Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement

When I was asked to read a paper to you, I wondered what idea I could bring before you which would be interesting and which would be helpful in your work in operating coal mines. The Institute has been studying ways and means of increasing the safety and efficiency of mine operations. Almost every subject along this line has been discussed from time to time. In thinking the matter over it occurred to me that there was one thing used by practically all coal mining companies in considerably large quantities and which in many cases does not receive the attention it should. It is the cutter bit placed in the cutter chains on coal mining machines. Coal mining machines have been repeatedly improved during the last twenty-five years until their efficiency and convenience have reached a high level. The generating units making electrical power to operate them also have been developed to a similar degree. This machinery has been in- stalled at a great expense to coal mining companies and the installation made for the sole purpose of pulling coal cutter bits through coal. Why not then give these cutter bits some attention so as to see that they do their work as efficiently as their driving and propelling units? The consideration of this question easily divides itself into three principal parts-First, the kina of steel out of which to make the bit; Second, the proper form or shape to give it; and Third, the tempering of the bit. Let us discuss them in that order. There have been tried at different times' various grades of steel for cutter bit uses. The cheaper steels, having a very low carbon content (.10 to .30 per cent carbon) have proved un- satisfactory because such steel cannot be tempered so as to produce a satisfactory cutting tool. Because of the low carbon content, it cannot be hardened to retain its cutting edge. It dulls quickly, bends easily on striking any hard obstruction in the coal, and so requires constant resetting to its original form. The high priced alloy steels when properly shaped and tempered will give a bit that would make a clean, even cut in the coal if no impurities were encountered. Such a condition is rarely found. Alloy steel is quite brittle and on striking impurities, such as sulphur balls or a sand spar, is readily broken and so the loss of material through these broken bits and the high price paid for it more than offset all the other advantages which this steel has shown in cutting. Experience has shown that steel having approximately .70 per cent carbon and from .25 to .35 per cent manganese will give the most economical results. Some mines have obtained better results by using a steel of slightly higher carbon content and in some cases a grade of tool steel has been used. The disadvantage of using a steel having too much carbon is that it can easily be spoiled in the black- smith shop by overheating. Steels having a carbon content of about .70 per cent have a sufficiently wide range of temperatures at which they can be forged and hardened so that with ordinary care and attention they are not likely to be burned. Steel of this quality, therefore, has been found to be the most practicable because of its reasonable cost, ease in working and tempering and general durability. The second annual RMCMI Mine Rescue Performance Evaluation was held in conjunction with the 1993 RMCMI Convention at Beaver Creek. [ ] Six teams participated in this year's evaluation; BHP Minerals, Navajo Mine, Fruitland. NM; BHP Minerals - LaPlata Mine. LaPlata, NM; BHP Minerals - San Juan Mine. Waterflow. NM; The Coteau Properties Company - Freedom Mine, Beulah. ND; Cordero Mining Company, Gillette, WY; and The Falkirk Mining Company - Falkirk Mine. Underwood, ND. The Western Energy Company of Colstrip, MT was represented through observers and evaluators. [ ] Realistic industrial related scenarios, closely simulating the stress of actual rescue incidents, were provided by members of the Eagle Valley Ambulance Service. Five different scenarios were presented to each team on the first day of the evaluation and three on the second. Each team was given the pertinent information to solve the problem as they assembled at the scenario site. The scenarios were going on simultaneously and each team was unaware of the circumstances until they entered the scene. Interested onlookers were afforded the opportunity of viewing the actual simulated rescue operations as they occurred. The teams received valuable pointers and direction from the ream of evaluators following each scenario. They were are also given the opportunity to observe the other teams in action and to meet with the members of all the teams to share information and ideas during team meetings per the predetermined schedule. The primary goal is to recognize current rescue skills, knowledge, and abilities of participating teams. In doing this, each team was provided with individual evaluations and a path for improvement as needed. Each team was recognized for their efforts at an awards breakfast on the final day of the evaluation. New innovations in rescue equipment were introduced and demonstrated for interested teams following the awards program. The importance of progressive training such as what we are witnessing at evaluations during the RMCMI conventions cannot be stressed strongly enough. These teams are the providers of immediate rescue and medical care for victims of accidents at their respective properties. Every mining operation has the potential for very serious accidents due to immense size of equipment and mining logistics. These rescue teams must be prepared to act with the most immediate, professional and knowledgeable actions to save lives and prevent further injuries. Safety is a primary concern of every mining operation and the mine site rescue team is an integral part of that safety effort. I am not an orator and have never said a word in public during my thirty years' experience in the coal mines of Colorado; but, being requested to speak by our worthy chairman, and as I am deeply interested in the future welfare of this organization, 1 will make an effort to say a few words in behalf of the Rocky Mountain Coal-Mining Institute, which we are about to organize. As 1 understand it, it is the object and intent of this organization not merely to assemble occasionally for the purpose of discussing various problems in coal-mining, and thus to obtain the best possible results in economic operations, but its especial duty will be to devise ways and means whereby accidents in coal mines will be minimized. Figuratively speaking. we are about to plant a tree in the State House of Colorado, and desire its roots and branches to extend over Wyoming on the north, New Mexico on the south. and Utah on the west. So we expect this tree to bear fruit over a vast area. We must remember that the planting of a tree, even in good soil, is useless unless we cultivate, prune, and nurture its development. If we will not do so, the tree will not bear the desired fruit. So, in order to make the Rocky Mountain Institute a success, we must not only start it off in good shape, but we must keep on adding to its strength in various ways, so that it will become a known factor and a recognized power over this broad territory. In other coal-mining states and countries of the world much has been accomplished through similar organizations to reduce loss of life among men engaged in the production of coal, and there is no reason why our institute in the West should not be equally useful and attain the same results. There are many ways by which this organization can be made beneficial to the men engaged, in various capacities, in handling the "dusky diamond." I will endeavor to confine my brief remarks to the necessity of a crusade of an educational nature among three classes of men that are directly and indirectly connected with coal mines. First-We need to educate ouselves. It is amazing how few of our number, holding positions of trust, and having charge of men in and around coal mines, are conversant with our brief mining laws and cognizant of our duties in enforcing them. Going down the line to our company men and miners, I think 1 can safely say that not over 5 per cent of them are in any way familiar with the statutes that have been enacted for their especial benefit and protection. This condition, 1 think, can be, and ought to be, remedied, and. if thoroughly done, the effect in reducing loss of life will soon become apparent. Now, to reach the officers or men in charge I consider an easy matter, which could be accomplished in this manner: Have our general managers or owners of coal properties issue a circular, compelling every superintendent pit boss, fire boss, or other officer having charge of men, to send them a copy of the mining law in their own handwriting every six months. But to come to the masses engaged in coal-mining. to get these men of various nationalities educated in the mining law, will be a difficult task indeed; but I think I have an original scheme that is practical, and which, if put in operation, would work wonders in educating our company men and miners. This plan is as follows: Have every school in every coal-mining district devote one-half hour on Friday afternoon after school hours to the familiarizing of all male pupils between the ages of twelve and sixteen years with the contents of our laws governing coal mines. At the end of each term of school, award small prizes- say, $5, $3, and $2- to those that are best posted, the principal of the school to be the sole adjudicator. Now, someone may say that this is causing extra work to our teachers, with no compensation. In this respect, I will vouch that 95 percent of our teachers will do this work gratis, providing we can show them the benefit of the system. If we go a step farther, and put an incentive before our teachers, probably it would be a good scheme to award a prize-say, $20 or more-for the best set of practical amendments to our mining laws complied by any school and its teachers, judges of the amendment to be members of this Institute and appointed by the President. There is no denying the fact that we need to be educated, and that we should adopt some system that will encourage a knowledge of practical and scientific mining amoung our present forces and the rising generation. MR. J. J. CRARON: If Ross Weber rings that bell of his, I think I have a few secrets on him that I will tell. It is not such a long time ago when the sales and executive departments of the coal industry were constantly urging the operating department to increase their output, and this cry for increased production resulted in vast development work and increased capacity to the point where the operating departments are today in position to produce coal upon sudden demand far in excess of the ability of their sales departments to dispose of it. So today our ability to produce coal is away ahead of our ability to market it. There are many reasons, of course, for this condition. First, the present economic situation, which has prevented even a normal consumption of coal. Secondly, the over-development and production of every commodity and industry as the result of war time and post-war time prosperity. Thirdly, the inroads made by competitive fields, particularly oil and gas, because of the desire of the public for automatic heat.

Mr. Chairman and Gentlemen: The subject assigned to me would cover a great many pages if it were gone into thoroughly. Therefore. I have just touched on a few of the most important points. I think that everyone engaged in the production of commercial coal understands all about its preparation, but I will set forth my views as to how I believe it is best accomplished. In order to produce the best prepared coal, your first attention should be to the miner at the working face. The most careful system of blasting should be adopted to avoid heavy charging of holes which results in the shattering of the coal. The lump, or any other screened sizes that may be screened from coal that has been improperly shot, are subject to greater degradation in transportation and handling, as well as reducing screened sizes, which results in dissatisfied customers in the first case, and lower realization in the latter.

Gentlemen : It is a pleasure to come to Glen- wood Springs to participate in this meeting of the Rocky Mountain Coal Mining Institute an organization created to handle chiefly the economic questions dealing with the coal industry of the Rocky Mountain District. I am not unmindful of the many and varied problems confronting the mining industry of this country which is so general at the present time throughout the United States. By reason of the difficulties experienced in marketing the product of your mines, there is all the more reason for greater economy and efficiency in production. No industry can be efficiently operated without giving due consideration to the safety of the employees. Safety and efficiency are inseparable for the success of any industrial enterprise. While the Bituminous coal companies of the United States are doing splendid work in the promotion of safety, yet our fatality rate is exceedingly higher compared with that of foreign countries, and with greater cooperative organized effort on the part of mine owners, mine officials, mine workers, and state and federal governmental agencies having jurisdiction, much more substantial progress can be made in the future and a greater economic saving .to the industry effected, not taking into consideration the greatest and most important phase of safety, which is the conservation of life and health of all those who are engaged in the occupation of mining. You are concerned with freight rates, marketing of coal and similar operating problems. PRESIDENT MARKS: We have a letter from Mr. Frank N. Cameron, of the Utah Fuel Company, that perhaps I had better read to you. It is addressed to Mr. Shubart, Rocky Mountain Coal Mining Institute (hands letter to Secretary Shubart). UTAH FUEL COMPANY MINE SUPERINTENDENT Castle Gate, Utah, February 9, 1926 Mr. F. N. Cameron, Vice-President & General Manager, Salt Lake City, Utah. Dear Sir: It has now been about nine months since we started the system of having the fire bosses take charge of all shooting and gas inspections at the Castle Gate Mines. We had considerable trouble when we started. Like all other new systems which have been installed, this one was hard to get started and was criticised both by the miners and officials in our own organization, as well as by other organizations in the mines of this county. The older the official and miner was the stronger they seemed to be opposed to the new method. They have no arguments to offer against it, but they know it is not right "because their grandfather did not work it in that way." We know that when some of the other systems were started in the mines of this county, they were fought from all angles. The electrical shooting almost brought the miners at Sunnyside out on strike; their main argument was that they could not make a living if they had to obey the rules that the company was trying to enforce. They also claimed that they could not make enough coal for the day's work by only shooting once at the end of the shift. The same applies to the sprinkling the miners claimed that they would all die of some disease if they were forced to work in a sloppy, wet mine every day. The mining machine was another thing that was hard to install the miners claimed that the company was trying to rob the Door miner out of a chance to make living by installing mining machines to cut the coal. I do not think that the system we have at our mines is perfect-there is still room for improvement in the shooting and inspection of the mines, but I do really think that for safety and efficiency, the inspection department at our mines, working under the new system, is as good if not better than any other inspection department working under the old method in the other mines. I am giving some of the arguments in favor of the new system and would like to hear the arguments against it-if there are any. In cutting the men from monthly to day wages, I do not think it is only the company that benefits by the arrangement, but the fireboss is the one that gets the best of it by the change. How often have we heard the fireboss complain of the hours he had to put in just because he was a monthly man? Under the new wage scale he is paid for every hour he puts in the mines, and when the mines are working every day he makes considerable more than when he was being paid a monthly salary. When the mines are working slow, there is generally some work that has to be done on idle days, or in slow times the force could be cut to a point where some of the work could be done on idle days, and thus the fireboss could be given the preference in this extra work and in this way, his wage could be kept up to the standard monthly salary he was getting before. Mr. Chairman and Members of the Rocky Mountain Coal Mining Institute: Your Secretary has asked me to write upon a subject' which is a most interesting one, and which has a very wide scope. In view of the great need for further decreasing costs at its coal mines, the Colorado Fuel and Iron Company began early in 1924 to experiment with methods of mining which had not previously been. tried out at its mines, and which were selected because of the greater possibilities for the concentration of the work, better grouping of workmen, and increased tonnage per workman, with a resultant increased efficiency, better supervision, and lowered costs. Because of the great competition of the day, means and methods must be provided by which fewer mines can be made to produce larger tonnages and at a lower cost. Western physical conditions are such as to make our problems far more complicated and not so easy of solution as compared to many of the eastern fields where conditions are more favorable for the operation of the mines. The dry condition of our Western mines on account of a relatively low humidity, and with additional gaseous conditions, makes the problem still more difficult to solve. A study of new methods was necessary before adoption, and this was particularly true of the method of extracting the coal. Where mechanical means are used, particularly in the coking coal mines of this state, due consideration must be given to the type, and machines or conveyors should not be installed solely on the basis of their performance elsewhere, without the knowledge of local influencing factors. In trying out the newer methods of extraction at our mines, very careful consideration has been given to the question of safety and the adoption of any new methods must provide adequate means of protection to employes, and be approved by' the State Coal Mine Inspector. In any large industry there are a few outstanding operating costs, and usually the leading ones in their order are labor cost, material cost, and power cost. The things which we, hope to accomplish: 1. Reduce labor costs. 2. Reduce material costs. 3. Reduce power costs by the con 4. Reduce the amount of powder used per ton of coal produced. 5. Increase the lump percentage (particularly at the domestic mines). 6. Reduce accidents and annual compensation payment. 7. Reduce haulage costs. 8. Reduce cost for track work. 9. Reduce cost for timber and timbering, and increase the recovery of timber at a considerable additional saving. 10. Reduce the brushing costs. 11. Reduce the amount of rock hauled to the outside. 12. Reduce the cost for drainage. 13. Reduce the cost for ventilating. 14. Reduce cost of inspection and supervision. 15. Reduce the cost for shot firing. 16. Reduction of number of working places. 17. Grouping of men with increased sociability. 18. Increased tonnage per man. 19. Reduction in total number men employed. In the consideration of the methods used and now working successfully, there were three points which were considered outstanding, to make them wholly successful: ventilation, roof control, and transportation. George B. Brennan, Secretary-Treasurer, Imperial. Coal Company, Denver, Colorado, opened the third session of. the Sixtieth Regular Meeting of the Rocky Mountain Coal Mining Institute at 8:30 a.m., and introduced the first speaker of the morning with the following remarks: It is a pleasure to welcome you here this morning. We are indeed fortunate to have such excellent speakers this morning, some of the outstanding people in the mining industry. I know I express the feelings of the entire RMCMI when I say thanks to these excellent speakers for all of the time and trouble they have taken to prepare such talks and come here to give these presentations of some of the more modern developments with which we in the coal mining industry are concerned. The first speaker this morning is going to give a paper on a subject which has only recently caused one or two of unfortunate accidents. It hadn't, prior to this, been considered such a serious problem. However, the. Bureau of Mines is hot on the trail to insure there will be answers to this previously somewhat unrecognized difficulty.
