Abstract

Mineral development in South Dakota is aggressively encouraged by both state statute and county ordinances. Yet, an increasingly conservative philosophy is taking hold, resulting in expanded regulatory controls and concomitant increases in direct and indirect costs to permit and operate a mining operation. This paper examines the hidden costs associated with protracted permitting timeframes, land buy-outs, attorney's fees, etc., associated with the increasing emphasis for stiff controls on mineral development in South Dakota.
