Large-scale testing of the explosibility of coal dust as conducted by the Bureau of Mines in its Experimental Mine involves a large initial investment, and a high charge for maintenance and conduct of the test; in addition the work is necessarily slow because of the time required for the preparntion of the tests and the cleaning and repairing of the mine after each test. These tests have been made along practical mining lines that admit of a range of mixtures of dust varying from 5 to 10 per cent. and with gas as low as 0.5 per cent. increments. Because of the time and expense involved, efforts have been made to devise a type of gallery for laboratory use in which the results obtained in the Experimental Mine may be correlated as an aid in a study of dusts, the explosibility of which might be approximately determined quickly and at a minimum of expense. The explosibility of coal dust has been studied by a number of European investors, using small laboratory devices; among these may be mentioned the experiments conducted by Galloway, Vital, Hall and Clark, Abel, Mallard and Chatelier, Thorpe, Bedson and Widdas, Engler, Holwartz and Meyer, and Taffanel, results of whose experiments have becn reviewed by the Bureau of Mines.' The Bureau has conducted many tests with the Frazer-Cle1ncnt5 apparattus, which gives the pressures set up when the dust cloud within is ignited with a platinum coil or tube, heated to different temperatures, but for these tests the sample must be especially prepared as to size (200 mesh) and must be dry. Need for a Dust-testing Apparatus An attempt has been made to design an apparatus that may be used for checking and correlating the expcrimental tests. The first design was a wooden gallery, 8 by 10 in., inside cross section, and 12 ft. long, and having a number of strips along each side for creation of turbulence. The wooden gallery did not get beyond its period of calibration; it mas difficult to make the gallery sufficiently tight, for it was necessary that the top be removable in order that the gallery could be cleaned. In the use of the wooden gallery, however, sufficient operating data were obtained to be a guide in the design of a steel gallery having a circular cross-section. One of the features was a flap valve, at the closed end of the gallery, that would open inwardly thus preventing a reduced pressure within, caused by the cooling of the gases of combustion, and the explosions propagated much better than when the valve was not used; another feature was the determining of the best method for getting a cloud of dust simultaneously in all parts of the gallery, which was accomplished by the use of the concussion wave of a small quantity of powder or by the use of compressed air.

This study investigated roof falls in room-and-pillar drift coal mines in eastern Kentucky and utilized geologic methods for Predicting roof conditions in advance of mining. In the Highsplint mine, the roof was classified in four categories or conditions: Condition A and B (Laminated Shale); Condition C (Rolling Sandstone with Shale in Pockets); and Condition D (Zone of Major Sandstone Roll(s)). Structure contour and isopach maps of the Darby coal bed and associated immediate roof rocks were used to project axial trends of the sandstone roof. Trend mapping in the mine and on outcrop provided more detailed control for roof projections.

The year 1934 in Southwest Texas was marked by aggressive development and exploratory work and resulted in the finding of five new fields and a new producing horizon in one of the older fields. This activity is the result of a reasonable market outlet for production, on both oil and gas, and the fact that drilling and operating costs are reasonable and that possibilities of finding new productive areas are rather high. A large part of the area is prospective and very little, if any, satisfactory surface geological work can be done. This, together with the possibility of finding new productive areas, stimulates wildcatting throughout the counties under discussion. Development work continued actively in all of the newer fields. Exploratory work was most intense in Duval, McMullen, Starr and Zapata counties. The activity in Duval and McMullen counties was the result of persistent efforts to find new trends of production similar to and perhaps associated with the Government Wells group of fields. The activity in Starr and Zapata counties was stimulated by the discovery of the Sam Fordyce field in Hidalgo County as well as the continued effort to find new productive trends southeastward from some of the older fields in northeastern Zapata County and western Jim Hogg Comity. Statistics on production are shown in Tables 1 and 2. New Fields Lopeno.—The Lopeno gas field in the southwestern part of Zapata County was opened in August, 1934, by R. B. Morrison No. 1 Ramirez. This is an anticlinal structure mapable in Claiborne beds and the producing horizon is the Queen City sand at 2100 ft. in the Upper Mt. Selman. At the close of the year only two gas wells had been completed but drilling operations were in progress on several other wells and a gas line was being laid to the field so that withdrawals from the area will begin early in 1935. Comilas.—The Comitas field was opened by Merle Gunby No. 1 Haynes in a sand at 800 ft. in an area southwest of the Escobas field. MANY fires have occurred in the mines of Butte in recent years, and while all have been of a serious nature, simply because they were mine fires, six of them have been especially dangerous in respect to loss of life and property, and the expense of extinguishing or controlling them. It is not my intention to discuss the relative merits of methods used in fighting these different fires because the conditions under which they occurred varied in each case, and it was not always advisable to expend the large sum of money necessary to actually extinguish them if they could he bulk-headed off from the rest of the mine. It is needless to say that everything possible has been done to check all fires at the beginning, but without success in some cases; and it has then become necessary to bulkhead all connections to them, in which state several now exist. The mine fires of Butte, or fires in any mine, may be divided into two classes, namely: Those occurring in accessible workings, and those occurring in inaccessible workings; because these two conditions govern to the greatest extent the methods of fighting fires. Accessibility and in-accessibility in the case of mine fires concern not only new open workings and old closed workings, respectively, but also the condition of the ventilation in and about those places. When a fire is accessible at the start it should not be difficult to confine it to a small area and extinguish it in a relatively short time, but when it is impossible to actually reach a fire in old filled, abandoned workings, or there is no opening by which the gases may be conducted away from the fire zone, then the time consumed in changing those conditions permits the fire to increase to such an extent that it is a long, hard fight to overcome it.

An analytical method has been developed and used in batch and continuous tests to provide initial insights into the effect of soluble calcium ion in anionic flotation of silica from iron ores. A deficiency or excess of calcium ion in pulps subjected to this type of flotation produces an impairment in flotation efficiency. Data developed in the investigation are from a single ore, but show that total calcium requirement is met from water, ore and reagent sources. In batch studies, starch additions were shown to exert no influence on the calcium level, but fatty acid and sodium hydroxide had subtractive effects. The investigation was next extended to continuous flotation testing where the general observations from batch testing were confirmed. Factorially designed experiments were performed showing that the relationship of calcium additions to flotation response was not a simple one, but tended to shift to higher additions with increased fatty acid. Nevertheless, the range of soluble calcium levels measured remained fairly constant in areas of good flotation response. It is concluded that techniques developed should be useful in removing empiricism from flotation operations in this and other systems requiring activation for success. Further development should aid in process control both through methods outlined and through investigations aimed at studying the effects of other soluble reagents. Of the major mineral commodities, iron ore was one of the last to succumb to flotation processing. Commenting on this fact, one of the speakers 1 at the convention celebrating the 50th Anniversary of flotation in the U.S.A., said ". . . in 1951 froth flotation as a means of beneficiating nonferrous minerals was a might giant and could be characterized by 'you name it, we float' - but not iron ore". This tardiness in applying flotation to iron ores was the result of a number of factors, including economics and ready availability of direct shipping ores. Even now, when the need for beneficiation can no longer be denied, proposals for flotation of iron ores are apt to be viewed with some misgivings. This disquiet results from knowledge that wide variability, which would necessitate corresponding adjustments in reagents, often exist within even a single ore deposit. Coupled with ore variability is the fact that, at present, there is no way of quickly and precisely anticipating the direction and magnitude of reagent changes required for uninterrupted production of acceptable concentrates. Despite the long delay, iron ore flotation is now practiced commercially, although the chief applications2-4 are to specular hematites having relatively coarse liberation and low slime content. In addition, the application of flotation in upgrading magnetic concentrates seems assured. However, these flotation methods do not appear applicable to substantial tonnages of fine grained, earthy, and frequently more complex semitaconites and nonmagnetic taconites. The U.S. Bureau of Mines, in devoting its attention to the semitaconite and nonmagnetic taconite class of materials, has demonstrated that anionic flotation of calcium-activated silica can be utilized with an expected high frequency of success.' Even so, it has been recognized that the flotation method is a complex one, and that the reagent suite must be carefully tailored to the feed. These conditions would be expected to offer difficulties in treating ores with the wide range of variability previously discussed. Accordingly, research was initiated to develop methods to remove much of the empiricism from the flotation operation by measuring the reagent variables within the pulp for a correlation with flotation response. A simple illustration of the technique sought would be in the well established use of pH meters to provide feedback control to reagent feeders and thereby limit acidity or alkalinity to a range producing optimum results. The first efforts in this area have been concerned with measurements of soluble calcium ion. FOR many years steel producers have been concerned with the presence of hydrogen in steel. Hydrogen dissolved in excess of its solid solubility at the melting point may cause bleeding and gross unsoundness in ingots and castings. In fully-killed steels the hydrogen content which results in these difficulties varies with the alloy content1 and may range from 6 to 12 ppm.* It is also recognized that of heat treatment diminishes rapidly as the size of the part to be treated increases. The time required to remove a specified fraction of the hydrogen present increases as the square of the diameter of the section, making the treatment of large- sizes impractical. In order to prevent bleeding and gross unsound-ness due to hydrogen, and in view of the inadequacy of corrective heat treatment alone to provide optimum properties when hydrogen is present in large sections, efforts to limit the hydrogen content must be taken while the steel is still liquid. The main subject of this paper is a discussion of the factors affecting the hydrogen content of liquid steel in acid and basic open hearth, and basic electric two-slag furnace processing. Literature Survey Because many of the results and observations reported in the literature have a direct bearing on the results obtained in the present research and form part of the basis for conclusions reached, a brief summary of the findings is necessary. Methods for experimental investigation of hydrogen in liquid steel are comparatively new. The first attempts to estimate the hydrogen content of the open hearth bath were by Kalling and Rudberg,6 who devised a method for collecting gases evolved from the boiling bath of a basic open hearth furnace. VANADIUM is generally spoken of as a rare element; but, even in the light of our resources as known a couple of years ago, this description could be accepted in a qualified sense only. In fact, vanadium is very widely distributed, being a constituent of most clays, while even caustic soda has been shown to contain almost regularly a minute proportion of it, although the quantity in each case is so small as to render impracticable the extraction of the metal there from with profit. The opening-up of a large deposit of vanadium sulphide ore in South America has put a new phase on the commercial outlook of vanadium, the technical value of which for the improvement of steel has been proved by rigorous scientific investigation.

This method of briquetting flue-dust, or flue-dust mixed with fine ores, or, in a few exceptional cases, coke-dust, has come into large commercial use in Europe, and a small plant is already in operation in the United States. It promisea to become of such great importance to the iron industry of the United States that the following description will certainly interest the majority of our pig-iron producers. Discovered in 1908, the process Tests upon the observation of Dr. Schumacher that blast-furnace flue-dust, while possessing of itself no binding or cementing properties, acquires strong cementing properties if mixed with a very small amount of certain salt solutions, the amount of which is so small that the resulting cementation appears to be rather by catalytic action of the salts added than by the mass-action of such chemicals. To be more specific, fresh blast-furnace flue-dust mixed with from 5 to 10 per cent. of its weight of magnesium chloride or calcium chloride solution—that is to say, with from 0.25 to 2 per cent. of its weight of magnesium chloride or calcium chloride—acquires the property of setting within a short time, from 15 to 60 min., and forming a hard cemented briquette. Alkaline solutions appear to have no action such as described, and they even interfere, if present, with the action of the magnesium and calcium solutions. When treated in this way the flue-dust briquette sets very hard, apparently from pure excess of cementing- and setting-power. It is, therefore, possible to mix with the flue-dust a considerable proportion of inert ore or like material, which has no setting-power by this process, and thus to make a compound briquette containing large quantities of ore mixed with flue-dust, but in which the flue-dust may be regarded as the cement or binding-material. he possibility that carbon may be soluble in copper to a limited extent has bten recognized for over a century. The quantitative investigation of this problem, however, requires more sensitive techniques than have formerly been available. Three recent developments have made possible more accurate determinations: the vacuum-fusion method of analysis, the production of copper of high purity and the availability of high-purity refractories, particularly graphite. In addition to its obvious theoretical interest, the problem of carbon solubility in copper is of practical importance. In the production of copper and of high-copper alloys, carbonaceous covers are freauerltlv used. If even minute amounts of carbon are dissolved, insoluble carbon oxide gases will be formed when such metals are poured under oxidizing conditions. A mechanism of this kind could well be one of the principal causes of gas porosity in casting copper-base products. Review of Literature In 1823 Vivian1 raised the question as to whether copper by overpoling becomes "combined with a minute portion of carbon." Karsten2 asserted, in 1832, that carbon reduces the high-temperature strength of pure copper, so that when the carbon content has reached 0.2 per cent the metal will be brittle at a dark red heat. According to Karsten, carbon contents of 0.05 per cent make it difficult to hot-work copper. He also reported that the specific gravity of copper is 8.8969 and that it increases to 8.9258 if the copper is cemented with carbon and then melted. He emphasized the difficulty of determining analytically the small amounts of carbon present in copper. The metal was removed by wet methods and the residue considered as carbon. At Percy's request, Dick,3 in 1856, carried out various working tests on copper that had been ill prolonged contact with carbon, and found that the working properties of the metal had not been affected. He also attempted to determine the presence of carbon analytically. In one experiment the copper was dissolved and the residue was fused with litharge, and in another essentially a combustion analysis was made on a copper sample. In a final experiment, a sample was dissolved and the residue subsequently subjected to a combustion analysis. Indications of as much as 0.005 per cent carbon were found, but Dick considered his work inconclusive largely because of the possible interference of sulphur. An experimental investigation of the thermal and mechanical responses of rock materials to laser radiation is described. Specifically, the following three topics have been studied in detail: 1. Temperature measurements on thin discs subjected to laser radiation. 2. Strain measurements on thin discs subjected to laser radiation. 3. Observation and evaluation of cracking and spalling phenomena in constrained and unconstrained thin discs respectively, subjected to laser radiation. In conjunction with the experimental work done, use was made of a heat flow analysis and a stress analysis program developed for this purpose. It was possible to theoretically predict the thermal and mechanical responses of a rock specimen to laser radiation and then compare them with experimental observations. Good correlations were obtained.

In reheating quenched steel to remove part of the hardness, the softening effect has generally been considered to be a function of temperature and time. The temperature effect is well known, and long before pyrometers were heard of the blacksmith was able to do a good job of tempering, by rule-of-thumb methods and experience in judging temperatures. Modern conditions, which demand steel that will withstand the severest tests, require that the heat treatment be carried out with every possible precaution to secure the best results obtainable. Pyrometers and heat-treatment furnaces of many types are on the market and improvements are continually being made so that it is now possible to regulate the temperature in heat treatment very accurately. There is still a question regarding the time that the steel should be subjected to treatment. It is customary with all operators to insure the desired temperature throughout the specimen and it is generally supposed that a longer treatment of a hardened steel produces a further softening but there are few published figures showing the exact effect of time of treatment at constant temperature. A search of the literature disclosed several brief statements that the tempering effect was a function of both time and temperature, but in no case were any figures given. The opinion is very generally held that the well-know tempering colors are accurate indicators of the degree of tempering. This is disputed by Brearley (The Heat Treatment of Tool Steel, page 102) who states: It has been said that the result would be the same in respect to both hardness and other properties whether the colors were obtained by a shorter heating at a higher temperature or a longer heating at a lower one. This, to say the least, is a very doubtful conclusion, and is certainly not borne out by mechanical tests on oil-hardened and tempered motor car steels which, after tempering for periods varying from 15 min. to 2 hr., show no very great bifferences. The present investigation had for its object the obtaining of some definite data regarding the effect of time, which might serve as a guide to those engaged in the heat treatment of steel. IN gathering material for this review the aid of the individual members of the Milling Committee was invoked and the assistance received is hereby most grate- fully acknowledged. The replies were much alike; almost everyone stated that in 1932 his operations had been cur- tailed or stopped entirely, that the only activity and progress were in milling gold ores, and that the Hadsel mill' looked like a coming machine in the crushing and grinding field. However, further inquiry and search have shown that the year was not quite so barren of developments as the foregoing statement would indicate.

THE application of gas or air under pressure to obtain more oil from a sand which has been practically exhausted by ordinary production methods has been practiced to a limited extent for many years. Until recently such methods were confined to the Eastern fields, principally those of Ohio and West Virginia, where in many cases the production obtained after applying pressure for a few years was nearly equal to the total production prior to that time which had been obtained by the usual production methods.' As early as 1917, J. 0. Lewis1 called attention to this method of increasing the recovery of oil and cited the phenomenal results obtained by H. E. Smith, I. L. Dunn and 0. C. Dunn, who pioneered the application of air or gas pressure recovery methods. With this information available it would appear that other oil-producing sections of the country have been extremely slow to realize the advantages of repressuring. However, after a few successful projects in the Mid-Continent area, the oil producers appreciated the value of this method for obtaining further and profitable production from their practically exhausted leases and are now making extensive use of it. In general, it has been the practice to apply pressure to the sands when production has declined to a small yield per well. The purpose of this paper is to discuss some of the advantages which may be expected from returning gas under pressure to the oil sands during the early stages of development, before the rock pressure has been dissipated and the gas exhausted, and to stimulate discussion of this subject on which comparatively little actual field data are available.

Simultaneous measurements of lattice (elastic) strain by X-ray line shift method and total strain with an electrical strain gage have been carried out on polycrystalli,ne nickel with the help of a specially designed tensometer attachment for the X-ray dif-fractometer. During the initial stages of deformation, the rate of increase in lattice strain closely follows the total strain until the plastic strain sets in. From then onwards, the two strains deviate from each other and with further increase in afiplied stress the rate of increase of lattice strain eventually decreases. Depending upon the mode of unloading, both compressive and tensile strains have been observed in nickel deformed up to 0.29 pct strain. These results have been explained on the basis of the effects of clustering of dislocations and also the production and behavior of point defects during loading and unloading, respectively. POLYCRYSTALS deformed plastically in a uniaxial tension test show residual lattice strains (hereafter referred to as RLS), which broaden the X-ray line profiles and shift their peak positions.''4 It is known that uniform straining of a crystal lattice (macrostrain) produced movement of ddfraction line peaks, whereas nonuniform straining (microstrain) causes line broadening.= Though the nature and origin of RLS in deformed metals is not yet clearly understood, these are believed to be due to the presence of some form of a locked-up stress system. Several possible detailed interpretations6'" of the stress system have been proposed by various workers and common to all these interpretations is the assumption that different parts of the aggregate have different tensile yield stresses; e.g., that a part A yields under a lower applied stress than a part B. Therefore, during the deformation process, the elastic strain in A will be less than that in B, and, after completion of deformation, B will tend to contract further than A but will be prevented from doing so by the restraining influence of A. Thus, when equilibrium is reached, A will be in compression while B is in tension. Although there is general agreement on the correctness of this argument, controversy still exists as to the exact nature of the parts A and B in a deformed metal. In an alternative approach to the creation of parts A and B, many other investigators have assumed that the RLS observed in unloaded specimens are in some way connected with the lack of proportionality between lattice strain and applied stress in the region above the yield stress." cullity13 has prepared a schematic summary of the results of previous workers, mainly Smith and Wood,2'11 which suggests that, above the elastic limit, the lattice strain may increase less rapidly with respect to strain, or may even decrease with increase in applied stress. If the applied stress is then decreased, the lattice strain would decrease along a line parallel to the loading line in the elastic region and thus produce a compressive residual lattice strain after unloading. At equilibrium, to balance these compressive stresses? there would have to be regions under tensile stress which may well be the grain boundaries or the substructure walls formed during deformation. The present investigation was undertaken to gain a better understanding of the nature and origin of RLS and also to experimentally verify the salient features of this hypothesis. EXPERIMENTAL Stress and strain determinations were made with a specially constructed tensometer attachment for the X-ray diffractometer, Fig. 1: which permits the following measurements simultaneously on a sheet specimen under uniaxial tension at various stress levels during loading and unloading: a) lattice strains, E=. in a direction perpendicular to the direction of pulling (x direction) from shifts in X-ray line peak positions; b) the total strain, ex, in the direction of pulling. with the help of an electrical strain gage affixed to the back of the specimen directly below the area irradiated by X-rays: and c) the applied stress, with the help of a load cell which consisted of a calibrated stainless-steel sample of dimensions identical to those of the specimen under investigation, and to which it was coupled. An experimental study of the variation of transverse-rupture strength with composition Anexperimentaland grain studysize has shown that the strength reaches a maximum for values of the mean free path between carbide particles of 0.3 to 0.6 microns. The fracture oforiginates in and proceeds through the carbide grains mainly. Impact strength and hardness also were recorded. MOST of the physical properties of sintered carbides vary linearly with composition. The transverse-rupture strength, however, shows a unique behavior. As the amount of binder metal is varied from 6 to 25 pct by weight, the strength at first increases; then, between 15 and 20 pct Co, it reaches a maximum of nearly 400,000 psi, and finally decreases with further additions of binder metal. This behavior of the transverse-rupture strength has been reported, among others, by Englel and Sandford and Trent.' The significance of these observations has not been discussed in the literature. That it may be of more than specific importance is indicated by the very similar variation of strength with composition encountered in other systems sintered in the presence of a liquid phase, such as Tic-Ni3 and Fe-Cu.' Experimental Details All compacts were prepared and sintered according to normal industrial practice. The average diameter of WC grains and the mean free path between grains were measured on metallographically prepared samples by a method of linear and planar analysis sing the relations where d is the average diameter of dispersed grains; Nl is the number of noncontiguous grains intersected on a metallographic plane by a line of unit length; N, is the number of noncontiguous grains per unit area; P is the mean free path between grains of dispersed phase; and f is the volume fraction of dispersed phase. Approximately 1000 grains were counted on each sample. For each composition d2 was plotted against P, the resulting straight lines serving as a check on the measurements. The distribution curves of the WC powders of different average diameters were homologous, and no attempt was made to influence the grain size by blending powders, adjusting the sintering conditions, or otherwise altering the particle size distribution. Densities were measured by differential weighings in air and water. The degree of densification did not vary consistently with either composition or grain size. The density is influenced by slight amounts of impurities, specifically by 0.1 to 0.2 pct Fe which enters the powders during ball milling. As an illus- -tration of the experimental variations, a number of measured densities are listed in Table I. They are expressed in percentage of theoretical density, as calculated from the published X-ray densities of WC and Co.' For the purpose of determining the transverse-rupture strength, rectangular test specimens (3/16x 3/8x3/4 in.) were broken by loading at the center of a 9/16 in. span. The average strength of five or more samples is reported for each composition and grain size. The compacts were ground on two parallel surfaces only. The load was applied at an average rate of 6,800 psi per sec. Since the elongation after fracture of the alloys is very small, it was assumed that the compacts deform elastically to failure and the fracture stress was calculated by the conventional beam formula. The data for one alloy are presented in Table II as an example of the results and scattering ranges encountered. The precision of the test, as measured by the average difference between duplicates, is of the order of 15,000 psi. The results are strictly comparable only to compacts prepared and tested in the manner described and of similar chemical composition and grain size characteristics. Unnotched Charpy specimens were used for impact testing. Each point represents the average of 3 to 20 samples, the larger number being used in an attempt to determine the influence of grain size. Considerable scatter was encountered, the range from lowest to highest value often amounting to 30 pct of the impact strength. The hardness is reported as a Ra reading, using a 60 kg load with diamond brale indenter. Compositions are given in weight percent.

THE following paper aims to make a full explanation of the phenomena of rock jointing: It may be unnecessary to give any general description of what are termed joints in rocks, but Professor Geikie's clear and faithful generalizations are so illuminating that no excuse need be given. for introducing the following and other quotations into this paper "Almost all rocks are traversed by vertical or highly inclined divisional planes termed joints. These have been regarded as due in some way to contraction during consolidation (fissures of retreat) ; and this is no doubt their origin in innumerable cases. But, on the other hand, their frequent regularity and persistence across materials of very varying texture suggest rather the effects of internal pressure and movement within the crust." 1 General Explanation.-In this paper I show that the phenomenon of jointing may to a large extent be accounted for by the pressure of the water contained in the pores of the rock. To understand this, each constituent grain of the porous material may be considered to be separately compressed by the water which submerges it. As all the grains are held together by cohesion, the whole mass is contracted by this pressure. In an indefinitely extended mass, however, there must be a limit to the possible contraction without rupture, because the material is restrained from moving freely by other material around its boundaries. The mass of rock thus becomes broken up. This phenomenon is known as '" shrinkage " jointing. The term " shrinkage " is an apt one, if it be understood that the shrinkage of the rock is often brought about by change of stress. Stresses.-The compressive component of water stress on the individual grains is evidently the same as that of the water with which it is in contact. This is so, both before and after the jointing is formed. Before the jointing is formed there is, however, a tensile stress in one or more directions which keeps the material from contracting. .

The Committee, appointed early in May, met and organized in Washington, May 9, 1923, and were then advised that such data as they required would as far as obtainable be submitted to them in tabulations, and that they could not be allowed to see the individual reports nor know the identity of the operators on whose reports the figures submitted were based, therefore the Committee's valuation is based on data received from your statisticians, and on tonnages estimated by your staff and by the United States Geological Survey. Various methods of valuation for mining properties have been suggested, but all authorities seem to agree in accepting, as the fairest and most practicable and logical, a capitalization of the estimated future earnings, when such estimate can reasonably be made. Hoover and Finlay both emphasize this. The United States Supreme Court says in Cleveland, Cincinnati, Chicago & St. Louis Railway Co., v. Backus, 154 U. S. 439: But the value of the property results from the use to which it is put and varies with the profitableness of that use, present and prospective, actual and anticipated. There is no pecuniary value outside of that which results from such use. The amount and profitable character of such use determines the value. The Committee on Federal Taxation of the American Institute of Mining and Metallurgical Engineers, appointed in 1919, in its report states: A proper value of a mining property is the present value of the prospective net earnings, taking into account probable variations in output and value. Ingalls ("Wealth and Income of the American People," p. 97) says: The fundamental principle of mine valuation is the present worth of an annual dividend accruing during the period of years corresponding with the lie of the mine. It is a convention that the estimated period shall not be more than 30 years.
