Abstract

Groundwater remediation is growing in occurrence in the western United States. Groundwater remediation programs are regulated by state water quality statutes. The remedial action plans implemented under these statutes may conflict with well-established existing rights to withdraw groundwater for beneficial use. This paper discusses how the states of Arizona, Colorado and New Mexico administer conflicts between the need to withdraw and remediate groundwater with the existing rights of others to withdraw groundwater for beneficial purposes.
