The Wednesday morning session was called to order by President Lewis at 9:00 am, He called on Bob Wilson to conduct the business meeting. In the absence of any of the Auditing Committee, the treasurer's report, which had previously been examined by them was read. He asked for a motion of approval. It was made, granted and approved. The Resolution Committee was called on to make its report. Mr. Shirl McArthur read the following report: (1) "WHEREAS, the Pneumoconiosis or Black Lung provisions of the Federal Coal Mine Health and Safety Act which have been construed and administered largely as a welfare program rather than as just compensation for occupational disease has resulted in enormous expenditures and commitments from the Federal Treasury, WHEREAS, the imposition of the full cost of future welfare oriented black lung awards on coal operators without regard to workmen's compensation standards and without due process in granting benefits is grossly unfair and discriminatory to the coal operator and places an undue burden on the present cost of coal,

CHAIRMAN I. N. BAYLESS: Will you come to order, gentlemen? They told me that you had a very interesting meeting yesterday and a good time last night. Our program is rather long this morning, and I am not going to take up any of your time, as we got started a little late. I will ask Mr. Marchant to make a few announcements. (Announcements.) SECRETARY MARCHANT: I just noticed in this morning's paper a rather serious accident at Hobbs, New Mexico, in which George Kaseman, a former President of the Institute, and a loyal member ever since its organization, was killed. I think that this meeting should go on record and prepare a resolution of condolence, etc., and with your per- mission we will have the Committee on Resolutions do that. I assume that will be all right. CHAIRMAN BAYLESS: Our first paper and discussion this morning will be Education of the Miner, by Thomas Allen, Chief Coal Mine Inspector of Colorado. Mr. Allen.

President Ziolkowski called the meeting to order at 9:30 a.m. He called on the Auditing Committee to give its report. Jack Leech read the report and asked that it be approved. A motion was made, seconded and approved. The Resolution Committee was asked to give its report. The following was submitted: (1) RESOLVED, WHEREAS, in the year since the last convention of The Rocky Mountain Coal Mining Institute, the Institute and the Coal Mining Industry have suffered the loss through death of the services of the following: James A. Flint John L. Paynich Joseph E. Ward NOW, THEREFORE, BE IT RESOLVED, that there be spread upon the minutes of The Rocky Mountain Coal Mining Institute recognition of the passing of these members, who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere regard and sympathy of the members of the Institute.

Thank you President Nielsen, and thank you ladies and gentlemen of the Rocky Mountain Coal Mining Institute. I'm glad you asked me to join you a second time. The setting here at Tamarron is splendid. A few days ago the National Coal Association held its Diamond Anniversary meeting at the Broadmoor in Colorado Springs. Although NCA is junior to this Institute in years, we do try to keep up. Our speakers looked at 1992 as the possible eve of a new era in world history - a pivotal year. It offers the opportunity to replace a dying era of war and tension with a new one of peace and prosperity built on economic cooperation and trade and, of course, energy to uphold all four - trade, cooperation, prosperity and peace. The Persian Gulf War was only a sample of what can happen to the other four if the energy isn't there. And so I especially like your theme: Energizing America With Coal. It is most pertinent. I was invited to discuss the National Energy Policy and its impact on coal and I intend to do that. But more important is coal's impact on the Nation and the world and so 1 shall discuss that as well. This year - 1992 -also will be pivotal in the Nation's politics.

Overview: Public awareness of the drug abuse problem within the government and industry is growing each day. The economic cost to industry is staggering-estimated to be more than $50 billion per year. Employee drug testing programs are one way to combat the problem, yet they are not without legal and scientic pitfalls. Some of the issues and needs that should be considered before implementing or continuing a testing program are: Why test? What do you test for? Are the results accurate? What impact will the new Federal Rules have? Accuracy of the testing continues to be controversial, especially when the "poppy-seed" and "cold-medications" issues are mentioned. The new Federal laboratory certification program which is about to start, should reduce or eliminate the question of lab error. Determination of on the job impairment will, however, continue to be a problem.

MORTENSEN: On behalf of the Rocky Mountain Coal Mining Institute, I take great plea¬sure in saying good morning to you at Vail. With a few clouds in the sky, at least we won't get sunburned. We won't have to worry about our kids in the swimming pool, perhaps. It is delightful for me to have been able to have represented the Rocky Mountain Coal Mining Institute for the year 1982-1983. This has been our 71st year and this is our 79th meeting. In recognizing the attendance here, that dinner we had last night, and some of our entertainment must have gotten to some of us, or it is a little early. But I'm sure as the day goes on, and with the speakers outlined, it will be very beneficial for those who do attend. We do appreciate your attendance. I'd first like to make an introduction of our head table. Doris Finnie, she is our executive secretary. As most of you are aware, Gussie Whiteside retired as secretary. This will be the first time since the Institute started that there has not been a Whiteside present at one of our conventions. I'm sure Gussie would appreciate any calls or letters that any of you would care to make to her. Doris, I might add, has been a great help to me and all of the people who have been working on the program for the Institute this past year. There's been lots of reorganization and we are very pleased with Doris's ability to take hold from Gussie without any waves. Much credit must be given to you Doris for this and we do appreciate the help you have given us and believe me she has kept us out of trouble. Next, we have Art Neill. He is our vice president of the Institute from Montana and he also works with Western Energy Company. We appreciate the help that all of these session leaders and chairmen give to us. We have other names on the head table, but they will fill in as the morning goes on, so we won't bother you with any of those at this time. To set the stage for business, first I would like to call on Doris for a motion to approve the minutes of last year. MS. FINNIE: Thank you, Vernal. Mr. President, I suggest that the reading of the minutes be dispensed with and that the members refer to pages 9 through 80 of the Proceedings for the 78th regular meeting of RMCMI, as published MR. MORTENSEN: Thank you, Doris. Do we have a motion to so approve? MR. LINVILLE: I so move. MR. MORTENSEN: Loren Linville so approved. Do we have a second? MR. GARR: Second. MR. Since the day when one of the most progressive of our flat-head for- bears used a pry pole to loosen large rocks to crash upon the head of his, enemy, thereafter making notes of his performance on tablets of stone, the arts of mechanicalization have developed and progressed to the benefit of mankind. In the early coal pits of England the crudest of tools were wielded in the most slavish of toil to win a very small amount of product. In our own country it is but a few years since coal was hewn by negro slaves in the mines of the southland. The past thirty years have brought the use of the mining machine, power drill and locomotive, and we now stand on the brink of the coal mining era that will change the toiler of the mines into a skilled mechanic and render far more safe the winning of the fuel necessary to the nation's need. The ingenuity of our citizens has made it imperative that coal be produced at a lesser cost. Vast supplies of fuel oil have been developed; enormous resources in water power are turning the wheels of many mills and, most commendable but distressing to the coa.1 producers, the high price of coal has resulted in efforts and accomplishment in fuel economies unheard of a short five years ago. The railroads of the United States alone in 1924 accomplished more hauling with $30,000,000 less in coal bills than in 1923. The loading of coal by machines has been under investigation and trial for some time past and in an effort to have its men informed of the practice of the eastern coal fields, The Union Pacific Coal Company sent the writer through a number of states to view as many operations as possible. Notes were taken of machines and processes seen and time was spent with engineers of the various coal companies; also with the United States Bureau of Mines Engineers, particularly Mr. Edwin H. Johnson, who devoted one year to the most careful study of the mechanical loading of coal. The writer wishes, at this time, to acknowledge the helpfulness of the information acquired through contact with Mr. Johnson.
