THE first year to which the Revenue Act of 1936 has applied is now passed. It is appropriate to try to give some calm thought to the plan of Federal income taxation as now imposed and what it will mean to the business and industry of the country if this plan of taxation is continued unchanged. Whether or not we like to pay these taxes is beside the point. Taxes are high and may be expected to be high for many years. The important question is whether the taxes to be imposed will destroy or injure business enterprise and development, and, in so doing, lower the standards of employment, living, comfort, and welfare of our people. The power to tax is the power to destroy. That destruction may come suddenly as a cyclone, or slowly as dry rot. What, if any, features are there in the present plan of Federal income taxation that have these destructive tendencies? A few of the points follow that seem to call for consideration.

DESPITE the handicap of reduced production in many districts, the mining industry in 1938 forged steadily ahead toward solution of its minor technical problems and has of-defected major advances in several fields. In California hydraulic mining for gold, shut down for forty years, will shortly be resumed following revision of restrictive laws. Disposal of hydraulicked ground is to be regulated by settling dams so as not to interfere with agriculture. GROUND movement from mining, whether it be for coal, metal, industrial minerals, or .oil, will always present many difficult problems. These are especially serious when valuable surface improvements may be badly damaged. The mine itself, if mining methods are not suitable to the formation, is subject to heavy falls of the main roof in the working places; and with certain structural conditions the movements may cause in coal mines disastrous bumps and outbursts of gas, and in deep metal mines rock bursts. THE mineral industries in this country have now had about a year of national planning. Al. though the period is short, the volume of activity and legislation designed to make that planning effective has been nothing short of enormous. Those who have been privileged to see and study a few of the codes to regulate our mineral industry, such as those for oil, coal, steel, and copper, are driven to the conclusion that nothing was really known about the proper way to conduct those industries in this country prior to June, 1933; or if anything was known, nobody in actual practice made use of that knowledge. And yet those industries, in days gone by, helped to make this country the most prosperous in the world, and to maintain a standard of living even today higher than that of any other country. Without wishing to assume any first-hand knowledge of the Russian standard of living, I must confess that the evidence seems to indicate that even with dictatorial authority, national planning encounters unexpected difficulties. ZINC metallurgists continue to follow with keen interest reports of successful results from the continuous retort plants at Palmerton, Pa., and Meadowbrook. W. Va. The new process had already demonstrated its ability to reduce the lead content of the metal and to effect savings in labor and fuel. The past year has shown that the retorts themselves can he built to last long enough so that the retort cost per ton of metal is lower than in past practice with small horizontal re- torts. A number of the latest type of retorts are reported to have been in continuous operation for over 18 months without a failure and are said to be still in good condition. This seems a complete answer to the last question which remained before continuous zinc smelting could he pronounced commercially practicable.

G EOPHYSICAL prospecting was presented in its several aspects and discussed with much vigor at two sessions during this year's annual meeting of the Institute. The first session was devoted entirely to the presentation and discussion of various technical papers, while the second meeting took the form of a round table conference on the advisability of revising the existing mining laws to recognize the results of geophysical prospecting. This conference was immediately followed by further consideration of technical papers. Each session was well attended and great interest was displayed by everyone present.

THE 142D MEETING of the Institute is rapidly shaping up with splendid prospects of a strong technical program and the lighter side of this annual occasion amply provided for. The date is February 20 to 23. The technical sessions will be held in the Engineering Societies building; the smoker-dinner, the informal dance, and the annual reception and dinner, at the Commodore Hotel, Monday, Tuesday and Wednesday respectively. The news to date on the technical side is as follows: Mining Methods-Subsidence The Mining Methods Committee has prepared an interesting program which will be divided into two sessions to be held early in the week. At the first there will be papers on mining methods and development, including a description of the "Sinking and Equipment of No. 2 Shaft at Minas de Matahambre," by Dudley D. Homer and R. H. Cromwell. They describe in considerable detail the equipment used and the practice followed in sinking this important shaft, giving detailed costs and performance figures. Hoist¬ing ?arrangements and mining practice at the "Red Ore Mines of the Woodward Iron Co. at Bessemer, Ala.," are described by Tenny C. DeSollar, superintendent of mines, in a second paper. At this session of the Mining Methods Committee, H. M. Roche and R. E. Crockett, of the Committee on Eastern Magnetite Mining and Milling Methods, will present their paper, "Iron Ore Mining at the Scrub Oak Mine." This mine is in the highlands of New Jersey about 40 miles west of New York City. Prof. Robert K. Warner of Yale University will present a paper on "The Selection of a Mining System," which should have an interesting discussion. Pierre R. Hines, of Portland, Ore., will present, with stereopticon slides, his paper on "The Owyhee Tunnels, U. S. Reclamation Project, Owyhee, Oregon," describing one of the recent irrigation undertakings.

IT IS generally recognized that the natural gas absorbed in petroleum plays the leading r6le in moving the oil through the sands to the well and supplies the energy that delivers the oil to the surface when the wells are flowing. It is the purpose of this paper to note the amount of oil that could be lifted by this gas if 100 per cent. efficiency were obtained and the efficiencies actually obtained in the use of this gas. An article in MINING AND METALLURGY,' stated that in a Wyoming field, with a pressure of 300 lb. per sq. in., there would be absorbed 65 cu. ft. of gas per barrel, or 1.55 cu. ft. per gal. of oil. The writer does not know if data have been obtained, by experiment, for pressures beyond those indicated in this article, therefore, for the purpose of illustration, he has projected this curve to obtain figures for pressures greater than 300 lb., although probably experiment will show that the extended line is not quite correct.

PROCESSES for the direct production of iron and steel from ores are hardy perennials, and new processes and revivals of old ones are continually being brought to the attention of the investing public if not to the attention of metallurgists. Direct production of iron and steel is so simple that it offers a fertile field for the promoter. Unfortunately in this way direct processes have acquired a bad name, not always deserved, with conservative capitalists and metallurgists. Direct processes cannot, except in special instances, be looked upon as a substitute for any single operation in present iron and steel practice but must be considered, as one link in an entirely new chain of metallurgical process from ore to finished steel. Thus it is, in my opinion, inadvisable to consider the use of sponge-iron processes as a means of treating ore of ordinary blast-furnace grade to produce open-hearth feed. In time I think it will be found equally inadvisable to smelt iron-ore concentrates in the blast furnace.

THE Eastern magnetite industry has not failed in its contribution to the war program during the past year. Man-power shortage was the critical problem in maintaining production and for the last half of the year, owing to lack of man power, it was necessary for some mines to change from seven to six days per week schedule. At Cornwall, Pa., the mine operated by the Bethlehem Steel Co. produced approximately 2,000,000 tons of crude ore and 1,200,000 tons of iron ore concentrates, a decrease of about 10 per-cent compared with the previous year. Railroad haulage in the open-pit at this mine was discontinued, being replaced by Mack trucks of approximately 30 tons' capacity. At the Mt. Hope mine in New Jersey, the Warren Foundry and Pipe Corp. produced about 195,000 long tons of crude ore obtaining 70.000 long tons of lump ore and 35,800 long tons of concentrates. An additional 24,500 long tons of concentrates was produced from a stock pile of 47.000 long tons of crude ore accumulated during the latter half of 1943, following the fire in their old dry mill. T HE Tonopah Extension assay office is a two- story, concrete structure on a solid foundation of andesite, situated about 100 yd. from the company's mill, so that it will not be affected by the stamps or the tube-mills; also it will not be affected by under- ground blasting. On the second floor are the mine superintendent's office and drafting and blueprint rooms. On the ground floor are the assayer's office,' mixing room, furnace room, crusher room, chemical laboratory, parting room, store room, and change and shower room for the mine superintendent, assayers, and engineers. The crusher room is outside of the main building, and has four concrete walls, thus eliminating the jar of the crusher; it is so situated that the least possible amount of dust spreads through the main building. An 8 by 10-in. jaw crusher, which crushes to ¼ in., was made by a local foundry. Attached to the top is a small galvanized-iron hopper covered with a ¼ in. screen, on to which the sample is dumped. The fines-pass through the screen into the hopper, while the oversize is dumped into the crusher. The crushed sample and fines from the screen drop down to a set .of splits suspended from an iron rod below the crusher jaws. The small sample is caught below in a small pulp pan. The rejects drop from the splits through a 2-in. pipe on to a bucket conveyor, which dumps into a galvanized-iron hopper in an upper corner of the room. The rejects drop through a 2-in. pipe to a reject bin outside the build- ing. This bin is constructed high enough for a truck to be loaded from it by means of a chute door on the side.

THE hall of the Western Iron and Nail Associations having kindly been placed at the service of the Institute, the opening session was held at 3 o'clock, Tuesday afternoon, May 13th, with an attendance of about one hundred and twenty-five members. Mr. William Metcalf, of Pittsburgh, read an address of welcome on behalf of the Local Committee of Arrangements, to which President E. B. Coxe responded. The following papers were then read and discussed : Regenerative Stoves; a Sketch of their History and Notes on their Use, by John M. Hartman, of Philadelphia. Some Curious Phenomena Observed on Making a Test of a Piece of Bessemer Steel, by William Kent, of Pittsburgh. On the Use of Determining Slag Densities in Smelting, by Thomas Macfarlane, of Wyandotte, Michigan. After the reading of these papers each member was presented by the Local Committee with a schedule of excursions, a specially prepared map of Pittsburgh and surroundings, and a directory of industrial works, all tastefully bound, and also with a metal badge bearing the seal of the Institute, to be worn on the excursions. OIL, the abundance of it in the hands of the Allies and the lack of it in the hands of the Axis, played a major role in winning World War II. It bids fair to implement the winning of the peace. In fact the signing of the revised agreement on petroleum between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the United States of America on Sept. 24, 1945, may be considered as the first step in establishing a new pattern in foreign relations by our Government. The significance of this agreement on petroleum is that it was arrived at on the part of the United States of America through the advice and consent of the most interested parties, the leaders of the petroleum industry and the Government, distinctly a first step toward unifying the power of business and the strength of the Government, which places us on a par with the British Crown which has always had the advice and counsel of its business leaders in formulating its foreign trade policies. And what is the thing so patently discernible in this new first step toward winning the peace? It is that the petroleum agreement, the first draft of which, signed in Washington on Aug. 8, 1944, almost caused an epidemic of apoplexy among the leaders of the oil industry, represents the desire of the people most concerned with the problems of petroleum both at home and abroad. This new agreement, which will come up before the Senate for ratification this month-hearings will commence in January - derives its "power from the consent of the governed," something about which our forefathers were vitally concerned once upon a time.

THE joint meetings of the Mining Geology Committee and the Society of Economic Geologists proved to be deservedly popular, and the interesting papers drew an attendance which strained the capacity of one of the large meeting rooms.. As might be expected these days when even the Supreme Court can't keep away from the subject of gold, the discussions opened on Thursday morning with several papers devoted to questions of structural and mineralogical relationships of the deposits of this metal. The presentation of Ira B. Joralemon's paper, "Veins and Faults in the Bralorne Mine," by Reno Sales, elicited considerable discussion on the relation of mariposite to gold, and the situation of the gold deposits with respect -to the Coast Range batholith. H. V. Warren stated that lie had observed mariposite always to be associated with gold in this region, but that gold was not always associated with mariposite. He pointed out that there is a series of veins on the west side of the batholith with a different mineralogy that, because of their richness but small size could quite easily make good, small mines. John A. Dresser concurred in this, and said lie thought this region was one of great promise for the mining geologist. He also reported having found mariposite associated with gold values below commercial limits, in the Appalachian regions.

TONIGHT I want to speak of the current problems and the postwar difficulties facing American industry. American industry has done an outstanding job in adjusting its operations to wartime necessity. The national income for 1942 was nearly $120,000,090,000 and of this outlay approximately $55,000,000,000 went for war material. The enormity of the expenditures for war material is indicated by the fact that the expenditures for war purposes alone were greater than the annual gross national income in the period 1931-34. This tremendous production job in turning out a record output of war products was accomplished by industry in spite of a large number of restraining and hampering influences, and I want to mention several of the more important problems.

COMPARED with 1939, the year 1940 has seen no material change in the production of anthracite. Many factors seem to indicate a stabilized anthracite production of approximately 50 million tons per year. The present war has stimulated demand in the Cana¬dian and New England markets, which were formerly furnished with a portion of their needs from Great Britain and other European countries. Neither has there been any material change in the "bootleg coal" situation. This problem is more serious in the Southern anthracite field than in the Hazleton, Wilkes-Barre, and Scranton areas. PHILIP NORTH MOORE was born on July 8, 1849, at Connersville, Ind. His father, a civil engineer, was descended from Henry Moore who came from Ireland in 1773 to live in Washington, Pa. Through his mother, Philip Moore was descended from John North, who came to America in 1635 and settled in Connecticut. The story of Mr. Moore's life as told by himself is given on pages 373-386 of T. A. Rickard's "Interviews with Mining Engineers." He studied at Miami University, where he gained the degree of A.B. in 1870, and A.M. in 1873. In 1920 his alma muter conferred on him the honorary degree of LL.D. He, as a special student, was a member of the class of 1872 at the School of Mines of Columbia University.

To evaluate chemically the sample of rock obtained by diamond drilling, it has long been recognized that the analyses of the two components of the sample, core and sludge, must be given appropriate influence in computing the average analysis of any unit of depth. The purpose of this investigation is to set forth what means are available for apportioning the effect of core and sludge on the final analysis, what variables affect the problem, and what combination of applied mathematics will closest approximate the truth under each condition as these variables proceed within their limitations. A drill hole is bored in iron ore ex- ploration principally to test variations in rock composition with depth and is usually directed as nearly normal to the bedding of a horizon to be tested as possible. This practice has a tendency to minimize variation in composi- tion laterally which in any event is not likely to be great. It is obvious that the opportunity for change in analysis of a particular rock is not statistically as great radially in a diamond drill hole where the distance in which such a change may occur is from 0.719 in. (EX bit) to 1.469 in. (NX bit) as there would be longitudinally even in a run as short as 5 ft. Variations in composition of bedded or layered rocks are usually greater normal to the bedding than parallel thereto. Even in massive rocks, like porphyries, varia- tions are functions of distance. Hence, in either case, variations along the hole are of greater effect than across it.

Since the U. S. Metals Refining Co. works was established, around the turn of the century, near the town which is now called Carteret, N. J., it has grown to be a major producer of refined copper and the main source of that special brand known as "oxygen-free high-conductivity copper." Owing to the complex metallurgical problems arising from handling a variety of raw materials such as copper concentrate from Matahambre, Cuba, copper and brass scrap from the New York area, and domestic blister copper, the organization is geared from top management down through its 2000 employes to maintain a high degree of flexibility in plant operation. The Company is a subsidiary of The American Metal Co. Charges for the smelter furnaces, one reverberatory furnace and one blast furnace, are made up in. bedding bins so that they may be tailored to the production of a constant grade of blister copper. The reverberatory furnace smelts the .sulphide charge, which may be a blend of ten different materials but principally the Cuban concentrate, and the matte from the process is poured into a converter. This reverberatory is 80 by 20 ft, silica lined with a slag bottom, fired by pulverized coal, and continuously side-charged from the top by bottom-dump cars which keep the side walls covered. It produces a 40 to 50 per cent copper matte. The fuel-charge ratio is 4.35 tons of solid charge per ton of coal. The furnace has a capacity of 10,000 tons of charge per month and produces from 5000 to 6000 tons of slag per month which must be disposed of. About 5000 tons of converter slag is produced monthly and returned molten to the reverberatory furnace.
