BEFORE the war we often heard the term "Big Business." And there were complaints of the ills and abuses attributed to bigness in business. Although there were examples where the small businessmen spoke for their rights and sought protection from the bigger ones, it has only been in recent war years that a tendency has developed definitely to divide the business of our nation into the big and the small. In some cases, those with an eye to the political value of the vastly greater number of small businessmen of the country have fomented this division by hurrying to the protection of these more numerous voters, and intentionally or not have emphasized in their writings and verbal attacks any and all differences of these interests that could either be found or fabricated to, suit the occasion. It has become another example of breaking the people into classes and thus setting up the basis for the claims of one class against another, and the subsequent demand for legislation and Governmental aid. The terms "big" and "small" are purely relative. One businessman, employing a hundred men, told me recently he did not know which adjective would be more appropriately applied to his operation. He did not know whether he should join the small operators' group that had been organized, or should consider himself big. He said that his present plant seemed big to him when he looked back to its humble beginning many years ago with a couple of men in two rooms. Yet, when compared with many of his competitors who employ thousands, his was small. He did add, however, that he probably became big one day a few years ago when the union moved in and organized his employees.

IN March 1949 the Calaveras Cement Co. was sued by five landowners whose properties are located in the vicinity of the plant. These landowners—all of them cattle ranchers—sued for dust damages of $120,338 and for an injunction preventing the company from casting dust upon their properties in injurious quantities. The issue was split, the jury deciding the amount of damages and the court handling the injunction features. The action came to trial before a jury in April of that year and resulted in damages being awarded in the amount of $7,508. A month later the court issued its injunction requiring recovery of stack dust to an 87 pct minimum. The Calaveras plant, shown in Fig. 1, is located three miles from San Andreas in the heart of the Mother Lode country, about 45 miles east of Stockton, Calif. Since it is in a small town, the company's responsibilities to its employees and to the community are different from those of plants located in large centers of population. Construction of the plant was begun in 1925, and production was started the following year. Standard gray Portland cement as well as several specialty cements are produced. Production facilities have been continually enlarged so that the present capacity is more than double what it was 25 years, ago. The most important item in the company's expansion program was the purchase in 1945 of an 11 ft 3 in. x 360 ft Allis-Chalmers kiln which had been declared surplus by the Defense Plant Corp. The company is now able to produce about 2,500,000 bbl of cement a year, and employment at the plant is approximately 300. The production of cement has always involved a dust problem, solution of which has been attempted in a number of different ways. By far the most efficient method of catching dust discharge is electric precipitation. Soon after the company went into production in the 1920's, the landowners near the plant began complaining about dust discharge. The company settled the matter by paying them a total of $27,000 for dust damages incurred during the period from 1929 to 1938. In the latter year the two-unit Cot-trell Electric Precipitator shown in Fig. 2 was installed and collected over 85 pct of the dust resulting from operation of the two 11 ft 3 in. x 10 ft x 240 in. kilns. From 1938 until 1946 the landowners registered no objection and were apparently satisfied with that dust recovery. In 1946, however, the substantially higher production resulting from operation of the new kiln immediately overtaxed the facilities of the existing two-unit precipitator. In a short time claims for dust damages were again received from the landowners. The company informed them that because of postwar shortages it would take several years to install a new precipitator. The company stated that it intended to purchase an additional precipitator and offered in the meanwhile to pay the landowners a fair amount to cover their damages. This offer was rejected and the landowners filed suit in the Superior Court of Calaveras County asking for total damages of $120,-338 and for the injunction outlined above. Case for the Ranchers The attorneys for the plaintiffs produced three different types of witnesses: first, the landowners themselves and members of their families; second, other cattle raisers who were sympathetic to the plaintiffs; and third, several types of technical experts: veterinarians, soil chemists, and an aerial photographer. The testimony of these witnesses was designed to establish that the flue dust from the plant had not only damaged the land and the forage, but had also caused fluorine poisoning to their animals. By a combination of these causes, the plaintiffs attempted to prove substantial loss of profits.

THE September issue of MINING AND METALLURGY might almost have served as a review of the advances in the metallurgy of gold during the current year. In addition to a scholarly article by F. W. Bradley, there were able descriptions by W. W. Bradley and W. F. Boericke of the methods followed in California and in Ontario. Considered together, the two last-named articles indicate the many possible combinations of flotation with one or more of the older processes. This, the prominence of flotation as an aid in the beneficiation of gold ores, is probably the most striking of the year's developments. It would perhaps be nearer the fact to say that the year has not been marked by the gold metallurgists' discovery of the flotation process, but rather by the flotation merchandizers' discovery of gold metallurgy. I say this because native gold was floated successfully more than fifteen years ago, and a reference to these results was published six years ago.

JUDGE GRANT, in a delightful satire of his, says: "Boston is a state of mind." I think that this same statement might well be made of the metallurgy of lead. I was particularly impressed with this when about thirteen or fourteen years ago I prepared a paper on "Development of the American Water- jacket Lead Blast Furnace." Dividing the time, as I did into ten-year periods, from the commencement of lead smelting at Eureka, Nev. (1870), and showing the tendency for each of the five decades it was evident that the progress had been through a succession of states of mind from the rule of thumb through the ultra scientific, or from what I might call the slag type period up to the present highly developed art. Conservatism has been characteristic of the metallurgist. This may have been most natural, especially with the lead metallurgist, the development of whose art was so entirely in the custom smelting plant, where the metal contents of his ores were paid for in cash and therefore excessive metallurgical losses could mean nothing short of financial bankruptcy. The metallurgist himself was held to a personal account, in these smelting plants. It was the metallurgist who was accountable. In the concentrating plants, if undue losses occurred remodelling of the plant was discussed, but if there were excessive metallurgical losses in the custom smelting plant, a new metallurgist was considered as the remedy. For this reason the tendency was to adhere to recognized practice and to be wary of unusual methods, using the word unusual in the sense in which it is used in Article VIII of the Constitution of the United States, as to punishments and modes of death. This conservatism of the metallurgist was reflected as other branches of metallurgy were developed. We have heard of the wonderful development of flotation, but it had to be introduced over the dead metallurgical bodies of its opponents.

The International Law of the Continental Shelf, so far ratified by 35 nations, extends the national boundary of any coastal nation to the edge of the continental shelf, this normally being at a continuous water depth of 200 m. The Law further extends this boundary to include the floor of the deep ocean to any depth that can be mined by advanced mining technology. In effect, proof of mining can constitute proof of ownership of the subaqueous land and the minerals on or below the sea floor. Irrespective of the fact that present technology is too limited to permit mineral exploitation in the high seas-and the law regarding the right to mine appears hazy-the U. S. Treasury Department's Bureau of Customs, has a ruling that would further deter mining operations on the high seas. This law contends that minerals mined on the continental shelf of the United States are actually mined within the continental United States and are free of tariff, but mined products or other articles obtained from the ocean or the sea floor beyond the continental shelf, if brought into this nation, must be considered as imported and are subject to such customs duties as are applicable under the tariff schedules of the United States.

The American Society of Chemical Engineers and the American Ceramic Society have for some years past devoted especial attention to the educational matters of their respective fields. The Engineering Foundation, representing the great engineering societies of the country, is deeply interested in technical education and maintains a Committee on Educational Research.

A discussion of the paper by Mr. Campbell, which was read by title at the Lake Superior meeting, but first presented at the New York meeting of the Iron and Steel Institute, October, 1904 (see p. 772). These papers are here published onder a mutual agreement between the Councils of the two Institutes, and will also be found in the Journal of the Iron and Steel Institute for the year 1901, vol. ii. Mr. William R. Webster, Philadelphia, Pa., said: We are under great obligation to Mr. Campbell for his exhaustive investigation, and the results he has put before us to-day. They are the most conlplete series of tests that have ever been made, where all the conditions of rolling, etc., were kept uniform. In discussing Mr. Campbell's first investigations, I claimed first, that the method of least squares, then used, would of necessity only gire the average value of any element, and that if the effect of any element was greater in the presence of high carbon than with low carbon this would not be shown by the method of least squares. Secondly, that the effect of manga nese should be considered on acid steel as well as on basic steel, instead of ignoring all the eff'ect of that element when it was below 0.60 per cent., as was then recommended by Mr. Campbell. I am pleased to note that the results of his present investigation confirm my views on these points. In presenting the results of his first investigation, Mr. Campbell referred to my investigation of 1893-94, and took exception to the value of phosphorus varying (depending on the amount of carbon present) from 800 to 1,500 lb. for each 0.01 per cent. He claimed that one might just as well consider the effect of phosphorus as being constant, and of carbon varying. I refer to this, as he now has introduced very similar conditions in his present tables, in that he gives variable values for manganese (depending on the amount of carbon present) for both acid and basic' steels. This paper presents an analysis of fracture mechanisms in coal subjected to bi-axial state of stresses, indentation of laterally con- fined coal specimen. Coal specimens were loaded to failure by the straight wedge indenters at various lateral confinement pressures. Strain distribution and acoustic emission characteristics of coal specimens under stress were recorded. The influence lines of vertical forces acting on the horizontal straight boundary of the coal specimen for each type of wedge indenter have been established using holographic interferometry technique. The effects of wedge indenter angle, confinement pressure, and coal anisotropy on fracture types, failure modes, and post-failure conditions were studied. The results indicated that combined application of holographic interferometry and acoustic emission monitoring techniques is not only suitable for studying deformability of heterogeneous and microscopically discontinuous material under stress but it also enhances the mode of fracture during the post failure stage.

WITH Thomas G. Fear, chairman of the Coal Di- vision, presiding, the coal miners opened their program Monday morning with a general session at which three papers were presented. The first, "The Classification of Coal for Stationary Steam Generation," was presented by the author, Thomas W. Harris, Jr. In discussion, H. T. Coates inquired if it would not be possible to pick out a geographical coal section, certain seams or a group of mines, which would rank high in a desired feature or features, perhaps giving different -- - local sections or different mines something to designate a rating ("good," "fair," and "poor"). This might be done relative to anti-clinkering, free-burning, ,anti-slagging, smokelessness, friability and grindability. These might be listed or arranged on a map or diagram so that the prospective customer could find a coal that rated particularly high in desired characteristics. C. A. Reed pointed out, in part, that coal producers and sellers have found a bad but necessarily present condition in the country, especially with the smaller user of coal. This is entirely due to the fact that the employer expects his purchasing representative to be a genius and have expert knowledge of everything he buys, coal included, whereas in the larger plants he has and uses expert knowledge from the active organization when necessary. J. B. Morrow said that size rating was important in classifying coal and he emphasized that it was impossible to come to a definite basis on analysis alone.
