VOLUME III The objective of Volume III of this report is to provide a concise review of six major types of legal constraints, controls, and regulations on surface coal mining in the United States, as of January, 1976. At the same time, an attempt is made to format the details of federal and state exploration, mining, and reclamation regulations such that point-by-point comparisons can be made and updated as revisions occur. Thus, Volume III should provide both an executive overview and a user's manual of legal controls of surface coal mining.

In the absence of any subsequent enactment of mining legislation, the Turkish mining law in effect in 1914, when Iraq became a British mandate, is still operative. The Constitution, or Organic Law, of Iraq, adopted by the Constituent Assembly on July 10, 1924, in articles 113 and 114, provides that:3 Ottoman en laws date and thao remained and lave pub- lished on or after that date and which have remained in force in Iraq u to the time of the publication of this law shall remain in force in Iraq' so far as circumstances permit, subject to any modi- fication or repeal in conformity with the proclamations, regula- tions, and laws referred to in the following article, and until they are altered or repealed by the legislative power or the High Court issues a decision rendering them null and void in accordance with the provisions of article 86. (Art. 113.) All proclamations, regulations, and laws by the Commander-in- Chief of His Britannic Majesty's Forces in Iraq, the Civil Commis- sioner, and the High Commissioner, and those issued by the Govern- ment of His Majesty King. Faisal, during the period between Novem- ber 5, 1914, and the date of the coming into force of this Consti- tution, shall be considered to be valid as from the date on which they came into force... (Art. 114.) 4 According to a German authority, it is the Turkish law of March 26, 1906, that, with a few modifications, is still in force. This law (similar to the French law of 1810) is discussed in a separate section of this paper.

This study by the Bureau of Mines documents the leadtime required for preliminary and detailed exploration, development of the mine, and construction of beneficiation and support facilities for selected copper deposits in Arizona. The time for major exploration ranged from 1 to 15 years, time for open pit development (or construction) was 1 to 4 years, and time for under- ground development was 4 to 8 years; one underground mine presently being developed may require 12 years to achieve production. Construction of the beneficiation plants required 8 months to just over 2 years. The data are supported by historical facts for each deposit during the leadtime stages from location of claims through exploration, construction, expansion, and leaching. The sequence of development and factors contributing to differences in the time spans are discussed. Histories are detailed for the Miami, Castle Dome, Copper Cities, San Manuel-Kalamazoo, and Twin Buttes properties; briefly summarized are the Pinto Valley, Miami East, Esperanza-Sierrita, Pima, and Mineral Park Properties. Each mining operation had its own pattern of development, and together they present a source of planning information for the development of other properties.

This paper describing the mining practices at the Old Dominion mine, Globe, Ariz., is one of a series being prepared by the United States Bureau of Mines on mining practices, methods, and costs in the various minim districts in the United States. The Old Dominion mine is situated in the eastern port of the Globe-Miami district, about 1-1/2 miles north from the center of the town of Globe. An average of nearly: 1,200 tons per day was mined during 1928. The prevent production is about 1,500 tons per day; of this amount,, approximately 100 tons is direct-smelting ore that is shipped to the smelter at Miami and 1,400 tons milling ore which is treated in the company?s concentrator at Globe. About 600 men are employed at the mine.

During calendar year 1972, the Bureau of Mines was engaged in some 20 major areas of research for the development of new and improved efficient methods of conservation and utilization for petroleum and natural gas, oil shale, and coal. Made up of numerous projects described in this report, the program was carried out through research performed at research centers and laboratories in the field supervised and supported by administrative personnel of this Bureau of the Department of the Interior. Based un this research, 186 technical reports were published by the Bureau or others, and numerous other reports were prepared for Federal agencies, State agencies, and organizations engaged in cooperative research programs with the Bureau.

Although not immune from the problems affecting the U.S. economy generally, the mineral industry in 1991 contributed nearly $300 billion in the value of processed materials of mineral origin. Supporting this contribution, the Bureau of Mines continued the research and analytical programs highlighted in this annual review. Featured in 1991 were such relatively new programs as minewide monitoring applications in ground control and advances in processing of ceramics and composites, along with more traditional research into health, safety, and mining technology, minerals and materials science, and environmental technology. Under Bureau sponsorship, a National Minerals Policy Forum brought together some 200 executives from industry and Government concerned with minerals policy to begin a dialogue on developipng a policy statement on current minerals issues. A major feature of the forum was the keynote address by Secretary of the Interior Manuel Lujan, Jr.

"THE BUREAU OF MINES was established in the public interest to conduct inquiries and scientific and technologic investigations concerning mining and the preparation, treatment, and utilization of mineral substances; to promote health and safety in the mineral industries; to conserve mineral resources and prevent their waste; to further economic development; to increase efficiency in the mining, metallurgical, quarrying, and other mineral industries; and to inquire into the economic conditions affecting these industries. The organic act of the Bureau, as amended by Congress and approved February 25, 1913, made it the province and duty of the Bureau to ""disseminate information concerning these subjects in such manner as will best carry out the purposes of this Act.""In accordance with that directive, the Bureau reports the findings of its research and investigations in its own series of publications and also in articles that appear in scientific, technical, and trade journals; in proceedings of conventions and seminars; in reference books; and in other non-Bureau sources. The number of these reports, the wide range of subjects they cover, and the variety of mediums in which they appear make the kind of list and index presented III this special publication both necessary and valuable. This issue describes Bureau reports and articles published during the period January 1, 1960 to December 31, 1964. It supplements the 50-year list of Bureau publications issued from July 1, 1910, to January 1, 1960,2 and the 50-year list of articles by Bureau authors published outside the Bureau from July 1, 1910, to January 1, 1960.3 It supersedes the annual lists of Bureau publications and articles from January 1 to December 31, 1960/ from January 1 to December 31, 1961,5 from January 1 to December 31, 1962,6 and from January 1 to December 31, 1963,1 The leading general and technical libraries of the United States maintain files of the Bureau's publications. Tremendous interest has been evidenced in the subject of dewatering and drying ooal for the past 10 years, and yet little effort has been made to summarize the literature, at least so far as this country is concerned. Only a few published articles have dealt solely with dewatering and drying coal. In most cases the subject has been discussed briefly, either in general terms or as to specific installations. It is desirable that a compendium be prepared collecting in one place information on the dewatering and drying of coal, the needs for this process in various fields, the available equipment, and the current American practice in regard to it. This work was underta..lten by the :Bureau of Mines in cooperation with the University of Alabama. New coal-washing plants in which various types of dewatering and drying equipment were in operation were visited in-Pennsylvania; Ohio, India...~a~ and Illinois. The dewatering·and drying of coel has .been studied in this coimtry by the Surface Preparation ·Committee of the ·coal Operato~s• Committee of the .American Mining ·Oongress. Coal has been mined by hydraulic means in various countries, i.e., the hydraulic excavation as well as the hydraulic transportation of coal has been practiced. The hydraulic breaking (excavating) of the coal dealt with in this report is done with a monitor directing a continuous jet of water against the coal, pressures of the water fed to the monitor range from 1500 to 2500 psi at 1000 to 2100 gallons per minute Transportation of the coal from the face is by fluming if a gradient exists in excess of 2 or, when a favorable gradient does not exist, the coal is pumped from the face by various types of pumps which can also provide a means of hoisting the coal to a higher elevation as required. This report presents: 1.) preliminary design and systems specifications of a demonstration miner (referred to in this report as a hydrominer), 2.) mining configurations showing good promise for typical U.S. thick coal seams in three seam pitch categories, (0° - 7° = Flat, 8° - 250 = Moderately pitching, 26° - 90° = Steeply pitching), along with cost and performance analyses for each system, 3.) a definition of a test program that will provide sufficient engineering data for the design of a water jet cutting head adequate to cut coal in those typical U.S. thick coal seams The cost analysis data showed hydraulic methods to be economically competitive with present thick seam raining methods. It was also obvious from studies of thick seam methods that the hydromonitor coal breaking techniques are more effective in removing most of the coal with its long reach of 60 ft. (or more), is a safer mining system, and produces very low coal-dust content in the air (usually less than 0.25 to 0.5 mg/cubic meter). It is recommended that the USBM sponsor a full fledged continuation of the hydraulic mining program: (a) lab, test, (b) preliminary field test, (c) full scale mine section demonstration.

Transportation charges for mineral commodity movements in western Oregon and western Washington were determined mainly by a stratified random sample canvass of producers. Total 1965 mineral production value for this area was $53.3 million; the cost or charge to move this production from the mine to the consumer or to the point of consumption was determined to be an additional $38.7 million. Thirty seven companies were contacted as a sample out of a total population of 349; the statistically expanded sample production value deviated 3.6 percent from that obtained by the Bureau's annual canvass. The agreement between the sample results and the canvass totals demonstrated the effectiveness of the sampling method for obtaining data with a predesigned level of accuracy. For comparison, the north-central Idaho and western Montana area was studied, A random sample experiment was designed, but because of the dominance of a few major companies, a random sample technique would have required more visits to producers than if only the larger firms were contacted. Eighty-four percent of the 1966 mineral value ($198.6 million) was accounted for by interviewing 27 firms out of a total population of 199. Total transportation costs or charges for the area were $26.7 million. The significant difference observed between the relationship of minerals production value and transport charges between the two areas investigated can be attributed to the difference in the minerals produced. The western Oregon and western Washington region is a nonmetals-producing area as opposed to the predominance of metals production in the Idaho-Montana region.

This volume- summarizes mining and petroleum legislation in 18 European jurisdictions. Within these jurisdictions, primary attention is given to requirements that must be met in each country for acquisition of rights to permit development of mineral resources. Coverage includes: First, identitication of the controlling laws or statutes governing minerals acquisition and reference to the administrative authority; second, analysis; of the laws governing mines and quarries and their products; third, analysis of laws applicable to natural gas, petroleum, and related materials; and fourth, mention of laws regulating offshore operations. Where pertinent, sections dealing with historical background or administration have been added in countries where minerals are subject to control of States or Provinces, those areas are considered separately from the central government.

In this report considerable space has been devoted to general and theoretical principles on the ground that under modern conditions the best results in any field of activity can be attained only with the a. id of an adequate knowledge of the best theories underlying the practice. The diffusion of such knowledge in the field of sampling metallic metallurgical materials appears to have been quite insufficient, and it is felt that when the principles involved are once thoroughly comprehended their universal application will be appreciated, so that it will make no difference whether pig iron or gold bullion is offered for test. It may further be noted that a discussion of the theories underlying practical methods is placed under the caption "Practical Sampling," with the idea that no one can be a practical sampler unless he is capable of analyzing his methods. No attempt has been made to advocate any one method, but it is hoped that the analyses of all of the methods in use will show where each may be correctly and safely applied. The fact that it is possible to demonstrate the theoretical correctness of several methods indicates the invalidity of the claim that any single one of them is the standard.

Data released by the Commerce Department's Bureau of Economic Analysis show continued gradual change in the real GNP's rate of growth in 1984, which has eased from an annual growth rate of 10.1 percent in the first quarter lo 7.1 percent in the second quarter, and then to 2.7 percent in the third quarter. The automobile industry strike in the last half of September had only a small effect, estimated at less than a 0.1 percentage point reduction in the growth rate. Among the components that comprise the GNP, personal consumption and fixed investment grew at lower real rates in the third quarter than in the second quarter, while net exports decreased. Personal consumption expenditures increased $0.4 billion in the third quarter, compared with an increase of $20.1 billion in the second quarter. Nonresidential fixed investment increased $3.9 billion in the third quarter, compared with $9.6 billion in the second quarter. The other component of fixed investment--residential investment--increased from $60.8 billion in the second quarter to $61.2 billion in the third quarter. Real net exports of goods and services decreased $1 1.3 billion in the third quarter, compared with a $3.1 billion decrease in the second quarter. Although exports increased from an annual rate of $144.7 billion to $150.2 billion, imports increased much more, from an annual rate of $1 56.2. billion to $172.8 billion (table 1).

The contractor examined L.T. White's Patent No. 3524680 and, finding it in need of engineering refinements, proceeded with a conceptual design of a variable wall mining machine. The contractor then proceeded to assess the feasibility of the variable wall mining machine measured against the criteria specified by the U.S. Bureau of Mines. The feasibility was judged from a physical aspect, a health and safety aspect, and an economic aspect. The Variable Wall Mining Machine was judged to be feasible on all three aspects provided that certain specified practices were adopted. Description The specifications and design and performance parameters of the Variable Wall Mining System as conceptualized are summarized in Tables I and II. The system consists of a side-cutting auger operating in a string of identical 12 ft. sections, along a 500 ft. retreating longwall face. In addition to the 41 identical sections, there is a special drive and discharge section at the head gate.

"As a part of the United States Department of the Interior program for the development and use of Alaska raw materials, the Bureau of Mines is conducting an investigation of deposits f nonmetallic minerals accessible to the Alaska Railroad for use in building materials in the Alaska Railroad-belt area. The results of the investigations, to date, indicate that raw materials for the production of brick products are in plentiful supply as clay in the Anchorage area, as fire clay at Sheep Mountain, and as shale in the Healy Creek coal formations near Healy, Alaska.Shale for the production of lightweight aggregate or Haydite occurs near mile 67 on the Glenn Highway, and preliminary tests give excellent results. Physical tests are new in progress on commercial-size concrete building units made with this aggregate. Another shale deposit in the same formation was located at mile 16 on the Matanuska Branch of the Alaska Railroad, and preliminary tests give comparable results.Natural lightweight aggregate in tree form of pumice and pumicite occurs in Katmai National Monument and has been used with excellent results in lightweight-building units in Anchorage and Fairbanks. These deposits will be investigated in more detail by the Bureau of Mines during 1952.One small perlite deposit near Healy, Alaska, showed excellent expanding properties, and the product compares favorably with commercial perlites being used in the States for plaster and concrete aggregates. Additional investigation by the Bureau of Mines to delimit the known occurrence and, if possible, discover others were planned for the 1951 field season.The pumice from Katmai National Monument also was considered for use as a pozzolan in pozzolan-portland concrete. Tests by the Bureau of Reclamation indicate that the pumice sample submitted by the Bureau of Mines would be satisfactory in strength development but is not outstanding. Natural activity is good and is greatly improved by calcination at 1,4000 F. Water requirements and shrinkage also are satisfactory. However, the material is ineffective in reducing expansion owing to alkali-aggregate reaction; and, if reactive aggregate is used to make concrete, it would not insure against excessive expansion. An attempt will, be made during the 1952 field season to delimit pumicite deposits along the Alaska Peninsula more amenable for use in pozzolan-portIand concrete.Because the Railroad belt has such a rigorous climate, insulation for new construction is of prime importance. Luring the Bureau of Mines, investigation of building materials all samples were submitted for chemical analyses as possible sources of raw materials for the production of rock wool, one of the best insulation mediums. Four areas having deposits of the required constitu¬ents were located as follows: Anchorage area, with Potter limestone and argillite; Cantwell-Windy area, with limestone and shale; West Fork of the Chulitna River area, with limestone and agrillite; and Homer-Seldoyla area, with Seldovia limestone and Homer clay. It was planned to take bulk samples of these formations and submit them for testing during the 1951 field season."

General economic conditions continued to improve in the second quarter of 1984 as real gross national product advanced at an annual rate of 7.5 percent (table 1). This followed an even larger first quarter annual rate increase of 10.1 percent. The slower second quarter growth was greeted as a sign that the economy is not over-heating. The signs of slowed growth in some sectors suggest that the recovery may continue well into 1985 without the inflation symptomatic of a rapid recovery. Most of the slowdown in growth was absorbed by business inventories, personal consumption of durable goods, and residential fixed investment. Business inventories grew by only 68 percent as much as in the first quarter, personal consumption for durable goods grew by 58 percent of the first quarter rate, and residential fixed investment slowed to only 44 percent of the first quarter growth. Sectors with accelerated growth in the second quarter included personal consumption of nondurable goods and of services, which increased at annual rates of 9.6 percent and 3.8 percent, respectively, and Federal purchases of goods and services, which increased at an annual rate of 47.9 percent.
