We have developed a new wireline hydrofracturing technique for in situ stress measurement which eliminates the need for drill rig and drill rod and renders the tripping of the straddle or impression packers continuous, fast, and inexpensive. Wireline conductors facilitate the use of downhole pressure transducers. We have confirmed the suitability of the new technique by testing it in a deep hole near the Monticello Reservoir, South Carolina. Our measurements indicate two local stress fields, one of them apparently linked to the impoundment-related induced seismicity.

The new entity, Yacimientos Petroliferos Fiscales Bolivianos, created in 1936 for the development and exploitation of all petroliferous zones of Bolivia, including those formerly belonging to the Standard Oil Co., is doing its utmost to bring about rapid development and by this means to create a new source of revenue for the State. With this in view, Y.P.F.B. has opened a new field in the Samaipata region, on the main road between Cochabamba and Santa Cruz. Installation of machinery has begun for the drilling of several wells on the five anticlines that occur in this region. Work has also begun in the Saipuru field, on the Santa Cruz-Charagua highway, which was discovered by the Standard Oil and temporarily abandoned. In this new field, a topping plant will be installed, to supply gasoline and kerosene to Santa Cruz. Explorations are also being made on the neighboring structures of Saipuru. At the end of 1937, the committee that is to study the region of the Chapare in the northeastern part of Cochabamba, was organized. The structures were studied 10 years ago by Kirtley Mather and other geologists. It is hoped that by March 1938 this camp will begin work, as this zone gives promise of being valuable. Development The capacity of the refinery at Camiri has been enlarged in order that it may supply all the needs of that region. In order that the supply of crude may be adequate, several wells that had been almost abandoned by the Standard Oil are being cleaned out. New wells have been located at this camp following the principal anticlinal structure, and during the first half of the year 1938 several wells will be drilled. The same program is being followed in Sanandita but on a greater scale, as the nearness of this district to the Argentine border, which is the best market for the Bolivian petroleum of the south, allows immediate sale of the petroleum. Possibly a new refinery will be installed at this camp, as the one now in existence is only a rudimentary distillery. At the Bermejo camp, which is farther south, intensive work is being done to bring the wells into production. The application of the Scintillometer to radioactivrty surveys in boreholes of oil wells has made it possible to determine bed thickness with a high degree of accuracy. This fact, combined with known relation of logging variables, makes thin bed porosity determination practical. With the use of the Scintillometer a method hot been derived whereby the apparent level of radiactivity, as recorded on radiation logs, may be converted to the true level. The true level of radioactivity is that level to which the recording pen would have traveled had the detector remained at a given depth for on infinitely long period of time. This factor is: radioactivity level, Ra, is the apparent radioactivity level, T is the bed thickness, D is drag, and L is the length of the detecting system. This method depends entirely on accurate measurements of bed thickness and drag. A thorough discussion of the concept of time constant and logging speed as related to drag is undertaken. INTRODUCTION Neutron curve interpretation has become one of the accepted methods for porosity determination in oil field practices. A great deal of literature has been published about neutron derived porosities, but this has been concerned with thick beds, or possibly even averaging of a series of thin beds as a single unit. There has been a lack of written information on methods whereby porosity can be evaluated for beds less than 10 ft in thickness. In certain areas, production is derived from relatively thin formations. The importance of thin bed evaluation, the fact that the Scintillometer is an adequate tool for this application, and the general lack of published information concerning neutron porosity for thin beds are the fundamental reasons for presenting this method of porosity determination. This concept is not put forth with the idea of discounting existing methods, but is merely suggested as a modification of other accepted methods of porosity determination which makes no allowance for quantitative evaluation of thin beds. The effects on the neutron log of counting statistics, statistical variation in the porosity of earth materials, and hole size must be taken into account to obtain neutron derived porosities. Since these effects have been described in past literature, the authors have not made an attempt to go into the subject in detail. With the use of statistical and repeated sections on the log, it may be determined which responses on the log actually correspond with lithologic changes. HeRbeRT Haas,—(communication to the Secretary*).—Fig. I plainly shows that the comparison of the steam-turbine and Diesel-engine plants was made on a basis of 6,000 kw. continuous operating load. The tabulation of costs for an 8,000-kw. load is merely done to show the relation of increased output on the unit power costs. Both plants would sacrifice their reserve capacity, which is to insure continuous operation, if operated to generate 8,000 kw. continuously; unless Mr. Hawkins advocates the operation of one of the turbines at 33.33 per cent. overload, retaining the other as a standby, which, besides overtaxing the turbine, results in a great loss of efficiency. It would be well for Mr. Hawkins to qualify certain of his statements. Thus, under the caption "Diesel Engines, Selection of Units," he says that '(two of the largest Diesel-engine builders take the position that, in the present state of the art, they would not attempt to put out units over 1,000 kw.;" he should qualify it by saying that "two of the largest American Diesel-engine builders take the position that, in the present state of the art in the United States, they would not attempt to put out units over 1,000 kw." The reason that American manufacturers restrict themselves at present to units of that size is to be found not so much in a lack of experience in building large units as in a lack of a sufficient demand for them in the United States to justify the heavy capital outlay connected with the development of such engines. There are relatively few localities in the United States where fuel prices are as high as they are in the South-, west, and regions of high fuel prices are sparsely settled and have a very limited demand for power. Where low fuel prices obtain, steam turbines are active competitors of Diesel engines for large power plants, particularly when the station load factor is low. As most of the American manufacturers of Diesel engines work under license agreements with European manufacturers, which limit their market to the United States and its possessions and Canada, a further limitation is imposed upon them, leaving to European firms practically the entire world as a market. The greater number of power plants range in size from 300 to 1,000 hp.; the average size of the central station, on a basis of all central stations in the United States, not greatly exceeding 500 kw.; in these sizes it is hard for steam engines to compete with Diesel engines, unless fuol oil prices are excessively high, and coal prices very low, or the exhaust steam is used for heating purposes.

AMONG the newer lead smelting and refining plants of the country is that of the United States Metals Refining Co., at Carteret, N. J. Not only is the technical practice here modern and efficient, but exceptional care is taken to assure healthful operating conditions for the employees. One large building houses the entire department, which includes, as its chief units, one reverberatory smelting furnace, one blast furnace, two softening furnaces, one utility reverberatory furnace, two Faber du Faur retorts, five 120-ton kettles, three 60-ton antimouial lead kettles, and one 5-ton kettle for experimental purposes. There is a 10-ton overhead crane in the kettle aisle, which is also used for shipping lead. Other auxiliary equipment is referred to in the outline of operations. A general plan of the plant is shown in Fig. 2, and a general view in Fig. 1. There are in this country some 20 or 30 societies for engineers and engineering scientists. Most of these organizations are autonomous, and there is little or no cooperation among them. Many do not touch the lives of our Institute members. However, during the course of the years several societies closely associated with the AIME have banded together to handle specific situations where cooperation was necessary. It is believed by many engineers that the functions of these cooperative societies should be analyzed and a plan set up to unify the engineering profession into an organization similar to the American Medical Association and the American Bar Association. The preliminary study of the AIME Committee for Inter-Engineering Society Cooperation has indicated that the following organizations bear upon the professional lives of our members. Some of these are federated groups, such as EJC and ECPD; others are individual-member participation groups, such as the Founder Societies and NSPE.

The area that produces Pennsylvania grade, which includes New York, Pennsylvania, West Virginia and a part of Ohio, increased its production in 1942 about 1,580,000 bbl. over that attained in 1941. Such an increase is substantial for this area, and measured in terms of increased output of lubricants, for which the crude is particularly suitable, it represents a needed arid worth-while addition to the lubricant resources of the United States. The year 1942 was a difficult operating period for most of the petroleum-producing areas in the United States, but the Appalachian region, owing principally to its location, type of operations, and crude value, suffered less from war influences than other areas. The state of Pennsylvania produced 17,823,870 bbl. of crude oil, which is approximately 63 per cent of the total production of Pennsylvania grade in the entire area. Production Bradford Field The Bradford field, which produces almost wholly by water-flooding methods, increased its production nearly 4000 bbl. per day over 1941 despite a very slight reduction in total number of wells completed. Well completions in the Bradford field (in both New York and Pennsylvania) includc both producing oil wells and water-intake wells. About half of the well completions are producing oil wells and the remaining half are water-intake or injection wells. About 10 per cent of the total well completions of the Bradford field were in Cattaraugus County, New York. No segregation of well completions is available, so that precise statistics cannot be given for New York and Pennsylvania.

Investigations were conducted by the lndiana Geological Survey for some dry methods of bene-ficiating low-grade gypsum ore. Seventy-two batch and continuous flow tests were performed with a roller mill, rod mill, pebble mill, electronic color sorter, electrostatic separator, and an air separator. Approximately 650 size analyses and 550 chemical analyses were performed during the investigation. Batch samples were tested by the Survey, and most of the continuous flow tests were handled by com-mercial laboratories. INTRODUCTION Although many companies producing gypsum have been interested in dry beneficiation, very little information has been published in the past. One of the most comprehensive investigations was reported by the Canadian Department of Mines.5 Other reports of interest have been published by the Canadian Department of Mines,' the South Australian Department of Mines,2 and the U.S. Bureau of Mines.3 Some beneficiating practices, such as hand picking, selective mining, crushing and screening, milling, and air classifying, were already in use in the Canadian industry prior to MacPherson's investigations.5 MacPherson examined the effect of tabling, air separation, screening, flotation, electrostatic separation, calcining, washing, and various types of milling, in his efforts to eliminate dolomite, limestone, and small amounts of silica and clay from the gypsum ore. RAW MATERIAL Gypsum and anhydrite occur within the lower part of the St. Louis Limestone (Mississippian) in southwestern Indiana. Gypsum in single beds 10 or more ft thick occur at Shoals, Martin County; near Freedom, Owen County; near Bloomfield, Greene County; and in the Devonian strata of LaPorte County. Only the Shoals deposit has been exploited commercially. The western edge of the Shoals deposit is contaminated by a continuous bed of shale, about 1 1/2 to 2 ft thick, near the top of the evaporite and by thin continuous strata or irregular masses of carbonate rock. The low-grade material used in these investigations was obtained from the waste pile of the National Gypsum Co.'s plant at Shoals. The waste ore averaged about 67.4% gypsum and was contaminated by various amounts of shale, dolomite, and limestone. All the material had been previously crushed and screened to minus 1 1/4 to plus 3/8 in. X-ray analyses of powdered, sedimentated, gly-colated, and heat-treated samples of the shale showed that it was composed of slightly structurally disordered illite, Fe-rich chlorite, and very finegrained disseminated silt. The clays and silt were partly cemented with carbonate material. Light-gray argillaceous limestone and gray or brown porous dolomite made up most of the carbonate rock contamination. Crushing Characteristics: The rate unweathered gypsum, carbonate rock, and shale reduce in size was determined by crushing handpicked samples in a rod mill and screening at minus 100 mesh (.0059 in.). Fig. 1 graphically represents the data. These data indicate that carbonate rock should be relatively easy to separate from gypsum, but that shale should be difficult to separate from gypsum by differential crushing. Controlled Samples: Eight rod mill tests of hand-picked samples of mixed gypsum and shale and mixed gypsum and carbonate rock were made. Sample weight and crushing weight were standardized, but the scalping screen size was varied from 3 to 10 mesh (.265 to .0787 in.) in order to obtain the optimum purity and recovery. The data obtained from the tests (see Table I) illustrate that the relatively hard carbonate rock allows appreciable beneficiation (13.6 to 18%), but the low strength gypsum and shale allows only minimal separation (3.1 to 7.5%).* Semi control led Samples: During the investigation considerable slaking of the shale was noted when the ore was subjected to alternate wetting and drying. As demonstrated in laboratory tests, as much as 76% shale can be removed by two cycles of wetting and drying in a 48-hour period with subsequent screening at .265 in. Five ore samples, stockpiled and weathered, were screened, rod-mill crushed and rescreened at .157 or .187 in. with excellent results (Table 11).

Reliable and detailed statistical data available for Kentucky, Ohio and West Virginia are the most meager and unsatisfactory of any of the producing states. Detailed histories and statistics are available for only a few pools. The antiquity of these pools, loose nomenclature, particularly where several names are applied to the same pool or various parts of the pool or a new namsed when the pool was rediscovered, made the collection of accurat historical and statistical data almost impossible. So many of the data reported are unreliable that a breakdown by pools or even by counties, until more accurate information is available, would lead to gross errors. Rather than perpetuate inaccuracies, we have endeavored to go to original sources wherever possible, sift these and provide data that may serve as an incentive and basis for future work. The necessity for accurate information is thoroughly recognized by the operators, particularly because of the effect of recent government regulations and request? for data in connection with the preparation of the various codes a pending legislation. Producers, both major operating companies and individuals, . freely given their time and assistance in the compilation of these data. Valuable information was obtained from tax records, rate cases, statistics published by the oil and gas publications and the Bureau of Mines. So many individuals cooperated in the preparation of these data that individual credit cannot be given. Undoubtedly many errors will be found. Some of the data are open to controversy, and many have been omitted in the hope that new information of a more reliable character may become available. Other omissions are due to an inability to contact the proper individuals, many of whom are no longer connected with this industry. Pennsylvania grade crude sold in 1933 for the lowest price since 1895. Gas production could not find sufficient new markets to fill the void left by industrial stagnation. In the gas industry, where the market price is fixed by contract, uncertainty persisted because of impending legislative action affecting both taxes and utility rates. THREE GENERAL REASONS exist for applying metallic coatings to steel: to improve its appearance, to resist corrosion, and to resist wear and abrasion. Coating steel with other metals to improve the appearance and to resist corrosion is an old practice; coating for resistance to wear is one of the newer development's' that has become of importance with the development of chromium plating. Coating for improvement in appearance is practically confined to electroplating. Metals like copper, nickel, silver, chromium, cadmium, zinc and tin, because of their pleasing color, are used for this purpose. But these metals are never quite corrosion-proof, except cadmium and zinc, when applied directly to steel. Improvement in color or appearance must be permanent and therefore corrosion-resistant and tarnish-proof. For this reason, with the exception of cadmium, zinc and tin, the above metals are used in combination to obtain appearance and resistance to corrosion. Resistance to tarnish is dependent on the property of the particular metal. Chromium, being nontarnishable, has made it possible to obtain combination coatings of copper, nickel and chromium, copper and chromium, or nickel and chromium, which improve the appearance and also resist corrosion and tarnish. Such coatings find a wide field in decorative work particularly the copper-nickel-chromium combinations, and when properly applied are very satisfactory.

The stress associated with the high-dislocation layer at the surface of deformed aluminum crystals was measured by progressively polishing the specimen and determining the change in the initial flow stress when the specimen was reloaded. This surface stress increased linearly with strain in the Stage II and Stage III region. The depth to which the high-dislocation layer extends was found to be 0.0025 in. The influence of the surface layer on Stage I is discussed and it is shown that Stage I ends when, on the secondary slip system, the difference between the applied stress and the opposing stress due to the surface layer is equal to the critical resolved shear stress. In previous papers'-3 it was shown that the surface exerts a pronounced effect on the plastic-flow characteristics of metals. For fcc metals it was possible to increase the extent and decrease the slope of Stages I and II and decrease the work-hardening coefficient of Stage II by removing the surface of the specimen continuously during the deformation process.2,3 More recently,L it was shown that the activation energy for plastic deformation and the activated volume were also influenced by the surface. These changes were related to the existence of a high concentration of dislocations in the region near the surface of the deformed specimen and it was concluded' that the effective stress, T, acting on a dislocation was T = Ta-Ti-Ts [1] where 7, is the applied shear stress, Tj is the internal stress, and TS is the stress associated with the surface region containing the high concentration of dislocations. From Eq. [I] it is seen that the effective stress, 7, acting on a dislocation is a function of 7,. Therefore 7, becomes important in any description of the work-hardened state. In this paper the value of 7, as a function of strain and its variation with depth are reported for aluminum single crystals. In particular, it will be shown that the end of Stage I occurs when the net stress, 7, on the secondary slip system is equal to the critical resolved shear stress. To measure Ts, single crystals of aluminum were deformed in tension to various strains, whereupon the load was removed and a known amount of metal was removed by electrolytic polishing. The differ- ence between the final flow stress before the specimen was unloaded and the initial flow stress upon reloading is designated as ?Tp and is the decrease in the stress due to the removal of the surface layer in whole or in part. The value for Tp is taken equal to -Ts. EXPERIMENT PROCEDURE The details of the tensile apparatus, method of electrolytic polishing, and crystal preparation were the same as those used previously,1"3 The single crystals were 1/8 by 1/8 in. in cross section with a 3-in. gage length. The initial purity of the aluminum was 99.997 pet. The specimens were held in vacuo at temperatures 50°C below their melting points for 16 hr and furnace-cooled. Just prior to the application of the tensile stress the specimens were electrolytically polished to remove 0.004 in. from the thickness. This latter operation was conducted after the specimen was placed in the tensile apparatus. The tensile tests were conducted at a strain rate, i, of 10"5 sec-' and a temperature of 3°C. The aluminum crystals used for the determination of 7, are designated A1-3-12 and A1-116. The orientation of the various crystals used throughout the investigation is shown in Fig. 1. An isothermal calorimeter suitable for measurements of heats of solution in liquid tin as solvent is described. Measurements of the heats of solution of gold, silver, copper, and a gold-silver alloy are reported. The heat of formation of this gold-silver alloy is also reported. HEATS of solution in liquids can be determined directly, but few such data have been published for metals as solvents. Knowledge of heats of solution is desirable because it contributes to the general understanding of energy relations in metallic solutions. Thermochemical measurements of this type also furnish answers to specific problems: For example, from the heats of solution of an alloy and of a mixture of its constituent elements in a given solvent, the heat of formation of the alloy may be found. Similarly, differences in the energy content of samples of the same metal in two different states, such as the annealed and cold worked states, may be determined. In the work reported here, gold, silver, and an alloy of gold and silver were dissolved in liquid tin at 240°C and gold, silver, and copper were dissolved in tin at 300 °C. The experiments yielded the heats of solution of these metals in tin. The heat of formation of the gold-silver alloy was also determined. The same calorimetric method is being used to measure the energy stored in metals during cold working and preliminary results have been published.' Equipment and Experimental Procedure The isothermal calorimeter used in this work, Fig. 1, consisted of a Dewar flask completely immersed in a constant-temperature salt bath. A long neck provided space for thermocouple leads and a stirrer shaft and permitted the injection of solute samples. The metal bath in the calorimeter flask was stirred at about 100 rpm by a small glass impeller driven by a constant-speed motor. The shaft of the stirrer passed through a Wilson vacuum seal.2 All measurements were made under vacuum in order to eliminate temperature disturbances resulting from gas convection and to prevent the oxidation of tin. The calorimeter flask was joined by an all-glass connecting line to a gas-control system which made possible the use of a protective atmosphere of deoxidized and dried hydrogen. At the operating temperature of the calorimeter tin oxide was not reduced by hydrogen, presumably because the reaction rate was too slow. Part of the closed system was a removable side tube through which the solute sample could be introduced and in which it was held at a temperature of 0°C prior to injection into the metal bath. In view of the current interest in magnetic materials having rectangular hysteresis loops, as for example those obtained with the grain oriented 50 nickel 50 iron alloys,t we wish to call attention again to the results obtainable with the perminvar (Co-Ni-Fe) alloys heat treated in a magnetic field. Data taken from direct current measurements made prior to and during World War II give the typical values shown below for two of the perrninvar alloys. Fig 1 and 2 show- the hysteresis loops for these samples. The first sample above consisted of small rings punched from 0.014 in. sheet stock. These rings were heat treated at 1000°C for one hour in a hydrogen atmosphere and then cooled with the furnace to 750°C at which point they were subjected to a magnetic field of 15 oersteds maintained during cooling to room telmperature. The molybdenum perminvar sample consisted of a spirally wound core of 0.001 in. tape. The heat treatment was the same except that box annealing methods were used and no hydrogen atmosphere was employed. Even better properties might be expected using hydrogen. The heat treating temperatures and cooling rates are not critical. Rectangular hysteresis loops produced in other perminvar alloys by heat treatment in a magnetic field were described earlier.',? Properties similar to those described above are realized in perminvars manufactured by conventional methods. Drastic cold working which in practice limits the final thickness and is gen- erally expensive may thus be avoided. This information may be of interest to those concerned with magnetic alloys and the development of contact rectifiers, magnetic amplifiers and so on.

THE electronic arts today constitute the outstanding development in the field of rare metals, if not indeed in the arena of scientific progress at large. The year 1930 may become known as the year in which the electronic tube took hold of the wheels of industry; it is the year in which the tube's emancipation from the art of communication was proclaimed. The little tube which made a $500,000,000 industry out of a vacuum has now been applied to mining, manufacturing, transportation, chemistry, and other industries. Not many appreciate the extensive utility that e1ectroni.t tubes have already found in transportation, where they control the speed and security of express trains, as well as operate traffic lights on important highways-in the case of the Detroit-Windsor bridge counting the traffic and instantly turning the reports into the superintendent's office some distance away. In an Ohio steel mill, ten-ton ingnts 'rash back and forth through the rolls, reversed by their own shadows. The vacuum tube also starts, stops, and levels, fast passenger elevators.

THE internal friction of nonferrous metals vibrating at low stress amplitudes has so far always been successfully interpreted in terms of inhomogeneities of one sort or another. Examples are the fluctuation of stress across a specimen vibrating transversely,1,2,3 the stress inhomogeneities due to the elastic anisotropy and partial random orientation of the individual crystallites,4,5 localized weak regions introduced by cold-working,6,7 grain boundaries and possibly twinning planes.8.9 Perfect single crystals are, by definition, homogeneous. Actual single crystals usually, perhaps always, contains some imperfections. The present investigation was undertaken to determine whether the internal friction of single crystals may likewise be attributed to inhomogeneities. This study was made possible through the gift of a large single crystal of 70-30 alpha brass by H. L. Burghoff, of the Chase Brass and Copper Co. The specimen, 3-s in. in diameter and 10 in. long, was similar to samples previously described by Mr. Burghoff.10 EXPERIMENTAL METHOD The experimental method used has previously been described in Institute papers.5,6.9 The measure of internal friction adopted here, I/Q, is (p) X the logarithmic decrement, a measure used by some writers, and is also (I/2p) X the specific damping capacity, a measure used by other writers. In all measurements the stress level was kept so low that the measurements were independent of stress level. In all measurements in which the temperature was varied, observations were made as the specimen slowly cooled from its highest temperature. The specimen was vibrated transversely. Observations were made at the fundamental frequency and at the first overtone, of about 620 and 1710 cycles per second, respectively. No attempt was made to avoid acoustical losses. EXPERIMENTAL RESULTS The specimen was annealed for several hours at 450°C. The temperature dependence of the internal friction was then determined from room temperature to 400°°C. As shown in Fig. i, the internal friction increased by only a factor of 2 from room temperature to 300°°C., then by a factor of 100 during the next :too' interval. These measurements are consistent with the view that the observed internal friction is the superposition of two distinct parts. One, dominant at room temperature, is nearly independent of temperature. This part may be accounted for by acoustical losses and by transverse thermal currents. It was not further investigated. The second part, when plotted in the manner of Fig. I, lies upon a straight line. Therefore it has a heat of activation H; i.e., it varies with temperature as Internal friction ~ e-HI/RT [I]

Report of the Americanization Society, New York Section During the past two months the Americanization Committee has held social meetings of various kinds for foreign-born women, as a preliminary to future effort along the lines of Americanization work. At the same time, a thorough investigation was made as to the work being done in New York by organizations devoted to this interest. The committee will be very glad to help any other committees being formed, in mining centers, with advice and information that has been gathered together as to classes and meetings of all kinds best suited to the needs of a foreign-born population. The work has been so extensively taken up in New York that for the present it would seem to be, for this committee, the most profitable and interesting work to continue the social meetings and to undertake the care of one or more immigrant families, to be friend and adviser in joy and sorrow, work and play, and in this way do some fundamental Americanization work. MANY complaints have been filed by mine prospectors, explorers and producers about inequities in mining taxation. They have insisted upon improvement, and in the past 35 years there has been some progress. Many of the best taxation provisions made to date are those contained in the Revenue Act of 1951. Mining economics presents special problems, a fact even recognized by many textbooks. Certain provisions have been made to take care of mining taxation rights, but these have been made by Congressional act and do not represent basic, constitutional, guarantees. Despite special provision, in the form of depletion allowances, there remain injustices. The industry faces the problem of gaining adequate income tax allowances for exploration and development expenditures, operating losses, and bonus and subsidy payments. Problems in mine taxation arose soon after the adoption of the 16th Amendment. This amendment gave Congress the power to impose income taxes. Supreme Court decisions against a number of mining companies held that Congress, under its power to tax income, could tax net operating revenue before depletion allowance was deducted. The court also ruled that the right to deduct depletion is a matter of Congressional permission. There is no statute provision permitting mining stockholders to recover their investment out of dividends while the mine is being operated. The Supreme Court did not recognize that part of mining proceeds are actually amortization of the cost of mineral rights. Both these omissions stem from failure to recognize that by its very nature mining consumes its mineral rights and therefore that a part of gross proceeds are not income but recovery of capital. Suppose a Congress unfriendly to mining interests repeals the provisions that allow deductions for depletion. Under such a situation assume that a corporation buys a mineral deposit for $300,000. They mine the deposit and earn an operating profit of $500,000. At the current rates they would pay a Federal Income tax of in excess of $250,000. This venture results in a loss of $50,000 as shown in the table below. For the example given the absence of depletion provisions in income tax law would turn ore into waste rock, because the word "ore" connotes commercially mineable rock. [ ] In retrospect the conclusion is clear: If the Supreme Court had recognized that a part of mining proceeds represent in reality sales proceeds of mineral rights, then profits derived from such sales would have been taxed at the favorable long-term capital rates, instead of being taxed at the high normal, surtax and excess profits rates. It is a question whether percentage depletion allowances offset this tax situation. History The history of depletion allowances has been one of general improvement. The original act did not include depletion, but an allowance at the rate of 5 pct of gross proceeds was provided in 1913. The Acts of 1916 and 1917 allowed depletion upon cost of property, and in 1918 the law was further changed to permit depletion upon cost, or market value as of date of discovery. In 1932 metal, coal and sulphur properties were permitted to elect depletion in percentages of gross income, limited to 50 pct of net income, in lieu of cost depletion. Shortly thereafter the rule was changed and percentage depletion is now allowable in any case where it is higher than cost depletion. Since 1942 percentage depletion allowances have been extended to cover many nonmetals, and in 1951 the rate for coal mines was increased from 5 to 10 pct of gross income. GREAT emphasis is being placed today on petroleum as a source of chemicals. Such prominence is well merited, for rapid strides have been made in developing processes for the conversion of petroleum into synthetic chemical products, which are now being made on a huge scale. These marvelous accomplishments have resulted in some highly optimistic predictions as to what can be expected in the future. Many of these forecasts are well justified, but some writers, especially those contributing to the Sunday supplements and the popular-cience type of publications, have let their imagination run wild and present a rather distorted picture of the possibilities in this field in the postwar period. Commercial manufacture of synthetic organic chemicals had its beginning in England with the establishment of a plant by Sir William Perkin in 1857 for the manufacture of "Aniline Purple" or "Mauve." The preceding year he had discovered in the laboratory how this dyestuff could be made from aniline, one of the many derivatives of coal tar, and he soon made commercial application of his discovery. Influenced largely by his success, organic chemists began research on production of a vast array of synthetic dyestuffs, medicinals, flavors, scents, and explosives. Rapid progress was made and by the turn of the century hundreds of these products were being manufactured. Most of these synthetic chemicals were derived from materials obtained as by-products in the conversion of coal into coke. These by-products are generally referred to as "aromatics" and are obtained by processing coal tar recovered in the coking process, so they are popularly known as "coal-tar chemicals." During the early years of this century, coal-tar chemistry was the wonder of the age, and rightfully so, since the products so made seemed limitless.
