It seems to be a matter of general understnading that title extraction or use of ground water may not be used as the basis of a depletion deduction under the United States Revenue Code And indeed, I have been unable to find any precedent upon which to base such a deduction. It is for this reason that the Shurbet case, which is the subject of my discussion and is now before the Court, may well become a precedent as authority for the allowance or disallowance of a depletion deduction for income purposes. It is well known that the law recognized that capital is consumed in the process of extracting minerals, oil and has, other natural deposits, and timber (underscoring supplied). This exhaustion, or depletion, is likened to the using up of raw materials in manufacturing. The law, therefore, provides a deduction for depletion which is intended as compensation for the exhaustion of assets consumed in the production of income through severance of minerals, oil and gas, other natural deposits, and timber.

Draglines often work from a position on the active highwall or spoil side bench to remove undisturbed waste material and spoil in the previously mined pit. To protect the dragline crew members and the machine, it is necessary that the highwall remain stable while the dragline is present on the bench. In the past several years, we have been involved in determining the causes for highwall failures that included the dragline. While there have been no injuries and limited dragline damage with these incidents, the potential certainly exists for a more serious outcome. In all cases, the operation had completed a geotechnical study to support the ground control plan and pit designs. However, all these incidents included aspects that would not likely have been identified in studies to determine highwall and spoil designs to support ground control procedures. In general, these events included aspects that were localized and would have been difficult to identify in initial slope stability studies either observationally or during the soil testing and modelling efforts. Although the authors do not have quantitative evidence of this, it does seem there has been an increased number of events in recent years. This may be due to loss of institutional knowledge, mining in more challenging areas, or simply an increase in localized variation. This paper will describe some of the issues we have seen and what the causes of failure were. It becomes clear that avoiding similar incidents in the future requires on-going observation and inspection of active highwalls and spoil benches to try and identify local variability and impact on mining. The information can proactively be used to update stability modeling of any concerning issues to determine likelihood of problems and to develop solutions.

As manufacturers and mine operators develop and implement proximity detection systems (PDSs), they need to be mindful of the systems’ compatibility with mineworkers’ tasks, and possible unintended consequences. Researchers at the U.S. National Institute for Occupational Safety and Health (NIOSH) interviewed mineworkers at mine sites that currently use or previously have used PDSs on mobile equipment, including shuttle cars, battery haulers and scoops. Mineworkers reported that mobile PDSs affect loading, tramming, section setup, maintenance and general work on the section. Mineworkers discussed the operational effects and increased burden, exposure and risk. Mineworkers also suggested that improved system task compatibility, training, logistics and PDS performance might help address these issues. Manufacturers and mine operators implementing this or similar technologies may also consider mitigating task incompatibilities up front, performing additional site-specific usability testing and restricting the use cases of the system to improve performance.

Nearly every community in the United States is dependent on aggregate (sand, gravel, and crushed stone) resources to build and maintain its infrastructure. Unfortunately, developing aggregate resources to meet societal needs causes environmental impacts. Most environmental impacts associated with aggregate mining are benign. Extracting aggregate seldom produces acid mine drainage or other toxic effects commonly associated with mining of metallic or energy resources. The most obvious environmental impact of aggregate mining is the conversion of land use, most likely from undeveloped or agricultural land use, to a hole in the ground. This major impact is accompanied by loss of habitat, noise, dust, blasting effects, erosion, sedimentation, and changes to the visual scene. Some of the impacts are short-lived, and most are easy to predict and easy to observe. Most impacts can be controlled, mitigated, or kept at tolerable levels and can be restricted to the immediate vicinity of the aggregate operation by employing responsible operating practices and available technology. The intensity of environmental impacts generated as a result of mining are determined in large part by the geologic characteristics of aggregate deposits (geomorphology, geometry, and physical and chemical properties). Mining deposits that are too thin, or contain too much unsuitable material, results in the generation of excessively large mined areas and large amounts of waste material. Mining aggregate can lead to serious environmental impacts in some situations. Some geologic environments such as active stream channels, slide-prone areas, and karst terrain are dynamic and respond rapidly to outside stimuli including aggregate mining. Some geomorphic areas and (or) ecosystems underlain with aggregate serve as habitat for rare or endangered species. Similarly, some geomorphic features are themselves rare examples of geologic phenomena or processes. Mining aggregate might be acceptable in some of these areas, but should be conducted only after careful consideration, and then only with extreme prudence. Failure to do so can lead to serious, long-lasting, and irreversible environmental consequences, either in the vicinity of the site or at locations distant from the site. Environmental impacts caused by irresponsible aggregate mining can compromise mining in an entire region.

INTRODUCTION The decontamination of the former Shiprock uranium millsite and the interim stabilization of its tailings piles began in March 1974, and ended in June 1978. Personnel monitoring for whole body gamma ray exposure was conducted for selected individuals working at the mill site throughout most of this period. The millsite and exposure conditions are briefly described to develop a basis for interpretation of the exposure data. Millsite The Shiprock uranium millsite is located in the community of Shiprock, New Mexico on a bench overlooking the San Juan River (Figure 1). Both Shiprock and the millsite are located on the Navajo Indian Reservation. About 1.5 million tons of tailings were produced on the millsite during its operation from 1954 to 1963. The tailings were pulped with waste process fluids and water, and discharged to form two tailings piles. The piles (ponds, dams) were formed with earth starter dikes and the dikes were then raised using the separated sand fraction of the tailings. The slime fraction of the tailings were discharged into the diked impoundment. The mill was shut down and partially dismantled before the lease expired in 1973, and the remainder of the mill and tailings reverted back to the Navajo Tribe which was the lessor. Portions of the millsite were then occupied by the Navajo Engineering and Construction Authority (NECA), a tribal enterprise. In addition to its regular activities, NECA established an on-site training school for heavy equipment operators. The trainees principally used the south tailings pile as a practice area and spread the tailings into a 10 hectare row of raffinate ponds located along the southwest side of the millsite. Overall, the training activities inceased the effective area of the tailings piles from 20 to 35 hectares. Another 56 hectares were contaminated with wind and water eroded tailings. Exposure Conditions Persons decontaminating a millsite may be subject to radiation exposures from several sources. Only whole body gamma exposures are discussed in this report. These exposures are arbitrarily divided into three levels: high, intermediate, and low. The levels are related to areas in which the decontamination work was being done and have no connotation concerning imminent hazards. High exposures would result when persons were working with raw tailings, and intermediate exposures would occur when persons were working in the ore storage and mill yards. Low exposures would result from working in areas where surface contamination exists from wind and water erosion. [ ] The millsite and its contaminated environs were divided into major areas to facilitate the decontamination work (Figure 2). Nickel is a metal whose workability and mechanical strength at high temperatures and in corrosive environments makes it an indispensable alloying element for the realization of stainless steel, specialty steel, super-alloys, rechargeable batteries and electroplating. Because its main fields of application are key to the development of industry and, thus, to society, nickel has recently been recognized as a potentially critical mineral, despite its abundant reserves. The purpose of this paper is the creation of possible case scenarios determined by factors and events that, in the medium to long term, could change the current structure of the nickel market on the demand and/or the supply side. Four scenarios have been determined by considering a demand variation due to the occurrence of a natural disaster and an aerospace plan implementation and taking into account the resource nationalism and the skills shortage as supply varying factors. Through the creation of a georeferenced global nickel database, the paper proposes supply strategies related to the four scenarios for each top nickel consumer: China, India, European Union, United States and Japan.

"INTRODUCTION Mining and processing of sulfide ore bodies has the potential to solubilize sulfate. Gypsum in the host rock, as well as oxidation of sulfides during milling and processing can solubilize sulfate. Acid rock drainage (ARD) also has the potential to generate waters high in sulfate. Even after treatment of the ARD with lime, the treated water can have sulfate present in gypsum saturation levels. Most mine-sites reuse sulfate impacted water but as a mine nears closure, reuse options may be limited and water treatment becomes an option. Furthermore, sulfate discharge requirements, particularly for anti-degredation narrative standards, can be very strict. Freeport has investigated many new technologies to economically remove sulfate from these types of water. A Dutch company, Paques B.V. developed one of these technologies and it utilized biological reactors to convert sulfate into elemental sulfur in a 2-step process. In 1992 the first industrial reference of the SULFATEQTM technology was commissioned at the Nystar Budel zinc refinery in the Netherlands. PILOT PLANT TECHNOLOGY AND DESCRIPTION As shown in Figure 1, the plant contains several process steps, which can mainly be divided into the following sections: 1. Anaerobic biological system in which sulfate is reduced to hydrogen sulfide by sulfate reducing bacteria. 2. Aerobic biological system in which hydrogen sulfide is oxidized to elemental sulfur by sulfide oxidizing bacteria. 3. Solid/liquid separation in which sulfur, calcium carbonate and biomass solids are separated and dewatered. Sulfate impacted ground water is pumped to the feed water tank through a plate and frame heat exchanger to maintain the solution temperature around 95°F. A custom mix of micronutrients is dosed to the feed tank. This nutrient mixture provides essential elements for the growth of anaerobic and aerobic biomass. Urea is added to the feed tank and provides the required nitrogen source to the biomasses. The pretreated feed water is pumped into the anaerobic reactor. The reactor works on the gas lift principle. Sulfate reducing bacteria utilize hydrogen gas as electron donors and reduce sulfate to hydrogen sulfide. This reaction increases the alkalinity of the solution. Carbon dioxide gas is added in order to control the pH within working range of the reactor. Due to the low solubility of the hydrogen gas, the anaerobic gas mixture is recycled through the system. The gas mixture recycle also provides the gas lift for mixing within the anaerobic reactor."

Strip mine reclamation Fs the process of restoring the land affected by the mining process to its most productive use. This can be timber production, pasture, crop land, wildlife and/or recreational use. The mining companies must determine, through the advice of their technicians, what the most advantageous use of the land will be. If the Company does not own the surface, the owner or owners must be contacted to determine their desires as to how the land should be reclaimed. Many times, in making the plans to restore an area with vegetative cover, the watershed and the quality of the water in the area is overlooked. The water itself must be an integral part of the reclamation plan. Many lakes and/or pits can be created with proper planning. In areas in the Midwest, where lakes are a scarcity, these strip mine lakes can become storage reservoirs for large amounts of water, They can help control runoff and low flow augmentation. The strip mining operation will affect the watershed regardless of whether a reclamation plan in made or not. It is up to the reclamation technician to see that the plan benefits the watershed instead of affecting it adversely. This can be done during the operation by intercepting the water before Pt enters the active pit. Diversion ditches above the highwall will handle the runoff water from the watershed. Water that does gain entry into the pit should be removed as quickly as possible. If the rules and regulations adopted by the Ohio River Valley Sanitation Commission in Resolution 5-60 are followed, water encountered during the operation can be handled with little or no adverse effect to the receiving watershed.

Epidote is a common hydrothermal alteration product in many copper deposits of the southwestern United States. In many of these deposits epidote, along with calcite and chlorite, generally characterize a distal or halo propylitic alteration assemblage, but the mineral can occur within the central potassic alteration zone as well. Epidote is also a common alteration mineral in deposits formed in calcareous host rocks -- the skarn or pyrometasomatic ore bodies. Within the past 15 years, studies of the major and trace element composition of other alteration phases, principally biotite, associated with base metal ore deposits have demonstrated that some hydrothermal alteration minerals are compositional distinct from their igneous or metamorphic counterparts: However, the use of major and minor element content to identify and zero in on mineral¬ized areas does not appear to be very promising. Little work has been published upon the geochemistry of epidote from this standpoint and the results of my work suggest that a similar conclusion can be applied to epidote. My work (Fellows, 1976) suggests that epidote minerals in hydrothermal alteration suites from porphyry copper deposits in the southwestern United States are generally iron-rich rather than aluminum-rich. As a group, these alteration minerals differ compositionally from epidotes of regional metamorphic terrains. I ascribe these differences to the variations in the oxidation character of the respective environments. However, it appears as though the use of major element compositional variations of epidotes as an exploration tool is severely limited. Epidote is a complex calcium-aluminum silicate. "INTRODUCTIONThe Port of Miami Tunnel (POMT), designed and constructed by Bouygues Civil Works Florida between 2009 and 2014, was a Public Private Partnership between the Miami Access Tunnel Concessionaire, Florida Department of Transport, Miami-Dade County and the City of Miami. The project comprises dual 11.3m internal diameter, 1.27km long, twin lane road tunnels running between Watson and Dodge islands and under the main shipping channel in Biscayne Bay (Figure 1).The POMT was a unique project which embodied many technical firsts and involved the first large diameter tunnels constructed through Florida’s challenging sedimentary carbonate strata. At the outset, a comprehensive ground investigation was performed, using both conventional and less conventional investigation techniques, to characterise the highly heterogeneous ground conditions.The findings of the investigation had a major impact on the tunnelling methods, triggering a series of mitigation works to ensure that the tunnels could be excavated safely and effectively. The mitigations included modifications to the already designed Tunnel Boring Machine (TBM), to facilitate an innovative excavation process, and a unique grouting campaign (Storry et. al. 2013a). The project was completed and opened to traffic in August, 2014 and has significantly alleviated traffic congestion in Downtown Miami.GEOLOGICAL CONTEXTThe geological conditions at the project site consist of carbonate sediments which can be divided into distinct geologic units; the Miami Limestone Formation (Layers S3, S4), the Fort Thompson Formation (Layer S5), the Anastasia Formation (Layer S6), the Key Largo Formation (Layer S7) and the Tamiami Formation (Layer S8). Multiple changes in sea level over a relatively short geologic time scale have resulted in a heterogeneous profile consisting of interbedded sedimentary rocks and sediments, which vary widely, both vertically and laterally (Figure 2)."

"Thousands of years ago large glaciers carved much of the landscape in Puget Sound, depositing abrasive and granular soils including cobbles and boulders along with layers of clay and sand. Tunneling in this geology – common throughout much of the northern and Midwestern U.S. – is challenging and can be unpredictable. The use of pressurized face tunneling, most commonly with EPBs and slurry type machines, has made excavation in this geology more efficient, but difficulties still remain. Through analysis of recent projects in Seattle, Washington, USA, the authors draw conclusions as to the best TBM designs and operational parameters for this variable, abrasive and often difficult ground. Performance data is analyzed with an eye towards advancements that could further improve TBM tunneling in glacially deposited soils. INTRODUCTION Over the past several ice ages, extensive glaciers reaching across much of North America transported large amounts of soil and rock as they moved across the land. The substantial weight of the ice sheets mixed together a wide range of soil types along with a variety of rocks and boulders of all sizes. Many rock formations were reduced to pebbles or particles containing highly abrasive characteristics. Any boulders able to survive were generally comprised of harder materials which were scattered throughout the soil. This highly variable mixture of abrasive soils and high strength boulders can be found in many areas across the Puget Sound and other regions of the country. Wherever they are encountered, they often create a difficult and unpredictable mining environment for both equipment design and operation. Modern TBMs are optimized early in the design process for specific types of geology, and unexpected conditions can require extensive modifications. In addition, several operational parameters need to be adjusted to balance ground characteristics, and advance rates can be significantly affected in mixed and rapidly changing soil conditions. Both EPB and slurry machines can be used successfully in these conditions, provided their respective operating criteria are met. Ideally, an EPB is operated with a relatively thick muck consistency, which accommodates moderate changes in soil permeability and maintains a reliable pressure differential through the screw conveyor. However, this also causes higher wear on rotating components and requires more energy at the cutterhead. Alternatively, slurry machines typically operate best with a more fluid muck consistency that can be easily pumped through the extensive piping system. This tends to reduce the wear on the cutterhead and the power requirements of the cutterhead drive system, but also makes the machine more sensitive to changing soil conditions. Generally, the slurry piping system is also more capable of controlling high face pressures, although the screw conveyor of an EPB can also be designed to accommodate most high-pressure conditions."

The Iron Ore Company of Canada mines, processes and ships crude iron ore, concentrate and pellets from the rich ore bodies of the Labrador Trough area in the extreme north-eastern part of Canada, some five hundred miles from Montreal (see figure 1). There are three main sites of activity. At Schefferville, approximately 12 million tons a year of crude ore (chiefly limonite) are mined, crushed, screened and shipped to Sept-Iles. At Labrador City, 40 million tons of specular hematite are mined annually for processing into 17 million tons of concentrate. Of this, 9 million tons are converted into pellets. All product 1s shipped to Sept-Iles. At Sept-Iles, on the north coast of the St. Lawrence, a six million ton per year concentrator and pellet plant process much of the Scheffervllle ore into high-grade pellets. Also at Sept-Iles are the company's administration offices stockpiles and shipping facilities. The Terminal facilities can berth and load a 250,000 ton bulk carrier at 19,000 tons per hour.

A Mark IV surface force apparatus (SF A) was used to conduct direct force measurements in dodecylamine hydrogenchloride collector solution between mica surfaces at varying pHs. It has been found that the long-range hydrophobic forces reach a maximum at pH 9.5, which also corresponds to the maxima attained by the contact angle and flotation recovery of quartz. The charge densities are comparable on both mica and quartz surfaces (0.40-0.48 run2), making it possible to draw conclusions on the flotation of quartz from the direct force measurements conducted on mica. Therefore, it may be suggested that the maximum flotation recovery of quartz m the range of pH 8.0-10.3 may be attributed to the appearance of long-range hydrophobic force, which in turn can be related to the formation of a close-packed monolayer (or hemimicelle) in the presence of neutral amines formed as a result of hydrolysis.

A majority of continuous mining machines employ a water spray system and a machine-mounted flooded-bed scrubber to suppress and capture dust during coal mining. These machine-mounted dust control systems must be designed to function within the localized face ventilation system at the mining section to control both dust and methane. Spray systems can impede or improve the scrubber effectiveness in controlling dust or methane at the mining face. Laboratory experiments were conducted to examine the effect of spray type, spray pressure, machine body blocking sprays and scrubber airflow on dust and gas levels, while using a 12.2-m (40-ft) exhaust ventilation curtain setback from the face. These experiments were conducted with the mining machine positioned at the end of a simulated 6.1-m (20-ft) sump and slab cut. Results indicate that the hollow cone nozzles with blocking sprays best complement the flooded-bed scrubber performance in an exhaust ventilation system. This external spray system notably reduced dust and gas levels on the off-curtain side of the mining machine for both the sump and slab cut compared to the flat spray nozzles. Higher scrubber airflows reduced dust and gas levels on the curtain side and in the return of the continuous mining machine. The remote operator position, located on the off-curtain side and parallel to the inlet end of the exhaust curtain, sustained the most stable and lowest dust levels around the mining machine.

"INTRODUCTIONThe Port of Miami Tunnel (POMT), designed and constructed by Bouygues Civil Works Florida between 2009 and 2014, was a Public Private Partnership between the Miami Access Tunnel Concessionaire, Florida Department of Transport, Miami-Dade County and the City of Miami. The project comprises dual 11.3m internal diameter, 1.27km long, twin lane road tunnels running between Watson and Dodge islands under the main shipping channel in Biscayne Bay. Five cross passages (CPs), spaced at 200m centre to centre, provide emergency access between the two tunnels, as shown in Figure 1.The CPs were constructed by open-face excavation methods but the particular geological conditions at the project site (loose and variable carbonate sedimentary strata with very high permeability) required specific ground treatment solutions to provide safe excavation conditions and to ensure the long term serviceability of the permanent works construction. Where access allowed, ground treatment was performed from the ground surface using deep-mixing techniques; however, at two locations (CP2 and CP3) surface access was restricted and ground treatment by freezing, performed from the tunnels, was required. The CPs are 12.3m long with an excavation diameter of 5.8m and are located up to 30m below the water table partly or wholly within the Key Largo limestone (termed Layer S7 in the ground model). Layer S7 is a coralline limestone having a metastable honeycomb structure and high variable porosity. At CP2 the upper portion of the excavation was within the overlying Anastasia Formation limestone (Layer S6), comprising a highly permeable coquina. The geological profile along the project is shown in Figure 2.This paper presents aspects of the freeze design and the risk mitigation necessary to successfully achieve the construction of the CPs in the unique geological conditions."

The intensive use of computers for mineral application at Serrana's phosphate mine in Jacupiranga, State of Sao Paulo, Brazil, began in the late seventies. The early hardware and software available are described in sufficient detail to allow comparisons between that solution and the new one, based on a personal computer and a new software package - PC MINE SYSTEM from GEMCOM SERVICES INC - that provides full color graphics capabilities plus mine design and planning tools. The process needed for adaptation to the new technology' and its impact on SERRANA S.A. DE MINERACAO are described. Finally, future enhancements to the System and mine control and planning are focused.

Coal workers’ pneumoconiosis (CWP), commonly known as black lung, is caused by the inhalation of respirable coal mine dust and is a disabling and potentially fatal lung disease with no cure. Historically, CWP has taken a tremendous human and financial toll on the U.S. coal mining industry. Recent health surveillance data indicate that CWP continues to occur at elevated levels. Respirable coal dust exposure must be controlled to prevent the development of CWP. The Pittsburgh Mining Research Division of the U.S. National Institute for Occupational Safety and Health (NIOSH) conducts laboratory and mine-site research to identify control technologies that can be used to successfully reduce respirable dust levels. Various technologies, using multiple methods of control, can be applied to reduce dust levels. An overview of CWP’s impact and a general methodology for controlling respirable dust in underground coal mines are discussed in this paper.

Nalco Chemical Company and a North Carolina Phosphate operation have formed a successful supplier/customer team effort that has resulted in major improvements in the operation of the clay thickening circuit at the Aurora, North Carolina concentrator. A Nalco OPTICUS® Automated Process Control System for thickener and flocculant control was installed in 1994. The paper will discuss in detail the development and refinement of the OPTICUS system over the past three years. The paper will survey the development and networking of process control for monitoring, controlling and operating four 325-foot Dorr-Oliver thickeners, three 80-foot high-rate Enviro-Clear thickeners and control links to the facility's clay/gypsum blending operation.

Wastewater treatment systems, both industrial and municipal, produce large quantities of sludge which require disposal. Sludge disposal poses significant environmental liabilities, logistical problems, and economic burdens. Minergy Corporation has developed and implemented several new technologies for the recycling of such high volume wastes as sludge, ash, and foundry sand. These technologies perform mineral recovery from the waste material, converting them into construction material and industrial feed stocks which are inert, marketable products. With a continuously operating processing system installed at the waste source, these technologies reduce handling, eliminate downstream liabilities, and reduce disposal costs.
