Computations and allowances for mine depletion for Federal income tax purposes depend upon the meaning of certain terms in the pertinent provisions of section 114(b) 4 of the Internal Revenue Code. Unfortunately, but one of these terms is defined in the Code. Congress left it to the Commissioner to define the other terms in the Regulations. Even though the Commissioner, through his staff, labored long and earnestly to draft these definitions they have not been satisfactory to the mining industry, because the definitions in the Regulations and the interpretation placed thereon by the Commissioner do not state what the industry believes to be the clear and obvious intent of Congress. Consequently serious and prolonged disputes, unduly delaying the settlement of Federal tax returns involving percentage depletion deductions are continually arising between taxpayers and the Commissioner.

F. W. Matthiessen, who, with E. C. Hegeler, of La Salle, was one of the creators of the zinc industry in the-United States, was born in Altona, Schleswig-Holstein, Germany, Mar. 5, 1835. He was one of a family of remarkable brothers, two of whom were long absociated in this country with the sugar and glucose industry. Mr. Matthiessen was educated at Freiberg, and came to this country in 1857 with Mr. E. C. Hegeler, after having, in company with that gentleman, visited the mining districts of Germany, Belgium, and England. They first went to Friedensville, near Bethlehem, Lehigh County, Penn., wherc attempts had already been made to produce zinc from the ore deposits found in that place. The ore was a he silicate but all attempts to extract zinc from it had failed. Mr. Matthiessen and Mr. Hegclcr were successful, but declined to invest their money in the zinc industry at Bethlehem because 01 certain local conditions. Hearing of the discovery of zinc -ore in the West, they visited both Wisconsin and Missouri and thought of settling in the coal region of East St. Louis. Finally La Salle, as being near to the Wisconsin fields and having much coal, was selected ae the site of the new smelting company, and on Dec. 24, 1858, the first shovelful of dirt was turned for the buildings of the new industry. The Civil War at first interfered with the manufacture of zinc, but afterward a lively demand for the metal arose and the future success of the institution was established. A large rolling mill was added in 1866, and in 1881 the manufacture of sulfuric acid as a byproduct was begun. Mr. Matthiessen also developed the Western Clock hlanufacturing Co. of La Salle, which manufactures the Big Ben alarm clock, from a small plant having 25 men to the present large institution which employs some 2000 workers. Mr. Matthiessen's affiliations with other metal industriefi have been numerous. But the contributions of the great zinc manufacturer to the causes of philanthropy and education have made his name known throughout the country, beyond industrial circles. He has given to the city of La Salle probably a sum total of $500,000 in various benefactions. Among the objects of his philanthropy were the La Salle-Peru Township High School, which he has made a model institution of secondary education for the entire United States; also the Tri-City Hygienic Institute of La Salle, Peru, and Oglesby, Ill., which he endowed for $200,000 This Hygienic Institute, which is unique in the United States, has a traincd staff of health officers, bacteriological laboratory, medical library, infant welfare station, milk station, free dental clinic, school nurse, and isolation hospital. Mr. Matthiessen was elected mayor of the City of La Salle three times and gave generously to the municipality of which he was the head. He also saved for the people of Illinois one of the great scenic districts of the state, Deer Park, with its cafions and natural beauties, which he con-verted into a model scenic resort, and the proceeds of which he gave to the charities of the Tri-Cities in which he lived. He died on Feb. 11, 1918.

As I drove in from the airport on Sunday somebody said 'On the right you will see Duntroon, which is the military training school of Australia.' So I asked the driver, where did they get that name? 'Oh,' he said, 'from some people who built a house there. That was it's name- Duntroon.' It strikes a note with me because, that's the name of a 12th century castle on the west coast of Scotland where I spend what leisure hours I have and, therefore, it establishes the long connection between Australia and my native land. There is also a story I should tell you about the oil industry and its upsurge in Scotland recently which has resulted in great prosperity. And in Edinburgh, the walls of the banks are bulging-because of the incursion of foreign exchange and other resources. Charlotte Square, as some of you know, is the centre of the Scottish financial world and at one of the corners of Charlotte Square, where ho streets intersect, there are three stores-three emporia on the ground floor. Two of them at opposite corners are banks: The Royal Bank of Scotland, and not to be beaten by that, The Bank of Scotland. But the third building is occupied, or was occupied, by a furniture store over many years-very high-grade, high quality furniture that the elite of the Edinburgh society always supported. And suddenly, the store was cleared out and in came a bunch of carpenters and other people busily engaged in rebuilding the store, and finally the new tenants arrived on the scene.

CLEANING fine coal in jigs is not new in Europe, where the feldspar jig is being used almost exclusively for this purpose. A feldspar jig operates with an artificial bed made up generally of feldspar or other hard rock material. Dimensions and specific gravity of this material must be of suitable values for good bedding qualities. For good efficiency, the size should range between 1x2 in. and 2x2x½ in. thick. The disadvantage of an artificial bed is that it is not mobile and must be replaced every so often with new material to obtain good cleavage characteristics. A semi-mobile bed has been developed to retain only a part of the feldspar on the sieve screen— the other part is drawn off with the refuse material, from which it is reclaimed and returned to the jig feed. Recirculating this feldspar rock offers definite advantages. However, in time it will lose its original shape because of wear, and new bed material must be added to the jig feed. The latest feldspar jigs arc generally air-pulsated, Baum-type jigs, although more than 70 pct of the feldspar jigs operating in Continental Europe are still of the piston type. These jigs are very popular in Europe, but they do require a great deal of time and attention. New Theory to Eliminate Artificial Bedding: At the preparation plants of Pittsburg & Midway Coal Mining Co. it has always been the contention that a small piston-type jig could be developed to clean fine 1/4x0-in. coal down to 28 to 60 mesh efficiently by obtaining and admitting bedding material from the present plant refuse circuit to the jig feed. This eliminates use of artificial bedding materials. The jig should incorporate these essential adjustable features as follows: Adjustable Sieve Screen A screen that can be raised and lowered to increase or decrease washing compartment depth. The sieve screen also can be set on an incline level, or decline. Adjustable Plunger Eccentric Length of stroke can be adjusted to increase or decrease pulsion and suction. Variable Plunger Speed Variable speed reducer for decreasing and increasing the number of strokes per minute. Water Distribution Adjustable baffle plate separating the plunger and sieve compartment so the water can be distributed uniformly over the entire sieve screen area. Refuse Ejector Special unique rubber-type refuse ejector gate operated by air and electrically controlled (as a conventional jig). Automatic Control Conventional float that measures the specific gravity of the coal-water refuse medium in the jig is of the submerged type. The float is mounted on a vertical stem held in position by two parallel arms. A movable weight regulates the effective specific gravity of the float. The float stem can be raised and lowered, having a graduated scale to indicate the depth of bed for the setting of the float. Hutch Drawoff Hutch material is drawn from the cell compartment to the elevator compartment by gravity. PLASTIC relaxation can occur at the edge of a moving crack by the operation of pre-existing dislocation sources or by the creation of new sources in a region of perfect 1attice.l'2 The amount of relaxation in a given crystal depends on the crack velocity and the temperature, and can determine whether a crack propagates in a brittle or a ductile manner.1-3 Tetelman and Robertson4 observed microcracks m Fe-3 pct Si single crystals that formed on (100) planes by the precipitation of hydrogen gas during electrolytic charging at 23°C. The plastic deformation accompanying crack propagation was observed in the form of dislocation etch pits and an extensive analysis has been made of the size, shape, and crystallography of the dislocation arrays5-7 This paper describes the effect of temperature on the plastic deformation generated around hydrogen-induced cracks in Fe-3.1 pct Si and Fe-4.2 pct Si single crystals. The observations are compared with the results of an elastic-plastic model for yielding around a crack containing an internal pressure. 1) EXPERIMENTAL PROCEDURES The composition of the materials used in this study are given in Table I. MINE executives, as a rule, have always been willing to adopt new ideas of operation, or to listen to proposals which might increase the effectiveness of their enterprise, more especially so if they could be shown how definite results might be attained by introducing any conception suggested. In these days of high wages, high cost of supplies, and high taxes, operators are even more inclined to accord consideration to innovations or improvements, and many go so far as to employ men to conduct special investigations and make studies for the purpose of advancing production. Where a man is brought into an organization to do work of an efficiency nature, it often creates resentment among the operative heads because of having their work directly scrutinized, or investigated, and there is a tendency, if not actually to obstruct, to fa.il to cooperate; in which case the investigator is handi-

EVERY producer of crude oil knows what is meant by the Rule or Law of Capture. It means that the ultimate ownership of a migratory substance such as oil is not determined until that substance is reduced to physical possession. Unless, therefore, the producer moves quickly to capture his share from the common pool, he may lose to any neighbor who is drilling and producing more rapidly than he a portion of the oil originally underlying his property. And there is no recourse open to him if his property is so drained. Under this rule it is obvious that the owner of an oil property, if he is to protect his' ownership, must be governed in his development and production policies by the activities of his neighbor rather than by his own business requirements. He must drill as densely and as fast as the other operators in the field or lose part of the oil to which he should be entitled.

The mineral gypsum, CaSO4 + 2 H2O, has been used for many years as a sulphurizing and basic flux in several smelting-operations. Thus, in smelting oxide nickel-ore in the blastfurnace, it is commonly added to the charge to furnish the sulphur necessary for collecting the metal in a matte, and a base for slagging the siliceous gangue. In the concentration of lead-copper matte in the reverberatory furnace it has been used for years at Preiberg, Saxony,1 for a similar purpose, and for producing at the same time a copper-matte with less than 0.15 per cent. of Fe. The latest use gypsum has been put to is in the blast-roasting process of Carmichael-Bradford.2 The term " blast-roasting," given by A. S. Dwight3 to the Dwight-Lloyd method of roasting and agglomerating: is a happy generic term which covers the ground better than the " lime-roasting " of Ingalls5 or the " pot-roasting " of Austin: in that it leaves the operation independent of the character of the flux and the form of apparatus, and retains the characteristic feature of this class of processes—namely, that of using forced draft. In the Carmichael-Bradford process the dehydrated material, mixed with galena-concentrate, acts as a diluent and a flux. The process differs in this from the Huntington-Heberlein7 and the Savelsberg8 processes, in both of which limestone is used.

IT is a pleasure to realize even at that day the dignity of the engineer's calling was upheld. May I also add my firm belief that today there be many engineers who will qualify to the specifications of our interesting author. Since that time, the development of the world has been chiefly due to the engineer, and so far as human brain can foresee, the material tasks of the future will continue to follow the directions of his judgment. Popular opinion says this is the age of the engineer; literature, which in the long run, voices public sentiment, shows it in the number of engineers who figure as characters of fiction. The engineer has been doing the big things necessary to increase the comfort and efficiency of mankind, but while a certain amount of fame and repute falls to him, too often he figures as the hired man of the entrepreneur, using that term not in the offensive sense of a mere promoter, but to mean the great visioned master of enterprise who has seen ahead of other men, recognized the coming needs of the world, and through ability to inspire others and to hire capital for his use has also been able to hire engineers as needed. Justly enough, therefore, to such men comes the fame as well as the prize of the game.

The history of the development of gold metallurgy in South Africa is divisible into two periods: That preceding the introduction of the cyanide process on a commercial scale in 1890; and the 24 years intervening between that important event and the present time. The period between the discovery of the banket reefs of the Witwaters-rand and the year 1890 was one of phenomenally rapid progress in mining development, but of no special interest to the metallurgist, There were no strikingly original or distinctly local advances in the treatment of gold ores. Californian practice in stamp milling and amalgamation prevailed, in mills ranging in equipment between 5 and 50 stamps, operating within a wide range of efficiency, and under the trying conditions usually encountered in a new and isolated field. The somewhat incomplete records of gold output of that period show that in December, 1887, there were 20 producing companies in the Witwatersrand district, of which 10 had mills, the largest being of 20 stamps. The only official record of returns for May, 1887, was that of the Wemmer mine, whose modest achievement with a 5-stamp mill was 100 tons crushed, producing 887 oz. 3 dwt. of gold. This is interesting in view of the present-day output of this field, which in 1913 reached 8,430,998 oz. The rapid increase of production during this first period (May, 1887, to January 1891) is shown by the following summary for the year 1890:1 Total tone crushed.................................. 702,828 Number of stamps in operation....................... 1,046 Average number of tons crushed per stamp per day..... 2.36 Yield of gold, ounces................................ 494,817 Yield per ton, pennyweights.......................... 13.36 The stamp duty ranged between 11/2 and 4 tons per day, according to weight of stamp, fineness of screen, and operating skill available. The prevailing weight of stamp was about 900 lb., and the screen, 900 meshes to the square inch.

THE work to be described was undertaken at various periods from 1937 to 1939 on the Busia gold field, in the eastern province of Uganda. It was decided to examine the possibility of reef prospection by the resistivity method, for it was not known how far the usually disintegrated nature of most reefs in the ubiquitous laterite near the surface would obscure indications obtained by resistivity traverses. The work at the commencement was therefore largely experimental, but the results obtained thereby were satisfactory, and a survey was started at the Government closed area at Amonikakine. With the limited time and resources at the writer's disposal, it was not possible to complete the survey to his satisfaction or to follow up exhaustively all the geophysical indications, but some of the results of the experimental work and the survey were of sufficient interest to be worth recording; in particular the relation between the width of reef, electrode separation and shape of the curve, and the interference effect of constant separation curves over zones of float are significant and useful. Three new veins were located, but only one contained sufficient gold to warrant detailed prospection. This was called the Geophysical reef, and was uncovered over a strike distance of 1140 ft., and there are indications that it extends over a distance of 1990 ft. These results and the recommendations consequent therefrom were embodied in a special report to the Uganda Geological Survey. HISTORY OF THE FIELD The Busia field is in the southeastern corner of Uganda near the Kenya-Uganda border, and is about 17 miles north of the northeastern corner of Lake Victoria. Gold was first discovered in the area in the stream beds by Davies1,2 in 1932. Subsequently numerous small alluvial claims were worked by prospectors and the area was prospected for reef by a company for periods varying from three to nine months, but was finally abandoned, as the results were considered unfavorable. Further prospecting by the Geological Survey in 1935-1936 under Davies3 and later under the writer4 uncovered three reefs with sufficient gold values to be of economic interest. These were finally taken over by a company known as Borderland Syndicate, which still owns the area, and from September 1937 to the end of 1941 about 13,000 oz. of gold was extracted from reefs of the area proved by the Geological Survey. Opencast mining operations are still proceeding (February 1943). The Amonikakine area lies to the immediate north of that of Borderland Syndicate. A certain amount of prospecting had been done when the writer started work there. As a result of his report, this area was taken over by another syndicate, but little further work was accomplished before it ceased operating because of difficulties of wartime working.

The effect of rain size on the creep behavior of an austenitic iron-base alloy has been studied at 1300° F under conditions of constant stress. The average grain diameter varied between 9 and 190 p (ASTM 10.7-2). The subgrain size and apparent activation energy for creep were not found to depend in any systematic manner on gain size. The variation of c, with grain size is believed to he associated particularly with grain boundary generation of dislocations which becomes more important with increasing temperatures. SEEMINGLY inconsistent experimental findings have led to a certain amount of confusion concerning the effect of grain size on creep behavior. The confusion is attributed to a lack of test results obtained over sufficiently wide ranges in grain size, stress, and temperature. Experimental results presented in this paper and results available in the literature1-5 show a consistent behavior and lead to a unified concept for the dependence of secondary-or steady-state creep rate on grain size. In accordance with this concept, which is substantiated experimentally, secondary-creep rate should increase with increasing grain diameter at low creep temperatures, leading to greater creep strengths for fine-grained materials. At intermediate temperatures the secondary-creep rate should decrease to a minimum and then increase as the grain size is increased. At high creep temperatures the secondary-creep rate should decrease with increasing grain size, leading to greater creep strengths for coarse-grained materials. Whether a temperature is high or low for creep in a metal or alloy depends primarily on its melting temperature. MATERIAL AND TEST PROCEDURES The material tested was an austenitic iron-base alloy of the following composition (wt pct): C, 0.005; N, 0.017; Mn, 1.26; Ni, 14.21; and Cr, 17.18. Two 15 -lb ingots were forged and hot-rolled to 5/8-in.-diam bars which were then cold-rolled and cold-swaged to a diameter of 0.49 in. These were sectioned into 3-in.-long blanks and heat-treated at various temperatures to obtain different grain sizes. The procedures employed and the results obtained are summarized in Table I. The secondary treatment at 1400° F followed the primary treatment without intermediate cooling to room temperature. This final treatment was employed to minimize various effects arising from heating to different temperatures during the primary treatment, particularly differences in intragranular dislocation structure, segregation of interstitial atoms at grain boundaries, and density of grain boundary ledges. The intragranular dislocation structure was examined by electron transmission metallography after each of the treatments described in Table I. Isolated dislocations and a few tangles were observed but no evidence of subgrains was found after any of the treatments. No grain-size effect was evident on the density and distribution of dislocations. Stabilization of grain boundary structure is particularly important because, as will be discussed later, grain boundaries influence high-temperature creep behavior. HOSTILITIES in Europe, Asia, and northern Africa were responsible for dislocations in rare-metal supplies during 1940. Although the consumption of some of the rare metals is small the dislocations may be relatively large. In some cases these are advantageous to North America and in others they are disadvantageous. Specific instances will be cited later. Barium T HIN films of barium metal on special steel balls greatly improve the life and reduce the friction of rotating anodes in highly evacuated small X-ray tubes and make possible the operation of these anodes at relatively high temperatures. These remarkable results are described in an article by Atlee, Wilson, and Filmer in the Journal of Applied Physics for September, 1940. Oil could not be used because of the high temperatures on the one hand and its volatility on the other. Fig. 3 shows diagramatically the rotating anode and the method of coating the steel balls with barium. The letters K.I.C. refer to "Kemet Iron Clad." DURING the past several years of diamond drilling in Washington County, Mo., the St. Joseph Lead Co. has discovered a concentration of commercial lead-zinc ore at four different points within an area of 36 square miles. The largest and to date the most promising group of these orebodies is located in the Indian Creek area. It was considered to be of sufficient value to warrant development. The Indian Creek area is in the center of the northern half of Washington County, 11 miles northwest of Potosi, Mo., the county seat. The location is readily accessible from Potosi by car or truck over the all-weather Missouri State Highway No. 114. The topography is one of rolling relief, varying from an elevation of 700 ft above sea level on Mineral Fork and Indian Creek to a maximum of 1176 ft at High Point Tower. It is divided in equal halves between the drainage to Mineral Fork and to Indian Creek. The shaft site at 1060 elevation is on the divide between the two drainage areas. The Indian Creek side is rough and heavily wooded, with only a few cultivated clearings. The slopes to Mineral Fork are more gentle and rounded, with much of the area cleared for farm land. Most of the surface is covered with Potosi and Eminence formations, which show little evidence of any structure. Ore structure was worked out by extensive diamond core drilling, with holes varying in depth from about 700 to 1300 ft. As of Oct. 1, 1950, 218 prospect holes had been drilled within the 36-square mile area. The ore is disseminated galena with considerable accompanying sphalerite in the Bonne Terre forma-tion in the shape of irregular blanket-type deposits. The main controlling structural feature of the outlined mineral zone is a buried pre-Cambrian rhy-olite-porphyry ridge extending partly through the Bonne Terre formation, which laps against the por phyry and also covers it. The mineralized zone parallels and forms an irregular halo around the porphyry ridge and is concentrated in the Bonne Terre formation where the La Motte sandstone is cut out by the porphyry ridge. This is a very common mineral occurrence in the southeastern Missouri lead belt district. The La Motte sandstone, which normally underlies the Bonne Terre formation, is thus cut out entirely. In this area the Bonne Terre is usually about 275 to 320 ft thick, the La Motte varying in thickness from zero up to 400 ft. Commercial concentrations of ore are indicated at several places, the most notable being at the shaft site where an orebody at least 4000 ft long with widths of 500 to 600 ft has been outlined. The total thickness of mineralized rock reaches 150 ft in some holes, although total ore thickness runs from 8 ft to about 60 ft, often in more than one layer. Preliminary Planning Ore reserves as outlined lend themselves to open-stope mining with trackless haulage and mobile loading machines and drilling equipment. This type of equipment has proved to be very efficient during recent years in the company&apos;s lead belt operations. After a study of bids for shaft sinking and an estimation of comparative costs, it was decided that the shaft would be sunk by St. Joseph Lead Co. personnel using company equipment. Since the plant site is about 26 miles from the company&apos;s nearest lead belt operations, it was necessary to plan a complete surface plant, including mill, shops, office, change room, and warehousing facilities. Immediately following the filing of an application for a certificate of necessity, a headframe was selected for which detailed drawings were already available. The order was placed for fabrication so that it could be delivered and erected in time to serve for sinking the shaft. This eliminated the expense of a temporary headframe. The American Society of Mechanical Engineers extends an invitation to members of the Institute to participate in an exceedingly interesting excursion on Saturday, November 11. Permission has been secured for a visit to the plant of the Electric Boat Co. at New London, Conn. There will be run a special-test on a high-power 8-cylinder, 4-cycle Diesel engine. A large number of submarine and other engines in various stages of construction will be seen, also the boring of torpedo tubes, cylinders and other equipment for submarines. The drafting rooms and foundry mill also be open for inspection. The party will have an opportunity to see at close range the submerging of several submarines, and an attack on a vessel on the surface, an exhibit which is being arranged by courtesy of Rear Admiral A. W. Grant, who is in command of the submarine forces of the United States. The Boston members will leave South Station on train No. 7 at 8.30 A. M. Those from Providence will board this train at 9.36 A. M. The Worcester members will leave on train No. 745 at 8.36 A. M. The New York contingent will leave the Grand Central Terminal at 8.31 A. BERYLLIUM is one of the most interesting of the minor metals and distinctly a modern development, for until the last two decades it had practically no commercial importance whatever. Then it was discovered that when small quantities of it were alloyed with copper, a copper alloy of unusual and valuable qualities resulted. This is by far its major use-in the manufacture of strong, heat-treated copper-base alloys in which the beryllium content varies from about 0.3 to 2.5 per cent. Its second most important use, though much smaller, is in the form of oxide or other nonmetallic products in the fluorescent lamp, X-ray, cathode ray, and television industries. Certain beryllium salts have the quality, in common with several other materials, of transforming short-wave radiation and cathode rays to visible radiation. Such materials are commonly known as phosphors, and the beryllium salts are the most important phosphors now in use. The third largest use for beryllium is for ceramics, including refractories. Beryllium is also used in small quantities in the form of the metal itself.

THE Midvale mill of the United States Smelting Refining and Mining Company is situated on a flat site whose elevation is 50 ft above that of the Jordan River. Tailings are impounded in the area between the river and the flat upon which the mill and railroad switchyard are located. The water supply is pumped from the Galena canal which leads from the river at a point some ten miles to the south. The mill has a present capacity of approximately 1700 tons daily. It started out originally in 1926 as a 750 ton three-unit plant. The tonnage was gradually increased to 1200 tons by 1934, and in late 1935 a fourth unit was added. The accompanying flowsheet shows the principal equipment and how it is utilized. The ore is principally sulphide with varying degrees of oxidation, with individual lots ranging widely in both precious and base metal content. THE public generally has-become aware that there is something wrong with the coal industry and a clamor has arisen for an explanation if not a remedy for this disorder. It is only reasonable that this Institute be looked to for a diagnosis to show the way for some other .agency to prepare the patient for prescription or operation. The subject is extensive, widely diversified, and beyond the efforts of an individual to cover completely; one of the objects of this paper is the initiating of a symposium on the non- technical factors essential to an understanding of the bituminous coal industry. The present condition of the coal industry cannot be described in a few words but, in effect, it resolves itself into a simple statement: The average coal operator is losing money notwithstanding a firm conviction on the part of the consumer that he pays too much for his coal. Without enumerating the many and varied. factors which contribute to this condition, this paper will be devoted to the interrelation of taxation and ownership of coal and its effect on finance
