2013 has seen metals, industrial minerals, and coal all reduce in price due to market and geo-political factors. Many companies are taking write-downs to recalibrate their reserves and have enacted focused cost reduction programs. The public domain includes statements where companies have operating cost reduction goals in the $500 million range. Zero-base staffing & budget analysis is a means to achieve optimal employment and cost levels for a given level of production. The method involves measuring the work to be done similar to Lean. Lean is a method to review each step of production and remove anything that doesn?t add value or is necessary to complete finished goods. Zero-base methodology has been applied to mines worldwide producing realistic and sustainable levels of staffing and costs based on the quantity of work. The objective of this paper is to provide the framework of zero-basing with examples of application.

The molecular form of aliphatic amines precipitates in alkaline solutions when the amine solubility limit is exceeded and forms a typical colloidal system. The zones of mines precipitation and micellization are defined and it is shown that the appearance of a colloidal system in a certain pH range is a unique feature that makes weak electrolyte type surfactants differ from strong electrolytes. The formation of iono-molecular complexes reported in the literature is shown to be a pre-precipitation phenomenon. The zeta potential - pH curves for minerals and bubbles in the presence of amines in the pH range where the amine forms a colloidal precipitate are entirely determined by the precipitate. The pH dependence of the flotation of certain minerals using amines is discussed in the light of these findings.

Introduction Though temporarily shutdown due to the depressed economy, the Henderson mine is a large underground molybdenite producer, using a continuous panel-caving mining system. The location of the ore body requires access from the surface through three shafts, the collars of which are located about 3.15 km (10,350 ft) above sea level. At this altitude, normal temperatures are such that heat must be added to intake-ventilation air for about half of each year. This prevents ice from building up in the intake shafts, waterlines from freezing underground, employee discomfort, and equipment-related problems such as pneumatic rock drill icing and cold starting of diesel engines. Because of topographic and environmental constraints, the Henderson mill and concentrator are located 24 km (15 miles) from the mine, on the west side of the Continental Divide. All ore from the mine is transported to the mill by an electrified rail haulage system, with 15.4 km (9.6 miles) of the trip being underground through a double-track tunnel. A shaft at the midpoint of the tunnel exhausts air drawn from the mine and from the portal that is at an elevation of 2.7 km (8,950 ft). Intake air at the portal must be heated for part of the year to prevent ice buildup. Mine Ventilation System The mine ventilation system uses three sources of fresh air and two exhausts. The primary freshair intake is No. 3 shaft. It is concrete lined to a diameter of 7 m (23 ft) for a total depth of 698 m (2,291 ft). An airflow of 755 m3/s (1.6 mil¬lion cfm) is supplied to this shaft by two vane-axial 932-kW (1,250-hp) fans on the surface. The air is distributed within the mine by means of fresh-air distribution levels connected to production and development levels by raises. A secondary source of fresh air to the mine is provided by No. 2 shaft, the primary man and material access. This shaft is concrete lined to a diameter of 8.5 m (28 ft) for a total depth of 946 m (3,105 ft). Downcast airflow is induced by a pressure differential produced by the fans in the system such that net intake and exhaust volumes are equal. The No. 2 shaft flow of 165 m3/s (350,000 cfm) enters the mine network from the production and haulage levels. Exhaust air is moved from the various working levels through connecting raises to exhaust col¬lection levels that return it to No. 1 shaft. No. 1 shaft is the primary mine exhaust. It is concrete lined to a diameter of 7 m (23 ft) for a total depth of 788 m (2,584 ft). Three vane-axial 932-kW (1,250-hp) exhaust fans are located at the collar of No. 1 shaft, producing a flow of 850 m3/s (1.8 million cfm). In addition, an airflow of 71 m3/s (150,000 cfm) from the intake distribution level is exhausted via the haulage tunnel, by means of No. 4 shaft located midway in the tunnel. The main features of the mine ventilation network are summarized in Fig. 1. Subway tunnels proposed for the Los Angeles County Metropolitan Transportation Authority (LAMTA) East Side Extension are to be excavated below the groundwater through an area of Los Angeles, California with dissolved hydrogen sulfide concentrations in excess of 200 mg/L. To address unique construction and worker safety issues, bench scale and field pilot test studies were conducted to evaluate various mitigation alternatives including in-situ oxidation by chemical injection, slurry pH adjustment to suppress H2S evolution, and chemical treatment to remove the H2S from the slurry and muck material. The results provided the basis for detailed hydrogen sulfide control specifications for the contractor.

Strictly defined, a stull is an inclined or horizontal timber support; a vertically placed timber is defined as a prop. Common usage allows the catchall term "stull" to refer to all such uniaxial mine support, regardless of orientation. Typically a stull is a round wooden column that is wedged in place to provide short-term auxiliary support between sill and back, or between hanging wall and footwall. Stulls may be used exclusively or in con- junction with other support systems such as roof bolts, shotcrete, or cribbing. Stulls are used both as local temporary support in stoping operations and for uniform systematic support installations. Where stoping areas are to be abandoned soon after excavation, stulls may be used to provide temporary support during mining operations. Where controlled caving and subsidence is required, stull supports are designed to fail in a systematic, predictable manner. Wood type is selected on the basis of availability, price, and load carrying characteristics. Coniferous woods are typically used, especially to carry heavy ground loads. Brittle woods are generally avoided because of their tendency to fail suddenly. Gradual yielding failure is preferable to sudden, unexpected failure of the support. Some usage of wood from deciduous trees such as cottonwood and other poplars has been reported in Grants, NM. These stulls reportedly mushroomed as the ground load increased but continued to maintain their structural integrity. Stulls fabricated from structural steel are used in special applications. Adjustable lengths are commercially available in mechanical, hydraulic, and pneumatic designs. The high cost of mechanical stulls limits their use to mining systems where recovery and reuse is possible. End blocking, also called headboards or footboards, uses wood blocks that are placed between the stull end and the ground they are supporting. The blocks are typically 50.8 to 101.6 mm (2 to 4 in.) thick, 203.2 to 304.8 mm (8 to 12 in.) wide, and 381 to 609.6 mm (15 to 24 in.) long. End blocking serves to distribute the support over wider back area. Compression of the end blocking gives visual indication of wall movement prior to failure of the stull. A common application of the stull is in flat-bedded uranium mining during pillar extraction. Many western US uranium mines use a pillar pattern development to delineate the irregular ore pods. After development of an appropriate sized pillar, the ore pillars are then sequentially mined out, leaving the undercut hanging wall or back to cave. Where thickness of the ore is less than 4.3 m (14 ft), stulls are generally used to provide ground control as the pillar is removed in slices. Experience dictates the density of stull placement. In general, the number and size of stulls should be sufficient to resist ground closure and to provide support for drilling and loading operations adjacent to the pillar. Stulls next to the mining face are often lagged 0.9 to 1.2 m (3 or 4 ft) up from the floor (or sill) to confine the blasted ore to a passage next to the pillar. Mucking is simplified by this confinement. Experience dictates whether back control along a mining face requires removal of stulls to allow con- trolled subsidence of the back or hanging wall. Without caving or closure, abutment pressure can create poor ground conditions near the pillar.

Gold heap leach operations often process low grade ores with little margin for cost increases. The advantage of heap leach operations is the considerable savings in both capital and operating costs. This paper looks at an alternative pH modifier to lime in the heap leach process, namely bauxite waste mud or red mud. The red mud can contain trace amounts of gold and was found to be an excellent source of slow release sodium hydroxide for long-term pH modification. Column cyanide leaches showed that 25 kgt-1 of red mud provided a higher pH and longer pH modification than 0.25 kgt-1 of lime. Contaminants leached from the red mud hampered the adsorption of the aurocyanide complex onto activated carbon.

Introduction Pegasus Gold's Montana Tunnels mine is a large surface gold, silver, lead, and zinc mine located 37 km (23 miles) south of Helena in southwestern Montana. Milling operations commenced in late March 1987. The concentrator achieved full production in May that year after undergo¬ing several modifications and improvements. Production for 1988 is projected to be 2.48 t ,80,000 oz) of gold, 34.2 t (1.1 million oz) of silver, along with 8.5 kt (9400 st) of lead, and 22.6 kt (25,000 st) of zinc from lead and zinc concentrates. Mill throughput currently averages 11.7 kt/d (12,900 stpd), compared to the origi¬nally designed capacity of 11.3 kt/d (12,500 stpd). Cash production costs, net of bypro¬duct revenues for the third quarter 1988, were below $3.20/g ($100 per oz). The introduction of ore to the concen¬trator marked the culmination of 12 years ex¬ploration, evaluation, and development. Initial milling operations encountered diffi¬culties with the circuit as designed. As a result, several modifications and improve¬ments were made to the plant. This article is intended to assist other companies developing projects of this type and complexity. It discusses the mine's de¬velopment from feasibility and construction through start-up. The operation, as it exists today, is reviewed including the modifica¬tions and improvements made since start-up. History The mine is situated in Jefferson County, MT within the historic Corbin-Wickes min¬ing district. Underground mining began in 1864 and flourished until the early 1900s. Between 1864 and 1900 the vein deposits in the district produced about $41 million dol¬lars worth of lead and silver ores containing subordinate amounts of zinc, copper, and gold. At various times, three smelters were operated in the area.

INTRODUCTION This presentation will address changing trade patterns in lead and zinc from the mid 1980's to the early 1990's. Lead and zinc deposits are developed where they are found in many parts of the world. As many are not in major consuming areas, there is significant international trade in both lead and zinc concentrates and in refined metal. Forecasts of mine production have been analyzed, primary and secondary refining capacity and future consumption levels have been estimated, to arrive at the changes in trade patterns expected during the next half decade. This paper will first address concentrate and metal trade patterns for lead, then for zinc, and finally some remarks will be made on captive mine/smelter agreements, on regional trade agreements, and on barriers to trade. I would like to note that. there is only a small international trade in semi-fabricated products such as zinc die-cast alloy, zinc oxide, lead oxide or rolled lead and zinc. Most of the world's zinc and lead trade is in concentrates or refined metal. LEAD TRADE PATTERNS Lead Concentrates Six countries are exporters of lead concentrates. Three countries are in the Americas - Canada, Mexico and Peru, with two in Africa - Morocco and South Africa (including Namibia), and Australia. Due to the limited growth in lead consumption and consequent minimum investment in new production facilities expected, mine and metal production levels and future consumption levels are not forecast to change much between now and 1990. Accordingly, the tonnage of lead concentrates exported will remain essentially unchanged from these six countries. In total they have exports of 480,000 metric tonnes (metal content)* and by 1990 this figure is forecast to rise only slightly with the only increase taking place in Mexico. The concentrates are exported mainly to Western Europe & Japan. Apart from these six main lead concentrate exporting nations, a significant change is expected in the United States. Temporary local seismic networks were installed in western Crete, in central Crete, and on Gavdos, an island south of western Crete, in order to image shallow seismically active zones of the Hellenic subduction zone. Data acquisition was divided in four campaigns through the years 1996 to 2001. More than 4000 events in the magnitude range between 0.5 and 4.8 were detected and localized. The resulting hypocenter distribution allows the localization of seismically active zones in the area of central Crete from the Mediterranean Ridge to the Cretan Sea. The comparison of the hypocenter distribution and the structure has allowed intraplate and interplate seismicity to be distinguished. A southwards dipping zone of high seismicity within the Aegean lithosphere is found south of central Crete in the region of the Ptolemy trench. Between 20 and 40 km depth beneath central Crete, the Aegean lithosphere appears to be seismically inactive. Especially for the year 2001, 1560 events were localized, by the seismic network installed on Messara, central Crete. Most of the seismic events were located, as expected, in the South region of central Crete. National Observatory of Athens (NOA) maintains a permanent seismic network in Greece. In this work a comparison of the earthquake epicenters obtained from both the NOA network and the BOCHUM-TUC network is presented.

The Floridan aquifer, which underlies all of Florida, yields water with a sulfate content of less than 50 parts per million in the north-western part and throughout most of the center of the State. In the southern part of Florida and along the most of the east coast, the sulfate concentration generally exceeds 100 parts per million and is as much as 1,700 parts per million. The sulfate concentration tends to be higher in the deeper zones of the aquifer. This map shows the sulfate concentration in the upper part of the aquifer. Sulfate is found in almost all natural water. Sulfate in rainwater is dissolved from impurities and gases in the atmosphere. Rankama and Sahama (1955, p. 314) report that the average sulfate content of rainwater is two parts per million; however, concentrations have been as high as 283 parts per million. Much of the sulfate in rainwater comes from hydrogen sulfide gas which is generated in shallow water on the continental shelves. The combustion of bituminous coal used for heating and industrial purposes seems to be an important local source of sulfate.

"Steel Fibre Reinforced Concrete (SFRC) Segmental Tunnel Linings have successfully been used for over 20 years in the UK and have been adopted in a number of high profile projects such as High Speed 1, Crossrail, Thames Tideway, as well as High Speed 2. Tunnel linings and especially SFRC design are not covered in the Eurocodes. This shortage of SFRC tunnel design rules seems to be partially addressed by several international publications. However, in the UK, the ‘design-assisted by testing’ (DAT) approach has also been adopted. The Paper discusses the UK’s best design practice and focuses on the DAT methodology as applied in the case of the 6.9km (4.3miles), 7.8m (25.6 feet) ID Lining for the £635million Lee Tunnel Project. The design approach, the full scale testing at the Building Research Establishment (BRE), and the construction innovations are presented. This experience will be transferred to the £4billion Thames Tideway Tunnel.INTRODUCTIONSteel Fibre Reinforced Concrete (SFRC) has been used for Tunnel segments for more than 20 years. The first application of SFRC in the UK was for the Heathrow Baggage tunnel (1994). Since then significant size tunnels have been designed and constructed, such as the Jubilee Line (1999) High Speed 1 (CTRL, 2006), Crossrail (2014), Lee Tunnel (2014) and the scheduled 25km Thames Tideway (‘Super Sewer’) and High Speed 2 rail tunnels. However one the main obstacles in achieving streamlined design and improving efficiency are the lack of appropriate design guidelines for SFRC tunnel segments. This issue will – to some extent – be addressed by a number of current documents on tunnel FRC design either being produced by BSi (PAS8810, expected 2016), ACI (544.R) and ITAtech (Design Guideline PCFRC, 2015) in an effort to advance the design of SFRC and take into consideration the recent developments in Steel and Macro-Synthetic FRC technology."

Modern high-performance disc filters such as the BoVac Disc Filter have set new standards in applications where large capacities of solids, liquids and air have to be managed through the filters. These disc filters have an enormous hydraulic capacity. For applications in mineral processing - with a special focus on tailings – which typically have high solids throughputs but low filtrate and air flows, this capacity can be used to expand the filtration area while maintaining the benefits of very good cake discharge even with thin cakes (4-5 mm) and a high filter speed. Research work over the last century has proven that increasing the filter area should be achieved by increasing the disc diameter. Because adding more discs leads to big problems with the cake discharge. However, as the disc diameter increases, the filter segments become longer and heavier. A suitable compromise was therefore found by doing both. The result is the first vacuum disc filter that offers significantly more than 300 m² of filtration area, but has no more than 6 discs.

A review of the the more common evaluation tests made on coal and how the test results are applied in commercial practice. Parameters used to select coal blends for wet and preheated charges should also be of interest.

Acid mine drainage (AMD) is a common water pollution problem on active and abandoned coal mine sites in the eastern United States. AMD forms when surface mining brings unweathered pyrite-containing rocks to the surface or when deep mining allows oxygen to contact buried pyritic strata. In the absence of neutralizing compounds, the drainage that results can be extremely acidic and contaminated with dissolved iron, manganese, and sulfate. Drainages with pH < 3.0 and concentrations of sulfate greater than 1,000 mg/L, iron greater than 50 mg/L, and manganese greater than 10 mg/L are common. Where water flows through alkaline materials (such as limestone) before surfacing, the drainage is less acidic and occasionally circumneutral, but it can still contain high concentrations of sulfate and metals. Current water quality standards in the United States require that mine discharges have a pH between 6 and 9, total iron concentration less than 3.0 mg/L, and manganese less than 2.0 mg/L. At thousands of active and inactive mine sites, drainage does not meet these standards and is being treated before discharge by the mining company. At thousands of other sites, which were abandoned prior to the enactment of water pollution laws or were operated by companies that have gone bankrupt, untreated AMD is polluting receiving water systems. The standard mine drainage treatment system involves the addition of a1 kal ine chemicals to the water, which raises the pH and cause metals to precipitate in a settling pond. These systems are expensive, often costing tens or hundreds of thousands of dollars per year for chemicals, operation, maintenance, and disposal of the metal- laden sludge. Because the drainage on many sites will likely be contaminated for decades, there is financial incentive to find alternative water treatment systems. In the last five years, many mining companies and engineering firms have experimented with the construction of wetland treatment systems. Very few of the several hundred wetland systems that have been built are performing well enough to justify total abandonment of chemical treatment. Nonetheless, systems continue to be built because the mining companies have found that wetlands can reduce their AMD treatment costs. It is also their hope that further research and development will eventually result in systems that will completely rep1 ace chemical treatment and offer long term performance at minimal cost. The Bureau of Mines has been actively involved, from a research perspective, with this approach to AMD treatment since its inception. In this paper, the status of constructed wetland technology is discussed with respect to the construction and performance of systems, chemical and biological processes that affect AMD chemistry within constructed wetlands, and the future of this technology as perceived by the Bureau of Mines. ORIGINAL OBSERVATIONS The constructed wetland concept has its roots in observations of natural Sphaqnum peat wetlands that received acid mine drainage and, instead of being adversely affected, appeared to cause an amelioration of the polluted water (Huntsman et al. 1978; Wieder and Lang 1982). These observations instigated the idea that wet1 and systems might be used for the intentional treatment of mine drainage. Because the discharge of AMD into a natural wetland is prohibited in the U.S. by several laws, it has been necessary to construct wetlands which act solely as water treatment systems. Initially, most wetland research and construction efforts mimicked the original observations by utilizing Sphaqnum moss and peat. Despite promising laboratory results (Kleinmann et al. 1983; Tarleton et al. 1984; Burris et al. 1984; Gerber et al. 1985), virtually all field tests of Sphasnum-dominated constructed wetlands failed to provide sufficient water treatment for more than several months. Sphasnum proved quite sensitive to the stresses associated with transplanting, abrupt changes in water chemistry, excessive or insufficient water depth, and

The development of a new means of measuring the relative abrasivity of a slurry came about by necessity in 1967 during a full scale loop test of a 560 H.P. reciprocating pump handling magnetite slurry. In order to evaluate the life of expendable fluid end parts, the question of the amount of attrition in a re-circulated slurry had to be considered. An expected reduction in abrasivity as a result of this attrition would certainly give erroneous data on a parts life test. There- fore, some means of measuring such change in abrasivity became imperative. Several test methods were investigated1 but it was felt that these did not fully represent the wear due to back and forth rubbing action associated with a reciprocating pump. A "rubbing block" device used some years ago to determine the quality of hard facing materials was recalled, along with its shortcomings, in that an attempt was made to suspend a small percentage of abrasive particles in a colloidal viscous "mud". Erratic results were attributed to the fact that it was difficult to maintain a consistent slurry concentration under the metal wear block and the reciprocating speed was not great enough to maintain good agitation.

The Electric Power Research Institute (EPRI) initiated a program in 1976 to develop and demonstrate an instrument system for on-line continuous measurement of coal properties. The program has focused on the use of Prompt Neutron Activation Analysis (PNAA) for elemental determinations and microwave absorption for moisture determination. One of the major results of the EPRI program is the development of the CONAC (Continuous On-Line Analysis of Coal) instrument, with Science Applications, Inc. (SAI) as the prime contractor and Kennedy Van Saun Corporation as a subcontractor.

Perlite is rhyolitic glass with 2 to 5 percent by weight (wt.%) bound water held within the silicic-glass structure. It is often distinguished by vitreous, pearly luster and concentric perlitic fractures ("onionskin"). Occurrences worldwide are associated with Tertiary to middle Quaternary volcanic rocks. Perlite is in silicic domes, plugs, laccoliths, flows, vitric tephra, chill margins of dikes and sills, and welded ash-flow tuffs. It is a hydrated volcanic glass formed through secondary alteration of obsidian by the incorporation of water into the glass/silica structure. Post-emplacement hydration (weathering) of cooled glasses by meteoric water is the principal alteration process, but some hydration by magmatic or meteoric water during or shortly after emplacement, or hydration by water exsolved during cooling may occur. Commercial "perlite" is any volcanic glass that expands or "pops" when heated quickly to plasticity while evolving steam and thus forming a lightweight, frothy material. The expansion temperature typically ranges from 1,100 to 1,500°F. An expanded volume increase of 10 to 40 times the original volume yields expanded densities of 1.5 to 11 pounds per cubic foot (lbs/ft3). Perlite is mined by eight companies at 10 operations in six western states. New Mexico accounts for more than 80% of the total tonnage mined. The rest comes from Arizona, California, Colorado, Idaho, and Nevada. In 1992, domestic production was 571,000 short tons (st), domestic apparent consumption was 591,000 st, and the value of crude perlite was $15.3 million. In 1991, with about the same production and price of crude perlite, the gross value for expanded perlite was $101.7 million. Perlite exports in 1992, primarily to Canada, are estimated an 30,000 st; and imports, from Greece, are an estimated 50,000 st. In 1992, 70 plants in 33 states expanded crude perlite. Construction uses of expanded perlite accounted for 66% of total domestic sales. Expanded perlite used as filter aid accounted for 15%. All other markets, including use as a filler and in agriculture, accounted for 19%. Leading states for expanding perlite, ranked by order of sales, were Mississippi, Pennsylvania, California, Illinois, and Georgia. Domestic perlite encounters transportation disadvantages in some areas of the eastern United States compared to perlite imported from Greece. However, western U.S. perlite exports to Canada offset this in large part, and net import reliance for perlite is about 3% of domestic consumption. Perlite grab samples were tested at the New Mexico Bureau of Mines and Minerals Resources (NMBMMR) for their basic suitability in horticulture, construction, filter aids, and fillers/extenders using Perlite Institute techniques modified by the NMBMMR. Most commercial perlite ranged from 2.5 to 3.0 wt.% bound water for all major types (classical, granular, and pumiceous). Expanded density varied widely, but the lowest density of 1.9 lbs/ft3 was for granular. Average brightness of expanded perlite was 47.6 to 69.3%. Nonexpansibles, commonly obsidian or "dead" perlite, ranged from 18 wt.% to less than 1 wt.%, with granular perlte generally the lowest. Compacted density was not related to either perlite type or nonexpansibles present. Sieve analyses of the -50+100 mesh product showed that, in general, pumiceous perlite produces more fines and classical and granular perlite average 60 to 80% -30+100 mesh after expansion. Samples were tested for crystalline silica that ranged from below the detection limit of 0.5 wt.% to nearly 0.2 wt.%, but most tested below 0.5 wt.%. Although quartz content can be lowered in the expanded product by the expansion process, producers can further lower crystalline silica in the product by mixing low-quartz crude with high-quartz perlite before expansion. Chemical analysis by x-ray fluorescence confirms the rhyolitic composition of perlite, but indicates that surface weathering may increase the concentration of some elements, such as potassium and calcium, by infilling cracks or fissures developed during or after perlite emplacement.

Coal refuse slurries stored in tailings impoundments can potentially lead to environmental concerns such as effluent seepage, property devaluation, and in extreme cases, dam failures. Pressure filtration offers an opportunity to reduce the impoundment requirements by providing significantly drier solids. A full-factorial design was used to study the effects of temperature and pH on dewatering a refuse slurry obtained from a coal preparation facility in Pennsylvania, USA. The experimental results indicated a strong effect of temperature on cake moisture as the cake moisture after about 2800 s was 22% at 43 °C and only 36% at 10 °C for tests conducted at pH 3. ANOVA results confirmed the statistical significance of pH, temperature, and their interaction effect. Also, the results showed no significant differences between the tests conducted near neutral and alkaline pH values at low and ambient temperatures. On the other hand, Tukey’s test indicated higher reductions in cake moisture at higher temperatures for lower pH values. This study affirms the need to monitor and control the pressure filtration process as throughput could significantly vary with changes in temperature and slurry conditions.

This section begins with an introduction to several key environmental laws. This is followed by a discussion of some of the issues raised by such environmental regulation. Finally the subject of regulatory reform is addressed. Overview of Selected Major Environmental Laws The number, type and complexity of environmental laws and regulations affecting mineral resources development have grown at an astonishing rate since the 1960s. The most significant laws and regulations are those addressing the use of the public lands; those concerned with air quality, water quality, and surface reclamation; and those defining government responsibility for its actions having important environmental consequences. The laws and regulations governing activities on the public lands will be taken up in the section 5.15C, "Minerals and Land Management." In this section we will concentrate on five primary laws: the Clean Air Act, the Clean Water Act, the Surface Mining Control and Reclamation Act, the Endangered Species Act, and the National Environmental Policy Act. The Clean Air Act: The legislative and regulatory framework for controlling air pollution has developed in a series of steps. Most important for present purposes are the Clean Air Act of 1970 (P.L. 9 1-604) and the 1977 Amendments (P.L. 95-95). The rather complex air quality control scheme includes four key elements-national ambient air quality standards, state implementation plans, the prevention of significant deterioration program, and the non- attainment program. National Air Quality Standards. The 1970 Clean Air Act is a landmark law because it contains the first explicit recognition that pollution is a nationwide problem requiring a national control program. The federal government through the Environmental Protection Agency (EPA) was to establish national air quality standards for at least the six pollutants named in the Act (sulfur dioxide, carbon monoxide, total suspended particulates, photochemical oxidants, hydrocarbons, and nitrogen dioxide). These standards were to be established so as to protect public health, "allowing an adequate margin of safety." The cost of achieving these standards is not to be considered. The 1970 Act unrealistically required that these standards be achieved in all areas of the country by 1975. As the program has developed, the air quality control regions are now to be designated as "attainment" or "nonattainment" with respect to each of the national standards. State Implementation Plans. Under the Act the states are given the primary role in achieving the ambient standards. States are to develop and implement control plans governing emissions from all existing and new sources. These plans can include emission limitations for existing stationary sources, transportation control plans to reduce emissions from mobile sources, and pre- construction review of new stationary sources to assure compliance with new source performance standards. The EPA must approve all state implementation plans. Sanctions are given to the EPA to be applied if states fail to submit acceptable
