Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement

When the writers were asked to prepare a paper on this subject for this meeting of the Institute there was some question in our minds as to what to say that would be of interest to the members. You all know that Utah has some wonderful seams of good coal, on which have been opened some of the most modern mines in the United States, and that her coal operators have been putting forth many efforts to reduce losses due to accidents as well as disease. While I believe that the physical condition of Utah's mines is as good as in any other state we are not unaware of the fact that a great deal can still be done and we are always willing to frankly discuss the accident situation in the state. Dr. Murray has assembled some interesting figures showing the monetary loss due to accidents and disease which I will will proceed to give you to show the necessity of continued efforts in welfare work regardless of humane considerations.

To make the statement that coal mine operation has been entirely revolutionized within the last ten years is a mild statement. This has been entirely due, of course, to the almost universal introduction of mechanical loading in coal mines. Under the old system of contract loading too much was left to the individual miner's judgment and willingness to do the right thing. Each miner regarded the place in which he worked as "his place," and depending upon the judgment and ability of the miner, conditions as found in these places largely reflected that man's individuality or personality. Many men kept their places well timbered and in such condition that they were not only able to load their turn but were able to take advantage of any surplus cars that might be available in their particular entry. These men were often regarded as "coal hogs." However, these men's places were usually found to be well timbered and well maintained. Supervision under this old system in a strict sense of the word amounted to casual visits to the man's working place by the foreman or his assistant once each day as required by law.

[Mr. Brown did not make his speech available for reprint.] Productivity is the Answer - Always Was; Always Will Be When Bill Balaz invited me to speak here this morning, he asked me to examine the three most important issues Consol will face over the coming decade. There are more than three. But the more I thought about that question, the more I realized all our issues come down to only one. As I reviewed the U.S. coal industry over the past ten years, and as I thought ahead into the year2000, one thing stood out. Not markets. Not government regulations. Not record tonnages. But productivity. The recent history of American coal is a tale of productivity improvement. It is a story that needs telling. And understanding. Not just for the good of the coal industry, but for the benefit of the American economy. Americans today do not appreciate the value of productivity growth. I don't say that lightly. As I review recent debate over American industrial competitiveness, as I look at certain legislative proposals, I see disturbing trends. It's not that anyone is against productivity per se. But many people seem to fear the very processes that enhance productivity. Twentieth century America enjoyed unprecedented growth in productivity. And in personal standards- of-living. Those two go together. This century has been one of change. Demographics. Education. And technology. Many new industries-cable television, computer services, telecommunications, for example-have grown from mere dreams to billion- dollar enterprises employing tens-of-thousands. And some older industries have declined. The nature of work has changed-from manual work to know- ledge work. From agriculture, to manufacturing, to services. In the mid-1960s. AT&T employed more than one million people. These were not high-paying jobs: telephone operators, linemen and equipment assemblers. Today, the successor Bell companies and their new competitors employ no more than a few hundred thousand. Because of automation. Because of enormous gains in employee productivity.

Grant, Assistant to Manager of Navajo Mine, Utah International, Inc., Fruitland, New Mexico. Mr. Grant was delegated to open the meeting due to the untimely death of Past President A. F. Geiger. Mr. Grant introduced President Roy Coulson, President and Director of the Kemmerer and Gunn-Quealy Coal Companies, Frontier, Wymoing. MR. MARGOLF: Thank you very, very much Harris. There's sure a lot there to think about in terms, of our image, particularly. I think we should keep' in mind what Harris said about our history not being monolithic. Therefore our image can only be that, which is reflecting the weakest link in our industry and I think that's a burden on all of us. Perhaps to do some policing amongst ourselves to try to improve whatever might be our weakest link and thereby elevate our entire industry. Our third speaker this afternoon is another good friend of mine of long standing and I am very pleased to be able to introduce to the Rocky Mountain Coal Mining Institute Bob Golten. Bob is a graduate of the University of Michigan with a degree in Economics and Harvard Law School. His professional experience encompasses private practice in Chicago where he was born and in the federal government as a public defender in Washington, D.C. and in the Department of Justice as a tax , attorney. Some of us have come to know Bob more in his present role as the senior counsel for the I National Wildlife Federation. He's also Adjoint Professor of Law and Director of the National Wildlife Federation Resource Clinic, University of Colorado. Boulder campus. In addition, Bob has served with the Rocky Mountain Center on Environment as one of its directors for a number of years. He's very active in a number of areas that are not only civic but he does reflect what I would present by way of introduction as a perspective

Mr. Chairman and Gentlemen: At the request of our Secretary, Mr. Shubart, I am pleased to present the following brief discussion of the Alamo Washery. In order to insure an excellent and uniform preparation of nut coal, the Alamo Coal Company erected last year a modern washery at a cost of about $50,000, in which, since the completion last December, all of the nut coal shipped from the Alamo Mine, has been washed. In part of the workings of the Alamo Mine, the coal is overlaid by a lenticular strata of slate, which invariably falls when the coal is shot down and breaks for the most part into fragments of such size as pass through three-inch round perforations, and are retained on plates having one and a fourth inch round holes with the nut coal. This "draw slate" comprises the principal impurity in the Alamo coal, and to remove it, some bone and a few small fragments of sandstone from the roof and floor, the washery was designed and erected. Railroads, attempting to increase their tonnage without adding new lines, have for some time realized there is a definite relationship between increasd haulage efficiency, and constant communication with each moving unit that operates along their roadbeds. Elaborate radio communication equipment has been devised for this purpose, and is rapidly being installed. Coal mines are faced with similar haulage problems and have sought this constant contact through the use of telephone systems, and dispatcher stations. Often the fixed mine telephone system is unsatisfactory, since the desired person is not present at the phone when needed. Dispatchers lose contact with a motorman as soon as he is out of sight, until he calls in from another telephone. The recently developed frequency-modelated radio phone which makes use of the trolleywire network in a mine as a carrying medium, permits instant and continuous contact between dispatcher and locomotives. The motorman can immediately contact another motor or the dispatcher regardless, of his motor's position on the trollywire system, whether moving or standing.

The Hiawatha pitmouth is located at the head of the middle fork of Miller creek, at an altitude of approximately 8,100 feet. The coal is lowered to the tipple down a gravity tram two miles long, in 16 car trips which carry about 60 tons net. The average running time of the trip is about nine minutes. At the bottom of the tram there are two tracks for the loads and two for the empties. The trip, after being cut off the rope, is dropped by gravity onto a feeder, where the cars are uncoupled and fed one at a. time across the pitcar scales and into the dump. The dump is of the full revolution type, friction driven. On passing out of the dump the cars are returned by a kickback onto the empty car haul. They are caught at the bottom by a brake which consists of a pair of steel squeeze blocks operated by heavy springs. The empties are elevated to the double tracks, where the trips are made up. The feeder, scales, dump and empty car haul are all built on the solid ground of the hillside instead of being incorporated in one structure with the screening plant. The coal is dumped into a small hopper with a capacity of about 15 tons, whence it is fed by a reciprocating feeder onto a scraper conveyor which takes the coal over to the screening plant, a distance of 120 feet. This conveyor is 48 inches wide and travels at 120 feet per minute. The screen itself is interesting. It is of the Marcus Horizontal type.
