Mr. Pickett's remarks were primarily concerned with the legislative aspects of the coal industry. Mr. Pickett stated that as a result of the 1952 election, only two senators and eleven representatives are now in the legislature who have ever served under a republican administration. He said there are 425 legislative issues now on the floor of Congress concerning the coal industry, but the coal industry has difficulty in legislation, because, although there are 31 coal states, only 11 states produce more than 5,000,000 tons per year, and 11 states produce between 500,000 and 5,000,000 tons of coal a year. In these states there are 44 senators and 195 representatives, less than a majority in either house, if all could be counted on to support the coal industry. An important committee to the coal industry is tile House Ways and Means Committee, composed of 25 members, 15 Republicans and 10 Democrats. Even with the support of the senators and representatives from these 22 states, legislative action is difficult.

The question of disposition of the slack and dust so troublesome to coal mine operators of the West has been divided by your committee chairman into three heads, viz: The preparation and transportation of fine and powdered coal. The developments along the line of low heat carbonization. The uses to which fine and pulverized coal have been put. The development of low heat carbonization has been assigned to me. This is really not a part of the subject but as it has a most important bearing on the future use of coal, I presume the chairman thought best to include it. An English committee on smoke abatement makes the statement that the burning of raw coal is "dirty, wasteful and unscientific". I will go a step further and characterize it as an "economic crime." It has been predicted by eminent scientific men that eventually no raw coal will be burned for heat or power purposes. All this will take time, experimentation and large expenditure, but it will surely come. The question of disposition of slack and dust so troublesome to coal and utilization of its by-products has been retarded by the abundance and cheapness of the raw coal, and by the abundance of suitable coking coals for metallurgical purposes. But necessity is surely, if slowly, demanding that the enormous waste ensuing from the burning of raw coal for heat and power must cease. For instance, smoke abatement investigations in Manchester, England, showed that the increased cost of household washing was about $1,250,000 per year due to smoke and soot. It is estimated that in London 200 tons of soot and smoke particles are suspended in the atmosphere over that city during dense fogs and that much more than this is emitted from the chimneys each winter day during the forenoon. As an example of what benefits a smokeless fuel gives, it is cited that in the mill town of Shaw, England, the burning of smokeless fuels in the factories has reduced the so-called fogs by about 80%. Pictured on these pages are the seven RMCMI Scholarship Award Winners for the 1987-88 year followed by a brief profile. Six of the winners were present as RMCMI guests at the June convention in Breckenridge, Colorado to receive their recognition plaques at the welcome session held Monday, June 27, 1988. In addition to the plaques, each winner receives $500.00 to be used toward tuition in the coming academic year. Also, as this is a continuing award, the winners from the previous year will also receive an additional $500.00 for tuition use in their senior years provided they have maintained a good academic standing and are recommended by their university. Criteria for these awards is (1) That the award be made in the spring to a sophomore student to be used toward tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the state involved. (3) That the recipient have good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program was extended in early 1988 to include curricula other than mining department, but in the engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member. She plans to earn a dual degree in Mining and Geological Engineering then pursue a Master's degree in Mineral Economics at the University of California at Berkeley. Among her honors are a four year scholarship from Sante Fe Southern Pacific Foundation, a one year scholarship from Mobil Oil Corporation and another from Eastman Kodak.

At the meeting of the American Institute of Mining and Metallurgical Engineers, G. S. Rice, Chief Mining Engineer of the U. S. Bureau of Mines, announced the definition of a gassy mine. This definition has been awaited with much interest, especially by the Safety Committee of the Rocky Mountain Coal Mining Institute. It applies to the whole area of all mines, any part of which is on the public domain of the United States. Consequently it will be of wide application in the western part of this country. The safety committee of the R. M. C. M. I. has been hopeful that the Institute would adopt this definition without exception as the codes of rules to be recommended at all mines in the Rocky Mountain area. The statement follows: "The U. S. Bureau of Mines believes that all coal mines are potentially gassy; but for purposes of administration in respect to prevention of explosions and fires, the Bureau recommends the following classification: "Class 1 coal mine-A practically non-gassy mine in which flammable gas in excess of 0.05 per cent cannot be found by systematic search. "Class 2. coal mine-A slightly gassy mine in which (a) flammable gas has been found, ? but in quantity less than two per cent in still air in any active or unsealed-abandoned workings; or (b) flammable gas can be found, but in quantity less than four per cent, in some place from which the ventilating current has been shut off for a period of one hour; or (c) flammable gas can be found,* but in quantity less than one-fourth per cent in a split** of the ventilating current; or (d) flamamble gas is found in quantity greater than' specified rate*** of not more than 25 cu. ft. per minute. "Class 3 coal mine- A gassy mine in which flammable gas is found in quantity greater than specified for a Class 22 coal mine. GENERAL NOTES REGARDING DECISION NO. 3 "(A) Flammable gas found in coal mines is, with rare exceptions, methane. In coal-mining fields where natural gas is found in lower geologic horizons by deep wells which pass through or nearby the coal mines, there have been rare instances of la leakage from the well. Natural gas is chiefly methane; that constituent almost always forms more than 85 per cent of the whole, but it usually contains ethane, propane and traces of butane also. Therefore if the latter gases are found in mine air it is an indication of leakage. The lower limit of explosibility of methane-air mixture when there is turbulence of five per cent and of natural-gas-air mixtures with about ten per cent ethane and associated hydro-carbon gases is 4.6 per cent. The limit therefore varies with the character of the mixture. " (B) To determine the proper classification of a coal mine, it is advisable that systematic testing and sampling be done at least three times in a period of not less than 72 hours. All tests and samples of the mine air, except one, must show an inflammable-gas content less than the maximum limit of the class to which the mine is assigned. In other words, a tolerance of one test or analysis may be permitted to provide for a mistake or a very exceptional occurrence. "(C) When a new mine is being opened in a coal field where existing mines are generally gassy, it is common sense to assume that similar conditions will be found in the new mine, and its development and equipment should be based upon the expectation that it will be assigned to Class 3."

Mr. Chairman and Gentlemen: I tried to get Benedict Shubart to have some fellow-some big fellow with a big voice-to read this paper for me, but he said there was nothing doing; [ ] that I would have to read it myself. I will try and not take up too much of your time. It is a pretty big subject, Mechanical Loading, and it covers a good deal of ground. I have merely touched on the high spots, as it were. A great deal has been preached and written in the last year or so about mechanical loading, and I doubt if any other subject in the mining industry has been discussed so freely and as often in the last few years. It is not the intent of this paper to dwell on the merits or demerits of any [ ] particular type of loader, that is, to say what the writer thinks is the most efficient or most inefficient machine. There are several types of loaders on the market to-day that are proving very successful in many mining districts. The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

Twentymile Coal Company?s first longwall face in the late 1980?s was oriented approximately 45 degrees to the major coal cleats and 45 degrees to the primary horizontal stresses. This combination of stress and coal cleating resulted in frequent violent bursts of coal along the longwall face. The bursts created particles of sufficient size and force with the potential of causing injury to employees and occasional damage to shield components. Partial web cutting was subsequently developed in an attempt to relieve the stress on the coal face and required the shearing machine to travel to the tailgate and back for a full 36 inch web. The partial web cutting pattern is focused on first cutting the lower 90% of the seam to relieve the stress as the shearer travels from the headgate to the tailgate. The web depth during the headgate to tailgate pass is typically in the range of 70% to 80% and varies with conditions to maximize production rates. The top and bottom of the seam in the remaining 20 to 30% of the web are then cut out to allow the shields and face conveyor to advance. 100% of the web is cut at each gate end for a distance of approximately 19 shields. This paper addresses some general mine geology and the procedures and benefits of partial web cutting with respect to safety, production and maintenance on a high production longwall face.

I want to say just a few words of welcome to all the delegates this morning, both old and new. There is a large group of men around here I notice who come to this meeting year after year, and it occurs to me that they must be getting something worthwhile out of these meetings, the renewal of old acquaintances, the making of new acquaintances, and the opportunity to find out what is doing in the technical end of the coal business, and what is new. So, we greet you enthusiastically and trust that you will find this meetnig on a par with all those which have gone before and. that each one of you will leave these sessions determined that you will not miss next year but will be back again. So, with that introduction, we will proceed with the business of the convention. As time is fleeing away from us, if there is no objection, I wil lentertain a motion to dispense with the reading of last year's minutes. Will somebody make that motion? MR. H: C. The subject of this paper may seem threadbare to, many of you, but even if I repeat what you already know, just smile to yourself and think how much wiser you are than your neighbor, for it is startling what a number of tipples are erected that violate the elementary fundamentals not only of good design but of practical operation. Possibly a coal screening plant is a simple plant. If so, we treat it like we do a great many other simple things. We treat it entirely too lightly and fail to take into consideration, not only the changes that may occur later, the conditions we may be compelled to meet as competition changes, but even the elementary physical conditions that exist right at the tipple site. If I get too positive over some particular point, don't blame me, but remember some of the heart-breaking experiences we have had correcting these omissions, trying to make a tipple do merely what it was designed to do, when the builder tied everything up in such a constricted space, that no room was left to get the results he must have. Perhaps some of the things will look too expensive. Don't say that you can't afford them. Many of them you can't afford to do without, and when you figure that a tipple is put up for possibly twenty years of operation, you can't afford to omit any reasonable precaution not only in taking care of the present, but in foreseeing the future. We will consider a tripple screening plant, suitable for Western conditions, capable of handling approximately 2,500 tons per eight hours. The largest screen sizes must be loaded into either open cars or box cars, and arrangement provided for screening and loading not less than five sizes of coal: lump, egg, nut, slack, dust, or any reasonable combination of these. As we are considering only the preparation of the coal, we will omit all consideration of the method of haulage, pit cars, methods of dumping, and will take the coal after it is in the dump hopper. The track arrangement will frequently be determined by the ground layout. Our sizes and tonnage can be loaded on three tracks, but four tracks are better. The two outer tracks should be left for loading lump coal, No. 3 track should be left for egg coal, and No. 4 track for loading nut, slack and dust. Where a fifth track can be provided, No. 5 track should be held open only for run-of-mine coal, to act as a storage where emergency coal can, be run, should there be any delay in the screening equipment or in changing cars. Track No. I should be used for loading lump coal into box cars only. Track No. 2 should be used for loading lump coal into open cars only, and may or may not be provided with picking table, loading boom, or both. Where picking is necessary, a picking table can frequently be put between the two "lump tracks, heading down track, pivoted at one end, so it may be raised or lowered to feed either open or box cars; with

It is a well established fact that 60 per cent of all accidents in coal mines occur from falls of roof and coal at or in the proximity of the working face. Notwithstanding that this is well known, and has been frequently discussed by mining men, this seems to be the irreducible minimum. It is even said by those in a position to know that the percentage stated is increasing. With this, information before us it would seem that not enough attention is being given to close supervision at the working face, and until this is done we may expect to continue experiencing an increase in the accidents in this area. No workman generally feels that it is more important to finish loading a car of coal than to set a timber for protection, and many accidents happen from this source, not from a lack of knowledge of the dangerous conditions existing, but negligence in taking remedies necessary to remove the danger. It is true that nearly all state laws require the mine foreman or his assistant to visit each working face every day, but with the constantly changing conditions on account of the advance of the working faces, these daily visits may be entirely inadequate to discover possible dangers and prevent accidents. The obvious remedy then is closer and more systematic inspection and supervision of the working faces. Many accidents are caused in mines on account of not enough clearance between the rib and track or between timber and track. On all main haulage ways. there should be a space of at least 30 inches between the rib and track, or timber and track, and on all rooms not less than two feet should be left between the track and upright timbers.. A great deal has been said and written with regard to systematic timbering. We doubt very much the feasibility of adopting any standard of timbering that would be suitable for all roof conditions, and any such system in our opinion would not tend to cause a decrease in the number of accidents. The proper place to put up a prop, regardless of whether it conforms to any established system, is under a piece of loose roof. No habit is becoming more prevalent among miners and other mine workers than wearing gloves, principally flimsy canvas gloves, which afford no protection to the wearers and are the direct cause of many hand injuries. If gloves must be worn, and no doubt they will be as the habit has become well established, then they should be made from some heavy material and should fit the hands fairly snug.

Profiled here are the eight RMCMI 2000 Scholarship Award winners. Six of the eight attended the 96'' Regular Meeting and convention at the Sheraton Tamarron Resort in Durango, Colorado in late Tune. Each spoke during the Scholarship Awards Monday luncheon and shared their goals with attendees. In addition to receiving a 52,000 tuition credit, thanks to the Patrons of the Institute annual funding of scholarships, each received recognition at the luncheon with a brass plaque signifying this honor. The winners arc guests of the Institute Sunday through Tuesday noon and have an outstanding opportunity to meet many in the coat industry who could be potential employers. The state vice presidents host the winners and pay for their travel and hotel expenses. This is a continuing scholarship and may be renewed for tuition credit again in the senior year it the winner is a full time student and is recommended by the dean of the college or university. A resident from each of the eight member RMCMI states is selected by the Scholarship committee from Board approved institutions. Criteria for these annual awards is that the recipient (1) is a full time sophomore student who will use the tuition credit the junior year. (2) Be both a U. S. citizen and a legal resident of the member state. (3) Maintain good academic standing, be pursuing a degree in a mining related field and have an expressed interest in western coal as a possible career path. Contributions to this worthwhile project are tax deductible to each individual RMCMI member or his company. Through donations of $100 or more to the Patrons of the Institute, each Patron receives a plaque and a year bar for each additional year contributions arc made. Vatterrodt University of Arizona The son of Charlene and Larry Vatterrodt, David graduated from Marana High School, Tucson, Arizona where he attained a 3.6 GPA. In his second year at the University of Arizona he has a 3.4 GPA and is pursuing a Bachelor of Science in Mining Engineering. He is a member of SME and enjoys playing tennis and riding his motorcycle. He is the recipient of a $1,000 Tradition of Excellence scholarship. David volunteers every Saturday morning during the academic year at the U of A. San Xavier Mining Laboratory. His tasks there include work area inspections, jack-leg drilling, scaling, roof bolting, operating an LHD and overshot mocker, track laying and other general maintenance. COLORADO WINNER [ ]Jonathan B. Casten Colorado School of Mine. Graduating with high honors and a 3.99 GPA from Windsor High School, Colorado, Jon is well prepared for the rigors of academia. In high school he was on the Dean's list, Salutorian of the Senior Class, member of National Honor Society, Colorado Boys State delegate and lettered in varsity golf.At Mines, Jon belongs to SME and Work Study and maintains a 3.75 GPA. He enjoys golf, hiking and weight lifting. His parents are Katherine and Fred Casten of indsor. Jon has chosen Mining Engineering as a career as he plans to improve the nation's efficiency of extracting natural resources.

Pictured on these pages are seven of the eight RMCMI Scholarship Award Winners for the 1993- 94 year followed by a brief profile. Seven of the eight winners were present as guests of the Institute at the June convention in Snowmass Village, Colorado to receive recognition at the Institute Awards Luncheon Monday, June 27, 1994. Due to another conflict. Jason T. Dale of Wyoming was unable to attend. Each state vice president sewed as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman. Alan Czarnowsky, each winner receives $750 tuition credit for the coming academic year, as well as transportation, hotel lodging and meals at convention as guests of the Institute. Because this is a continuing award, the winners from the previous year will receive another $750 for tuition credit in their senior year if they have maintained good academic standing and are recommended by their university. A resident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the member state. (3) That the recipient have good academic standing, be pursing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholarship program and the various vice presidents contribute the travel expenses to convention for these outstanding young collegiates. Profiles of the 1994 Scholarship Winners follow. [ ] ARIZONA WINNER Christy L. Brandt University of Arizona Tucson. Arizona Christy Brandt is the 1994 RMCMI scholarship winner from Arizona. She is majoring in Mining Engineering at the University of Arizona in Tucson, Arizona, but recently is considering switching to Environmental Engineering with emphasis on mining. She told the Scholarship Chairman that if she wasn't part of the solution, she was part of the problem. Christy has received numerous awards during school including being on the honor roll and university chapters of Society of Mining Engineers. Besides her academic activities, which includes being a member of Student Council, Christy is quite an athlete and enjoys basketball, softball, tennis, golf, and soccer. Last summer, she worked as a safety assistant/laborer for the Magma Copper Company. This summer, Christy is working in the safety department at Magma Copper Company's Pinto Valley Mine in Arizona.
