The Tuesday Morning session opened at 9:00 a.m. and was presided over by Mr. E. C. DeMoss, Vice President, Utah Construction & Mining Company, San Francisco, California. Mr. DeMoss introduced Mr. C. Howard Hardesty, Jr., Senior Vice President, Con¬tinental Oil Company, New York, N. Y. Mr. Hardesty spoke on the "Relationship of Coal to Progress in Oil Industry." Mr. Hardesty was born in Fairmont, West Virginia, 1922. He is an attorney by profession; he attended Mercerburg Academy in 1939 and received a Bachelor of Science degree from Duke University, 1943. He then served three years in the U. S. Navy and returned in 1946 to obtain his LL.B. from West Virginia University in 1949. Mr. Hardesty has had an outstanding professional career which started as a partner of the law firm of Furbee & Hardesty, Fairmont, West Virginia. He subsequently was West Virginia's State Tax Commissioner and President of the West Virginia Bar Association. In 1963 lie became General Counsel of Consolidation Coal Co., Pittsburgh, Pennsylvania; in 1964 he was made Vice President, Secretary and General Counsel, Consolidation Coal. In 1966 he was elected Executive Vice President of Consol, and, shortly after it was merged with Continental Oil Co., he was made Senior Vice President of Continental. He is married to the former Doris Wilson; they have two children and reside in Greenwich, Connecticut.

The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. (Articles of Incorporation and Bylaws as adopted are printed following these minutes.) Additional resolutions were read by Linville as follows: Item 1: WE RESOLVE herein that in the year since the last convention of the RMCMI, the Institute and the coal industry have suffered the loss, through death, and the services of: Lloyd W. Taylor Charles T. Holland THEREFORE, BE IT RESOLVED, that we record in the minutes of the RMCMI, recognition of the passing of these members who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere sympathy and deep regard of the members of the Institute. Item 2: RESOLVED, that in recognition of their long and faithful service to the coal industry that the status of Life Member be conferred upon: Bernard Bernstrom Roy Coulson Shirl C. McArthur Item 3: RESOLVED, that we commend and express our gratitude to our Executive Secretary, officers, chairmen and committees for an outstanding job in presenting. the 80th RMCMI meeting. Item 4: RESOLVED, that the RMCMI express its gratitude to K&P, INC. of Golden, Colorado for their generous donation of office facilities and furniture for the RMCMI office and to K&P SALES ENGINEERS, INC. also of Golden, Colorado for their assistance in telephone answering, other office procedures and the use of certain office equipment. Item 5: RESOLVED, that six scholarships be awarded annually to advance the education program of the Institute to worthy students pursuing career paths in mining or other related industry in the six states in which the Institute generally operates and has members and in accordance with the criteria set forth by the Scholarship Committee. The Forty-Sixth Meeting of the Rocky Mountain Coal Mining institute convened at the Hotel Colorado, Glenwood Springs, Colorado, June 19, 1950, at 10:00 a. m., G. E. Sorenson, President, presiding. PRESIDENT SORENSON: The meeting will come to order, gentlemen. I note from the program here this morning that you were supposed to have an address by the president. I can assure you, gentlemen, that the president is not going to make an address, so you don't need to squirm in your chairs. I do want to say it's certainly a pleasure to be here. I am sorry that I wasn't here last year. Apparently my absence lent consent, and I think it would be a good warning to every member of the organization to be here for all the meetings for your own protection! It's always a pleasure to be here and meet again with some of our old friends and meet a lot of new ones. It always interests me at these meetings to meet with the rugged individuals that operate the coal industry. They have to be rugged; they couldn't be any other type of men and live in it. I also know that it takes a good rugged man to fight this game nowadays. I feel that the men who operate the coal industry are fighting a battle against socialism. You all know we are the first industry they have their eyes on. If they take over our industry, they will take over everything else.

Chairman Doc, distinguished guests, and fellow members of the Rocky Mountain Coal Mining Institute: It's a genuine pleasure to meet with you again at the 54th regular meeting. I might add that it is always pleasant to be at the top of the batting order. The field is wide open since there is no danger of repeating something already said. At the same time, I am aware that the lead-off speaker has a responsibility to avoid stepping on the toes of subsequent speakers. I promise to confine my remarks to areas other than those to be covered by the well qualified speakers that follow. During our meetings at this convention, many fine papers will be presented. Our thanks are due Bob Williams and his hard working program committee for the superior selling that brought so many eminent speakers to our meeting. And, of course, our special thanks go to Doc Schloss, general chairman of this meeting. Doc and his able colleague, Stan Shubart, have been the spark plugs that fired up all of the arrangements we are enjoying here in Glenwood Springs. I'm sure all of us are appreciative of the many hours Doc has devoted to seeing that our meetings will be pleasant and profitable. When we mention arrangements, we always think of that master arranger, Fred Whiteside, who, as a charter member and secretary-treasurer of the Rocky Mountain Coal Mining Institute, has had more to do with more matters around these parts than just about anyone I can think of.

The Sixtieth Regular Meeting of the Rocky Mountain Coal Mining Institute convening at the Stanley Hotel in Estes Park, Colorado, was declared in session at 10:10 a.m. by Past President Mike Zakotnik, Jr., General Superintendent, The Kemmerer Coal Company, Frontier, Wyoming. Mike introduced Claude P. Heiner, President, Minerals and Development Corporation, Salt Lake City, Utah; and President of the Rocky Mountain Coal Mining Institute. President's Address Members of the Rocky Mountain Coal Min- ing Institute, guests, visitors and friends: I feel this is a distinct honor to talk to you on the occasion of this 60th regular meeting of the Institute. I once assumed this would be the Institute's 60th birthday, but later found that the first meeting was held in the State Capitol at Denver on November 12, 1912, at which time a comparatively small group of operators duly organized the Institute; a Mr. Weitzel of Colorado Fuel & Iron Company was then elected president and our late and dearly remembered Fred W. Whiteside, whose wife Gussie now carries Fred's work forward, was elected secretary. From Fred's records, early meetings were held semi-annually at rather irregular intervals, so that this 60th meeting is approximately the 52nd birthday of the organization and I am number 44 to serve as president. This latter development, I am sure, was conjured up last year by certain members at Glenwood Springs when I was absent. Anyway, I am honored and trust 'that these sessions will be both interesting and instructive in helping us on our way in the coal business.

The 77th Regular Meeting of The Rocky Mountain Coal Mining Institute convened at the Marriott's Mark Conference Center, Lionshead Village, Vail, Colorado, and was in session at 10:00 a.m. Past President, Loren V. Linville, District Sales Manager. Industrial Products Division. Uniroyal. Inc., Denver. Colorado, called the meeting to order. He introduced President, Edward F. Ziolkowski, Senior Vice President and General Manager, Energy Development Company, Hanna. Wyoming. A biographical sketch follows: Ed Ziolkowski is a 1953 graduate from the Colorado School of Mines with a degree in Engineer of Mines. His mining career began with Pickands Mathers Company in Gogibic Iron Range in Northern Wisconsin and Michigan. In 1961 he joined Texas Gulf Sulphur Company as Shaft Mining Engineer for their Cane Creek Potash Project near Moab, Utah. After serving as General Mine Foreman. Mine Superintendent and General Superintendent at Cane Creek, he was transferred in 1969 to Green River. Wyoming as Project Manager of Texas Gulf Black's Fork Trona Development. In 1971 he joined Allied Chemical Green River Works, as Resident Manager. In 1972 he joined Energy Development Company, an Iowa Public Service Company Subsidiary, as General Manager of their Coal Development. He currently is Senior Vice President and General Manager of Energy Development Company, and serves on their Board of Directors as well as the Boards of several other subsidiaries. This past April he was elected to Iowa Public Service Company's Board of Directors. Ed, his lovely wife Pat and children live in Hanna, Wyoming. He has been a member of the RMCMI since 1973. Is a staunch supporter of his community and the mining industry.

The 65th Regular Meeting of the Rocky Mountain Coal Mining Institute convened at the Stanley Hotel, Estes Park, Colorado, and was in session at 10:00 a.m. The first session was called to order by Past President Joe T. Taylor, Kaiser Steel Corporation, Palo Alto, California. Manager of the Stanley Hotel, who welcomed the guests to the Stanley. After a few remarks, he introduced Bob Dean, for- mer Manager of the Stanley Hotel and again associated with the Stanley, who also made a welcoming talk as Mr. Dean has hosted the Institute at the Colorado Hotel in Glenwood Springs and in Estes Park. Mr. Taylor introduced President Stanley C. Shubart, Secretary-Treasurer, Schloss & Shubart, Inc., Denver, Colorado. Stan was raised in the machinery end of the coal industry following the footsteps of his Dad who was one of the founders of the RMCMI in 1912. And following his Dad's years of service to the Institute, 12 of them as Secretary, Stan has been active as Chairman of the Hotel & Registration Committee for 16 years, and, prior to his election as President, was General Chair- man for two years He is a graduate of the University of Colorado with a degree in mechanical engineering. He served our country in World War II and retired as a Colonel, Army Ordnance, after 43 years in the Reserve. He is a Trustee of National Jewish Hospital and was their President for 3 years. He has been active in many Military and professional societies, and in civic projects. I give you our President, Stan Shubart, for his remarks.

The 74th Regular Meeting of the Rocky Mountain Coal Mining Institute convened at The Mark Conference Center, Lionshead Village, Vail, Colorado, and was in session at 10:00 a.m. Past President, Ralph Moore, Vice President, Operations, Westmoreland Resources, Hardin, Montana, called the meeting to order. The membership was asked to stand and pledge allegiance to the flag. He welcomed members and guests and thanked Park Lamborn, the Program Chairman, for the excellent speakers and program he engineered. He mentioned the cancellation of our golf tournament due to the conflicting dates with the Annual Jerry Ford Invitational Golf Tournament. He thanked all of the committees with a special "thank you" to Loren Linville and Gussie Whiteside. He introduced President, Shirl C. McArthur. President and General Manager, American Coal Company, Huntington, Utah. A biographical sketch follows: Mr. McArthur, a native of Huntington, Utah, began his coal mining career shortly after graduating from North Emery High School and worked his way up through the ranks, having worked at every job available underground. For example, he dug coal with a "banjo" at the Independent Coal and Coke Company in Kenilworth. In the summer of 1941, he worked at Straight Canyon Mine as a timberman and advanced to section foreman in four years. He was face boss for part of the time. In October 1946, he received a call from the LDS Church General Welfare Board (presided over then by Marion G. Romney) and took over as superintendent of the Church Mine. He operated in that capacity until the mine became privately owned in 1971. In 1961, Mr. McArthur formed Castle Valley Mining company, and in 1970, he organized American Coal Company, which he presently owns and operates.

MR. C. M. GODDARD: Mr. Poli invented this little safety switch box. This junction box he has does improve the appearance mentioned in the underground junction boxes used in the foreign countries, where this thing is compulsory. There was some arrangement whereby the attachment could not be made with the switch in. The switch has got to be out of place before they can put the terminals into this box, which avoids all possibilities of short-circuits, except where protected on the inside of this box. In mines that are not gaseous, this is not so essential, but he has invented a very small junction box which probably. could be built for six or eight or ten dollars; if those things are necessary, for the handling of mining machines and their apparatus, takes current off the transmission line, and he has something that would meet that requirement, and I think when it is looked into it will meet the approval of the Bureau of Mines. He had this little box yesterday, and some of the members had looked it over and think, if they will look more favorably into it, they will find something to their advantage. PRESIDENT PRYDE: I think it is a good idea to bring in safety appliances and devices at this meeting. There were two more devices brought in here this morning; one a safety powder flask, and the other a carbide can. We have talked a great deal about permissible powder. It is going to take a little time to change over, and we would have to use the black powder cans. I will leave them in the window, if you care to investigate them.

Lloyd W. Ingles, Superintendent, Allen mine, Colorado Fuel and Iron Corporation. Stonewall, Colorado, called the meeting to order at 9:30 a.m. He introduced George C. Trevorrow, Safety Director, Bituminous Coal Operators' Association, Washington, D. C., who spoke on "Recent Developments for Improving Safety in Underground Coal Mines." (Refer to the index for the printed text of this paper.) Following Mr. Trevorrow's paper, James Westfield, U. S. Bureau of Mines, Washington, D. C., spoke briefly to the group or some of the new methods of controlling fire mentioned in Mr. Trevorrow's paper. Mr. Westfield stated that the Foam plug had been used in the Bureau's experimental mine, and was also used in New Mexico, but was not successful in putting out the lire. In a recent fire in Southwest Virginia where 18 men were lost, the foam plug was used after the fire had been burning for about 6 or 7 days. It did have a good effect, but the section had to be finally sealed off. In a fire in Pennsylvania about 2 weeks ago, the foam plug was put into action after about 9 hours. Although the section was finally sealed, managers of the mine credited the foam plug in saving the mine. Mr. Westfield stated that equipment must be at hand when fighting a fire; that time wasted in securing proper equipment may make the difference. Mr. Westfield also stated that as late as 2 months ago, it seemed that a methane monitoring device was as far as 4 or 5 years away. Now it is expected that it may be put in production within the year. Experimental models are in use in Pennsylvania and West Virginia. Mr. Westfield concluded by complimenting Mr. Trevorrow on his excellent paper.

The 68th Regular Meeting of the Rocky Mountain Coal Mining Institute convened in Manor Vail Lodge, Vail, Colorado, and was in session at 10:00 a.m. The meeting was called to order by Past President Max A. Robb, Vice President and General Manager, U.S. Fuel Company, Hiawatha, Utah. Mr. Robb welcomed the members and guests and was pleased with the large attendance. He then introduced President Joseph E. Ward, former District Man- ager, Denver Office, Coal Division, Joy Manufacturing Co. (Retired). A brief biography follows: Mr. Ward is a transplanted Westerner, having spent the greater part of his life in the Eastern and Southern areas of this country. In 1927, he graduated from what was then the Carnegie Institute of Technology in Pittsburgh, Pa., with a B.S. degree in Mining Engineering. He dropped out of school for a period between his Junior and Senior years and worked in the coal mines in order to obtain sufficient money to complete his education. Practically all his adult life since graduation, has been spent in or around the coal mines in this country. After graduation, he worked the next 15 years of his life as an underground supervisor, first for the Hudson Coal Co., in Scranton, Pa. and later for the U.S. Steel Corporation in Birmingham, Alabama. He then went into sales, selling basically to the coal mine industry and other mining operations. The last 13 years of his business career were spent as a district manager for Joy Manufacturing CO., 10 years of which were in the Coal Division of their Denver office, covering the Rocky Mountain area. He retired in August 1970 but still retains an active interest in the Rocky Mountain Coal Mining Institute and the Rocky Mountain Coal Industry it supports. He is a widower, his wife, Thelma having died in July 1970. He has two children and six grandchildren.

Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

This time of year, our lawn is host to goodly numbers of birds - robins, English sparrows, finches of various flavors and some whose names I don't know. We lure them with a feeder in our backyard and I'm sure Patti and I spend several minutes a day watching them through a picture window that overlooks their coming and going. And, while the picture window supplies us with a constantly changing view, it does not treat our winged friends nearly so kindly. You see, at certain times of the day, reflections on our window feed back to our birds a mirror image of the backyard. Lifting off from the bird feeder, they see before them what is behind them. And, not infrequently they fly straight into the window. They stop abruptly, of course. It has to be quite a shock to discover that what is behind you is not the same as what is in front. At this point, I might be tempted to say something about bird brains - except for the fact that we humans also are prone to deceptive images thrown up by the past. Today, I think we hear a great many voices painting past images as they look to the future. We hear that the price of oil soon will rise to its former elevated position; the price of copper will bounce back; a hungry world soon will escalate the demand for food and our agricultural industry will be back in the black. In fact, we can hear hope from many voices telling us that our major resource-rich, basic industries are poised to fly up. I can hope that the voices are right, but I keep thinking that those expressions come from people seeing false images. Most certainly, it is more comfortable to see the past, rather than acknowledge that the world economy is being restructured and that the restructuring is affecting the Rocky Mountain states profoundly and negatively. The worst mistake we could make may be to place too much credence in the images from our past. We can be lulled into a dangerous complacency. What we need is a tighter belt and the will to do some serious bootstrapping. Before proceeding, I would make two points: First, it is not my intent to be a prophet of doom. But I do think we need some healthy doses of realism, if we are to avoid the shock of flying into a false future. Second, by now you have detected that I have choosen to diversify the assignment you handed me on utility diversification. As I proceed, you soon will see that the roots of diversification for many utilities lie in the subject that we ponder now. We could begin in many places, but let's start with energy. It is pervasive in our businesses and industries. We all use it. And, despite conventional economic wisdom, we are using less of it. The price is down, but we have not reverted to our profligate ways. That is true whether you look at the industrial customer or the residential consumer. As a nation and as a people, we have learned to do more work with less energy. A few statistics illustrated the point. If we use 1973 as the base year, energy use in the United States has declined almost I percent. If we examine the year of peak energy use, 1979, the decline approaches 7 percent. Let's look at it another way. In 1973, for every dollar of gross national product, the United States consumed 27,100 Btu of energy. Last year, 1985, the comparable figure was 20,700 Btu - a decline of 24 percent. So, not only are we using less energy, but we are using it more efficiently. Even though the price of energy has declined, we are unlikely to use substand with natural gas and petroleum consumption. Use of natural gas has dropped almost 21 percent since 1973. Petroleum consumption has declined 1 I percent since 1973 and almost 19 percent since 1978, when the U.S. used a record quantity of petroleum. We also know there's been no appreciable change in amounts of oil and gas used since 1981. We weathered both a sharp recession and a healthy recovery without altering the amount of those fuels used. That the use of oil and gas dropped sharply, while the total use of energy merely slumped a bit is easy to explain. The use of coal, nuclear power and hydroelectricity from 1973 through 1985 increased almost 48 percent. Some people will tell you that the large decrease in the price of oil and gas will result in increased demand that will displace coal, nuclear and hydropower. In turn, demand will force the price of oil and gas upward. I doubt it. From the poking around I've done on the subject, I suspect there may be some short-term displacements, but they will be, for the most part, cancelled out by declining use among existing customers. For instance, we all know what has happened in the automotive sector. In 1973, the average U.S. automobile made 13.1 miles to the U.S. gallon of gasoline. In 1984, the most recent available statistic, the average auto made 16.94 miles to the gallon. That's a 19 percent improvement. Because annual miles driven per automobile are essentially unchanged over the period and the number of cars on the road is not increasing, we are witnessing a drop in this segment of the petroleum market. That trend will continue. Now, let's look at energy consumption patterns still another way. Between 1973 and 1985, consumption in the residential and commercial sectors of our economy increased total energy use by 11.2

The thirtieth regular meeting of the Rocky Mountain Coal Mining Institute was called to order at 11: 20 o'clock A. M., Wednesday, June 3, 1931, President G. A. Kaseman presiding: PRESIDENT KASEMAN spoke in part as follows: I have in mind to say a few words of welcome to the coal operators, but I am afraid that the words I might have said would be hardly appropriate, because I believe the coal operators are in the minority today. It demonstrates to my mind something that has been running through it for some little time. When the hard times came on a year ago, we thought we were going to get over it rather lightly. I recall at this time a year ago we thought that the depression was about at an end. The National Administration from Washington told us we had reached bottom and things were going to perk up, and for a few weeks or maybe a month or more there was a sort of optimism throughout the country. I had been East, and when I re- turned to Albuquerque I said to my friends and associates that things were getting better in the East and that they would soon be better out here and we will not have felt the hard times very much. But I have learned differently since. I have learned that hard times are no respecter of communities or corporations, or persons, or activities, and that we all suffer alike. On that account we find that our Institute is suffering just the same as other activities, whether national, state, local, social, or what- ever it may be. Our attendance is light or, that account. We all know when times are hard we have to stay at home and watch things closer than when they are good. And when they are good we feel that the machine will run of its own momentum and in this way we can get away to see what is going on in the world. When times are hard we have to stay at home and look after everything from day to day and hour to hour.

Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,

The Annual Business Meeting of the members of The Rocky Mountain Coal Mining Institute held during he 84th Regular Meeting of the Institute was called to order by the president, H. Dean Jacot at 11:30 a.m Tuesday, June 28. 1988 in Peak Room 5 of Beaver Run Resort at Breckenridge, Colorado. Twenty three were present and a quorum was established. The president stated the purpose of the annual meeting is to inform members of the status of the affairs and activities of the corporation during the year. It was moved by Loren Linville, seconded and carried to approve the minutes of the previous meeting as published in the 1987 Proceedings. The chair called for reports of the various com¬mittees and these reports will he placed on file in the RMCMI office. Bylaws and Resolutions. Chairman Loren V. Linville reported there were no bylaws revisions. He further reported that the Board had adopted two resolutions: (I) Noting the passing of members since the last convention-Richard T. Brownrigg. Don A Dewey, John T. Maulshy. Hugh D. Nyquist and Mike Zakotnik. (2) Recognizing the superior skills of J. Brett Harvey. RMCMI Vice President of Utah. For recruiting 26 new members from the State of Utah and named him as #1 Recruiter in the Institute?s 1988 membership drive. Linville further commended the Executive Secretary officers, chairmen and committees loran excellent job in planning the 84th Regular Meeting and convention. Membership. In the absence of chairman Ed Sullivan. the secretary reported there are currently 718 active or dues paying members, 51 Life Members and 250 delinquent in dues payment. In the 1988 membership drive. 132 new members have been recruited and 74 of them attended this convention making up 27V, of the total attendance. Patrons of the Institute. This report was given by the secretary for chairman Ira McKeever. A total of 124 plaques has been prepared during the low year life of the program. It has been culled to 119 possible donors as some firms have gone out of business or consolidated. Of this number 46 renewed their annual $100 donation and three new Patrons have joined prior to the convention for a total of 49. During the convention. four new Patrons donated $100 each. tour former Patrons pledged $100 each and seven would be-new Patrons pledged $100 each for a total of 15. This would bring the grand total to 64 if all pledges are received prior to the close of this fiscal year as opposed to 59 renewals in 1987. Program. Co-Chairman Pete Nielsen announced the convention program theme "Broadening OUR Horizons" was well received despite the loss of three speakers during the final days prior to convention. Because the remarks of the Monday luncheon keynote speaker ran over the first time-to-be-tried Monday afternoon Poster Session was delayed almost an hour in beginning. This well thought out feature will he run again next year but in a different time frame. Nielsen thanked his co-chairmen, Bill Balaz and the Poster Session chairman Marcie Greenberg. Publicity. Chairman Tom Egan reported three newsletters including the convention newspaper were sent members during the year. He and Bob Jacob of Bob Jacob Public Relations were at registration daily to secure business card ads and to solicit advertising for the Proceedings. Scholarship. Chairman Keith McGinnis reported that six of the seven scholarship recipients were present at the convention. The University of Arizona at Tucson was added this year and it was the only university visited this year by the chairman. Each scholarship recipient was introduced to the membership at the Monday morning Welcome Session, presented a plaque and responded. The input Iron each winner was most favorable to the program. Each was appreciative of the many contacts made and the educational seminars and programs. McGinnis noted that the mining engineering department at the University of Wyoming may be dropped during the coming year. Joe Dunlap suggested that every member rally support of this department. My acquaintance with rock, dusting as a preventive of wide spread explosions in coal mines dates from the fall of 1914 and the spring, summer and fall of 19.1.5 when I had an opportunity to observe the staging (both before and after) of several of the explosions in the Experimental Mine at Pittsburgh and saw violent explosions stopped by rock dust, also saw violently explosive coal dust made insensitive by use of rock dust to ignition or to propagation or spreading of an explosion. From this work I became a convert to rock dusting though I had previously been a firm believer in watering methods and am yet a firm believer that watering, methods have a well defined place in promoting the health and safety of our coal miners. In 1916, while in the Bureau of Mines service, I made an underground study and a report to the Bureau on the first extensively rock dusted mine, in the United States, the Delagua Mine of the Victor American Fuel Company near Trinidad, Colorado, there being then some ten miles of entry in that mine which had been kept well rock-dusted for at' least four years The dust used was " adobe" or surface soil screened from sweepings of the dry surface wagon roads through a screen with one-eighth inch openings, the dust giving about 20% through 200 mesh and about, 10% of approximately 1/8-inch size. The material was collected during dry weather by contract at $1.00 per ton (sacked) and was accumulated in summer and stored for winter and spring use. The dust was scattered through haulage entries by hand or by an electrically operated blower and was held on shelves along the ribs or between and on timber caps with from 1/4-inch to 2-inch thickness of the rock dust. The cost of maintaining the 10 miles of entry well dusted was about $1,500.00 per year or $150.00 per mile per year. Total cost of 'the rock dusting over a four-year period was about $6,000.00, about 2,500 tons of dust being used and 2,000,000 tons of coal produced; the above cost included about 1,200 days labor dusting at $2.50 per day, 2,500 tons of rock dust at $1.00. per ton and miscellaneous labor, material, repairs, power cost, etc., amounting to about $500.00. The cost per ton of coal produced for keeping 10 miles of entry rock dusted being about 3/10c. In addition to the rock dusting, some sprinkling was done, chiefly in the interior of the mine, costing about 2/5c per ton; and due to spilling of coal and sifting of coal .dust through loose cars on the entry floors, the floors of haulage roads were kept sprinkled between and just outside-the rails. Total cost of sprinkling and rock dusting was about .7/10c per ton much less of course than the same work would now cost. Between January, 1916, and July, 1924, my duties in the Bureau of Mines allowed me, to follow up and make underground inspections and reports on more than 20 coal mine explosions and fires in a number of states of the union and in this work a large number of samples of road, rib, and other dusts were taken to ascertain the effect of moisture, roof and floor dirt, etc., upon the propagation or the stopping of the explosion; also a large part of my work was to obtain evidence pro and con as to influences affecting the disasters and very prominent among those influences were the occurrence or use of water, water drippers, or ponds, as well as of sand, roof or floor rock or dust on floor, ribs, etc. The Dolomite explosion near Birmingham, Alabama, in November, 1922, and the Dawson No. 1 Mine Explosion at Dawson, New Mexico, in February, 1923 (at both of which I made underground inspection and report) both starting on main intake haulage road and both in mines which had fairly elaborate watering systems, convinced me that at least as far as freezing can occur on main intake air courses which also act 2s main .haulage ways, rock dusting is likely to be much more dependable than sprinkling. One of the most dreaded things which mining men sometimes have to contend with is underground mine fires, which are both dangerous and expensive. In the Reliance mines we have had considerable trouble with mine fires. We have at the present time five different fire zones, three of these zones give us considerable trouble and the other two have not given any trouble since they have been walled off. Fire Zone No. 1 comprises No. 2, 3 and 4 South Entries, about 50 acres are enclosed in this zone. Fire Zone No. 2 comprises the main drift entry from the mouth to the Old Boundary Plane and extends to the crop line, about 10 acres are enclosed in this zone. Fire Zone No. 3 comprises 1 and 2 North Entries from the main slope to the Old Boundary Plane, a distance of about 1,200 feet, about 15 acres are enclosed in this zone. Fire Zone No. 4 comprises 11/2 and 2 North Entries, a distance of 1,100 feet between New Slope and Old Boundary Plane, about 15 acres are enclosed in this zone. Fire Zone No. 5 comprises the inside end of No. 11/2 and 2 North Entries and 3 North Entry from the New Slope to 30 room, a distance of about 2,600 feet along No. 3 North Entry, about 20 acres are enclosed in this zone. The first mine fire started in No. 2 South Entry in No. 1 zone in 1914. Inside of No. 7 room on the high side of the entry, there was a soft piece of coal. There were no rooms driven in this coal and one day a fire was discovered in the solid pillar on the high side of the entry, work was started at once to load out this fire. and several places was driven into the pillar and cribs built where the coal was taken out, but this method proved a failure and a sand pack was put up along the entry between the track and the high rib. This consisted of timber set about 3 feet from the rib and 2-inch boards put behind the timber and sand or adobe put in between the boards and the ribs, and this method gave very good results except that it required close watching as the sand would settle and let the smoke out between the roof and the sand. Fire broke out in No. 3 South Entry in No. 1 zone in the summer of 1919. We sealed this fire off by building 36 fire stoppings, which also enclosed the fire in No. 2 South Entry and we have never had any trouble with fires in this zone since it was walled off. The fire started in No. 2 -zone in 1919 and has been very active ever since. When this fire was first discovered we built new stoppings in front of the old one in the room necks; we also opened up some of the room necks and loaded out part of the burning coal and rock but this did not help any, the fire, would burn out around the stoppings also burn along the roof between the top coal and the roof sometimes nearly across the entry. Several holes were drilled from the surface to the fire area and flushing the fire was tried but this was also a:\, failure, the rock above the coal was so hot that the mud would dry in the hole and fill it. In 1921 we started to take down the top coal along this entry, timber the entry and put 2-inch boards behind the timber and fill in between the coal and the boards with sand or adobe. We have at present over 1,000 feet of this work done and it has given us better results than any other method that we have tried. As the coal burns out behind the timber the weight breaks the timber and it is necessary to renew some of it. Fire broke out in No. 1 North Entry in No. 3 zone in 1922. There was a stopping in this entry that had been put in when the entry was finished some few years before. The fire burned around the stopping on the low rib of the entry, we built another stopping in front of the old one taking down the top coal and extending it up to the roof also digging in both ribs and setting the stoppings into the coal about 18 inches. This fire did not cause any trouble until June, 1924, when we discovered this fire was very active on the inside
