At the time of mine accidents one frequently hears the expression "there will be accidents as long as there are mines", or it may be varied to state that the accident in question was unavoidable, or something similar indicating inability to prevent accidents. However, it is the opinion of the writer, after over twenty-one years experience in both coal and metal mining, seven years being spent wholly in safety work, that by far the greater number of all accidents is due to carelessness or negligence. This carelessness or negligence may be on part of the victim of the accident or of one of his companions, or on part of his employer or possibly even of the inspector or safety man, and in some cases all of these agencies are involved. It manifests itself in various guises, one of the most serious being violation of state mining laws or regulations or of mine rules, and frequently the rules of ordinary common-sense. The cause very frequently is that trait in human nature to "take a chance" and it has been the writer's observation that the worst offender is the old-time miner who has come safely through many years experience, who was mining when the "safety man was a baby", and who clings to old-time ideas and practices and has "no use" for "newfangled" present-day "notions". Unquestionably, there are accidents, wholly unavoidable and many are caused by ignorance and by the new-comer in mining, yet as previously indicated, the writer's observation is that the old-timer is by far the worst offender, bringing grief to himself, companions and employer. Of the numerous manifestations of carelessness and negligence in connection with mine accidents, which have come to the notice of the writer, only one will be treated in this paper, viz: Violation of State Mining Law, and mention will be made only of explosions and major accidents in coal' mines with which the writer came in personal contact as investigator. In most cases, in addition to mine inspection after the accident, the writer heard the evidence given at Coroner's inquest and thus was enabled to for¬mulate fairly definite impressions as to events and conditions leading up to the occurrence.

The coal stripping project of the Edna Coal Company in Routt County, Colorado, near Oak Creek, is not greatly different than many other such projects in the United States-with two rather significant exceptions. The project is at an altitude of approximately 8,000 feet, and the topography is that characteristic of mountainous terrain. The first exception-that of high altitude-makes year round operation a challenge. The second exception-that of rugged topography makes the haulage of materials a difficult task.

I am not an orator and have never said a word in public during my thirty years' experience in the coal mines of Colorado; but, being requested to speak by our worthy chairman, and as I am deeply interested in the future welfare of this organization, 1 will make an effort to say a few words in behalf of the Rocky Mountain Coal-Mining Institute, which we are about to organize. As 1 understand it, it is the object and intent of this organization not merely to assemble occasionally for the purpose of discussing various problems in coal-mining, and thus to obtain the best possible results in economic operations, but its especial duty will be to devise ways and means whereby accidents in coal mines will be minimized. Figuratively speaking. we are about to plant a tree in the State House of Colorado, and desire its roots and branches to extend over Wyoming on the north, New Mexico on the south. and Utah on the west. So we expect this tree to bear fruit over a vast area. We must remember that the planting of a tree, even in good soil, is useless unless we cultivate, prune, and nurture its development. If we will not do so, the tree will not bear the desired fruit. So, in order to make the Rocky Mountain Institute a success, we must not only start it off in good shape, but we must keep on adding to its strength in various ways, so that it will become a known factor and a recognized power over this broad territory. In other coal-mining states and countries of the world much has been accomplished through similar organizations to reduce loss of life among men engaged in the production of coal, and there is no reason why our institute in the West should not be equally useful and attain the same results. There are many ways by which this organization can be made beneficial to the men engaged, in various capacities, in handling the "dusky diamond." I will endeavor to confine my brief remarks to the necessity of a crusade of an educational nature among three classes of men that are directly and indirectly connected with coal mines. First-We need to educate ouselves. It is amazing how few of our number, holding positions of trust, and having charge of men in and around coal mines, are conversant with our brief mining laws and cognizant of our duties in enforcing them. Going down the line to our company men and miners, I think 1 can safely say that not over 5 per cent of them are in any way familiar with the statutes that have been enacted for their especial benefit and protection. This condition, 1 think, can be, and ought to be, remedied, and. if thoroughly done, the effect in reducing loss of life will soon become apparent. Now, to reach the officers or men in charge I consider an easy matter, which could be accomplished in this manner: Have our general managers or owners of coal properties issue a circular, compelling every superintendent pit boss, fire boss, or other officer having charge of men, to send them a copy of the mining law in their own handwriting every six months. But to come to the masses engaged in coal-mining. to get these men of various nationalities educated in the mining law, will be a difficult task indeed; but I think I have an original scheme that is practical, and which, if put in operation, would work wonders in educating our company men and miners. This plan is as follows: Have every school in every coal-mining district devote one-half hour on Friday afternoon after school hours to the familiarizing of all male pupils between the ages of twelve and sixteen years with the contents of our laws governing coal mines. At the end of each term of school, award small prizes- say, $5, $3, and $2- to those that are best posted, the principal of the school to be the sole adjudicator. Now, someone may say that this is causing extra work to our teachers, with no compensation. In this respect, I will vouch that 95 percent of our teachers will do this work gratis, providing we can show them the benefit of the system. If we go a step farther, and put an incentive before our teachers, probably it would be a good scheme to award a prize-say, $20 or more-for the best set of practical amendments to our mining laws complied by any school and its teachers, judges of the amendment to be members of this Institute and appointed by the President. There is no denying the fact that we need to be educated, and that we should adopt some system that will encourage a knowledge of practical and scientific mining amoung our present forces and the rising generation. Much has been written by men connected with the coal mining industry, and mining laws have been enacted for the safety of the men employed in the mines, and for the protection of property connected therewith. It seems almost impossible for anyone to select a subject that has not already been read, discussed and put into effect, especially in the coal mines of Western America. There is, however, a subject of much interest to the mining public, and to which I have given a great deal of study and consideration, and which I believe will be received by this convention, and will be given due consideration in the future in applying it to the safety of the mine,- "Efficiency in Shot Firing." Beginning with 1865, and for a period of 28 years in the state of Colorado, the annual reports of the chief inspectors show that 1159 coal miners were killed in the following manner: Five hundred eighty-two by falls of rock and coal ; 517 by gas and dust explosions; 6o by careless handling of explosives and the shooting of coal by the, individual, miner. It is my firm belief that 75 per cent of these fatal accidents might have been avoided, if a safe and proper shot firing system had been installed, at each and every mine. This may sound unreasonable, but I believe that the blasting of coal by the individual miner, and the use of black powder, squibs and fuse has, in reality, caused the death of many miners, from shock after blasting, the shooting out 'of timbers, and working in powder smoke, which fatal accidents were attributed to falls of rock or coal. These conditions led the people of Colorado, through their representatives of the General Assembly of Colorado, to enact a new coal mining law, and in 1913 this law became effective, containing twelve sections devoted to the subject of Efficiency in the System of Shot Firing. During the period 1913 to 1920, the employment of a shot firer, the use of permissible. powder, and the electric hand battery has resulted in safer mines, safer miners and safer shot firers, and I believe every coal mine in the state should employ first-class, certified shot firers, use permissible powder and fire the shots with an electric hand battery. I believe where gas generates in dangerous quantities, which is generally determined by inspection of the mine, and the daily report, the shooting in. such a mine should be done by electric battery located outside of the mine. Where permissible powder is used, I have seen the shot firer start down the mine with a belt around his waist containing one hundred caps, a safety lamp to test for gas, and an open light to ignite the fuse. Would it not be much safer for the shot firer if he used the electric hand battery? In non-gaseous mines where black powder is used, I have. seen the miners carry fuse into the mine, and shot firers have been known to partly tamp the holes, which was

At the Annual Meeting of the RMCMI Board of Directors held June 29, 1985, the following amendments to the corporation bylaws Article III were made: Section 2. Advisory Board. There shall be an Advisory Board of Directors which shall be com- posed of all former presidents of the corporation and of the unincorporated association, also known as The Rocky Mountain Coal Mining Institute, of which the corporation is the successor. The Advisory Board shall periodically review the philosophy and policies of the corporation and make recommendations concerning the same to the Board of Directors. The Advisory Board shall hold an annual meeting at the same place as and immediately pre- ceding the annual meeting of the members in each year and written notice stating the place, day, and hour of the meeting shall be given or mailed to each member of the Advisory Board at least thirty days prior to the date fixed for such annual meeting. The annual meeting of the Advisory Board shall be for the purpose of electing a chairman from among its members and the person so elected chairman shall also serve as a member of the Board of Directors of the corporation. The Advisory Board shall meet at such other times and conduct its affairs in such a manner as it shall determine from time to time by resolution. Section 4. Regular Meetings. A regular meeting of the Board of Directors shall be held immediately following the annual meeting of the members, at the site of the annual meeting of the members, the day and time to be fixed by the Board of Directors at its annual meeting immediately pre- ceding the annual meeting of the members in each year, without the necessity of any other or advance notice. Such regular meeting of the Board of Directors shall be for the purpose of considering committee appointments, and for the transaction of such other business as may come before the meeting. A regular meeting of the Board of Directors shall also be held in the Fall of each year following the annual meeting of the members and written notice stating the place day and hour of the meeting shall be given or mailed each member of the Board of Directors at least thirty days prior to the date fixed for such regular meeting. Such Fall regular meeting of the Board of Directors shall be for the purpose of receiving the treasurer's annual financial report of the previous fiscal year as reviewed and approved by the auditor, to take action on the budget, and for the transaction of such other business as may come before the meeting. Section 8. Standing Committees. The Board of Directors may create by resolution adopted by a majority of the entire Board of Directors, a Bylaws and Resolutions Committee, a Nominating Committee, a Finance Committee, and one or more other committees each of which shall consist of two or more directors and which shall have and may exercise such authority in the management of the corporation as shall be provided in such resolution or in these bylaws. Section 9. Ad Hoc committees. The Board of Directors from time to time may by resolution create a Membership Committee, a Scholarship Committee, an Education Committee, various convention committees, and one or more other committees each of which shall consist of members of the corporation and which shall have and may exercise such authority, other than in connection with the management of the corporation, as the Board of Directors may determine. MINUTES of the Rocky Mountain Coal Mining Institute 81 st Member Annual Business Meeting July 2, 1985 The 81st Annual Business Meeting of the mem¬bers of The Rocky Mountain Coal Mining Institute was called to order by the president, Charles W. Margolf at 1:35 p.m. Tuesday, July 2, 1985 in the Windom Peak Room of the Tamarron Resort near Durango, Colorado. Thirty members were present and a quorum was established. It was moved by Bill Balaz, seconded and car¬ried to dispense with the reading of the minutes as these were published on pages 67 thru 77 of the 1984 issue of the Proceedings. The chair called for reports of the various com¬mittees and these reports will be placed on file in the RMCMI Office. Bylaws and Resolutions. Chairman Loren V. Linville reported that the Board of Directors had adopted changes to Article III, Sections 2, 4, 8 and 9 calling for clarification of Ad Hoc and Standing Committees as well as setting forth a purpose for the Advisory Board meetings and stating a time for an annual meeting. The labor turn-over at coal mines has long been a fertile subject for parade by complaining coal operators, the question invariably occupying a place of prominence in the list of disabilities that tend to increase the cost of producing coal, adding likewise to the now startling number of accidents that occur in coal mines. This disability, however, is like the weather question, which some humorist once remarked of by saying, "The weather is something we all talk about, but nobody does anything to improve it." Endless compilations covering the shift of employment by coal mine labor have been made and published, and while the actual loss expressed in cents per ton in cost of coal produced has never been determined, the fact remains that such represents a substantial item, taking the mines of the country as a whole. Efficiency engineers who have made studies covering the cost of breaking in and training each new man employed in certain manufacturing industries, fix same as averaging not less than $100.00 per man, and when the character of mine employment is given due consideration, including its ever-present hazards, the difficulty of close personal super- vision of individual employes, and the, at times, almost impossible ability to transmit to men of many diverse nationalities understandable instructions, it is quite safe to say that the cost of securing and breaking in new men for underground mine work will fully equal that suffered by the factory managements. When we speak of mine labor turnover we must necessarily exclude the enforced shifting about of men who are laid off by the closure of mines due to accident or lack of market, con- fining ourselves to the turn-over occasioned by- (a) the dismissal of individual men or groups of men; (b) the voluntary resignation of the individual workman. It is these two methods of severance that the employer and employe alike suffer from; the item "Unclaimed Wages" carried in the accounts of every large coal company illustrative of the "quit this job, get another one" attitude of many workmen, who frequently, when leaving, fail to claim small sums due them, while others, in turn, leave a train of debts, large and small, behind.
