Boron has been used to produce nonaging low-carbon sheet steel. Retention of the necessary minimum amount of about 0.006 pet partially killed the steel. Amounts exceeding about 0.012 pet increased the degree of deoxidotion, piping tendencies, and possibility of hot tearing in primary rolling. Semikilled practice resulted in good ingot yields and satisfactory surface quality. Aluminum added with the boron provided a protective de-oxidizer. Good drawobility was indicated by performances of the steel in a limited number of deep-drawing trials. Some problems with hot-tearing and boron-analysis procedures were overcome. Metal lographically, the boron semikilled steels revealed some structures not usually found in plain low-carbon steels. IN 1943 Low and Gensamer1 reported that strain aging, which hardens and embrittles ordinary low-carbon rimmed steel, was due to nitrogen and carbon, and that oxygen played a relatively unimportant role. Since then, many investigators have substantiated their findings and indicated that nitrogen is particularly potent. Commercially, today's most widely produced non-aging sheet steels for deep drawing are either aluminum killed or vanadium rimmed types. The difference in deoxidation practice, alone, is evidence that oxygen is apparently not an important consideration in control of strain aging. The fact that nitrogen is important is apparent in the consideration that has been given, knowingly or unknowingly, to the amount combined with aluminum and vanadium. Patents were granted to Hayes and Griffis2 for the processing of aluminum-killed steel, and to Epstein" for the manufacture of vanadium rimmed material. Certain prescribed steps in producing these steels can be correlated with the formation of the respective nitrides within certain temperature ranges below the usual hot-finishing temperatures. The potential nonaging properties of either type can be reduced or suppressed by cooling too rapidly to permit the aluminum or vanadium to combine with nitrogen. Subsequent suberitical annealing of the cold-rolled strip, however, normally forms the nitrides and produces the resistance to strain aging. Titanium-killed nonaging steel, described by Comstock,1 forms a nitride in the molten state and is essentially nonaging throughout its processing. Zirconium-killed steel, which was investigated briefly by the author,* appeared to have similar nitride- forming characteristics. It is known" that chromium can produce nonaging rimmed steel, but relatively little is known of the potentialities of some of the other nitride-forming elements such as boron, silicon, columbium, and cerium. In attempting to develop a new nonaging cold-rolled sheet steel with good drawability, the following factors were considered pertinent. Such a steel would necessarily have a low carbon content and therefore have a relatively high degree of oxidation when made in a basic open-hearth furnace. If the denitriding element were also a deoxidizer, a part of the addition would be lost as oxide. The degree of deoxidation would determine whether the steel is rimmed, semikilled or killed, and also could be expected to have an important bearing on ingot yields and ultimate surface quality. Assuming that the pattern for the production of cold-rolled sheets would not be changed to any great extent, the nitride must form in the molten steel, in hot rolling, in subsequent cooling, or in annealing. The nitride, once formed, should resist dissociation and be stable in the final product. Usually an excess of the nitride-forming element is required to combine with sufficient nitrogen. If the element used is a strong ferrite strengthener, a small excess may markedly decrease drawability. With aluminum and vanadium, about 0.03 to 0.05 pct in the steel is preferred. Epstein has said" that about 0.30 pct chromium is required. Titanium nonaging steels are hard unless a sufficient amount (about 0.30 pct) is added also to combine with the carbon. The cost of the necessary amounts of these latter two elements discourages commercial acceptance. Silicon was considered as a possible nitride former, but since amounts up to 0.10 pct in rimmed and semikilled steels do not induce marked resistance to strain aging, larger amounts are apparently required, which would tend to harden and strengthen the ferrite. Of the other elements mentioned, all but boron are expensive heavy-metal elements. Stoichi-ometrically, almost an equal weight of boron would be required to combine with the nitrogen—-ordinarily about 0.003 to 0.006 pct in scrap-practice open-hearth steels. Boron is a slightly stronger deoxidizer than carbon but is less powerful than zirconium, aluminum, or titanium. Thus a rimmed-steel practice might be possible. There is much in the technical literature concerning the hardenability effects of minute amounts of boron in killed steels but very little about its behavior in low-carbon material—particularly as a ferrite strengthener. The available data indicated a need for better information concerning the effects of boron in low-carbon strip steels. Experimental Work Development of a Boron-Treated Nonaging Strip Steel—Initial attempts to produce a boron-rimmed strip steel employed 3-ton basic open-hearth heats which could be teemed into molds large enough to sustain a normal rimming action. Boron as ferro-boron was added to the ladle in small amounts because of the reported hot-short character of aluminum-killed heat-treating grades containing more than about 0.005 pct boron. THE Johnson award for 1926 was given to T. L. Joseph for his experimental work on blast-furnace operation. When the Bureau of Mines undertook its experimental blast-furnace investigation in 1919, a number of operators and metallurgists were doubtful as to the practicability of small-scale tests. Several pre-vious attempts, outside the Bureau, to operate small furnaces had been unsuccessful. However, pig iron was produced in three and four-ton furnaces during the first half of the nineteenth century. The operation of a small furnace did not therefore seem an impossible task. This point of view, together with a realization of the importance of problems connected with the pro-duction of pig iron, prompted the Bureau to undertake this work. Such problems as the feasibility of using charcoal briquets as a fuel, the application of oxygen enriched blast, and the use of new ores and raw ma-terials, in general, can be investigated only at consider-able cost on full sized furnaces, while with an experimental furnace they can be conducted at a com-paratively ;small, cost. The results of small-scale tests are sufficient to determine whether the problem. War-rants the expenditure required for a trial on a com-mercial scale. The accompanying photographs and chart show the various stages of the experimental furnace development. Some idea of the size and shape of furnaces which were tested can be had from the development chart. In oper-ating furnaces A to F, a series of changes were made to increase hearth temperature. Perhaps the most im-portant change was the position of the tuyeres with respect to the bottom of the hearth. The height of the tuyeres above the hearth was gradually increased and the hearth diameter decreased. It was shown by this series of furnaces that metal and slag are the chief source of heat supply to the crucible. For this reason there is a minimum rate at which these materials can be brought into the hearth of a small furnace if it is to function properly. The rate of slag "and metal fall are determined by the burden on the furnace and the rate of blowing. Due to lack of funds necessary to provide ample blowing equipment, hot blast stoves, essential mechani-cal features, and to meet operating expenses, it. was necessary to work with much smaller furnaces, such as G to K shown in the chart. The particular object of these tests was to study the extent to which reactions could be speeded up by decreasing the size of the stock. One decided change, noticed at the beginning of this series of tests, was the effect which coke size had on the production of a strongly reducing gas. Furnace G, 22 in. high, operating on coke crushed to pass 10 mesh, made a gas richer in carbon monoxide than did fur-naces A to F, operating on run-of-the-oven coke.

IN this paper, which I have the honor to submit to the Institute, it is my intention to treat especially of that part of the North Staffordshire field which converges to a long tongue in the neighborhood of Congleton, and which includes the villages of New Chapel, Ford Green, Norton, Biddulph, Bradley Green, Gillow Heath, and the immediate vicinity. My object is not so much to give a minute description of the geology or systems of mining and smelting, as by a general review, some idea of the extraordinary facilities for the production of excellent iron, which have enabled this district to maintain its position more successfully than any of its rivals against the late depression in trade. The North Staffordshire coal field has the Cheshire and Lancashire fields some thirty-five miles to the north, those of Derbyshire and Nottinghamshire forty miles to the east, those of South Staffordshire and Shropshire, about thirty miles to the south, and the Denbighshire and Flintshire fields some forty miles to the west. It is highly probable that the coal continues under the new red sandstone to the Western and Southern fields as the dips on both sides, and absence of large faults, make it impossible to come to any other conclusion. In a section of this coal field, from Chatterly to Whitfield, thirty-two workable seams of coal are shown, of an aggregate thickness of 130 feet, varying from 2 feet 6 inches to 7 feet, and thirteen seams of ironstone, 24 feet, averaging from 2 to 4 feet. All of these seams have been minutely described in a paper by Mr. Charles J. Homer, read in 1875 before the British Iron and Steel Institute. In the northern part, to which I especially wish to direct your attention, the beds lie in a V-shaped basin, the underlying millstone grit and Yoredale rocks rising and forming escarpments on either side of the valley containing the coal. Throughout this district, at the outcrop of the coal, there are indications of old workings. PHOSPHORUS combines with copper in various proportions, forming true alloys, some of which are of commercial importance. These materials find wide application as deoxidizers and as a means of introducing phosphorus into other alloys, as in phosphor-bronze. Phosphor-coppers containing 10 and 15 per cent. of phosphorus are the commercial grades that are most generally offered. Each has certain advantages when used in making other alloys. The 10 per cent. grade of phosphor-copper has an advantage over the 15 per cent. in that it has a much lower melting point and can be prepared by certain methods with a much lower loss in phosphorus. The 15 per cent. grade has the advantage of lower freight rates per unit of phosphorus and, by the method to be described, a uniform product can be prepared with practically no loss of phosphorus. Alloys of copper and phosphorus containing any desired percentage of phosphorus lower than 15 per cent. can be prepared by melting together the requisite amounts of copper and 15 per cent. phosphor-copper. Processes for making phosphor-copper may be divided into two classes as follows: (1) Those depending on the smelting of phosphate rock or superphosphate of calcium with copper or copper-bearing materials, and coal or other carbonaceous material; (2) those depending on the direct combination of metallic copper and elemental phosphorus. A number of formulas for preparing phosphor-copper according to the first method have been published. The Metal, Industry' gives-the following: Superphosphate of calcium, 60 lb.; granulated copper, 301b.; finely powdered coal, 10 lb. Similar formulas are given by Brannt2 and others, and detail 'variations are covered by patents, such as those of L A Jeffs3 and H A Webster.4

THE work herein reported shows that galena in certain organic solutions of fatty acids becomes coated with lead soaps, and that this coating is not only highly water-repellent but is also repellent to certain organic liquids, particularly those [ ] of high surface tension; i.e., nitrobenzene, diphenylmethane. WETTING PROPERTIES OF GALENA IN NONAQUEOUS FATTY ACID SOLUTIONS When a "captive bubble"1 is withdrawn from a polished, plane galena surface under a nitrobenzene solution of stearic acid, the air bubble shows a decided tendency to "cling" to the mineral surface. The contact angle, therefore, was greater than zero, although it was not large enough to be measured quantitatively by the captive-bubble method.* [ ] When pure nitrobenzene' was substituted for the nitrobenzene-stearic acid solution, no clinging of the bubble was observed; viz., contact angle = zero. Although the contact angle developed in air-galena-nitrobenzene-fatty acid solution was small, the organic solvent repellency of the galena surface was great enough to enable good recovery in a laboratory flotation cell.2 In Table I are given the results of flotation experiments using several different fatty acids dissolved in nitrobenzene.

Using specially del'eloped titanium nitride crucibles and a pressurized syslem, it has been possible to determine the solzibilitv of liquid calcium in liquid iron and iron-base alloys. At 2925°F the solubility is 0.032 wt pet Ca in pure iron. The solubility is increased by aluminum, carbon, nickel, and silicon additions, and lowered by additions of gold. An inflection in the calcium-solubility curve occurs as carbon is added to iron. At approximately 0.87 Wt pet Ca the CaC, phase replaces liquid calcium, and the calcium concentration de- creases as more carbon is added to the iron. The maximum solubility, 0.36 wt pet Ca, was obtained in iron containing 10.5 wt pet Si. The data have important implications regarding the use of calcium in process metallurgy, as well as providing an interesting test of theories of metallic solutions. Reasonably good agreement is found with theories of Alcock and Richardson and of Wagner, and criteria are suggested which permit these theories to be applied more readily to systems of this type. AT the present time relatively little is known about the factors influencing solubility in liquid metals. Information of this type is important for such matters as the control of impurity levels in liquid metals, the use of magnesium in ductile-iron production, and the use of liquid-metal alloys as fuels and coolants in nuclear power plants. One important example of restricted solubility concerns the extent to which liquid calcium will dissolve in liquid iron. This is a matter of considerable interest in view of the strong potential of calcium for removing certain impurities in steel,. as well as the ability of calcium to desulfurize, inoculate, and produce spheroidal graphite in cast irons.' Since ferrous materials normally contain other elements in addition to iron, the interactions of third elements with the Fe-Ca system are of interest. In view of the foregoing, this investigation was conducted to determine the solubility of liquid calcium in liquid iron and the effects of various third elements upon the solubility. For reasons of theoretical and engineering importance, the elements investigated were aluminum, carbon, gold, nickel, and silicon. Numerous attempts were made in the early part of the present century to determine the solubility of calcium in both liquid iron and steel, employing a variety of open-melt and closed bomb-type systems.2-4 From the results of these tests Wever concluded that calcium is insoluble in liquid and solid iron.5 These investigations were unsatisfactory in that they failed to insure the presence of a liquid layer

This paper presents a new technique for solving some of the partial differential equations that are commonly used in simulating reservoir performance. The results of applying this technique to a simple problem show that one obtains accurate pressure values near wells, as well as accurate pressure pdients, which can be explicitly calculated. The method is completely rigorous in that convergence of the discrete numerical solution to the continuous solution for both pressure and pressure gradient is established. High-order, piecewise-polynomial approximations are used near the wells where pressure gradients are steep, while low-order, piecewise-polynomial approximations are used elsewhere to reduce greatly the calculation time. This combination is shown to give a uniformly good approximation to the solution. These approximations, obtained by using a Galerkin process with suitable Hermite subspaces, are shown to be theoretically and numerically superior to the usual approximations obtained from standard finite-difference techniques. Not only are much greater accuracies obtained, but computer times are also greatly reduced. The application of this technique to multiphase flow problems (e.g., single well coning problems) would have considerable practical interest, but such extensions of this technique with full mathematical rigor have not been made as yet. However, the numerical methods presented here are general, and in principle extend to multidimensional, multiphase flow. Moreover, the preliminary results given in this paper are sufficiently encouraging that we feel the effort in attempting these extensions is justified. INTRODUCTION The problem of obtaining accurate pressure distributions and pressure gradients around wells is of considerable importance in the numerical simulation of reservoir performance. The most common approach to solving this problem is to use finite difference techniques (see McCarty and Barfield9 or Peaceman and Rachfordl0). This approach, however, has many disadvantages, the major one being that many grid points are generally necessary for accurately describing the pressure distribution and the pressure gradient around wells. This need for a fine grid results in large computer times and often in prohibitively high costs. Besides investigating the method of finite differences, some authors, such as Welge and weber17 and Roper, Merchant and Duvall,13 have considered a combination of analytical and numerical techniques with some success. These approaches, however, are all nonrigorous and quite often cannot even be applied. In this paper, we present a numerical formulation of high-order accuracy, based on the Galerkin method, for solving this problem. We treat here only the partial differential equation that describes steady-state, single-phase flow. However, the methods presented are general and in principle extend to multidimensional, multiphase flow. Specifically we treat special cases of the problem in two dimensions described by: where G is a rectangle (with sides parallel to the coordinate axis) with boundary ?G, ?/?n denotes the outward normal, and y and B are non-negative constants such that y + B > 0.

There has been considerable discussion of late as to the best method of determining the silver-contents of sulphides of silver resulting from the leaching of silver-ores, and also as to the relative merits of the crucible- and the scorification-method for the determination of the silver-contents of ores. Owing to the great depression in the silver-market, these are questions of considerable importance, at the present time, to both the producer and the smelter and refiner. In the hope of throwing some further light on this subject, the following experiments were recently made by the writer:

ALTHOUGH valuable information has been pub-lished on the important problems of slag losses with which every copper metallurgist has to contend, a great deal of money is still being wasted in copper smelters all over the world, through metal being irretrievably lost in reverberatory slags. When smelting a relatively low-grade pyritic concentrate together with a proportion of direct-smelting oxi- dized ore, as is done in Oroya, slag volumes are of necessity high, and even a relatively clean slag, say of 0.5 pct Cu, means a loss of almost 4 pct of all the copper charged, or over $1,000,000 annually at present output and prices. While it is known that such losses can often be reduced by allowing the slag time to settle, with or without addition of a reducing agent such as coal or pyrite, the facilities for such treatment are not always available in a plant of old design working to capacity under severe space limitations. Nor is it easy under such conditions to run large scale tests which may endanger the smooth flow of production for considerable periods without yielding

THE (110) [001] texture in silicon iron is of considerable interest both from the technological and scientific points of view. Its occurrence was reported more than 20 years ago.1-4 The texture develops by means of secondary re crystallizatjon5 and can be very strong, that is, greater than 90 pct alignment even thouh the primary re crystallization texture is weak or complex. This behavior is in contradistinction to the face-centered metals which develop their strong secondary recrystalliza-tion texture from a strong primary recrystalliza-tion texture.', The microstructural changes accompanying the (110) [001] texture formation in silicon iron are as follows: When properly prepared cold-rolled sheet (i.e., 0.015 in. thick) is annealed at about 800°C, primary recrystallization occurs and a fairly stable fine-grained primary recrystallized matrix of about 0.02-mm-diam grain size is produced. The material at this stage does not have the strong (110) [110] texture. As the temperature is raised to about 900°C, relatively large grains appear in the finegrained matrix and they grow at the expense of the smaller grains to many times the sheet thickness. In time the complete sample is consumed by these large grains. This process of the growth of relatively few grains (about one in 105 primary grains) at the expense of many grains is called secondary recrystallization. Since all the secondary grains are of essentially (110) [001.] orientation, the strong texture is developed by this secondary recrystallization process. Theories of the (110) [001] texture in polycrystal-line silicon iron have been proposed by Decker and Harker and by Dunn.Decker and Harker have shown that grains initially in the (110) [001] orientation will upon annealing after cold-rolling, re-crystallize back to the initial orientation. To account for the sharp texture in silicon iron they propose that (110) [001] grains become more highly strained than grains in other orientations and therefore recrystallize first. They are then the lowest energy grains and can consume their higher energy neighbors. Grains in orientations other than (110)

[ ] Professor Hibbard's paper presents a very interesting theory concerning the influence of texture on the tendency of brass tube to stress-corrosion crack. I should like to present the result of some work done in 1941 which may throw further light on the subject. In the first place, in regard to his review of the influences of grain boundaries, we not only confirmed the findings which he quoted, but also were unable to crack single crystals of beta brass in the standard mercurous nitrate test in 50 hr under loads up to 18,500 psi. Samples containing two or more crystals of beta brass always cracked at grain boundaries and generally followed the same pattern as for alpha brass, although cracking occurred sooner than in alpha brass under the same conditions. Such a specimen is shown in Fig 4. Second, at the possible risk of repetition, we should like to call attention to the reported role of grain size as influencing the tendency to stress-corrosion crack. This phenomenon, originally mentioned by Dr. Allan Morris in the Transactions, AIME, 1931, is illustrated in Fig 5, showing the effect of variations in grain size on the tendency of drawn brass wires to crack under load in the mercurous nitrate solution. This was taken from my work published in Proceedings A.S.T.M. 41, (1941), 905.

The mechanism of two-phase flow in porous media has been a subject of wide controversy. One of the properties essential for understanding the dynamic behavior of two-phase flow is relalive permeability. Relative permeability to a certain phase is defined as the ratio of the effective permeability of that phase to its permeability when it is the only fluid present and powing. In this research, a theoretical analysis was made to determine the effect of viscosity ratio between the non-wetting and the wetting phase on relative permeability. Experimental work was conducted to test the validity of the derived equations. The experiment was conducted on four natural cores. Four oils were used as the non-wetting phases with a viscosity range of 0.42 to 71.30 cp and two wetting phases with a viscosity range of 0.86 to 0.96 cp. Oil and bring were made to flow simultaneously at various ratios, and relative permeability curves were constructed. A total of eight relative pertileability cycles representing eight viscosity ratios were run oil each sample. It was found that relative permeability to the non-~cletting phase varies with viscosity ratio. The relative effect of this variation on relative permeability values was a function of the sample's single-phase permeability, decreasing with its increase. It was concluded that, for .samples of single-phase permeability over I darcy. the effect of viscosity ratio could be disregarded, and relative permeability would be, in effect, a function of satrtration only. INTRODUCTION Two-phase as well as multiphase flow occurs in many fields of science. This type of flow is of particular interest in petroleum production. The knowledge of relative permeability, which describes the dynamic behavior of two-phasc as well as multiphase flow, is essential for solution of problems arising in that field. Thc relative permeability ot a porous medium to a given phase in multiphase flow. is generally considered to be only a function of the saturation of that phase, independent of the properties of fluids involved and ranging in value from zero to unity. Work by Leverett' and Leverett and Lewis' apparently supports this concept. In his experiments Leverett used a clean, packed unconsolidated sand of high permeability (3.2 to 6.2 darcies) with two phases (water and oil) flowing and a viscosity ratio range of 0.057 to 90.0. His results showed that the wide range of viscosity had practically no effect on relative permeability-saturation relationship. Recently accumulated evidence from work performed by several laboratories and a paper by Nowak and Krueger,2 in which relative permeability to oil of a few core samples in the presence of interstitial water was considerably greater than single-phase permeability to water, cast some doubt on the conclusions reached by Leverett' and subscribed to by a large number of individuals in the oil industry. One explanation advanced to explain this behavior states that it is caused by the variable extent of hydra-tion of clay minerals present in the sand. The greater the water saturation, the greater will be the area of contact between water and clay minerals; therefore, the greater will be the extent of swelling with corresponding reduction in permeability. Yuster4 presents another explanation for the recently accumulated evidence. Utilizing Poiseuille's law, he analyzed concentric flow in a single capillary where the non-wetting phase flows in a cylindrical portion of the capillary and concentric with it. The wetting phase flows in the annulus between the non-wetting phase and the capillary wall. The equations obtained indicate that relative permeability to the non-wetting phase is a function of saturation and viscosity ratio. Although Yuster's equations show that fractional rel-ative permeability to oil could be greater than unity, as was indicated by the data of Nowak and Krueger,1 they failed to present an explanation to the experimental data of early investigators such as Leverett.1 Due to the importance of relative permeability in understanding the flow behavior of petroleum reservoir fluids, this work—theoretical as well as experimental —was undertaken to determine whether relative permeability is a function of saturation only as was concluded by Leverett1 or a function of saturation and viscosity ratio as was theorized by Yuster.4 THEORETICAL ANALYSIS An equation will be derived for the rate of oil flow through a porous medium that is initially filled with water. Based on this equation, an analytic expression for relative permeability will be developed. The porous medium will be assumed to consist of .straight circular capillaries of different radii. It will also be assumed that there are no interconnections among the capillaries and no mass transfer across the oil-water interface. Mixtures of' MnS, ZFeO-SiO,, ZMnO.SiO, FeO, and MnO were prepared synthetically and used to study the planes ZFeO. Si0,-ZMnO.SiO,-MnS, FeO-MnO-MnS, and Fe0-MnO.Si0,-MnS in the quaternary system. Because the oxides and silicates studied flux MnS, inclusions in this system are partly liquid during rolling. Also, oxygen can modify subsurface inclusions through the reaction MnS + FeO—FeS + MnO during the soaking of ingots and the reheating of blooms and billets. NONMETALLIC inclusions in steel have long been a subject of study and conjecture because the properties of many steels are known to be affected by the the kind and amount of inclusions present. In free-machining steels, the type of inclusion present has a direct bearing on their machinability; in other steels, cleanliness is important and metallurgists direct their efforts at reducing the amount of non-metallic inclusions. Thus, the accumulation of knowledge about the formation and behavior of inclusions during all stages of steelmaking and processing should aid in improving the quality of steels and decreasing the production costs resulting from rejections. Previous studies of inclusions have contributed greatly to our understanding. The investigators have generally examined inclusions in finished steel. Boulger, Moorehead, and Garvey1 found that in Bessemer steels, low silicon contents results in globular sulfide inclusions with attendant high machin- ability ratings. Van vlack2 also found that low silicon contents favor inclusion morphology that contributes to high machinability ratings. Boquist and Stoll* found that silicon content affected sulfide inclusions and machinability of blooms, billets and bars more than did the finishing temperature in the range between 1775° and 2075°F. Carney and Rudolphy3 studied the distribution of sulfur, manganese, silicon, and carbon in a commercial ingot of resulfur-ized steel and found that silicon was concentrated near the bottom. This helped to explain why bottom cuts had poorer machinability. Klinger and Koch4 developed techniques for extracting inclusions from steel, and the technique devised by Gurry, Chris-takos, and stricker5 for extracting carbides can also be adapted to the study of inclusions. A different approach to the study of inclusions in steel consists of synthesizing the constituents that form inclusions and determining the phase eauilibria in the system that contains the constituents. The resulting phase diagrams can then be used to determine the effect of the various constituents upon each other. In this way, it becomes possible to under-

(communication to the Secretary*).¬If anyone advocates the abolition of the antecedent mineral discovery requirement for the purpose of making it easier to secure title to public land, I hasten to say that I am not of that number. I am in Hearty accord with all that Mr. Gardner has to say in regard to easy patenting as a handicap to small camps, and that in general it acts to retard the mining industry. And the following sentences I want to repeat in order to emphasize and endorse them, "None of the writers on this subject seem to have taken into consideration the effect amending the law pertaining to mineral discovery will have upon the Government's administration of the public land. It must be borne in mind that this land belongs absolutely to the people of the United States as a whole, and their interest must be considered. It is not a no-man's land, as some people would appear to believe." However, I believe that the discovery prerequisite should be abolished, because it fails to effect the protection for which it was designed, and I look for other provisions that will better serve the purpose. We propose to abolish the law of apex not because the theory is objectionable but because the question of physical fact gives rise to never ending litigation. Now the design of antecedent mineral discovery is good; the court rulings are unobjectionable; but when it comes to the physical fact this requirement is second only to the apex law as a healthy litigation breeder.
