Earl C. Herkenhoff Publication of the article "The Flotation Behavior of Digested Asphalt Ridge Tar Sands" by R.J. Smith and J.D. Miller has confirmed and again spotlighted a most significant and important development in the field of tar sand and heavy oil mining. This is the ability to recover 95 % of the bitumen in dry tar sands by a hot water process. The initial investigation by Miller and Sepulveda in early 1978, "Separation of Bitumen from Dry Tar Sands," was the first blockbuter. It is disappointing that there has been so little scientific and industry ackowledgement that the authors laid to rest the long entrenched belief that the sand grains had to be "water wetted" for a hot water process to be applicable. Dr. Miller and his researchers at the University of Utah used slightly different mineral dressing terminology in describing their process but it is essentially the old, established technique of high solids attrition scrubbing at elevated temperatures with a conditioner or modifier, followed by dilution and froth flotation. Similar techniques were described in detail for other nonmetallic minerals in the mid-1940s by Stuart Falconer of American Cyanamid Co. The authors used a 15-minute "scrub" period (or in their terminology "digester step") at 73% solids and 95°C (203°F) in a 0.3 m solution of sodium carbonate -about 4 kg/t (8 lb per st) of tar sand. Flotation was at 10% solids. Obviously, the scrub is an expensive step with respect to energy input but the high recovery of bitumen appears to justify it. Two basic questions then arise: • What are the effects of shorter scrubbing time, lower temperature, and less sodium carbonate? • Would a two-stage approach be advantageous? That is, could you get the major proportion of the bitumen with a mild scrub and apply the high power and temperature only to the refractory portion? These variables should be evaluated. Apparently, all results were only for rougher flotation. What would the grade and recovery of bitumen be if multiple cleaner flotation steps were employed? We must concede that a 60-62% grade of bitumen leaves considerable room for upgrading. Finally, it should be noted by all executives who approve funds for heavy oil recovery schemes, most of which are variations of in-situ methods, that mining can yield a 95% recovery of bitumen. That is correct, 95%. Imagine what that does to the total barrels recovered from a heavy oil resource compared with the scrawny 30-35% maximum recovery we are getting now. Miller We, too, share Mr. Herkenhoff s enthusiasm for the mining of tar sands-heavy oil and continue the development of related processing technology. Specifically, it will be noted that by appropriate control of bitumen viscosity in the feed (probably the most important variable for successful separation) the recovery can be accomplished at low digestion temperature and low addition of alkali. A 91 t/d (100 stpd) pilot plant based on our technology is now being operated by Enercor in Salt Lake City (Hatfield, Oblad, and Miller, 1982). In these same pilot facilities, rougher concentrates containing more than 80% bitumen on a dry basis are being produced from Asphalt Ridge Feed. However, the processing of certain other tar sands results in incomplete digestion of bitumen/sand aggregates as discussed elsewhere (Miller and Misra, 1982). Such undigested aggregates are shown in Fig. 1. In this regard, it is intended that a recycle stream will be installed in the pilot plant to provide for redigestion of middling products. A new preparation scheme for a difficult-to-float coking coal from the Kailuan Mine, Tangshan, China was investigated. The results showed that grinding followed by column flotation was beneficial for obtaining products with low ash content. The positive effect of grinding on the coal floatability is attributed to the liberation of intergrowths and coal surface improvement. Tests indicated that 10 minutes was the optimum grinding time, and over grinding resulted in a deterioration in flotation performance. With a grinding time of 10 minutes, conventional flotation had potential to yield a product with around 12.42% ash content and 69.15% combustible recovery. Column flotation can reduce the product ash content to 11.15%and increase combustible recovery to 74.47%. Consistently better flotation results reveal that column flotation is more efficient than conventional flotation for such fines.

"This preliminary paper provides a summary of lab and mill flotation investigations into the copper collector at two Canadian operations. The orebodies illustrated in these studies both contain mainly copper and zinc with uneconomic quantities of lead. Silver is also present as a secondary precious metal.Each mill has advanced to the extended mill trial stage with Uniflot SP129 as the sole copper collector. The preliminary metallurgical results have indicated higher copper circuit zinc and lead rejection is possible as shown in Case Study #2. In Case Study #1, improved zinc circuit metallurgy has been realized during all the Uniflot copper circuit collector trials. A slight increase in silver recovery has also been observed in the extended trials at both operations. INTRODUCTIONThe Canadian base metal industry is presently going through a rationalization period in response to low metal prices and low grade ore bodies. The response from flotation mills has been to reduce costs by incorporating new technologies such as energy efficient large cells, low moisture pressure filters and low steel consumption SAG mills. Other optimization strategies have been incorporated to get better metallurgical performance such as improved process control and monitoring techniques.The newer flotation plants have embraced many of the latest equipment innovations but they continue to incorporate off-the shelf reagents like xanthate and methylisobutylcarbinol (MIBC) . New collector chemistries have been mostly unsuccessful. Our approach incorporates the best of the old and new chemistry into proprietary formulations that match the application. We have found most single chemical formulations cannot meet the demands of the optimized modern flotation plant."

TIMBER supports for large underground cavities are temporary expedients until the permanent filling can be put in. Nevertheless, timber supports are very necessary in some form. The general problem is to support the cavity in all directions withthe minimum of timber, disposed in the strongest way. The simplest way of filling an irregular space with timber sets is to form triangles.The right-angled isosceles triangle (Fig. 1) leads to the true square set, in which caps are equal to struts. The right-angled unequal-sided triangle and the scalene isosceles triangle (Fig. 2) lead to the oblong square set, where caps are longer than struts.The scalene triangle (Fig. 4) leads to the rhombic or oblique set. The equilateral triangle leads to the hexagon set (Fig. 3), in which the caps and struts are all equal. These five plane figures, the triangle, square, rectangle, rhomb and hexagon, are the only figures that will completely fill any irregular plane figure, without interstices. Hexagon sets were first suggested by the writer in 1902 to a mine manager at Broken Hill, who did not see his way to use them.

This study proposes a new approach to reduce the environmental impact during surface mining by improving environmental factors through the incorporation of carbon footprint into strategic mine planning. Two key variables were analysed by contrasting and comparing the baseline and optimised models generated. These variables include net present value, which helps determine the financial feasibility of the mining models and their carbon emissions. The variables were analysed by using linear regression, Spearman’s correlation, a P-value hypothesis, and an exponential decay test. Results show that at Mine A the projected net present value was 62% higher than when running a baseline model. Furthermore, the net present value from the baseline model portrayed a high rate of decay at 0.667 versus 0.118 from the optimised model. This indicates the baseline model’s sensitivity to long-term project timelines and fluctuating markets. The optimised method presents an opportunity to manage emissions during the high operational costs phases. It is represented by a 31% improvement in carbon emissions during the periods of high operational costs, whilst maintaining a positive net present value when compared with the baseline model. It was shown that the optimised model presents a better chance of achieving financial feasibility and balancing environmental impact, thereby ensuring that Mine A can align with the environmental aspect of economic, social, and governance principles through lowering the carbon footprint resulting from its hauling operations.

The 53 countries that constituted Africa in 1993 accounted for a significant portion of total world output of a number of mineral commodities. For the continent as a whole, world shares of most commodities showed little change from those of 1992 although most output volumes showed a slight decline. There were no significant production increases, but there were significant decreases of cobalt and copper because of political instability in Zaire and production problems in Zambia, of chromite resulting from cutbacks in South Africa and Zimbabwe, and of phosphate rock owing to a lower output by producers in general. (See tables 1 and 2.) Among the most significant mineral commodities produced in Africa, ranked by portion of world production in 1993, were diamond, cobalt, chromite, gold, phosphate rock, manganese ore, uranium and petroleum. Others of importance in world trade were andalusite, antimony, asbestos, bauxite, coal, copper, fluorspar, lithium minerals, platinum-group metals (PGM), titanium minerals (ilmenite and rutile), vanadium, vermiculite, and zircon. Several of these-chromite cobalt, diamond, and manganese-were not produced in the United States.

"Comminition process costs, which typically represent an important contribution to mining operating costs, can themselves be divided roughly between energy and liner /charge wear. As such, developing the ability of predicting mill wear will allow a more accurate estimation of wear costs and therefore their control. In this paper and based on the possibility of estimating energy dissipated in impact and abrasion by using a discrete element charge motion model for mill charge motion simulation, media wear will be investigated principally as a function of three wear mechanisms : impact, abrasion and corrosion. Experimental results will be used to identify a total media wear model. Model results will be compared with real mill data from three operating Australian mines. These preliminary results show for the cases tested that the overall average error, as compared with the observed cases, is 0 % with a standard deviation of 66.1 %. Results from the Bond abrasion index tests, for the same cases investigated, give an overall error of 73 % and a standard deviation of 192.5 %. Further work is in progress to improve test procedure, validity and confidence.INTRODUCTIONComminition process costs, which typically represent an important contribution to mining operating costs, can themselves be divided roughly between energy and line / charge wear. In Greenfield situations where the estimation of operating costs is critical in determining project feasibility, the level of confidence in such estimates becomes quite important. With regards to media wear, the Bond abrasion test currently serves as the standard media wear prediction device. However, as shown [l, 21 test results once compared with actual wear rates can vary greatly. Figure 1 shows test results as compared with 15 cases. Average error over this data is 73 % with a standard deviation of 192.5 %. As such, developing the ability of more accurately predicting mill wear will allow greater confidence in wear cost estimation and therefore their control."

Under the first phase of this contract as reported in the Phase I report it was determined that certain types of commercially available molded case breakers are capable of interrupting mine dc power supplies of nominally 300 volts or 600 volts rating. These circuit breakers incorporate conventional overcurrent trip units but also can be operated by means of low power signals fed to a shunt trip coil. Further development in the Phase I program produced a means whereby a discriminating circuit breaker detector unit could sense the presence of illegitimate loads on the dc electrical system and cause the circuit breaker to trip. The detector unit operated by detecting the presence of 3000 Hz currents which were generated in the illegitimate loads by means of a 12 volt, 3000 Hz signal applied to the dc system. Further development of the program has continued in Phase II with the aim of verifying the practicability of the complete discriminating circuit breaker concept and developing other types of equipments required to implement a system. These other equipments include electronic means for raising the apparent impedance of high power legitimate loads and static filters for smaller loads. The results of laboratory work and limited underground tests have been successful. This report describes the system and the tests that have been conducted on the various equipments that comprise the complete Discriminating Circuit Breaker Concept.

Beginning in 1987, miniature dataloggers approved by the Mine Safety and Health Administration (MSHA) were publicly available for sale. The principal among these was the model CR21XQM, manufactured by Campbell Scientific, Inc. These dataloggers had been tested and were deemed permissible by MSHA and thus could be installed in the return air of an underground coal mine. In 1996, production of all permissible Campbell Scientific dataloggers ceased due to lack of sales. Data collection with these dataloggers has been a staple of ground control research in the United States for decades, and, without them, or a replacement, the capability to monitor ground behavior is severely impacted. Since that time, any party requiring a permissible datalogger has needed to borrow one that was purchased during the production years. In order to fill this technology gap and ensure its own data-gathering capabilities, the National Institute for Occupational Safety and Health (NIOSH) has developed and refined its own miniature data acquisition system (MIDAS). On February 16, 2010, MSHA deemed the MIDAS to be permissible and approved it for use in the return air of an underground coal mine. The MIDAS is an intrinsically safe, 16- or 24-bit datalogger, compatible with a wide range of resistive, single-ended, and differential-type instrumentation. It contains enough data storage memory to operate for over a year with typical data rates and is efficient enough to do this on a single C-sized alkaline battery for that entire period. It is menu-driven and requires no programming knowledge to operate. It supports wireless or hardwired communication for datalogger setup and data download. This paper describes the design, field and laboratory testing, and capabilities of the MIDAS datalogger. While not as fully -functioned as the CR21XQM, it is the only new permissible datalogger available, and there is intent to make it available to the mining industry for purchase.

The Narragansett Bay Commission (NBC) is a regional sewer authority that serves ten communities in the Providence, Rhode Island metropolitan area. From 1992 to 1999, the NBC developed a comprehensive facilities plan to abate Combined Sewer Overflow (CSO) pollution in the Upper Narragansett Bay. The plan underwent many major evolutions during this period, most notably the addition of a stakeholder?s process by which NBC demonstrated a site-specific plan to control the pollutants and meet water quality standards. The favored solution consisted of deep tunnel storage with treatment at existing wastewater facilities that had been recently upgraded. In 1999, a final plan was accepted which included two tunnels, five CSO interceptors, twelve sewer separation projects, a wetland facility, and a wastewater treatment facility upgrade. The program is to be constructed over 20 years in three sequential phases (Figure 1). Phase I of the program includes a 4,963 m (16,284 ft) long, 7.9 m (26 ft) diameter, 70.1 m (230 ft) deep storage tunnel; seven drop shafts with connecting adits; ancillary facilities; and a pump station. Construction of Phase I began in 2001 and is expected to be operational by October 2008. This paper focuses on design and construction of the Fields Point Tunnel Pump Station (FPTPS)located at the south end of the main spine tunnel. A189 Ml/day (50 MGD) pump station is required to lift CSO flows from the tunnel to the Fields Point Wastewater Treatment Facility (FPWWTF). The pumps are to be housed in a 35.6 m × 18.6 m ×20.7 m (117 ft × 61 ft × 68 ft), 91.4 m (300 ft) deep cavern excavated in a complex meta-sedimentary rock of the Rhode Island Formation, and connected to the surface by 9.7 m (32 ft) and 3.4 m (11 ft) diameter shafts. Factors which influenced selection of the size, configuration and location of facilities included the preferred arrangement of pumps, critical aspects of site geology, and estimated cost. Technical and value engineering reviews also affected the final design. Following Notice to Proceed (NTP), concerns were raised by the contractor regarding constructability and design. Additional geotechnical investigation and independent engineering review were employed to validate the design assumptions. The cavern was successfully excavated and sup-ported in rock, completed on schedule and within budget in 2005. In 1992 the NBC retained Louis Berger Group (LBG) as Program Manager (PM) for the CSO Abatement Program. LBG thereafter formed a design team including: Jacobs Engineering Group(JEG) as the designer for underground structures and near surface collection facilities; Black and Veatch(B&V) to design the pumping system and associated facilities; Haley and Aldrich (H&A) to oversee the geotechnical program; and Malcolm Pirnie to design the system-wide instrumentation and control system. Construction management, resident engineering, and inspection services were provided by the joint venture Gilbane/Jacobs Associates (G/J).

Ventilation survey using tracer gas measurement is one of the techniques for mine ventilation design, monitoring and investigation of movement of fresh air and contaminants. However, there has been little research into using both tracer gas monitoring and numerical simulation. In this research, tracer gas technique was used for quantitative assessment of airflows through narrow vein shrinkage stopes with various opening shapes and friction factors. SF6 was used as a tracer gas to monitor airflow through three narrow vein shrinkage stopes in order to obtain diffusion concentration curves against elapsed time. The mine ventilation simulator, MIVENA Ver.6, was used to construct the entire ventilation network of the mine to monitor airflows through the stopes. The diffusion concentration curves against elapsed time were simulated with a numerical model. The result shows that the concentration-time curve is unsymmetrical and is skewed to the front of the flow direction. From the results of history-matching between the measured and the simulated curves, volume flow rates of airways and stopes were evaluated. Importantly, the tailing effect of the concentration-time curve between the measured and simulated is greatly improved by reconstructing an equivalent airflow route to represent unused mine openings, dead end drives and other open spaces. Finally, it can be concluded that openings, dead end drives and other open spaces have no relation on flow rates, but affect the airflow quality provided from the inlet portal as shown by tracer gas diffusion characteristics.

Construction-induced vibrations may be detrimental to adjacent structures and sensitive electronics operating nearby. Construction vibration sources have a wide range of energy and velocity, as a function of time, transmitted on the ground. Analysis of existing methods for predicting ground and structure vibrations shows that empirical equations provide calculations only of amplitudes of vertical soil vibrations with insufficient accuracy. This paper presents the application of the impulse response function concept to solve the geotechnical problem of predicting ground and structure vibrations before installation of vibration sources. Impulse response functions reflect real behavior of soil and structures without the investigation of soil and structure properties. A procedure is presented to compute predicted ground and structure vibrations. Good agreement is found between predicted and measured records.

Globalization and a growing demand for limited raw material resources have forced changes in the approach to the supply chain. This is particularly true in the case of rare earths, which are regarded as one of the most important development indicators of modern technologies. To ensure a secure supply of commodities, the European economies have been prompted to investigate REE recovery from sources which until recently, for technical or economic reasons, were considered not sufficiently attractive. An interesting example is apatite phosphogypsum waste dumps. The REE content in these waste dumps averages around 0.5-1 %. One of the most important phosphogypsum locations in Poland is the Lower Silesia region where a phosphoric acid Chemical Plant "Wizów" operated for several dozen years. In this work, rare earths are leached from the phosphogypsum crystalline structure by a chemical treatment and can then be separated into individual chemical compounds. The technology used in these recovery tests, matches up to a coherent European raw materials policy supporting effective management of resources and promoting waste materials recycling.

As part of a continuing study of mechanisms of breakage, the grinding at Nairne Pyrites Pty. Ltd. was traced by the addition of barytes and the results compared with parallel small scale laboratory tests. It was confirmed that the same basic mathematical functions described the behaviour of the full scale ball mill as those established in the small scale mill. However, an additional classification function was required to define the behaviour for the rod mill and was evaluated as a function of size from the experimental data. The classification and grinding of the pyrites ore was assessed from steady state size distributions around the circuit.

A predicted increase in aluminium production and the possibility of a diminishing supply of petroleum coke for anode electrodes in alumina reduction cells makes it desirable to find alternative electrode materials. Browncoal char, with a lower ash content and with an elemental purity similar to petroleum coke, was produced by leaching in hydrochloric acid, washing with water, and charring at 1,150°C. The cost of processing is estimated tobe competitive with petroleum coke.Without further processing the bulk density and real density were undesirably low, but by briquetting the coal before charring and crushing, the bulk density was improved to 92 per cent of the petroleum coke value andthe particle density was improved to 92 per cent of the density of petroleum coke by water displacement or 75 per cent by mercury displacement.Pre-baked electrodes were prepared from the char alone, mixtures of petroleum coke and char, and from petroleum coke alone, all bonded with coal tar pitch.The electrodes were tested for the usual physical properties and were evaluated for performance in a laboratory size alumina reduction cell.Electrodes based on brown coal char alone were found to be inferior in physical properties and performance, but mixtures of the char and petroleum coke, despite poorer density, electrical resistivity, and carbon consumptionon a theoretical basis, in performance tests gave up to 17 per cent better carbon consumption per weight of aluminium produced and 21 per cent better electrical current efficiency than the electrodes based on petroleum,coke alone.It is suggested that larger scale tests are warranted.

Glass wool meeting requirements for commercial use was made from glassy fractions of urban solid wastes by the Bureau of Mines. This research was a part of the Bureau's program to develop building products and other usable materials from reclaimed urban waste materials. Mixes of molten glass were fiberized into glass wool during laboratory studies by impingement of a jet of compressed air on a stream of the molten glass. The principal test variable studied was composition of the melt; this was varied by adding dolomite and alumina to obtain molten glass with the handling characteristics required for producing final wool products of the desired composition and physical characteristics. When no charge is made for the waste glass and approximately $75 per ton can be obtained for the wool product, an interest rate of return on investment after taxes of about 12 percent can be obtained. If a charge of $5 per ton is required for the waste glass, a selling price of about $78 per ton would be necessary to obtain a l2-percent-interest rate of return on investment after taxes.

All industrial processes are economically driven, resulting in the ever increasing need for process optimization in order to stay competitive and profitable. Numerous models has been published depicting the optimization of the raw material usage in an arc furnace, as well as the thermal and electrical efficiency; however, to obtain a holistic view of the cost-effectiveness of the process one needs to expand the model to include the cost of all the operational variables. This project therefore aimed to not only include the raw material feeds and power consumption as input variables, but also the labour, maintenance, and environmental costs to generate an all-inclusive financial balance. In the end, the model was able to mathematically optimize the ferrochrome (FeCr) production process through evaluating the effect of a specified combination of input parameters. It could therefore be used as a tool to aid in managerial decision-making; to appraise and correspondingly adjust certain operational variables in order to achieve a maximum return on investment. This paper fully describes the reasoning behind the choice of the essential model components, the assumptions made during the models development, the calculation approach, as well as the advantages, limitations, possible applications, and areas for expansion of the final model. Through running simulations with plant data, it was found that the accuracy of final model remained fairly constant when applied to stable furnace conditions, but was met with a number of limitations when applied to more complex situations. These limitations could, however, be overcome through further development and expansion of the existing model to include a larger number of process variables.

Last evening, in Auckland, I heard the Chairman of Heinz US, Dr Tony O'Reilly (who, in addition to Heinz's ownership of our largest food processor, also has substantial personal investments in this country), advocate New Zealand as a 'regional corporate capital'.   Why would someone like Dr O'Reilly hold that view? No doubt, as one of Ireland's great rugby players of the 50s and 60s, he admires at least one thing that we do very well (confirmed again in Dublin over the past weekend). But that's not sufficient to support such a view.   He cited many reasons for preferring New Zealand over, say, Sydney, Australia, calling this 'the most rational in which to locate [an] international headquarters', including û +         we have no capital gains tax; +         a more 'pro-business environment'; +         a 'first class' legal and banking system; and +         a 'simple political system'.   I can find no better 'text for today's address.

Mineralisation was identified at Gladstone Hill as far back as the late 1870s-early 1880s, shortly after the initial discovery of mineralisation at what is now the Martha Mine. Indeed, early recovery problems associated with the Martha mineralisation led to the preferred development of ore bodies within what is now the Union Hill Joint Venture tenement; ore bodies such as Silverton, Amaranth, and Union to name a few. Gladstone Hill forms the basis of the Union Hill Joint Venture, a 50:50 joint venture managed by Au-Ag Resources Ltd (a fully owned subsidiary of Otter Gold Mines Ltd), and Welcome Gold Mines Ltd (a fully owned subsidiary of the Normandy Group). The joint venture participants also operate the adjacent Martha Mine. Mineralisation of Gladstone Hill, as with mineralisation at the adjacent Martha Mine, has been interpreted as a low sulphidation epithermal Ag-Au system hosted within hydrothermally altered andesites of the lower Coromandel Group. Drilling in recent years has successfully identified extensive mineralisation associated with a number of vein sets throughout the tenement including the Gladstone Vein set, the Moonlight Lode and more recently along a north-easterly trend towards the historic Favona workings. A wide range of vein styles is apparent, ranging in character from thin stock works to broader lode-style banded chalcedonic to cherty quartz and have been interpreted as representing multiple phases of emplacement. At shallower levels mineralisation is often hosted by vein clasts within vent breccias. Visible gold is rare, with mineralisation generally associated with very fine-grained pyrite, arsenopyrite and minor electrum. Percentage levels of combined sphalerite-galena-(+/- chalcopyrite) have been intersected at depth however these have been gold poor to date. The potential for the Gladstone Hill area remains to be clearly defined as drilling to date has yet to close off mineralisation both along strike and down dip. If further drilling is successful, the joint venture partners believe Gladstone Hill could contribute significantly to the economic future of current operations.

With the ever-increasing price of diesel fuel, accompanied by the popular topic of carbon taxes and greenhouse gas emissions, the mining industry is looking to industry specialists for assistance. The benefits of a no-idle policy reach far beyond carbon reduction and fuel savings, ranging from decreased maintenance to increased engine life. With products like battery-powered ac systems and diesel-fired heaters, going noidle is easier today than ever before. With both systems being manufactured to withstand the harsh environments of the mining industry, the end user will see a seamless change from conventional, inefficient belt-driven systems to future, standalone mobile equipment HVAC.The history of GHGs and climate changeIn 1896, Svante Arrhenius first claimed that the combustion of fossil fuels may eventually result in enhanced global warming, but not until 1955 did Gilbert Plass draw global attention to global warming by summarizing that adding carbon dioxide to the atmosphere would intercept infrared radiation and thus warm the earth. Then in the early 1960s, Charles Keeling developed modern technology to produce concentration curves for atmospheric CO2 (Fig.1).In 1988, the Intergovernmental Panel on Climate Change (IPCC) was founded by the United Nations after acknowledgment of a rising global annual temperature. The IPCC consists of more than 2,500 scientific and technical experts from more than 60 countries. Because climate change could not be solved by a single country, the Kyoto Protocol was negotiated in 1998, requiring all participating countries to reduce their GHG emissions by at least 5 percent from the 1990 levels. The Protocol was signed by 186 countries in 2001 (since then several countries have retreated from the agreement, including the United States). In 2002, the Bush administration announced a policy for climate change relying on domestic, voluntary actions to reduce the "greenhouse gas intensity" of the United States economy by 18 percent by 2012. The U.S. still attends the Kyoto conference of parties (COPs) but does not participate in negotiations, as it is not bound by its terms."
