that was less than helpful to the company’s case. Of course, there were also a few helpful documents, but the overall usefulness of these records was outweighed by the negative impact they had on the conduct of the litigation. A second example involves e-mail. Several years ago, acting on an anonymous complaint that we later discovered was made by a disgruntled former employee who had been fired, a small army of federal environmental investigators descended on a client’s operating facility and, armed with a search warrant, literally commandeered the facility’s EH&S department. The investigators impounded the computers of the EH&S personnel and extracted all of the data from the hard drives of those PCs, as well as all EH&S related files from the hard drives of several servers used by the facility. These computers contained many years’ worth of stored e-mails, draft letters and memoranda, and other documents that provided grist for a four and one-half year criminal grand jury investigation of the facility and its EH&S staff. Both of these companies would have benefited from following a rigorous, enforceable, corporate records policy. Here is a third problem. My client had, during the 1960s, made a brief, and unprofitable foray into the nuclear fuel processing business. It ultimately sold the subsidiary, and was forced to give the purchasing company a broad indemnity against future liability. As might be expected, years later the facility was found to have considerable soil and ground water contamination both by chlorinated solvents and low-level radioactive material. Several years into the remediation program, my client discovered a tractor-trailer load of files, apparently removed from the subject facility, sitting in a parked trailer in a company-owned lot 300 miles away from the facility, where they had been for nearly thirty years. These documents were not helpful to the client, but had to be reviewed, at considerable cost, by paralegals. Moreover, several of the boxes turned out to have been mildly radioactive, setting off a chain of health and safety issues that consumed tens of thousands of dollars of legal expenses before they were resolved. Today, formal, enforceable corporate records management programs have become an extremely important element of overall corporate management. What was for most of the last century little more than a low level warehousing function is now a critical, actively managed, operating function that affects every level of corporate management. The rapid assimilation into corporate culture of electronic document management and the prevalence of e-email as the primary means of internal communication have created records management complexities the likes of which were not even conceived of fifteen years ago. Record preservation and destruction are no longer matters that can be handled on an ad-hoc decision making basis. Because of regulatory requirements affecting various classes of documents and the litigation consequences of ad hoc retention and destruction of corporate business records, and the need to have the ability to quickly retrieve documents in either a litigation or business negotiation context, a set of records management norms have evolved over time that have become the core elements of virtually every corporate records program. In most surface mining operations, overall project economics is driven to a significant extent by the slope angles that can be achieved within the rock masses present. This is particularly true of precious metal pits in which stripping ratios can be relatively high, although examples from other non-precious metal operations (such as large iron ore and copper pits) can also be found. As a consequence, it is not surprising that in most large (deep) open pit mines, relatively small changes in slope angle (of the order of two or three degrees can translate into changes in project value measured in the tens or even hundreds of millions of dollars. Understanding how this potential value can be realised, and quantifying the associated risks, should be one of the key outcomes of modern slope engineering practice. In striving for optimised slope angles, therefore, mining companies and their specialist consultants are increasingly turning to more sophisticated methods of engineering open pit walls. This paper summarises contemporary slope engineering practice as well as some of the key technical issues that are either currently being researched or will need to be researched in the future. It is written in the context of the slope engineering process; namely, data collection and analysis, failure mode identification and stability assessment, slope design, slope formation, and slope (face) mapping and monitoring (the latter two activities being the primary on-going data collection functions that close the design loop).

And to the extent that nonelectric initiators are immune to the hazards of stray current and radio frequency energy found on normal blast sites, an advancement in safety has been accomplished. However, as a cautionary note, it is important to realize that there are still many hazards associated with any initiation system. While some of these hazards may differ from those associated with electric detonators, others are identical to those associated with any type of initiation system. A sorption apparatus for measuring the equilibrium sorption isotherm and the rate of diffusion of methane from fine-sized coal was designed and constructed. Preliminary work that used Pittsburgh and Pocahontas No. 3 coal shows that the diffusion coefficient varies with pressure and that the fracture spacing in these two coals is substantially different.

"The research aimed at solving the problem of the stacked spent magnesia-chrome refractories using in non-ferrous metal smelters, which contain various heavy metals and are considered as a hazardous waste. The purpose of the research is to recycle the spent refractories environmentally and economically using gravity separation and flotation to obtain metal concentrates for smelting and using chloridizing volatilization to remove the trace metals from tailings, providing raw material to reprocess magnesia-chrome refractories. In the course of the study, laboratory techniques for the preparation of experimental samples of spent magnesia-chrome refractories were developed including the sequence of operations of material grinding, gravity separation, tails regrinding, flotation, filtration and subsequent unification of concentrates, filtration and chloridizing volatilization of tails, and collection of volatiles. Laboratory tests carried out on several types of samples of spent magnesia-chrome refractories from different smelters showed that gravity separation provided increase in quality of concentrates including about 80% metals (including Ag, Pb, Bi) and flotation separation provided increase in recovery of concentrates under the condition of 200g/t of emulsified kerosene, and 500g/t of combined collector. Based on combined technology of gravity and flotation separation, about 90% metals were recovered from the refractories by a closed-circuit test and the total concentrates contained 40% metals, which can be returned to smelting process as a feeding. Because a small amount of metal in raw materials will seriously affect the performance of refractories, chloridizing volatilization is necessary for removing the remaining 10% metals from tails mixed 8% coke and 13% magnesium chloride at a temperature of 1200°C. Thus, the tailings can be reused as a raw material for new refractories.INTRODUCTION Magnesia-chrome refractory has been used extensively in various industries such as secondary metallurgy, non-ferrous furnaces and cement making due to their high temperature stability, low thermal expansion and outstanding erosion-corrosion performance at high temperatures (Gotod et al., 2005; Vezza et al., 1997; Gregurek et al., 2015). Generally, the magnesia-chrome refractories are produced from a mixture of magnesia and massive variety of chrome ores. However, massive chrome ores are being depleted throughout the world. Even more serious is that the heavy metal chromium (Cr) can transfer into soil and water, which will have an influence on the survival and development of human beings (Zhao et al., 2006; Jiang et al., 2004; Qintie et al., 2013). As a result, regulations treating spent magnesia-chrome refractories as potentially hazardous waste are being enforced, making their disposal difficult and expensive."

Iron ore pellet feed pressing has been one of the first and most successful applications of High- Pressure Grinding Rolls (HPGR) in the minerals industry. Vale S.A. has been one of the pioneers in this application, currently with six HPGRs in operation in the pelletising plants of the Complexo de Tubarão (Brazil). In spite of the important advances in the technology, risks still exist when scaling-up the process from small-scale information. The present work takes advantage of the recent advances in the mathematical modelling of the HPGR performance, using the population balance model to evaluate the modified Torres and Casali model prediction in iron ore pellet feed pressing for different scales of operation. Results are presented that compare the HPGR performance in different operational scales for iron ore pellet feed pressing, demonstrating the confidence of this model-based approach for scale-up to full-scale HPGRs used in pressing iron ore concentrates. "A laboratory froth flotation experiment was conducted on a low-grade carbonatite copper ore sample obtained from Phalaborwa in the Limpopo province of South Africa. The sample was a homogenous hydrocyclone overflow which serves as the feed to the flotation cells at Palabora Mining Company (PMC). The sample has an average copper assay of 0.59% with predominant copper-bearing minerals being chalcopyrite, bornite and cubanite. The carbonatite nature of the ore comes from the high content of calcium (28.85%) and magnesium (6.84%) minerals. Collectors used were sodium diethyl dithiocarbamate and potassium ethyl xanthate alongside Senfroth 38 supplied by Senmin. The results showed that at 200 g/t mixture of collectors (50:50), an optimum grade of 8.03% Cu in the rougher flotation concentrate was achieved at 74% recovery, while during the second flotation, 24.65% Cu was obtained at 74.4% recovery using a Senfroth 38 dosage of 6 L/t with 100 g/t mixed (50:50) collectors. The particle size and pH value of the pulp played a significant role in that the mixed collectors performed efficiently at pH above 8.3 and at room temperature while particle sizes greater than 53 µm were well concentrated when compared with those of less than 53 µm. INTRODUCTION The need for copper ore concentration research is on the rise as a result of the depletion of deposits and the advent of low-grade copper ores. Although most copper ore deposits have other valuable minerals that support their economic extraction, the increase in technological innovations as regards copper usage and applications has increased the demand for copper. When this prototype is placed on stream next to a conventional grinding mill as you suggest how do we estimate the power requirements and the grind which will be achieved?ReplyLet me explain the Macassa circuit. The tower mill here was running in parallel with one of the ball mills. The feed entering the tertiary system is scalped in a primary cyclone. The finial cut is made in a secondary cyclone. The actual feed to the tower mill is the underflow from the two cyclones and was split to the ball mill and tower mill. During the testing we were unable to isolate the tower mill to determine its contribution to the overall system. We then started to look at the amount of material produced across the mill. We entered the mill at between 17% and 20% finished material and exiting at between 36% and 40% finished material. We were able to project, with a high efficiency classification system, and arrived at 6 Kwh/ton or better."

"SynopsisThe Kanichee open pit mine and milling complex is situated approximately four air miles north-west of Ternagami, Northern Ontario, in Strathy Township. Mining and milling production commenced in January 1974.Milling throughput currently is at a rated capacity of 500 tons per day, seven days per week. A bulk nickel-copper sulphide concentrate is produced, and is trucked daily to the smelter at Falconbridge Nickel Mines Limited, Falconbridge, Ontario, some 120 road miles from Kanichee. Concentrate grades produced are in the order of 4.0% Ni and 8.0% Cu, with corresponding recoveries of 68-70% nickel and 86-90% copper. Stage additions of 100% guar-gurn solution reagent to the flotation cells for depression of talcose minerals, proved to be the major break-through for optimizing metallurgical performance.2. HistoryThe present Kanichee Mining property is known to old-timers in the Temagami area as the former Cuniptau Mine. Several attempts were made in the mid '30's and 40's to extract the ore at a profit, but each effort resulted in failure.In 1933-36, Cuniptau Mines Development Co. Limited, later called Cuniptau Mines Limited, sank a 245-foot vertical shaft and completed 2,200 feet of lateral work on the 100-140 and the 225 foot levels. Fifteen tons of ore were sent for testwork to the Mines Branch, Ottawa, Ontario.Cuniptau Mines Limited, in 1936, milled some 3,000 tons, and the resulting concentrate was put through a pilot smelter situated on the present mine site. Metallurgically, the smelting results were not encouraging, primarily due to the high melting point of the talcose minerals in the concentrate. From the period 1937-48, minor exploration work was done by Ontario Mining Corporation, Ontario Nickel Mines Limited, and Trebor Mines Limited. During the period 1948-49, 128 diamond drill holes, totalling 40,900 feet were evaluated by Trebor Mines Limited. In 1961, the name was changed to Ajax Minerals Limited, during 1968, five diamond drill holes were sunk, totalling 1,700 feet. Since that period the property has remained idle."

The transformation of Polish economy, has contributed to the significant ownership changes and the way of management. Most of non-ferrous metals producers are now joint stock companies or stock companies, which shares are owned mostly by Polish shareholders, the State Treasury, banks or trading companies. However, as compared to the international tendencies, the cost of production of base metals in Poland are still relatively high, and the utilization of secondary sources is still very low. In this sense, the paper point out that some positive results of the current pro-ecological mineral policy in Poland have been already clearly visible in the case of non-ferrous metals smelters, where the emission of dusts and gases was significantly reduced. Therefore, if the current increasing tendency of world production of non-ferrous metals continues, Poland’s role as their primary producer will be reduced.

"On July 26, 2000, the Canada Foundation for Innovation announced an award of $1.3 M dollars for The Centre for Environmental Research in Minerals, Metals and Materials, CERM3, at The University of British Columbia. Additional funding was also provided by the British Columbia Knowledge Development Fund ($1.3 M) and the UBC Stewart Blusson Fund ($0.7 M). Annual industrial grants and contracts are providing support funding for the on-going research projects. Corporate membership in CERM3 entitles each participant to a seat on the technical advisory committee (TAC) as well as access to the five laboratory facilities currently under construction. Both the federal and provincial governments will also participate in the TAC through NRCan-CANMET and the BC Ministry of Energy and Mines, respectively. CERM3’s mission is:• to develop innovative methods to deal with environmental problems created by mining activity;• to promote sustainable development as a hallmark of management decision-making; • to produce mining and processing engineers with the required environmental skills; and• to enhance the image of mining in society as a vibrant and necessary component of a modern economy and society which disturbs the environment for the benefit of mankind.CERM3 brings together a multi-disciplinary team of researchers from over 12 departments at The University of British Columbia (UBC) to work on mining-related environmental problems. These include: chemistry; soil sciences; chemical and biological engineering; earth and ocean sciences; microbiology; civil engineering; electrical engineering; metals and materials engineering; mechanical engineering; mining and mineral processing, the Westwater Research Centre; the Institute for Resources and the Environment; and the School of Occupational and Environmental Hygiene. The centre intends to interact with scientists from industry, governments and other universities across Canada and around the world. CERM3 aims to become Canada’s leading environmental research facility for the mining industry. This paper describes the evolution of CERM3 and its coordinated multi-disciplinary approach to mining and the environment. Some of CERM3’s research projects include:• developing new protocols for environmental analyses to provide consistent and reliable assays;• isolating a natural virus for Thiobacillus ferrooxidans and other bacteria responsible for acid rock drainage (ARD);• designing bio-remediation and adsorption techniques for mine effluents;• promoting and enhancing the use of hydrometallurgy to reduce environmental pollution;• examining new approaches to comminution to decrease energy consumption;• developing a magnetically levitated hoisting system to reduce the footprint of a mine operation;• building a state-of-the-art supercomputer network laboratory for mine/mill simulations; and• designing intelligent bulkheads to seal tunnels following mine closure to survive for 1000 years.This latter project involves the establishment of a research station at the Britannia mine site, 45 km north of Vancouver, which will provide a full-scale facility to design the “Millennium Plug” and contribute directly to the solution to one of North America’s worst ARD-contaminated sites."

"Introductory Statement:In melting the nonferrous metals and alloys for foundry and rolling-mill work, even with the best practice, there is always a loss, due principally to oxidation. Melting losses are a serious source of financial loss in brass and bronze practice, but they are especially serious in the case of aluminum and its light alloys because of the relatively high price of aluminum. The indications are that the melting losses in many aluminum foundries of the United States are at times high, and in some plants (especially where certain furnaces are used) they are entirely too high when compared with the average practice. The fact that the oxidation losses in melting aluminum and its light alloys are high is well known, but it is doubtful whether the factors governing the most suitable methods of melting for a minimum of dross are equally well known. The metal losses involved in melting are worthy of especial attention now because of the rapidly growing importance of the aluminum industry.Factors in the operation of furnaces which affect metal and fuel losses:The essential requirements in the commercial melting of any metal or alloy are that the melting losses should be low, the melting should be rapid, and the melting cost should be low. Certainly it may not be possible to obtain these requirements in any furnace selected at random, and it follows that the design and the operation of furnaces for melting different metals are subjects that warrant the most extensive study and tests. As a general rule, in the industrial operation of furnaces, run on aluminum and aluminum alloys, an effort is made to keep the dross and oxidation losses as low as possible. In attempting to hold dross losses low, numerous factors involved in metal melting may be overlooked, or at least disregarded, and the net practical result may be that the furnace is exceedingly wasteful of fuel. In the case of aluminum and its light alloys, the effect of increasing the temperature of melting, at least in an atmosphere containing free oxygen and nitrogen, is to increase the net melting loss."

The influence of solution ionic strength (IS) and electrolyte valence on the flotation behavior of malachite has been investigated. The microflotation tests were conducted over a range of solution IS (1?300 mM) at a constant speed (340 rpm), pH (9.5), flotation time (10 min), and sodium oleate dosage (5.3×10-7 moles/g). The size of malachite ranged from 45 to 53 µm, and two different types of electrolytes (NaCl and CaCl2) were employed. Electrophoretic mobility was also measured over the same IS range employed in the microflotation study. Overall, strong coupled effect of solution IS and ion valence was observed. Specifically, the flotability of malachite increased with increasing IS in the presence of monovalent cation (Na+) while the flotability increased up to 30 mM and decreased with increasing IS in the presence of divalent cation (Ca2+). Notably, the flotability of malachite was greater with the presence of Na+ compared with Ca2+ under high IS conditions (IS>30 mM). Consistent trend for Na+ versus Ca2+ was observed from the flotation results with different SO dosages. The characterization and flotation results suggested that the trend was likely attributed to the increased unfavorable interaction between malachite and bubble via the charge reversal of bubbles and malachite at higher IS in the presence of Ca2+.

A geologic, petrographic and geochemical study has been performed on the pyroclastic flow deposits in the coastal area of East Zhejiang Province, Southeast China. This study leads to classification of the pyroclastic flow deposits into three associations: the extrusive type, the surge type and the ash flow type welded tuff associations. Through detailed investigation and comparison of the characteristics of these lithologic associations, with emphasis on the welded tuffs, a comprehensive model has been proposed to demonstrate the petrogenesis of the pyroclastic flow deposits.

Recent NIOSH published information has shown an increase of rapidly progressive coal workers? pneumoconiosis (CWP) in the southern Appalachian coal region (SAR) of the U.S., despite the fact that compliance data indicates that most coal miners have been exposed to coal mine dust concentrations below the statutory limit of 2 mg/m³. While the exact cause of these elevated CWP levels in the SAR has not been established, several factors may be contributing to the increase in occupational lung disease among coal miners. The mining of high rank coal is known to lead to higher CWP rates, and this type of coal is mined in a portion of this region. Also, a high percentage of the mines in the region are on reduced dust standards because of the high silica content of the airborne dust resulting in miners possibly being exposed to excessive amounts of respirable silica dust. Exposure to excessive amounts of respirable silica dust can lead to silicosis, a disabling and potentially fatal lung disease. NIOSH?s Respiratory Hazards Control Branch has been investigating the possible causes that would account for the observed higher trends in disease progression through literature review, data analysis and in-mine surveying. The investigation to date has revealed that underground mines are faced with cutting large amounts of rock in order to maintain haulage clearances. Cutting rock not only increases the potential for silica exposure, it increases the requirement for machine maintenance, which was a concern observed during dust surveys conducted by NIOSH. Over half of the mines operating in the SAR are on reduced standards due to high silica content. Adequate face ventilation of the continuous miner and roof bolter and limited down-wind operations from the miner are also issues of concern and items that require the constant attention of miners operating in these conditions.
