Due to the immense volumes of municipal wastes that are generated in this nation every year, it has become imperative that effective measures be developed to utilize all or portions of these materials in a productive and efficient manner. Nany larger municipalities employ incineration to reduce the bulk of material to be removed to disposal sites: but, even after incineration, approximately one-fourth of the original waste material in the form of non-combustible residue and flyash remain. It has been found that the flyash fraction of the incinerator residue contains varying amounts of copper, silver, gold, aluminum, iron and titanium along with many other important metals. The serious loss of these natural resources contained within the flyash and the monetary expense of current disposal methods present a serious and rapidly increasing problem to the public and to the Federal Government. The growing emphasis upon environmental control, rapidly increasing urban population and "convenience packaging" 'with its attendant increased waste production has led to the initiation of a broad range of studies concerning municipal waste. For example, the U. S. Bureau of I-lines is investigating all aspects of the incineration of municipal waste under its solid waste disposal program.l "In-house" studies range from improved incinerator design to potential recovery and recycling of the various components within the incinerator residue. A major portion of the latter research is being performed at the U. S. Bureau of ;-lines, College Park, Maryland facility while grants for specific areas of study have been issued to several universities and research institutes. In addition, the Department of Health, Education and Welfare has supported programs examining the potential recovery of paper; glass, metals and other components of unincinerated refuse followed by disposal in sanitary landfills.

"INTRODOCTIONMeasurement of the contribution of diesel exhaust to respirable aerosol in mine environments has become increasingly important because of current concerns over the occupational health effects resulting from exposure to diesel emissions. In response to this, the U.S. Bureau of Mines is developing and evaluating new sampling methods for measuring diesel aerosol in underground mines. Two such techniques are being studied by the Bureau, size selective sampling and Chemical Mass Balance (CMB) modeling. These techniques use measurable physical or chemical characteristics of a mine aerosol sample to infer the amount of diesel particulate material contained in the sample.Size selective sampling is being adapted for measurement of diesel aerosol by the Particle Technology Laboratory (PTL) of the University of Minnesota under sponsorship by the Bureau. 1 It is based on the premise that diesel and mineral dust aerosol can be physically separated by size and collected during sampling using inertial impaction. An independent effort by the National Institute for Occupational Safety and Health to develop a size selective sampling technique was also sponsored by the Bureau.The second technique, CMB modeling, is being developed by the Bureau as an alternative measurement technique to referee the results obtained using size selective sampling.3 It compares measured trace element ""finger prints"" of aerosol sources with similar profiles of mine aerosol samples. From these, the portions of the sample contributed by each source can be determined. Results of these investigations in underground coal mines have confirmed that diesel and coal dust aerosol are of different size and can be measured separately using size selective sampling techniques.A major difference in diesel usage among underground mines is the requirement for exhaust gas cooling systems in coal and gassy noncoal mines. Nongassy mines usually employ limited exhaust conditioning in the form of catalytic converters, which have limited effect on primary exhaust particulate. The cooling system in most general use in gassy mines is the water scrubber. This device has little effect on most of the gases but removes particulate material from the exhaust. 5 Because of this, exhaust aerosol characteristics in nongassy mines are expected to be different. To see if size selective sampling techniques can be used in such mines, the Bureau and the University of Minnesota conducted a second study in three metal and nonmetal mines, two nongassy and one rated as gassy."

"Two source apportionment techniques have been applied by the Bureau of Mines to aerosol measurements in diesel equipped underground noncoal mines. The first technique is based on size selective sampling and the premise that the diesel exhaust fraction of the aerosol is predominately sub-micron in size while the mineral dust fraction of the aerosol is mostly super-micron in size. The second technique, Chemical Mass Balance (CMB) modeling, was used to referee the analysis of diesel and mineral dust aerosol concentrations with the size selective method.The size distribution data were modeled using a log-normal regression to parameterize the sub- and super-micron fractions of the sampled aerosol and to estimate the mineral and diesel contributions to each. For the mines visited, analysis of the size selective: samples yielded an average value for the fraction of the fine aerosol attributable.to mineral dust of 3 pct.'The CMB analysis, applied to both fractions of the respirable mine aerosol, yielded the amount contributed to each by the diesel· and dust aerosol sources. Less than 5 pct of the sub-microm fraction was mineral dust, however, as much as 20 pct of the diesel aerosol was found: ""in the super-micron fraction requiring a correction of the sub-micron fraction to account for the missing diesel mass. More accurate measurement will require a carbon specific analysis of the aerosol."

Mineral production implies emissions of particulate matter (dust), noise and vibration that may cause conflicts with neighbors living nearby. In Norway a few conflicts has been brought to court, the latest in 2006. This paper discusses dust emissions and dust depositions (dustfall). The pollution authorities have accepted monitoring of dustfall instead of suspended dust as the first step in conflict cases concerning small and medium sized enterprises. In the case of exceeded limit values, the second step is to require monitoring of suspended dust and next the implementation of control actions to reduce dust emissions. Dustfall monitoring programmes carried out at six mineral production plants in Norway, show that the mineralogical rates of dustfall are rather low a few hundred meters away from the plants or the tailings disposal. They are mostly considerable lower than the limit value of 5 g/m²/30days accepted by the authorities. Seasonal variations between mineralogical and organic dust fractions can be observed in Norway, with higher content of mineral dust during winter time. Other sources to mineralogical dust can be recognized. During winter time wear of road pavement and sand on icy roads can give high emissions of mineralogical dust to the ambient air. Parallel monitoring of suspended dust and rates of dustfall indicate that dustfall can be used to estimate the level of suspended dust. A model for estimating suspended dust based on records of dustfall is presented.

A symposium on the characterization and toxicology of mineral dusts was held Sept. 19 and20 in Washington, D.C. The symposium was held to update the minerals industry, the health community, government agencies and academia on the technical, health and regulatory aspects of minerals to be evaluated by the International Agency for Research on Cancer (IARC).In October 1996, the IARC met in Lyon, France, to discuss and prepare “Volume 68 of the IARC Mono-graphs on the Evaluation of Carcinogenic Risks to Humans on Silica, Silicates, Dusts and Organic Fibers.”

Mineral economics interfaces the mineral sciences and engineering with finance and economics in the analysis of appropriate questions facing the minerals and energy industries. Its practitioners include those trained in the earth sciences; mining, petroleum, and geological engineering; metallurgy and mineral preparation; as well as finance, information systems, economics, and statistics-most usefully in one or more combinations. Allowing for some overlap, three general areas may be identified: evaluation, economic analysis, and resource appraisal. Evaluation begins with mine investment analysis (exemplified by Gentry and O'Neil, 1984) and process costing, for which the STRAMM Handbook (Anon., 1977) provides a well-known basis for mining and beneficiation. But it extends from property appraisal, often used for the determination of taxes and royalties, through the determination and comparison of transport costs (e.g., Richer and Soo, 1977), and to benefit/cost analyses of externalities. Economic analysis, the subject of this section, is displayed in rigor and extent both theoretically and as applied to commodity classes in Vogely (1985), but it is implicit though apparent throughout Lefond (1983). The text edited by Vogely places minerals in their aggregative context with economic growth and trade, proceeds to the theoretical analysis of minerals and their markets, analyzes the structure and performance of the major mineral sectors, and concludes with policy issues: fuel, nonfuel, and environmental. Resource appraisal employs quantitative methods for the estimation of mineral and energy resources. It moves through geologic, geophysical, and geochemical properties to the identification of estimation procedures for mineral endowment and for the economic measure of stocks and flows of specific minerals (Harris, 1984). DEPLETION is a subject of vital importance to the mining industry. Yet, in spite of its importance, its significance is not generally understood. The purpose of this discussion is to clarify the main aspects of the subject from the viewpoint of a metal mine taxpayer. To define the term depletion, it is necessary to distinguish among its various uses. In the economic or geological sense, depletion means the exhaustion of a natural resource. A mineral deposit is a wasting asset and once exhausted is nonrenewable. Millions of years were needed to produce an ore deposit, which may be consumed in a few years and which cannot be replaced except by the discovery of new sources of supply. The wasting asset feature of the mining industry has a vital bearing on the impact of the Federal Income Tax Law on this industry. This is recognized in the law by the various provisions dealing with the depletion allowance, and in this sense the term depletion has an income tax meaning. Depletion from the tax viewpoint means the statutory deduction from gross income designed to permit the return to the taxpayer of the capital consumed in the production and sale of a natural resource. The mining enterprise realizes income on the extraction and sale of minerals and a portion of the income realized represents capital consumed. As the resource is exhausted, the mining enterprise approaches the end of its existence unless new sources of supply can be acquired. Depletion from the tax viewpoint is a creature of statute with limited meaning and application and, in essence, is a method for amortizing the value of the primary asset of a mining enterprise. An example can best illustrate the significance of depletion from the tax viewpoint. Compare a manufacturing concern with a mining company. In computing taxable income of a manufacturing concern, consideraion is given to the cost of producing such income, the principal costs being capital investment for plant and equipment, labor, and raw materials going into the products produced. A mining enterprise, on the other hand, is faced with a different problem because its principal asset is the natural resource which it is producing. In computing its taxable income, consideration is given also to its capital investment for plant and equipment and the cost of labor; but in addition, recognition must be given to the fact that a portion of the proceeds realized on the sale of mineral represents capital. Without such recognition, the mining company would be taxed not on income but on capital and income, and Congress has never intended that capital be taxed as income. Thus, when depletion allowable is referred to in the mining industry, it means the statutory deduction allowable in computing taxable income of a mining enterprise. For guidance the appropriate provisions of the Internal Revenue Code, Income Tax Regulations, and the judicial decisions interpreting and construing them must be examined. It is important to identify and distinguish three methods of determining the allowance for depletion: 1—Cost depletion, 2—Discovery depletion, and 3—Percentage depletion. The basic method is cost depletion and in addition some taxpayers may be entitled to use discovery depletion and other taxpayers may be entitled to use percentage depletion. Discovery depletion and percentage depletion, however, are mutually exclusive and if a taxpayer is entitled to percentage depletion, he is not entitled to discovery depletion. By statute, a metal mine taxpayer is entitled to use cost depletion or percentage depletion, whichever produces the highest deduction. Thus, discovery depletion is merely of academic interest to such taxpayers and to most others. Briefly and broadly speaking, these methods of determining depletion may be described as follows: 1—Cost Depletion: Under this method, the allowable deduction for depletion is based upon the cost of the particular deposit to the taxpayer, unless the deposit was owned prior to Mar. 1, 1913, in which case the taxpayer may use the fair market value of the deposit on that date or actual cost, whichever is higher. This method is sometimes described as basis depletion or adjusted basis depletion, but in this discussion it will be referred to as cost depletion. 2—Discovery Depletion: Under this method, the allowable deduction for depletion is based on the fair market value of the deposit at the date of discovery or within 30 days thereafter and was originally designed to take into account deposits discovered subsequent to Feb. 28, 1913. 3—Percentage Depletion: Under this method, the allowable deduction for depletion is based on a specified percentage of the income realized during the taxable year from a particular property. As stated, the concept of depletion is based upon the exhaustion of a natural resource as distinguished, for example, from the concept of depreciation based on the exhaustion of property used in trade or business. From the tax viewpoint, depletion first became important in the administration of the Corporation Tax Act of 1909, which provided for an excise tax on net income. As soon as this act went into effect, mining taxpayers attempted to claim a deduction for depletion in computing net income although there was no specific mention of a deduction for depletion in the statute. The courts in these cases uniformly held that the statute did not permit an allowance for depletion in computing net income and also held that the provision permitting a reasonable allowance for depreciation did not include depletion. These early cases are quite significant because they establish the principle that the

The relentless presence of competitiveness is rehearsed as the source of the current trends towards continuous improvement and benchmarking. While this might be expected to lead to more spending on pyrometallurgy, the opposite appears to be the case. The paper examines the reasons and suggests that we face an increasing challenge for selective developments that can lead to sustainable competitive advantage - both in mineral and in waste processing.

Our task is to make a prospecting trip over the whole field of mineral economics which other lectures of this series will explore in detail. The old timers who really understand mining warn us that its economic aspects are often neglected, and this we find to be true. We shall try to show that mineral economics deserves recognition as a separate branch of economic science with urgent and distinctive problems of its own; that to cultivate it requires a fusing of the viewpoint of economics with that of geology and engineering; and that the help of both economists and technical men is needed in exploring its problems and in training workers in the field. To save time, we shall pass over the familiar subjects of production, consumption, and distribution which bulk as large in the market analysis of the minerals as they do in other commodities. The existence of these problems may be taken for granted and attention centered rather upon those that differentiate mining from other branches of industry. What then is the case for an economics of minerals? Why set up a new compartment in a branch of knowledge that is already well subdivided? THE value of a mine is basically dependent on its capacity to yield profits. Since the ore must be mined, treated, and sold, some of it in various future years. there is a risk involved as to future costs, selling price, and working conditions. It cannot be expected that the economic condition existing at the time of valuation will continue unchanged for long periods in the future. During the past 20 years, mineral production in the United States has been conducted under a changing economy in many respects more exacting than that applied to other businesses. There have been increased production incentives, technical aid, exploration of privately owned mineral deposits by government at federal expense, and liberal loans for development and equipment, with risk partially assumed by government.. Some of these benefits have been counterbalanced by price ceilings, consumption controls, and stimulation of competition from foreign producers who have been offered the same advantages extended to American operators. For the present, mines will operate under a government policy directed toward reducing federal aid and control. The tenure of this change will depend upon future elections and the status of foreign relations. War and threat of war are now of the most vital significance to the mineral industries. Other factors which influence cost of production, markets, and price of mine output might be classified as Acts of God or Acts of Government. In some countries expropriation and the difficulty of exporting earnings or investment returns are risks that must be considered by foreign capital. Recognizing that this retards American investment in foreign countries, the Mutual Security Agency offers insurance against such expropriation and guarantees the convertibility of capital and profits. Since it is impossible to predict with certainty either cost of production or selling prices of metals for long periods, some assumptions must be made as to profits in the future. The basic assumption must be that the price of the company's product will vary in proportion to changes in operating cost. There is often a lag in this reaction, however, for prices of minerals are generally more sensitive to declines and less sensitive to increases than are costs. This reflects in part the resistance of labor to downward wage revision and a corresponding alertness in realizing its share of price advances. Some labor contracts include automatic adjustments to metal prices. Notwithstanding the complexity of the, problems involved and the difficulty of weighing their effect on value, such risks may be appraised with reasonable accuracy and a rate of earnings adopted that is compatible with the risk. It is, of course, possible to revert to a yardstick of value such as the commodity dollar, which has been advocated from time to time, but while revaluation in 1933 disturbed public confidence, the theoretical gold dollar continues to be the standard of greatest stability. Its gain or loss in purchasing power is reflected ultimately in cost of production and selling price of the mine product. At present 35 dollars are allocated to one ounce of gold. Measurement of Risk In the application of the Hoskold and most other formulae, a yearly dividend rate commensurate with the risk involved is set aside out of annual earnings. If the risk is great, this rate may be 15 to 25 pct of the amount invested. The remainder is placed in a sinking fund invested in safe securities such as high grade bonds or conservative equities, and the interest or dividends from these securities are added to the sinking fund. The sum of these sinking fund payments and the compounded interest at the end of the mine life is taken as the value of the mine. Admittedly the decision as to the size of the risk rate is the most difficult element in valuation and one requiring the most exacting consideration. It is necessary to look years ahead in an effort to determine future costs, market prices, demand, competition which may develop, including that of substitutes, and other influences common to the mine and to the region in which it is situated. Another phase of risk is the enactment of unfavorable legislation, taxes, and what appears to be an alarming spread of nationalization and expropriation. Capital is sometimes borrowed from the government to finance strategic production. Such loans may be collectable only out of production and involve no liability otherwise. Valuation in these cases must recognize the effect of such a reduction in liability. Offsetting some of these risks are the possibilities of mechanization and other cost-reducing discoveries, improvements in mining and treatment methods, new uses for minerals and metals, and normal growth of markets. In this paper, the terms risk rate, dividend rate, and speculative rate are synonymous. Safe rate and redemption rate are also used interchangeably. These alternatives are used here because they are commonly found in the literature on mine valuation. In Michigan, the State Tax Commission has long employed a risk rate of 6 pct in its valuation of iron mines. There the outline of reserves is well established and operating costs and conditions are based on adequate experience. The following comment on rates appears in the report of the Minnesota Interior commission on Iron Ore Taxation submitted to the Minnesota Legislature of 1941.1 Most engineers agree that 7 percent for the specu-lative rate is "an absolute minimum". INTRODUCTION The two prior Seeley W. Mudd books on mineral economics devoted their final chapters to themes having to do with the future. In 1932, the last chapter in Mineral Economics8 was "The Future Value of Mineral Property" by J. R. Finlay. Both the first edition (1959) of Economics of the Mineral Industries7 and the slightly revised second edition (1964) closed with "Minerals and Man's Future" by Zay Jeffries. We are not inclined in this third AIME volume on mineral economics to ignore the tradition of the prior volumes. Moreover, it always is fitting and proper to close a book about the mineral industries by examining in a rather general way the challenges and uncertainties that are perpetually strewn in our path as we pick our way into the future. Unlike its predecessor volumes, which were written to acquaint the nonspecialist with the economic characteristics of mineral resources and to provide data about the mineral industries, this edition was also designed with the mineral economics student and practicing specialist in mind. Thus it is anticipated that it will be both a reference as well as suitable for use as a textbook. Consequently, this closing examination of our changing perspectives about mineral resources devotes some space to the past events and current status of mineral economics as a field of study. The fears and forecasts of the past can be a perceptive and usually deflating way to begin an examination of the future. As we look up and down the track of time from the 1975 platform, we find that many of the past views of the future were transient in character, others were imperfect in their prognosis, while others were based on fears that now seemed unfounded. But down through the years some of the observations or expressions of concern have a persistency which perhaps reflects some elemental characteristics of mineral resources. On these "truths" rest our contemporary understanding of the economics of the mineral industries. The uncertainties and priorities for the next 25 or more years, not surprisingly, have a somewhat different mix than those that seemed most compelling to our predecessors in 1932 or 1959. So it is appropriate that we review how the perspective of the mineral economist has changed over the span of a half century. In light of the particular interest of AIME on the role technology must play, it is fitting that we close with some observations on that topic. NINETEEN FORTY-SIX was an eventful year for the mineral industries. Perhaps the most significant development was the socialization of industry in Great Britain, initiated in 1945 but carried to fruition in the coal industry in 1946. On Jan. 1, 1947, management of the coal industry will be vested in a National Coal Board, responsible to the Ministry of Fuel and Power. A sum of £164,660,000 has been provided to compensate private owners for assets transferred to the Board. The British coal industry has been a problem for many years. Production has declined to a point where serious shortages of fuel for domestic needs have developed. Exports have dwindled to a small fraction of the previous trade. Costs have increased greatly, and quality has deteriorated. The industry's physical plant has not kept pace with the rapidly mounting wage scales in recent years. Some claim that the best and most accessible coal reserves of Britain are heavily depleted. The industry has been harassed by difficult labor problems, including bad morale among the workers and a shrinking labor force.

WORLD production of the three major nonferrous metals, copper, lead, and zinc, in 1939 will aggregate about 6,050;000 tons, compared with the all-time peak of 6,237,944 tons in 1937, and the previous peak of 5,679,442 tons in 1929. The United States will furnish 30.9 per cent of the total compared with 30.4 per cent in 1937 and 41.3 per cent in 1929. Table 1 gives the details of the three metals.

THE growing dependence of our vast industrial civilization (:n mineral products demands today, as never before, the highest technical skill in those who produce these product-;. That the duty of training the engineers, whose responsibility it is to produce these mineral products efficiently and in sufficient amount, falls directly on the schools of mining is beginning to be more fully recognized. The Institute, realizing this fact and that its future membership depends largely on the annual accretion of young men, is showing a keen interest in the problems of the mining schools and in the work of its Committee on Engineering Education. The Committee has, during the past several years, considered the problems connected with the training of men for the mineral industry, whether these have been problems of college training, or placement of the young engineer in the industry, or personnel training after he enters the industry. The field of interest and discussion has been as broad and varied as the mineral industry itself. Coal mining, metal mining and metallurgy have been discussed and the papers on these subjects have been outstanding contributions to the literature on mineral education.

Occasionally it is good to consider the past, assess the present and project the future. Curriculum, enrollment, matriculation of graduates and changes in industry which influence mineral education are all relevant for determining what changes will be needed in educational institutions to support growth and development in the United States. It would appear likely that with environmental pressures, energy needs with present stress in fossil fuels and general societal needs for metals and minerals that mining and metallurgical engineering faces a period of growth and may be on the threshold of a new era with a vitality that has not been enjoyed for several decades. The following information is based on material obtained through questionnaires received from twelve schools accredited in mining or mineral engineering (out of 18 in the U.S.), 2 not accredited and 5 which no longer have mineral engineering disciplines. The schools presented do not include the smaller nor larges of the undergraduate programs in mining engineering.

"Mineral endowment in northern British Columbia and the Yukon Territory was assessed on the basis of geological opinion which was gathered in a quantitative framework of subjective probabilities. The survey area encompassed 364,000 square miles and was divided into 310 cells having dimensions of one degree of longitude by one-half degree of latitude. The response solicited related to tonnage, grade and number of deposits of a particular mineral in each cell. The questionnaire sought an expression of mineral endowment down to mine-able depth as distinct from economic expectations. Details on the questionnaire and responses are presented in a series of contour maps on individual commooities, which illustrate the collective occurrence picture of the respondents. The approach is largely dependent on the cooperation of an adequate number of geologists familiar with the region being examined. This approach to an assessment of the mineral endowment of a region has a wide range of applicability, from the focusing of exploration effort to aiding government and development bodies in the formulation of regional strategies and the planning, for example, of road, rail and power facilities."

"Mineral processing – the first technological stage of utilization of mineral – has a very long history. In particular, it revealed and reveals the continuous development and perfection of technological operations and process organization, comprising not only new design solutions and exploitation procedures but also, for example, perfected systems of control and automation as well as methods of process description and result evaluation. During the recent decades the attitude to mineral raw materials was clearly changed, both to the primary ones, i.e. minerals, and to the secondary ones, such as side products and waste, formerly considered useless and at present more commonly used. This results both from the appearance and growth of demand for more and more numerous components of mineral raw materials and also from the necessity of protection of natural resources, constituting the integral part of the system of sustained development of society.These circumstances, and especially the requirements concerning gaining some components which cannot be separated by means of “classical” (used for many years) technological processing operations and aiming at increasing the technological procedures, evoked the necessity of using new technological solutions, applying other basic operations, also the ones characteristic so far for other processing technologies, i.e. chemical, biotechnological and others.These development tendencies, in general commonly perceived, allow us to formulate an opinion that the former state of tasks and processes of mineral processing is being transformed into a qualitatively new form. It can be assumed that this process was signaled by a situation in which, due to the growing role of technological operations based on physicochemical phenomena (flotation and others), magnetic and electrical ones, etc., one should have observed that the former term of “mechanical processing” became inadequate for the real content of the notion determining the discussed stage of mineral utilization, so the adjective “mechanical” disappeared in most languages."

Mineral exploration is the business of finding and defining ore deposits. Ore bodies are developed into mines and mines supply every mineral and metal upon which our society is built. Whether it be steel for our bridges, cement and aggregate for our concrete, coal for our power stations, copper for our wire, phosphate for our fertiliser or gold for our jewellery it first must he found, then mined and processed before we can use it. There is no other way.

INTRODUCTION Virtually all countries have general legislation covering most aspects of mining and mineral processing, including investment and tax laws, safety and health regulation, and specific rules applying to exploration reporting procedures. Yet most developing countries negotiate individual agreements with foreign investors for major mineral projects, in particular when all or part of the expected output is exported. Such agreements are known under several different names, as for example concession agreement; technical assistance agreement or service contract; management agreement; production sharing contract; joint venture; or contract of work. The objectives and conditions governing such contracts are as diverse as these titles are. While a mining project is only one among a large mumber of similar undertakings in industrial countries, in most developing countries such projects usually have a dominating position within the country's economy. The general legislation is often inadequate and insufficiently detailed to cover all aspects of large projects with extensive foreign inputs and international markets. Therefore, the need for specific arrangements. Specific arrangements may also become necessary due to the complexity of markets for mineral products, the large number of participants - equity partners, suppliers, financial institutions, buyers, etc. - or economic and political conditions in the host country and fiscal regulations in the home country of the investors. Most agreements are concluded between governments, or government agencies, in developing countries and private industry headquartered in developed market economies - Canada and the United States of America in North America, Western European countries, Japan, South Africa and Australia - or, in some instances, with state-owned firms in these countries. There are fewer agreements between developing countries and the centrally planned economy countries - Eastern Europe and the USSR - which cannot be considered here because of absence of adequate information. Agreements can be concluded at any of the different stages from exploration through closing of a mine. While most contracts are negotiated at the time when a potentially viable ore body has been delineated and investigated sufficiently to anticipate a realistic time for commencement of production, other agreements start with "grass-roots" exploration, during operation of a mine, smelter or refinery or, exceptionally, after a temporary shutdown. While several major provisions are included in all types of agreements, others are covered in much more detail (or not at all) in some contracts reflecting the specific work programme of each project. While it is realized that subdivision and classification of complex contractual relations is necessarily arbitrary to a certain extent, such grouping is useful in practical terms, especially for the non-specialist. The following discussion, therefore, will start with a description of the major forms of contractual relation - concession, investment contract, joint venture, management agreement, service and production sharing contracts. Major issues covered in all, or almost all, agreements will then be dealt with. These include stages of development, corporate structure and control, fiscal arrangements, infrastructure development and environmental law, and dispute settlement and renegotiation. FORMS OF CONTRACT RELATIONS There has been marked change in the type of agreement entered into during the 1960s (and before) and the early 1970s and the period thereafter. While straight "concessions" - granting of exclusive rights to foreign investors over a certain deposit or areas with little restriction or well-defined obligations - were the rule during the first half of this century, more complex agreements have evolved since. Some of these cover every conceivable aspect, foreseen or only possible, and define rights and obligations of all partners to the last detail. Over the years, agreements have without doubt become more beneficial for the developing host countries, in part as a result of well-publicized nationalizations, as for example in Chile, and in part due to changed attitudes in all countries
