Arbitration is a legally recognized alternate litigation for the resolution of civil disputes. The parties agree, either before or after a dispute arises, to submit that dispute to an independent third party for resolution. The decision of that third party is binding on the parties. A decision of an arbitral tribunal, typically referred to as an "award," cannot be reviewed by a court except on very limited grounds, such as fraud. See, e.g., Va. Code 8.01-581.010. Indeed, an arbitral award is typically less subject to judicial review than the decision of a trial court, whose decisions are almost always subject to appellate review as a matter of right. Arbitration is typically the result of a contractual agreement between the parties to submit disputes to arbitration. On occasion, arbitration can be required by statute. For example, the California Department of Transportation requires the arbitration of all disputes arising under its contracts. Public Contract Code, Article 7.1 (§§10240-10240.13). There may be a question whether statutorily required arbitration is truly arbitration or an administrative law disputes resolution procedure. The significance of the difference is that the decisions of administrative law bodies are typically reviewable by a court of law as a matter of right while, as set forth above, arbitral awards are almost never reviewable.

The main source of Mn in raw materials for SiMn production is Mn-ore and Mn-rich slag from the high carbon FeMn production. The amount of slag per tonne of SiMn metal is mainly determined by the ore/slag ratio. Increasing share of FeMn slag at expense of Mn-ore will lead to larger slag/metal ratio in the SiMn process. High volume of slag leads to an increased consumption of energy and probably to higher losses of metal inclusions in the final slag. Excavation of a SiMn furnace has shown that only modest pre-reduction of Mn-ore with CO gas seems to be obtained. Nearly all reduction of MnO was finished at the top of the cokebed. Dissolution and reduction of quartz obviously takes place in the cokebed zone after the main reduction of manganese oxide is finished. Probably the ?pick up? of Si in the metal is quite fast and takes place as the metal trickles down through the cokebed towards the metal bath. The distribution of Si between SiMn alloys and multicomponent MnO-SiO2-CaO-Al2O3-MgO slags is mainly determined by the process temperature, the silica content of the slag and its R-ratio = (CaO+MgO)/Al2O3. As an example, the equilibrium content of Si in the alloy will increase by about 6 % if the R-ratio is reduced from 2 to 1, provided constant temperature and silica content. The effect of temperature is also considerable. The equilibrium content of silicon will increase by approximately 6 % per 50°C in the temperature range 1550°C to 1700°C. The equilibrium content of MnO in SiMn slags depends first of all on the temperature and secondly on the silica content of the slag. At 1600°C the MnO content decreases from about 9 % at silica saturation to a minimum of about 3-4% when the silica content is reduced to about 40-45%.

Despite observations of spalling and damage of mine excavation wall rock in the Bushveld Complex (BC) over the passage of time, there have been very few time-dependent or creep tests carried out in South Africa on rock, particularly on BC rock types. The research described in this paper deals with the investigation of stress and strain conditions influencing spalling of wall rock in BC mine excavations, and the influence of time on the tensile strength of several BC rock types. Time-dependent laboratory testing of BC rocks was carried out in indirect tension. The results show that the magnitude of the tensile strength of BC rock types is approximately 5% of their uniaxial compressive strength magnitudes. The average long-term uniaxial compressive strength of the BC rocks, interpreted from the axial stress-volumetric strain graphs, is 56% of the UCS value. The long-term tensile strength is shown to be less than 70% of the normal tensile strength. Extension strains at tensile strength failure ranged between 0.16 and 0.21 millistrain. Values corresponding with the long-term tensile strength are less than 70% of this range, namely, 0.11 to 0.15 millistrain. These results represent new knowledge, since such rock testing and analysis does not appear to have been carried out previously on BC rock types. Elastic numerical modelling was carried out to illustrate the extents of tensile stress zones and extension zones around of typical BC mine excavations. The models showed that large zones of extension strain can occur around BC excavations, and that the magnitudes of the extension strain can substantially exceed the critical values determined from the laboratory testing. The implication of this is that there are substantial zones surrounding BC mine excavations that will be prone to time-dependent spalling conditions and perhaps more significant failure.

Alumina supported gold catalyst prepared by spray reaction method (spr) provides gold particle with about 20 nm of diameter. The gold particle size is larger than conventional gold catalysts. However, the spr catalyst shows higher catalytic activity for NO-CO reaction. In the present paper, we have discussed the local structures of spr-Au/Al2O3 catalyst by using Au L3-edge XANES spectra. In order to investigate the local structures of Au-sites, multiple scattering approach to XANES analysis was applied. Calculated Au L3-edge XANES spectra for fcc-Au and Au2O3 were in good agreement with the observed spectra. XANES spectra for spr-Au/Al2O3 were characterized by 4 types of Au sites (bulk, interface, surface and peripheral). In this case, almost all gold sites (> 90 %) are bulk site. The other sites are less than 10 % of gold particle. However, the experimental and the calculated results of Au L3-edge XANES spectra for spr-Au/Al2O3 require about 30 % of gold oxide or hydroxide. Bulk of Al2O3 contains a certain number of gold nano-particles, which was incorporated in the bulk Al2O3 support. In the interface area, gold oxide forms a few layers. This result was also supported by DV-Xa electronic structure calculations. The comparison of the catalytic activities of the spray catalysts and the impregnation catalyst for the NO-CO reactions imply synergy effects between gold nano-particles and alumina support.

Appropriate seals, portal ground improvement, and compatible shaft construction techniques are vital elements for launching and receiving tunnels effectively in urban areas where adjacent property requires protection from excess ground movements. This paper focuses on seals and ground improvement along with shaft wall types, required to launch or receive tunnel boring machines within wet, permeable ground at the portal zone. The paper also discusses probing to verify suitability before the tunnel eye is cut. Methods addressed include: rubber gasket seals; soft eyes; double walls; top hats for reception; and, portal zone ground improvement (permeation grouting, jet grouting, un-reinforced slurry diaphragm wall panels, ground freezing, deep soil mixing, dewatering, and over-excavation and backfilling). This paper focuses on challenges with launch and reception of pressurized-face TBMs with precast concrete segment linings. Challenges related to pipe jacking are discussed in a separate paper titled ?Mitigating Microtunnel Launch and Reception Challenges? (Hunt and Finney 2008).

The Bureau of Mines investigated extraction of aluminum from aluminum-silicon alloys as a means of utilizing domestic aluminum silicate ores for aluminum production. Aluminum was extracted from aluminum-silicon alloys by electrolysis in molten electrolytes of NaCl-KCI-AIC13 and NaCl-KCI-AIF3 in a laboratory-scale cell. Six alloys with aluminum contents ranging from 20 to 87 percent aluminum were tested, and aluminum products of primary grade or better were obtained. More than 80 percent of the aluminum was recovered with current efficiencies as high as 91 percent. Recovery of a metallurgical-grade silicon product from the anode residue by an acid leaching procedure was possible with the 50-50 and 65-35 Al-Si alloys.

Introduction Continuous monitoring techniques have been used in the US and abroad for many years. A continuous miner has a monitor that measures methane and automatically gives a warning if the methane exceeds 1%. It deenergizes the continuous mining machine automatically at a maximum concentration of 2%. Main fans are also continually monitored to ensure operation. Alarms may also be given at a remote location should a fan slow or stop. The systems being developed can continuously monitor various gases and equipment throughout the mine and transmit pertinent data to a surface monitoring station. At this station, conditions throughout the mine can be monitored and, in some instances, controlled. These are known as Mine Wide Monitoring Systems (MWMS). History The use of environmental monitoring systems began in 1976 when a federal court approved the petition of modification to use belt air at the face. The first mine to receive a modification did install a system to supplement existing safeguards. Later, the Mine Safety and Health Administration (MSHA) and the US Bureau of Mines (USBM) conducted tests dealing with the use of belt air. Findings from these tests are being used to set guidelines as requirements of a petition. These requirements include: • Velocity of air has to be 0.25 to 1.5 m/sec (50 to 300 fpm); • Monitors will be installed at each belt drive and tailpiece and at intervals not to exceed 610 m (2000 ft); and • An alarm level of 10 ppm, above the ambient level is appropriate. The early uses of environmental monitoring could only be used outby the last open crosscut. That may be a reason for an initial slow growth of these systems. In June 1982, MSHA began evaluating systems that could be used in returns to ensure that monitoring systems being used in areas where permissible equipment is required does not of itself pose an explosion hazard. This is known as the Mine Wide Monitoring Systems Evaluations and Sensor Classification program. The evaluations and classifications granted are based on electric currents and voltages. Use of mine wide monitoring systems The environmental aspect of MWMS in today's coal industry deals with carbon monoxide (CO), methane (CH4), and air velocity. Just as all mines are different and encounter different problems, the MWMS are diverse and can be used to provide necessary data in all areas of coal mines. Mine operators in an ultragassy seam, for example, may be concerned with monitoring methane, while a mine that used diesel equipment may want to continuously monitor for diesel contaminants. In a mine with roof fall problems, airflow monitors may be helpful as an indication of whether the air is flowing in its normal course and at its normal volume. Today's MWMS can monitor any or all of these parameters. Most systems can be expanded as mining needs require. For example, a mine is now being monitored for methane and five years from now CO monitoring would help increase safety. It may be possible to use the same system by adding additional equipment. In the US, 30 environmental monitoring systems were installed from May 1985 through May 1986. In 1984 and 1985, there were 38 and 44 environmental monitoring systems in operation, respectively. Due to mine closings, 11 of these are no longer in use. However, the number of mines using environmental monitoring systems increased to 63. Of the 28 accident/injury classifications listed by the Mine Safety and Health Administration, handling materials is second only to roof falls in terms of generating the highest number of reportable accidents in active underground coal mines. Two materials-handling activities that cause numerous injuries each year are the categories of “handling supplies or material, load and unload” and “moving power cables.” Mechanization and mine worker activity training are two methods that can aid in preventing these injuries. This paper describes three mechanical methods—the mobile manipulator, the in-mine hoist, and a cable-handling system—being developed and tested at the Spokane Research Laboratory of the National Institute for Occupational Safety and Health. Two of the devices are specifically designed for loading, unloading, and moving supplies and materials, and the third device is for handling trailing cables in the confined spaces of coal mines. Also described are safety solutions developed for underground coal mines geared to showing miners safe and unsafe ways of performing various materials-handling tasks.

This report describes a Bureau of Mines study undertaken to determine the applications and limitations of solution techniques as a general method of fluorescent X-ray spectrographic analysis. Systematic errors due to variations in particle size, surface preparation, and sample inhomogeneity are eliminated by the use of solutions. The range of applicability of fluorescent X-ray spectrography is increased in two ways: (1) Samples in the form of wire, filings, turnings, etc., can be analyzed as solutions, and (2) samples submitted as solutions can be analyzed as received 0 The lower limit of detectability varies from 0.14 gram per liter for sulfur, atomic number 16, to 0.0015 gram per liter for strontium, atomic number 38. Most elements have limits of detectability between 0.02 and 0.002 gram per liter.

Kalimantan has been a major diamond producer, while in the 1980s a placer gold rush occurred in Indonesia and Malaysia. Reviewing extensive geological and mining data highlights phenomenal palaeo-environmental changes in the Sundaland region, interpreted to be responsible for generating ‘giant’ placers. Correlation of the Late Cainozoic stratigraphy has been facilitated from mine exposures and drill holes distributed throughout Peninsular Malaysia, the Indonesian Tin islands and Kalimantan, including contiguous marine areas with extensive shallow seismic profiling data. Knowing the association of rich placers with palaeo-environmental episodes and stratigraphical units has been helpful to facilitate their discovery. All three placer commodities responded similarly to region-wide landscape evolution following Mio-Pliocene high sea levels. Commencing with major regression, important stages comprised: a long period of landscape stability with deep weathering during the maximum Sundaland extent gradually rising sea levels/precipitation initiated slumping of mineralised regolith to form fans, later reworked by braided streams with aggradation (Old Alluvium); during episodic pluvial periods downcutting upgraded placers significant change occurred around Middle Pleistocene time with peneplanation and pedogenesis from Late Pleistocene time ‘modern’ fluviatile deposition (Young Alluvium) filled incised V-shaped valleys.Placer seams show systematic variation in stratigraphic position, in particular cassiterite especially occurs in the Old Alluvium (equivalent Upper Dahor Formation in Kalimantan). Gold is commonly richer in gravelly younger deposits, partly because of secondary precipitation within permeable alluvium. "The versatility and specificity of rare earth elements (REEs) have led to their use in an ever increasing variety of applications in new technologies. Consequently, demand for REEs has increased significantly. However, to separate REEs safely and effectively is a complex and expensive process. While China has consistently invested in R&D of REE processing technologies, there have been only sporadic activities in REE mineral processing in North America in the past 20 years. This paper presents a review of REE mineral processing technology, providing an update on current capabilities in REE mineral processing. This paper reviews REE extraction from the major commercially valuable REE-bearing minerals such as bastnaesite, monazite, and xenotime, and also from the ion-absorption type of REE deposits. Currently, there are four major REE mining areas in China, one in the United Sates, and one in Australia. A review of the REE extraction processes in these major REE mining areas closes out the paper.INTRODUCTION The rare earth elements (REEs) include the 15 lanthanide elements, plus yttrium and scandium. The lanthanide elements are normally categorized in two groups: the light rare earth elements (LREEs), i.e. lanthanum through europium (atomic number (Z) = 57 through 63); and the heavy rare earth elements (HREEs), i.e. gadolinium through lutetium (Z = 64 through 71). Yttrium is usually grouped with the HREEs due to similarity in physical and chemical properties. Table 1 lists the REEs, atomic numbers, and abundances in earth’s crust (Taylor and McCleannan, 1985). Promethium is the rarest due to lack of stable isotopes. REEs with low atomic numbers are more abundant than those with high atomic numbers. More interesting is that the REEs with even atomic numbers are much more abundant than adjacent lanthanide elements with odd atomic numbers as shown in Table 1."

The potential of eccentric cone crushers for fine crushing has been improved by increasing the swing frequency of the moving cone, balancing the crusher, ensuring uniform feed via a rotating funnel with sideways discharge, introducing hyperbolic motion and employing the inertia crushing method, but further improvements to the specifications of existing cone crusher designs are limited by the rigidity of their kinematic coupling. A new design has been developed which combines two crushing modes, stone on liner and stone on stone, each with its own advantages. The main aims are to produce finer materials and to reduce liner weight. The benefits include an increase of more than 10% in the output of fine particles, improved protection of the liner against wear, as a result of filling of the cavities by material being crushed, and the use of almost 20% less material in casting of the liner. Contract is a PC-based software program designed to satisfy the main features that have been identified to be lacking from cost estimation systems currently in place in the Australian coal industry. Contract was developed in conjunction with an Australian contracting company to refine the existing core structure used by the company for project evaluation. The key feature of Contract is the availability of analysis functions to explore multiple options within a contract project by altering identified variables. The ability to update project files has been incorporated into Contract to ensure that it is user-friendly and relatively simple to use. Lists of mining equipment and consumables are stored in MS ACCESS database files, along with the supplier details for each item. Each time a project is initiated there is a dynamic link to the database files and the most recent current information is retrieved and linked with the project. Contract provides an option to calculate the changes in metre unit cost as a function of the average development cost. Keywords: Contracting, cost estimation, sensitivity analysis.

Newmont Waihi Operations is participating in the initiation of a community liaison forum in association with the local district council. The objective is to provide a forum for the free and regular exchange of ideas, concerns and information, and through improved communication seek to achieve a more comprehensive set of solutions to community, operating and closure issues associated with Martha Mine. A similar liaison forum has been operated on two previous occasions during earlier phases of the present mine's operation. This paper deals with the practical aspects of setting up a liaison forum to act as an effective conduit between regulators, mine operators, local businesses and the community. The mechanisms and procedures for identifying community issues and concerns are dealt with. The actions and structures required to ensure effective ongoing community 'buy in' at all levels are discussed. Corporate philosophies are addressed. Specific examples from Martha Mine, Waihi New Zealand will be used to illustrate the paper. This will include a brief explanation of previous and current community issues, Newmont Waihi's operations both at Martha Mine and the proposed Favona underground mine, and the practical issues involved in setting up a liaison forum.

In this paper, the author would like to point out with figures that the building industry is one of the key industrial sectors of the national economy in China. And in the coming 15 years, the output of building construction will not in the least decrease, but increase. The requirements for building standards, quality, functions as well as physical environment will also be higher along with the incessant development of the national economy and the gradual raising of people's living standard. China is a country with a vast territory and a great, variety of physical characteristics. The topographic and engineering geotechnical conditions are complex and varies considerably from place to place. Although, in recent years, encouraging progress has been made in building construction, there still exist many problems unsolved or even not explored at all, which we have to tackle in the future design and construction of foundations. Also reviewed in this paper are the achievements attained in the past thirty odd years and the challenge we will face in the foundation engineering field in China.

Electrowinning metals from solutions leached from low-grade ores is becoming an increasingly important extraction method as the metal industry turns to pollution-free recovery processes. Lead-alloy anodes are used industrially in the electrolytic recovery of zinc and copper. However, associated with the use of these anodes are the inherent problems of stability and lead contamination of the cathode. In an effort to eliminate these problems, the Bureau of Mines has developed a relatively inexpensive lead dioxide anode for electrowinning metals from strong acid solutions. The anode was prepared by depositing Pb02 directly on a titanium blank in a strong HN03-Pb(N03)2 solution at 2.15 to 6.45 A/dm2 and 60° C. This anode was tested in zinc and copper electrowinning cells containing 200 gpl H2S04 and 35 to 100 gpl metal ions at the current density of 3.23 to 6.45 A/dm2. Contamination of the cathode by lead was =0.005 pet. A 30-day test at 6.45 to 12.90 A/dm2 in an electrolyte containing 200 gpl H2S04 and no metal ions resulted in a slight change in surface morphology of the Pb02 anode but no measurable change in anode weight or dimensions.

Manganese-bearing deposits f the Leadville, Colo., district are of two distinct types. Manganosiderite, a combined or intimately mixed ferrous and manganous carbonate, occurs in unaltered zones as the predominant mineral. From 50 feet below the surface to as deep as 900 feet, psilomelane and wad, both black manganese oxide minerals, are found in intimate contact with hematite and limonite. A typical analysis of the black oxide ore shows 20.08 percent Fe, 18.64 percent Mn, 15.91 percent insoluble, 14.91 percent moisture, 0.94 percent Zn, and 2.13 percent Pb. A considerable tonnage of the oxide ore has been mined for production of spiegeleisen and for other purposes.

Detailed measurements made at a test section adjacent to a deep braced cut and other published data are combined to illustrate the limitations of the common methods of predicting movements associated with excavations in soft to medium clay. While past performance data can be used to estimate expected responses before construction in many cases, actual wall and soil deformations throughout construction can only be estimated using finite element procedures. Success of such analyses depends equally upon considering all aspects of construction that induce strains in adjacent soil, such as wall installation, excavation and bracing sequence, and time, and adequately modeling soil stress-strain behavior. Even when these two criteria are met, soil deformations can not be predicted adequately when strain levels exceed those that produce peak shear stress.
